Yikes, so it seems we're still looking at up to five months from the time he comes into the country, by the time we add how long he'll be here for wedding planning prior to the actual ceremony.  Thanks for the heads-up!

 

Marriage at the county courthouse usually takes only one week to schedule, then wait about a week for the certified marriage certificate(s) to arrive.  Then you filel AOS and apply for the EAD (which will take about 3 months to arrive).  So he could be working within about 3 months after arrival if you plan well and are quick about it.

 

Dont' forget about the CS to transcribe the vacc.records (make sure he obtains the DS-3025 form at the medical).

Sure you can file for anything you want.  The reason for the K-1 denial must be cleared up or else you'll be denied again, regardless of visa type being pursued.

We had a USCIS employee on a dating site I go to. He had been looking for a wife and ended up with a job in New Hampshire with them. He said these big files just annoy them. I saw when I left out my check for them oops8rh.gif and they immediately returned all my papers minus my beautiful binder. They use an Acco two hole at the top for themselves. They put smaller things in some type of baggies. He also said "just send them what they ask for and read the directions".

 

Lucky for me I lost less than 1 week.

I understand this post is not helpful but I have been on this forum for about 5 years and we always have the same conversation. It seems to me that Immigration will mostly do what they want to do and we just have to wait. Unless there is a big problem it will happen sooner or later and if there is a big problem you might need a competent lawyer.

 

There have been times when someone who works there is on forum and they reply that everyone there is working hard but they have their own priorities - not ours. But whatever they are seems to be a secret dry.png

Right. Although curious why Knightsbridge didn't administer them.

You'll have to go to a civil surgeon once you're in the US and have them fill out the I-693. You can get the vaccinations anywhere....it would probably be cheaper at your GP in the UK if possible. The US civil surgeon will need proof of you having received the vaccinations or will administer them to you in order to fill out the required AOS form.

Make some research to know if parents of such young man will approve of their son getting married to a Morrocan woman of with such age difference.

Cutural difference matters alot as its not just about getting married but being able to live in the marriage through difficult times.

The thread from earlier today is mine. It's filled with those who understood my question and desire for advice as the situation is what it is already at this point. It's also filled with A LOT of judgement and ridicual towards me, the US Citizen.

1st - I'm confused why so many say the Casablanca Consulate in Morocco is one of the hardest. Although my fiancé was nervous and stressed about how his interview went - it was otherwise a smooth process. I mailed my I-129f to USCIS in Texas at the very end of August and my fiancé had his interview on 12/23/13 and then arrived in the us on 1/9/14.

2nd - Vacationing in Morocco for a week (I spent almost 9 days) is much different than living together full time. I thought I did everything possible to help him understand what life was like here. I thought I had done all my homework... I was so in love, ready, and excited to have my man here for the rest of our lives and then when that dream came true it felt like I woke up in a nightmare. My head was spinning, I started to have panic attacks, I felt miserable and couldn't explain why.... There were definetly some things I learned about my fiancé (things we had discussed prior to his arrival). My now ex fiancé (whom is still living with me until next week) is hurt but understands.

3rd - I of course had to prove I made over 125% over the federal poverty guidelines which I did by sending a years worth of pay stubs, a formal letter from my employer, a year worth of bank statements, and a formal letter from my bank. I have 3 sources of income but only sent proof of my income from my career. When my fiancé received my proof of income days before his interview he questioned why it was over $20,000.00 lower than what I told him. This should have been a red flag for me but it just wasn't at the time. I explained to him that it was not necessary for me to send in proof of my other 2 sources of income because my career income was enough. I should have asked him for proof of what he kept telling me was his savings but I trusted him. Come to find out - that savings didn't exist and he arrived with not even a penny - knowing it could be 5.5 to 6 months before he could legally work here in the states.

4th - everyone's situation is different. Do not be persuaded by anyone's personal opinions or personal experiences. I wasn't at all when friends, family, and coworkers expressed their concerns - just like I'm not being pursuaded by others comments (their personal opinions) about my decision to not marry my fiancé due to my personal feelings over the things I quickly came to realize (like the things my fiancé promised were not really true). Do what is right for you and know if things change after his arrival - you have to do what is right for you both.

5th - I want you to know and hope you can tell by my previous status updates that my relationship was very real. My heart is broken that our dream come true didn't last or go according to plan. I do love and care deeply for my ex-fiancé. I know we will remain friends and continue to support each other through whatever it's is we do in our futures.

I think it's adviceable to breakup while dating than breaking up after marriage, though its really sad the poor guy dreams got shattered just like that as I can imagine what it's like when you bid goobbye to your family, friends and co-workers.

Lola you might want to consider getting him a ticket back home and maybe some $20k to take care of what you took from him, he just have to move on with our without you. I wish you luck as you search for your perfect gentleman.

The only way you can tell his father's name is misspelled is by comparing it to his father's Cambodian ID. We've already filled out all the forms with the translator's incorrect spelling. Do any of you think we should redo everything and have the certificate re-translated? Or will the embassy go with the translator's spelling? Sorry this is so nit picky.

Hi all!

 

So my fiance and I are almost ready to submit our application!! Yaaay! But we are a bit confused about how to organize it. 

 

I have our evidence in three groups with one sub-group:

 

1. From our time together in Hong Kong, Jan. 2012-June 2012

 (during this time we visited Cambodia together for the first time for one week, in May 2012 (And I have plane tickets, hotel stubs and so on for this evidence)

 

 

2. From my second trip to visit him May 2013-June 2013 

 

3. From my most recent trip to visit him Dec. 2013-Jan 2014

 

For each trip to Cambodia, I have plane ticket stubs, hotel receipts, bank account transaction receipts, receipts from grocery stores and Cambodian markets, pictures in easily recognizable Cambodian places (i.e. the Angkor Wat)  and letters from friends in Cambodia.  

 

For our time in Hong Kong, I have a copy of his Hong Kong ID, his transcripts from the Seminary where we studied, pictures, and a few receipts (I didn't know we were going to apply for this at the time, so we weren't saving everything yet). I also plan to get letters from the school officials and advisers who knew us well. 

 

 

ANYWAY! My question is whether or not to organize this chronologically by trip, or categorically (i.e. all the receipts in one area, all the photos in one area and so on)  

 

ALSO: I read they don't really like it when you organize things in folders? They prefer paper clips, right? Or can I staple things? Any advice on keeping things together?

 

 

Finally,  for the initial stage of this, do I need to submit evidence of our on-going relationship as well? (I have phone bills, a massive stack of used phone cards, over 23,000 facebook messages....what else?) Or is that for the next step, the interview?

I have asked my parents and they both regretfully said no. They have never met my fiance and they do not understand the commitments of co-sponsorship. They think if my fiance comes here and gets in an accident or gets sick (heaven forbid) they will be legally responsible.  Is that true? I thought it only concerned government aid.  I am not close enough with any of my cousins to ask, unfortunately.

Hi again everyone, 

 

So my fiance and I spent a lot of our time together during our last visit (Dec. 2013-Jan. 2014) in Cambodia preparing all the documents for our K-1.  I feel like we are so ready to apply. However,  I am starting to get pretty down about this.  

 

I am a Masters student and thus unable to meet the 125%-of-the-poverty-line income requirement.  Given how much tickets to Cambodia cost, and just the general weight of our hearts being separated like this,  we decided before I left to speed up the process. We were going to wait to apply for our K-1 until I graduated in 2017 and just visit each other as often as money allows.  But given just how expensive it is, and how agonizing it is to be away from each other, I decided to drop down to half-time classes in order to try to find a job that pays enough that I can sponsor him.  

 

However, finding jobs in my current city is really tough.  I am not sure I'll be able to find one until the summer when schools start hiring again (I also have a teaching license).  

 

VJ friends and commiserators, would any of you advise us to hold off applying for the visa until I find a job, or could we apply and just trust I'll find a job before (if? eeek.) we get to the round where we need to submit the Affidavit of Support. (that's like five or six months from when you initially apply, right?)  

 

We are both so tired and sick of being separated. ( I am sure there are many here who can understand)  Do any of you have advice about this?

Have you constructed a "relationship timeline" as posters dealing with the Vietnam embassy have done?

 Yup! I constructed a timeline (still refining it as I go through our older receipts and such)

 

And I just finished printing our 25 pages of phone bill records (we use an internet service called "Rebtel" which keeps track of whom I've called and when.)

 

I've got our boarding passes scanned and printed, passport stamps scanned (not yet printed)  

 

We've been selecting photos. We have over 350 now or more I think.  (but perhaps we'll only submit around 10 or so?)

 

We're working on collecting letters.  And I'll start sifting through our emails in the meantime. 

 

What is tough now is that since I've been going through our facebook messages selecting the logs that don't contain our ruminations,  I still have almost 386 pages, and I've only copied and polished up to July 2012.  We were apart almost all of 2012, so there are probably going to be another 300-400 pages easily.  And that isn't counting our Google Chat logs and text messages.  

 

I know that a couple in the Vietnam forum submitted ALL their internet chat information, totally over 1,000 pages.  But I think if I do that, I may need to take all this to a print shop, maybe? It is just so much paper! (additionally, we're making three copies of EVERYTHING. Yikes, 3,000 pages)

 

But it's Cambodia; so do I have much of a choice?

Hey all, 

 

So I've been doing a lot of research on the Embassy in Cambodia and other Embassies that have been proven to be difficult (Which is why I chose to post this here and not in a country specific forum)  and I know that my fiance and I will most likely need to provide as much proof as possible of our relationship and its authenticity.  

 

I have two major questions to that point. 

 

The first, though basic is this:

 

I know it says in the initial paperwork we only need to submit proof of having met within the last two years, but because the fiance is from a "high-risk" country should we submit proof of our on-going relationship too? (i.e. facebook messages, phone records,  and....what else?)

 

Secondly, along with that:

 

We have 23,000 facebook messages. I read about a couple in Vietnam who submitted over 1,000 pages of online chat messages and had a very positive interview. I am tempted, knowing about how applications from countries like Cambodia, Vietnam and others can sometimes go, to print and submit all of them. (I know it seems extreme, but what wouldn't we do to be with our loved ones?)  

 

The hard part is, our facebook messages bear a lot of the pondering we've done since we met two and a half years ago.  (in our innocence to the visa process, we talked of applying for a student visa, work visa or even trying for a visitor's visa again)  Does anyone think I should go through our messages and edit these things out? Or just don't print the pages that talk about these ruminations?

I read that when filling out the 129f, if the information asked does not apply to you, you would leave it blank. However, now I am seeing people stating they got RFE's for putting "none" instead of "N/A" or simply for leaving the spaces blank. What is the proper way to do it? 

 

 

Either typing or handwriting is fine.

 

I actually think that handwriting is superior because it avoids making typos.  I have seen so many threads with people saying "I typed the birthdate wrong!" or "I switched two numbers on the address!"  or even "I typed my fiance's name wrong!"

 

I filled out all the forms by hand.

And really the copy you send to your fiance is more of a reference to help prepare for the interview.  It is not needed for the interview, as the embassy will already receive the full petition packet from USCIS once approved.

The suggestion to make 2 copies is just good bookkeeping practice.  It's not required, strictly speaking.  If your fiance has a copy at the interview, then s/he is protected, in case the interviewer were to say "It says here you are a drug dealer!" or something.  Then the fiance can say "I have a copy of my forms and it clearly does not state that."  That is a silly example, but something might come up, like a date, or something.  You never know.

 

The other copy is for you, for your records.

On the VisaJourney guide for filling out the K-Visa, it states, "The above forms can be filled out on your computer and printed. Make sure you sign and date them as required. Anything you cannot fit by typing, you can handwrite (very neatly) in black ink in the blank instead. You should always verify the current forms at www.uscis.gov." Of course, I read right past that earlier and have already filled it out in my own (very neat!!) handwriting. Would this make any difference? Everything is clearly legible and written in all caps. 

 

 

Also, I was planning on submitting the paperwork within the next week. In the spring I will be visiting my fiancé in the UK for two weeks. Will this be an issue? Do I need to/should I mention this in my packet somewhere? Thanks guys!

Hello VJ Community,

 

 

I have read several older topics about the I-134 form which are helpful, but I would appreciate getting some newer responses and comments on the following situation:

 

1) Pay stubs: are pay stubs really necessary? The reason I ask is because I already have two letters from my employer (one stating my monthly income, permanent employment status and date hired and the other one stating my 2013 total gross and net income), letters/statements from my bank confirming my bank accounts with balance and date opened and a history of deposits in the accounts.

 

I also DO have all of my pay stubs from the last year, BUT this leads to my second question:

 

2) Official translation of supporting documents in foreign language(s): my pay stubs are in a foreign language because I work for a foreign organization, will I have to translate these with an official certified translator? This seems like a costly, unnecessary thing to do if I already have a good amount of documents confirming my income above 125% poverty level.

 

What do you all think? Should I waste money and time finding someone to translate some pay stubs or is it really not necessary?

I'm going to try to answer since our situation seems similar (I was also in the States while filing the form) Our case was sent to California Service Center and approved very quickly so hopefully we did things right! However, don't just take my word for it, we might have done something wrong and they overlooked it... I'm just giving you my honest opinion.

 

3.  Alien Registration Number?  I am a US citizen so I don't have one.  Leave it blank or write none?

We left it blank. My fiance is also a US citizen by birth so this does not apply to you

 

13.d.  I was born in the United States so for 13a I selected I acquired my citizenship through birth in the US.  But 13d asks if I have obtained a certificate of naturalization or a certificate of citizenship in my name.  If I was born in the US to two US citizens the answer to 13d is no, correct?

My gosh, I just noticed we left 13d blank!!! I guess they didn't notice :-P I would cross NO then

 

2.c.  If my Fiance does not have a middle name should I leave this blank or put None?

In Spain we do not have middle names so I left it blank (I didn't want them to think that my middle name is None!) What I did is attach a post it on top of the question explaining that in Spain we have ONE first name, NO middle name and TWO last names (the first is the paternal last name and the second is the maternal one) I signed the post it.

 

3.b.-3.i.  This question asks for Fiances mailing address. 

In Spain it's different but here's what I could do: if they don't use provinces, then just put the county name where it says province. Again, your fiancee can put a post it explaining how addresses work in Ireland and sign it.

 

15.a.-15.h.  If your Fiance is currently in the United States complete the following:  -  Do I answer this if she is here but is returning in two weeks?  Or are they asking if she is here long term?

I was also visiting my fiance so I did the following: in 15a I wrote VISITOR. Nothing on 15b as it no longer applies (since the ESTA system, there's no I-94 any more) 15d you have to look at the stamp in her passport; this is not the day she's leaving but the 90 days that the ESTA system allows you to stay in the States. I left 15f, travel document number, blank. What I did (surprise! :-P) was attach a signed post it saying that: form I-94 no longer exists and that I attached a copy of the official website http://www.cbp.gov/x...i94_rollout.xml and highlighted the part where it says Foreign visitors to the U.S. arriving via air or sea no longer need to complete paper Customs and Border Protection Form I-94 or I-94W

I also included: a copy of my flying itinerary highlighting the date of departure, a photocopy of my passport page where the stamp is (where it states the date when you have to leave) and a photocopy of my ESTA authorization number, highlighting the number. I don't know about Ireland but in Spain we need to fill in the ESTA form and print the page where there's a number and it says "approved". We have to bring this with us in order to be allowed entry in the US as a visitor or tourist.

 

36.a.-36.b. Your fiance will apply for a visa abroad at the American embassy or consulate at:

Since it says consulate, I wrote Barcelona, which is where I live. However, later on I saw that in Spain they only give visa interviews at the embassy in Madrid so I'll have to go there. If she's living in Ireland then she'll have to go to the embassy in Ireland (I'm guessing it's in Dublin as it's usually in the capital and there is only one embassy) But not sure how it works in Ireland! You could start a post with this question in the Europe subforum and ask other people from Ireland.

 

Last question. My fiance currently has an apartment in Dublin but may move back home (30 minutes away) with family to save money for when she travels back to the US.  I put her mailing address as her family's home but should I put her address abroad as her family's home as well just in case she does move back home?

For me the most important thing is to put an address that won't change as this may be a problem. Since both my fiance and I might move, he put his mom's address and I put my parents'. Even if he's not there or I'm not there, our parents can get the letters for us. None of them are going anywhere so it's safer to put their addresses than ours. My fiance is actually at his mom's until we find and apartment and so am I (at my parents') until I figure out what to do next so it works out but even if I move I'm leaving my parent's address as my home base :-)

appointment in the Guatemalan embassy was on Jan 3, 2014 and well besides the workers there being RUDE.... we were approved!!!!

we picked up the Visa on the following Tuesday!  He is here with me! thank you to everyone who helped!!! especially EMILY!!!!!
