My fiance makes around 40.000$ per year but he doesnt have money on the bank!

Annual income is key.  If they are over the guidelines for the new household size, then nothing else is required.

As I explained in before on other posts, my fiance was brought here by her parents when she was under age. They applied for political asylum, and were given social security numbers and work permit while the asylum process. Unfortunately, the asylum was denied and they were told to leave. They kept appealing for years, but at the end they picked up her dad from work. They contacted her to go report in person at a Deportation Enforcement Office, and we showed up. From there she was put under supervision while prepare to leave and gave us some time since we had a new born. She had to report in person every 30 days, until finally bought her own ticket and left. 

 

1. Does any of this means she was refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?

 

Short answer is No.  None of those apply to her case, but a letter describing exactly like you did here should be brought with.

 

2. Since we purchased her departing ticket, does she still count as deported? She left a about 2-3 month after her last work permit expired.

 

Yes she was deported and left voluntarily.

 

3. Would she use the same social security number she had when she was under work authorization? We are trying to figure out if we are going to be able to have our wedding on February 14. I know it's too close, but we aren't planing on a big wedding since budget is limited.

Is there a way to lessen the load without the person reviewing this to think "Why did they only Skype once a month?" 

 

 

You won't be lessening the load for USCIS, you'll be lessening the load for your poor fiance who would have to carry all that to the interview!

 

Evidence of relationship is only required at the interview, not for the petition filing....you only need the proof of meeting once in person for that.

 

Draft of summary of your relationship and refer to specific evidences that you'll attach for your proof of relationship.

Hey- I've been asking around about how much I need to make to be approved to sponsor my fiance before he applies for a job. All the answers I get are to study instructions and to look at a poverty chart thing which really only confuses me more.

 

Some informtion about me:

- I am the only one who works in my household. My grandfather has investments (he won't be a co-sponsor), but would those factor into my household income?

No unless he liquidates those into cash and deposits that into your account.

 

- I make almost 9 dollars an hour at my work, and I work anywhere from 14 hours a week to 35.

- There are 4 people total in my household

So if you're looking to bring only your ffiance over, then you new household size would be 5.

 

- I haven't worked a full calander year yet, so I don't have a good idea of yearly income.

Using an average hours per week, your annual is about $11,500 which I believe is very much lower than the 125% poverty guidelines for a household of 5.  It seems you really really need a cosponsor.  I  wouldn't submit any K-1 petition until you have this worked out.

 

 

 Please don't post the whole poverty line chart unless you can explain it to me please. I'm really wanting to figure out if I can actually sponsor mu fiance by myself. I am not having success finding a sponsor at the moment, so I'd love some clearer answers.I'm looking to file the paperwork in January. Thanks!

Hypothetically.

 

If a person is still legally married, but already in the ending stages of divorce, meets and falls in love with another person, and becomes engaged to them before their divorce is complete, but only files the petition after the divorce completes: how would that effect the validity of their engagement in the I-129f petition process?  Would their I-129f most certainly be refused?

Hello All

 

I am applying for my K-1 visa in the next couple of weeks.  my fiancée is now pregnant 1 1/2 months. 

what happens if:

1)  the baby is born before she get the visa.  How will she be able to get our baby to the US? I don't think we can leave our baby while my finacee does the K-1 visa process(going to the US and file for change of status). will we have to extend or redo the visa because of the timing of the birth of our baby. 

You declare the child as a K-2 To Join and pay for their medical and visa fee.......or if the other parent is a USC then you could file for it's US Passport but that may take more time than the K-2 process.

 

 

2) she gets the visa around the time that my fiancée is unable to travel because she is too close to birth?

 

Then you just wait to travel.  The K-1 visa is valid for use for six months after issuance and many Embassies extend the time period if asked.

No it means no ceremony just a dinner party.

 

and don't sign any legal paperwork or even apply for the marriage license. So, we wouldn't be legally considered to be married, and we would still be considered (and consider ourselves) single. It's basically just a party for our families.

Depends on the ceremony.  If it looks like a wedding.......

 

 

Once the visa came through, we would have a proper marriage ceremony where all the paperwork was signed, etc.

 

Although judging from the examples given in this thread, this isn't recommended.

 

 

Yep...do it like we all did.  INternational relationships and immigration to the US require the couple to act outside the norm.  If you or your family and friends can't understand that.....

Hello I have the same concern.

 

I get my NOA2 in May; by that time my tax returns for 2013 will be done.

 

2013 i made 24k.

 

The previous years not enough because I had a different job back then.

 

I am the only one in my household until my fiance moves here.

 

Can I just submit my 2013 one and be okay?

 

No harm is submitting the other years; many folks have similar histories....current income is the key.

Hello people.

Just to start off I have tried to research this on the internet and I have even sent email off to the US embassy in London where I should be going shortly (fingers crossed). The emIl I have had back felt like an automated email that didn't help me whatsoever.

My current situation is that me and my fiancé have recently sent off the I-129f form. The problem is (and I'm sure people have come across this before) but I can't seem to find anything is we need to book the wedding venue but have no idea if the visa will be approved in time? It needs to be this summer for work reasons.  It will be when you have gone through the approval process and interview and obtained the visa.  That length of time can vary.  It will be what it will be; regardless of your desires or plans.

Some questions that I have are:

What would happen if we got married and the visa was still being processed?







Then you will be denied the visa and need to restart all over with a CR-1.  Bad idea.

If anyone has been in this situation before, what did you do?

Waited until the visa was in hand, then book the flight, then come to the US and then get married (at the county courthouse is quickest).  Many then have the religious or big ceremony later.

 

 

IF your interview will be soon, then all looks very good for a US wedding.  Time the entry to the US such that the marriage takes place within the 90 window requirement (that is VERY important).

1. In your opinion is it worth applying for a tourist visa (I have a very respectful job for the English government and can easily show when I am due back at work, the same job I returned from my J1 visa for) Me and my fiancée would never do anything to jeopardize our K1 visa. But I wonder how immigration will view it.

No harm in trying, only potential is lost money.  Will not affect the K-1 process.

2. What is your opinion of the chance of our k1 success (As honest as our situation is, I totally understand certain red flags in regard to our case) There are no issues in regard to any other aspect of the application.
Way more than 90% chance of being approved.....more likely around 99%.

The USC petitioner and the USC sponsor (and cosponsor if needed) do not need to provide a BC for the beneficiary's interview.  The beneficiary does need one.

 Getting married before entry on a K1 means that you can't AOS because you where NOT single when you entered the US.   IF you pull it off at any time they find that you married before entry they will remove all benefits that you have aquired based on your fraud.  They really check things out when you apply for citizenship.  DO NOT TRY TO OUTSMART IMMIGRATION.   THey have been there done that 1000 times

No, your petition will be placed in the next open box and wait around for 5 months or so to get adjucated.  You've only added the time between your original filing to when they receive your updated package.

 

Reading the instructions should have caught this mistake.

Depends on the individual adjucator.  Some work on them again when they receive the updated information, some work on them one time per month, some work on them in a willy nilly fashion....there is no standard.

If most people are following the same guidelines on the website, wouldn't more applications be approved in a more timely manner? Especially those who haven't even received RFEs after waiting for months, as opposed to someone who filed the same day and was approved 20 days later.

None...the timelines here are averages.....therefore there are some cases that go quicker and some longer.  Use the average for your planning, as much as you can plan since all is in the hands of USCIS and you can't affect them.

3. Have the website creators worked for USCIS? Or have they all gone through the same processes as we are?

What are you talking about?

4. About how much notice do you get before your interview date? If the process is still going when my Fiancé graduates this summer I'd like him to at least come visit. I just want to make sure he has enough notice to get back in time for the interview.

Tons....since you schedule the interview, you can make for whenever you want.  It is possible to also reschedule an interview.

5. Why is there no black and white law/rule about how often is "too often" to be here visiting? How is it dependent on what the mood/personality is of the TSA officer you happen to get? I saw in another post someone said they had to be in their country for at least 3 months before coming back, but the government website says as long as the agent doesn't "think/feel" like you're trying to live here.

Because everything is on a case by case basis.

6. What possible types of issues could one have with their K-1 Visa in hand at Port of Entry? If you were approved and the packet is from USCIS, what could go wrong?

Carrying explosive materials or smuggling contraband or drugs would be a bad thing.

I had her fill out and sign her letter of intent to marry and g-325a, sign it, scan it and send it to me, I printed it out.

Since she is overseas its is the fastest way to get the document signed, but is it acceptable by USCIS and the US Embassies?

Draft a letter titles Evolution of Our Relationship.  In this you will describe how your relationship began, how it blossomed, how you met in person when you became engaged, what you talked about, what you planned for your new lives together.

Reference different types of evidences that you will attach to support each part of your evolution letter.

 

For example in the beginning your email conversations were "get to know you" content.  Later you talk about meeting in person.  After engagement they are about living life together.  Include one copy to support each.

I wrote two sentences.  The decision was easy since we only met once in person prior to filing.

 

There was a recent case here where the petitioner included a list of meeting and then various evidences for various meetings.

 

They pulled an RFE since the adjucator was confused about which evidence went where and they didn't have enough for any one meeting to satisfy the requirement.

 

List one meeting and include evidence of that.  You don't get extra credit for more meetings.....list them for the interview to show your relationship history.
