Hi all, 

 

This is a terribly nitpicky question, but when the Guides say ALL passport pages, do they mean even the page before the ID page?  

 

Also, we took our passport photos while I was abroad, and I look terrible because of the humidity and food poisoning. I know this may sound stupid, but should I retake my picture because I look so pale, disheveled and slightly green?

Cool....have one more question...my fiancee filled out the G-325a but it had the expire date on it of 8/2012, that's the one immagration sent me last septmember its one page like the revision do I need her to fill out the newer version or is the older version still good?

If you haven't sent anything in I would use the newer version- "just in case".  However, I used the older version on accident for my info (had it saved on my computer from a while back), and they accepted it just fine.

You probably can not.....doesn't matter as the info demonstrated does nothing to prove a legitimate relationship......it only establishes that the two chat names contact each other a lot.....who know what they talk about?????....maybe Tiddly Winks and nothing about a relationship.

 

This is why I suggest folks purposefully generate all sorts of evidences.....and draft a letter for the interview that can be titled Evolution of Our Relationship.

 

In this letter you will describe the first meeting and how the relationship grew (normally following a usual path and dialogue) and then agreement to meet in person...then talk of marriage and immigration and life together in the US.  All the while you would point to specific evidences that bore these facts out...copies of specific emails where you had a specific discussion, etc etc.

 

It's all about content,,,,not quantity.

 

Obviously it shows nothing more than contact, but its a cleaner/compact alternative to copying, pasting and editing pages of Skype messages for those would like to include something similar.  It is nothing more than a secondary evidence supplement for a package that should be filled with numerous pieces of quality information.   Your letter suggestion may also be something that others find useful, so thank you for adding that.

I found this neat little program (its free) for anyone who uses Skype as a means of communication- it basically creates a log of call durations and chats to print out, without actually recording the content of the chat.  I made a little sample to share, it ends up looking like this (I blacked out our names for obv reasons):

Thought it might be useful for others as well- it is super easy to use and set up.  For skype chats, the "Action Type" just says "Chat" along with a date.  The URL is http://www.nirsoft.n...e_log_view.html.

We used the same thing for our CR-1. They accepted ours. 

 

I had a different photo size for our initial petition as well, and had no problems with it (didn't even realize the Canadian and American pictures were a bit different until reading someone else's thread).  If you get a chance to redo pictures, it may be helpful for your own peace of mind.  If you have a digital copy of your photos, or have access to a decent scanner / printer, you can also use the photo cropping tool provided by US immigration http://travel.state....ral/photos.html.

 

For everything else (medical, interview), the 2x2 size is a requirement.

I am considering a surprise visit and I am extremely nervous about trying to cross the border, and reading the 'Yes, you can visit' thread made me even more nervous. Here's my situation:

In February, my fiancé (then boyfriend) came to Canada and then we were intending to drive back to the US together. I intended to stay for about 2.5 months. I had a return flight and a letter from my employer saying I was approved for a leave of absence, as well as travel insurance. They did not let me cross. I've yet to read about a situation like this so I'm curious and nervous. When they didn't let me cross, they didn't even ask to see any of my proof of ties to Canada even when I offered them they said no (This is all pre-K-1 filing). They allowed me to retract my 'application for entry' because they believed my intentions were honest. We were stuck at the border for hours where I had to swear under oath all of my intentions (to visit my boyfriend, that we intended on applying for a K-1 eventually, etc). They took my prints, picture, etc. Gave me a copy of the paperwork and he was on his way to drive me home...... Worst day of my life.

 

Since then, I haven't tried to cross the border at all. He has visited once since with no hassle, and then we sent in our application for the K-1 Visa. We've only so far received a receipt that it was received and the cheque was cashed. 

 

I really would like to still use my flight that I already had booked from the US to Canada on April 16th and I was thinking that I would like to surprise my fiancé with a week visit. BUT... I am soooo nervous they will not let me in. I know I could be banned from entering for five or ten years if so. Here's my situation:

I live with my mother, and pay rent to her monthly, but my name isn't on her lease. 
I haven't gone back to work since the leave of absence started. I still have the letter saying I am expected back to work on April 19th.


I have travel insurance through my bank until April 19th.

I can produce bank statements showing I have savings, however no money coming in since February.

I have the paperwork from when I was denied entry, showing I swore under oath that we would be filing for a K-1 and that I intended to marry him.

I have a copy of the K-1 Visa paperwork we sent in this month.

I can also have a copy of the e-mail sent to him saying that the Visa was received by them.

 

I just am so scared that they won't let me cross due to lack of proof of ties and I will be banned from re-entering for five-ten years because if that were to happen, we would change our plans completely and he would have to move to Canada, which we both don't want. Has anyone had any sort of similar situation who can offer me advice? I'm so nervous!! Thank you. 

 

 

Do you have any criminal charges at all that would affect your ability to cross the border, even if its minor (or seems minor) in nature?  It seems weird that they wouldn't even give you a chance to show proof of ties to Canada, but then again border crossing can be so random.  Was it your first visit?  Did you have a number of extended visits previously?

 

My boyfriend got denied entry to Canada when we were driving back to my home a few years ago because of a petty misdemeanor charge from almost 10 years ago (even though he had visited previously with no issues) ... that and we didn't even think to bring any proof of ties either (so naive at that point in time lol).  I had to drive him to Minot so he could fly back home and then drive back alone to Canada to work- yeah I was super devastated and so sad for a long time, it was awful.   When I came to spend last summer with him in the US, I got pulled into secondary screening for a while because I was planning on staying a few months and didn't buy a return ticket, and the CO asked me about that incident (so I guess expect your previous entry attempt will be documented when you try to enter).  They let me visit, and I have been to the US 4 times since then with no problems, but I was surprised that my fiances inability to cross into Canada was documented on my passport.

 

If you enter and they deny you, you shouldn't get "banned", but you will have to return home.  Just be prepared to face that reality again, because every crossing is a new adventure.

Side question.. So they just want to look at your total income and not taxable income? For some reason I thought that the taxable income had to be a certain amount over the poverty line. Hopefully that's not the case!! 

 

If you have an employer, than put your current income, which is how much you make an hour times how many hours you work a week, then multiply that by 52 weeks to get your current annual income. Supply a letter from your employer and/or most recent pay stubs to prove that current income amount. If you are self-employed, then use line 22, Total Income, from your most recent 1040.

I filled it in when my case was at the NVC. Just make sure you write down the application number that they give you and remember the security question. What I did was fill it in but I didn't finish it. It's valid for 30 days; you can open and close it and review it as many times as you want as long as you don't finalize it. To access it again they ask you for:

-application number

- first 5 letters of your last name

- year of birth

- answer to the security question (you can chose one question out of a list when you first start the process)

As soon as I got my "package 3" I confirmed it and printed the confirmation page (the one with a barcode) Before I did that, I (obviously) made sure everything was correct first (before you finish it all the information shows on screen so that you can make sure it's all ok) It's a pretty long form so I'm happy I did it beforehand.

I can't add much more but after doing some reading online I think it's probably the denied visa that caused them to write that on the form. It's good to know other people had the same issue but were approved anyways! 

Like the others said, just bring a lot of proof that day. It's great that your fiancee will be there with you! That'll help for sure.

I'm also waiting for my interview so even though I can't give you any valuable information (I wish I could!) I wanted to wish you luck!  :) I won't tell you not to get nervous because that's easier said than done  :P I'm sure I'll be pretty nervous myself!

I talked to an immigration attorney and they said "No pictures = No I-129f approval" and they said they could take over the case and send in the supplemental pictures/evidence before the RFE. But I called USCIS and they said it's not possible to send supplemental information until an RFE is requested. 


Don't worry about it, you will be fine. When my husband (my then fiance) applied for K1 petition, he only sent the I-129f form to the USCIS because we really don't know how the process was. He thought that he only need to fill out the form and send it. I only discovered VJ a couple of months after we filed for the petition. And I was so worried when I found out that we have to send a packet for I-129f and not just the form alone. I was worried that they might reject the application, so we waited and see. After a few months USCIS send us an RFE containing the checklist of what we need to submit and it's almost the same as the checklist here in VJ. So, I suggest it's better if you just wait for them to send u an RFE (is there's any, because photos are just secondary evidence).

I'm a student and using a co-sponsor (yes it is allowed at this embassy) but I'm not sure what they want on the I-134 for income.  Is it my adjusted gross income (which is a negative number because its adjusted for my tuition) or my total income.  I'm guessing it is the total income but I just wanted to double check.

My boyfriend works full time but that will not qualify him for the 2 person household poverty line i think by about 2000.
However he does do freelance graphic design. Which will put him over the poverty line. But the state where he lives in pays in cash most of the time. so no pay stub. He does have a few pay stubs for the freelance work. but not for everything he did. 

So my question is how strictly do they look at that stuff in the Amsterdam embassy?


ALL Embassies look at the income requirements the same and with total seriousness.

 

I have more the enough savings to get me trough it all. around 12.000 dollars.

Doesn't count unless you send it to his bank account, then only about 1/3 (or something like that)  of the value is countable.

 

Will they take that into consideration? or do they need his income to be 125% with taxes?

MUST meet the minimums.

 

We can always get him mom to co sponsor me. But if we don't have to we rather not.

Then wait to immigrate here until he has better income.  Go with Mom and thank her a lot.

Since you haven't even begun to compile your documents, I'd say your probably too late for a Fall, 2014 visa (might be very close if you'd be submitting now).  It is was it will be.  Follow the process and don't plan anything until you have the visa in hand.

I am almost ready to mail the initial package:

 

1) In the 129F application, question 34 asks if I have met and see fiance withint the 2 year period immediately preeceding: the answer is YES. So it is fair that section 34a relates to how we have met in withing those two preeceding years as opposed to how we first met (which was about 5 years ago). If that is the case can I put (which is the truth)?: "I drove from my house to baja california to see her about once a month." Is it too short?

No, its perfect but list actual dates.

 

 

2) On the G-325a, I never met my biological father, nor does he appear on my birth certificate. I was raised by my step dad (but never formally adopted). I ended up changing my name to his when I became a US citizen (when I was an adult). Can I put my step dad's info in the G-325a?

Yes list your step father.

 

I make decent money, put just in case I would also use him as a back up for sponsor, if necessary.  Any suggestions.

This doesn't matter.

 

3) my fiance has never been arrested. But do i need to send something from the police station/courts in mexico that she has a clean record with the initial package?

No, the Embassy will vet that out at the interview when she submits her police certificate.

 

 

I will use the letter of intent that is on this site and have her sign when I visit her this Friday. The letter of intent provided in this site has a section wherein I put the INS's address. What address to I put down?

Go to a restaurant and save the receipt, make sure it's dated.

 

The problems with pictures is that you don't know when you take them.

Take photos at the restaurant and maybe standing in front of it with the name in the photo.

 

I don't want there to be any question in the reviewers mind.

My current employer is ready to transfer me from my current location to USA once i have my EAD or GC done after getting married to my fiancee in states, Employer could not sponsor my work visa coz i already had K1 visa in process, now if my HR can issue me a letter stating i can start working from USA office as soon as i get my EAD or GC ready in states will that help during the K1 visa interview?.

 

 

 

Not really.  It all depends on your relationship and validity of that and your lack of intent to commit visa fraud just to enter into the US.
