I wrote two sentences.  The decision was easy since we only met once in person prior to filing.

 

There was a recent case here where the petitioner included a list of meeting and then various evidences for various meetings.

 

They pulled an RFE since the adjucator was confused about which evidence went where and they didn't have enough for any one meeting to satisfy the requirement.

 

List one meeting and include evidence of that.  You don't get extra credit for more meetings.....list them for the interview to show your relationship history.

Thanks for the help all. Just to clear up the confusion, I did mean the declaration and NOT the letter of intent to marry.

I've basically written just under a page, highlighting the dates each of us has visited the other since December 2012, and any further travel dates within these periods of time which involved us flying together. I've also included the date of our engagement,

 

There is no declaration of meeting in person.  Its just one or two sentences to answer that question on the form.

 

I would suggest to NOT make a list of all your meetings.  USCIS only cares about one meeting; you do not get extra credit for additional meetings.

 

The problem in listing tons of meetings is that you confuse them and your evidence supporting the meetings is not adequate.

 

List one meeting, especially the one that you have solid evidence of that meeting.  Save the multiple listings for the interview.

The declaration of how you met in person within the last two years should only be two sentences maximum, the size of the box on the form is indicative of the length of the answer.

 

The declaration of your relationship is not needed until the interview.

I don't think so, I believe you will list them on your DS-160. 

 

It's a new form that replaces a few old ones that the beneficiary had to complete.  On those old forms you merely listed the children intending to immigrate on the old DS-156K form. 

 

Go tot he USCIS website and look over the new 160 form.....it's not needed until prior to the interview so you have many months to investigate.

Hello to all I am trying to get together everything I need to be completed for the k1 visa so as it will be all complete and ready to file when needed, I am in the uk my partner american ... I have two children that will obviously be coming with me but I am a little unsure as to what papers I need to file for them can't see the information anywhere I know they each have to have a visa of there own and have to be included on my I-129f but all else bar the evidence is a blur. If anyone has any advice for me would be greatly appreciated. Thankyou in advance.

 

It's real easy.  You list ALL your children on the G325 form (regardless of age or immigration intent).

 

Then when you fill out the online D-160 form prior to the interview, you will list whomever you want to bring with or follow to join within a year later.

 

Each will need their own medical and visa payment fee, those coming with you will go to your interview and any to follow later will have their own interview scheduled by you prior to their travel date.

My soon to be be fiance and I are thinking of getting married on 12/13/14. I will start the application after feb 14 (the day or proposal I know we talk about the wedding even before the proposal). I know I am risking some money in case it did not get approved but we really wanted a church wedding and it will take at least 6  months of preparation as per catholic parish. I have heard that k1 applicaton is about 5-6 months so it could work out.

It could, depends on everything else.  If you want to marry her so bad, then do it in her country and then file for a CR-1.

 

 

International relationships and immigration to the US requires couple to conduct their lives a little out of the norm.  Many family and friends don't understand the need and requirements and sometimes the couples also.

My K1 was just approved and I think I must enter into US before July.  I'm planning to move to US in Jun at latest. However, my fiance may be assigned to a project working in EU for a few months (can't know how long, project is always delayed to deliver, let's say 6 months for now). 

 

So we are in a very tricky situation. What if the project can't be finished before my K1 visa expire. I know I must go there before the deadline, then I may have to be alone while waiting for green card or AP. 

 

I want to ask what we can do regarding to this possible situation. Thanks.

 

Then you'll need to be self sufficient living in the US while they are away.....unless you were planning to accompany him to his work site. Then I would suggest you abandon the K-1 and wait to accompany him....you could get married there and then file for a CR-1 visa.

My fiance is a USC, I am Canadian.  We have applied for our K1 visa and received our NOA1 on December 3 2013.  Since then, my fiance has been offered a job posting in Italy (for a year).  He loves it there and would like both of us to be there, together.  It would be a great experience.  Question is;  does anyone know how to go about this?  If we get married; would I be "allowed" to stay with him for the time he is there?  Also, when we come back, would I have to come back to Canada, or could I just apply for the k3 visa while I am overseas? Sure you could leave at any time and you can stay there as long as you have a visa as needed.  You couldn't AOS since that assumes that you will be permanently residing in the US.  When ready he would apply for a CR-1 spousal visa for you.

Is it possible to get 'married' (just perform the marriage ceremony & have the reception) abroad, and not have any documentation signed abroad or anywhere, then enter the U.S. on the k1 visa and get married legally in the U.S. w/in the 90 day period?  Is there any risk to doing this?

 

Only if such ceremony is customary to that country or culture, is a normal occurance and is so recognized by the Embassy.

 

Anything else, then you're probably viewed as married and your visa will be denied......or....worse.....if you make it to the US and get "caught" during AOS, could risk permanent ban and deportation.

 

Don't do it.

I have been doing volunteer work and for awhile now and am currently unemployed (although I do work on the side unofficially to support myself, I am an artist.)

 

But as far as forms go, unemployed is all I can put without making up white lies (which in my opinion, the government is no one to mess with in that sense just to "look better").  I am having my father as my co-sponsor so he is also filling out the Affidavit of Support.

 

A friend told me, even if I only have 2 pennies to rub together, I still fill out the form, which is fine.

 

However, my question is this-- are they going to look poorly on me for not having a job at the moment?

 

Any advice is appreciated. Thank you!

Hey all:

 

I was just posting in another thread and was told that a copy of the G-325A filled out by my UK fiance would likely not be accepted. I thought that everything except the I-129F form could be copies, since nothing on the G-325A directions (at least that I read) said it had to be original....so I only freshly signed the I-129F and my own G-325A. But his G325-A was a perfectly scanned copy that was signed. Will they accept this, do you think? Or, if they don't, are we just looking at an RFE for an original copy or are we looking at a rejection/denial of our entire petition?

 

I had no idea and now feel so worried and foolish.... any advice = very appreciated. Grrrrr.

 

If you read the Stickies at the top of the forum you'll read where sometimes USCIS accepts a scanned copy of the G325A form...but you'll also read where they do not.

 

I'd merely wait but get a signed copy from your fiance.  Read the Guides and follow them to the letter (along with the form instructions).

The guides may indicate more than you'd read from the instructions....that is because they are the compilation from many folks over many years of what works.....

I'm about to file a K-1 Visa and getting some things finalized. I will be writing a page regarding the question "describe the circumstances under which you met". 

I went to visit my fiancee in my home country, where I used to live for 11 years when I was little. Should I mention that in the letter in hopes of giving me an advantage or the embassy might see it as a negative. We still have an apartment there and thats where I stayed for the time being, so no hotel records are present for me.

I think you are confused.  They only want you to describe the circumstances of how you met IN PERSON within the last two years.....NOT how you met the first time.  The size of the box on the form is how long an answer they expect....about two sentences. There is no need for a long letter.
Save the letter describing your long relationship for the interview.

Hey guys, I have a some questions and need your help.

1) What type of certification does the translator need to have? I know someone who is a certified interpreter for an administrative court, will that do?

None.  You can translate the documents.....you must just write on the translation the you are fluent in the language and certify that the translation is correct.

 

2) My fiance (that I want to bring from mexico), email me passport type photos so I can have a passport photo shop here print them so I can attach to G-325a. However, she put some small earings on. Will that be a problem?

Yes big problem.  Do Not send photos that have earrings attached to them.  Just send photos, save the earrings for when she comes here.

 

3) When I went to visit her in Baja Cali a couple of weeks ago, I had her sign some blank G-325a forms that I was going to fill out neatly (she of course provided the info to put on document) when I came to Los Angeles.Was this a good idea?

Yes her letter must have an original signature.

She only speaks spanish. So it does not make sence that she sign my english letter unless it is translated.

Her signature is her signatue.  It doesn't matter what language the letter is in.  The letter will be in English with her signature below.

 

Or does she make her own? It is just that I wanted to send package this week, and do not want to drive to see her just to get her signature.

Use the Example Form, send that to her to sign and return.

 

5) i known her for over 5 years. We are getting married when she gets her we have talked about and want to get married, and will get married. But I wanted to do a formal

engagement party in Baja so I can propose to her.

Parties are great.

 

Does the formal engagement need to happen before I send the package to immigration?

The two Letters of Intent ot marry are all that USCIS wants.

This site has been great. I have some questions about the Form and my situation:

 

1) My fiance is Mexican (hence latin) and has two last names. Pater and Maternal. I don't want to get technical but it appears there can only be one last name (and one familly name for the matter). But I guess that depends what your definition of familly and last name are.

 

In Part 2, subsection 2.a asks for Family Name (last name). What is best? Both Paternal and Maternal? Or just paternal?

 

If just Paternal in Part 2 subsection 2.a, do I put both her paternal and maternal in part 2, subsection 10.a (where it asks for other names used)? (this does not make sense because they only provide the same space as it does in part 2, subsection 2.a., hence if we put the full name in other names used we might as well put it in the very begining.

 

I just don't want to run in trouble when we go fet her ID at the DMV and get bank account, etc.
 

ANY ADVICE???

Use the name that is found in her passport.

 

 

 

2) Declaration of how we met in person, 34a? and proof having met in past two years. Problems with Proof! need help.

Thechnicall above should be different, since you could have met in well beyond the last two years. We met in early 2008. My problem is that

I have seen her in person plenty of time since 2008, of course plenty of times within the last two years.

 

However, I live in LA and she lives In TJ. There is no airplane tickets, no greyhound pass, no train ticket. No passport stamt (they don't stamp it when you cross the border). All I have is five pictures of us together ( 1 from 2009, and 4 from about the last two years), stubs from when I took her the movies in 2013, a recipt from a restaurant, and a receipt when I bought her some shoes. Any advice??

Send all you have.

 

 

3) I am going to go to walgreens and print the picture that I have on my iphone. But should I submit the original pictures of us together or should I submit colored copies on paper (with dates written on the paper).

Both (that's what I did)  Write the names on the back of the photos.

 

 

4) how should the packet be assembled when I submitted (I guess cover letter is table of contents), three ring binder, or two holes on top of pages in legal folder?

No binder, Paper clips and binder clips only.

 

 

5) I don't have a birth cirtificate, but have my naturalization certificate. Will natuaralization certificate suffice?

No, need BC of copy of every page of passport.

Hello:

 

My wife, who is from Sweden, does not currently have a drivers license or healthcare coverage. She has never driven a car before nor had a license in her home country. Has anyone here been in a similar situation? Are you required to take drivers ed school or because she is an adult she is not required?

Depends on your state.  She may be able to obtain a learners permit and then take her driving test later.  My wife did that and didn't need classes.

 

 

Also, has anyone had experience with healthcare.gov? I imagine she will get insurance once she starts working later this year and I already missed the cut off to add her on mine. We need to move quickly with an option as she will need to get refills on her medications in the next month or so. Thank you for any advice or personal experiences in these matters! Much appreciated!

Most policies allow one to add a new spouse at any time.  May need to send a certified marriage certificate.

Yikes, so it seems we're still looking at up to five months from the time he comes into the country, by the time we add how long he'll be here for wedding planning prior to the actual ceremony.  Thanks for the heads-up!

 

Marriage at the county courthouse usually takes only one week to schedule, then wait about a week for the certified marriage certificate(s) to arrive.  Then you filel AOS and apply for the EAD (which will take about 3 months to arrive).  So he could be working within about 3 months after arrival if you plan well and are quick about it.

 

Dont' forget about the CS to transcribe the vacc.records (make sure he obtains the DS-3025 form at the medical).
