We have photos, passport stamps, boarding passes but we never call each other, everything is over skype, whatsapp and facetime.

I have read that emails and cards are not seen as strong evidence?

 

All your evidences, when put together, are what tell the tale.  Skype meeting and Facetime do not qualify for the meeting in person within the past 2 years prior to the filing date.  Maybe you are confused about the meeting requirement. 

 

Emails and that used as part of the evidence package required to show a legitimate relationship, which is only needed for the interview, not for the initial filing.

 

 

But since you asked......our evidences of our meeting in person included the following:

 

Plane Boarding pass copies

Passport Stamp copies

Rental Apartment agreement listing the dates, address and in my name.......and a pizza delivery receipt listing the same apartment address, date and in her name.

Photos of us in front of well-known landmarks

Currency exchange receipts with dates and city name

Famous restaurant receipt plus a photo of us in said location

All I know is that I filled my 129f package and got my noa1 on march 6, 2014. The next step is noa2. Eventually there is a point which I would need to show my taxes.

My last taxes 2013 I made about 85k. It has been that way for past three years.

However many years ago, I had a job where I was 1099 and to make it short i owe about 4k. I have not paid them.

I should pay up and pay but I spent my money on other things. My mistake.

Any thoughts on how this will affect me?

If you have not yet married, and are in the 90 day period still, there is a way to get the K-1 reinstated at the embassy.  They could only get it reinstated for the original 90 days, but it is possible.

 

Marrying and getting an emergency AP would take at least a month, I would guess.

 

This is true....but not guaranteed.   Email the Embassy, they are the only ones who can do this.

If it were true what they told you, then how do you explain all those thousands of people on here who visited during their K1 process without any problems?

On another note, I think you are extremely lucky that you can see your fiancé at least every three months. Not all of us are/were that lucky. I went over a whole year without seeing my then-fiancé, now husband.

During out timeframe, my fiance was most likely not even able to obtain a visa to visit me.  We got through it and actually used/needed the time to organize our lives and our future lives together.  I have no sympathy for those who are normally able to visit and then can not.  Most are not able to visit.

Next time you are together, take a LOT of pictures. When we went in to get our restrictions removed, they wanted lots more pictures than we had. We got approved right away, but they like to see those pictures. Wishing you the best!

 

It amazing the number of couples that attempt to conduct an international relationship is a casual way with no regard for the evidences that are required during the process.

 

You have to convince a total stranger, the Embassy CO (and later the USCIS AOS adjucator) that you have a legitimate relationship (for AOS a legit marriage).

 

I strongly suggest couples purposefully generate all kinds of evidences to help themselves out.....but having just said all that....the key is not quantity but quality.  It's the content of the evidences that should show a real relationship......most relationships follow a normal course and your evidence should show that progression and more important that the couple are talking about the relationship and the details of life together.

I'm recently started my own business and am on state health insurance since my income is unstable.  I would like to petition for my boyfriend with my parents as co-sponsors.  I saw on this site that even though they make a substantial amount, the fact that I'm on government benefits might cause a denial of the application.  If so, would it be best to no longer accept state health insurance and then file the application?  Please advise.  

 

No affect, file away......but know that some Embassies do not accept cosponsors for K-1s. Since you haven't filled in your information or timeline, we don't know your fiance(e)'s country and can't comment to that point.

Any evidence of itself is totally useless.....it's content that is key.  Most every relationship follows a typical timeline and the couple discuss topics in a typical fashion........Try drafting a summary document that could be titled Evolution of Our Relationship.....in it you should discuss how you came to meet, what you talked about, how you agreed to meet in person what you talked about.....how you agreed to pursue the K-1, what you talked about....how the relationship grew and your discussions about life together in the US.  Along the summary you should be able to reference specific evidence that supports that part of your relationship timeline.

I am a US citizen living in NJ. I am filing k-1 visa for a Chinese citizen currently studying in Japan. She moves (her address changes) frequently (like thrice a year). Her parents are in Beijing. 

 

My question is:

 

1. for Part 2. Information About Your Alien Fiance. 3. a-i Alien Fiance's Mailing Address. Can I put My U.S. address in there to ensure that the mail can be received so that I can scan to her or mail it to her newest address in case of move?

No this would be where the Embassy would send info about the interview, once you got to that stage.

 

 

2. for 29.a-f "Your fiance's address aboard." and 32.a-f. "Your fiance's address abroad (Native Alphabet)" Should I put her current Japan address or her parent's permanent Chinese address?

Ok so my fiance went to his second interview today. Here is what happened.. and a summary of his situation.

 

He was born in Venezuela but his mother and father are both Dominican Republic citizens. His mother brought him back to the DR when he was 1 years old. She then proceeded to get him a DR birth certificate etc which he has a cedula and passport under. This is also the name etc he applied for visa and used up until now. He has never been to venezuela..etc.

 

The embassy said that he was from venezuela and he admitted it. and they asked him to write a summary and sign the paper saying that. He did. THen they said they don't know if the relationship is real at all now. They also told him to go and get his venezuela birth certificate and they will see what they can do. They also gave him back his passport.

 

I know this is bad so please remain as much as possible from the exaggerated "just how bad it is" comments..

 

should he even bother going back with his venezuela birth certificate? He said its in bad shape by the way and needs to get  a new one from venezuela but has been unsuccessful in getting a new one from there.

 

What I need is advice.. any idea of how to fix it or a good recommendation for a good immigration attorney (not a quack).

 

This is the key concern.  Getting the Ven BC should be straighforward....as much as getting a BC from abroad for Ven can be.....but they don't believe you have a legitimate relationship.  That is where your focus as the petitioner should be.

We have been approved, the K1 is in my passport.

I intend to emigrate and marry in the summer.

Before this though, I would like to take a short holiday in the US (under the visa waver program).

 

So, I would like to travel to the US but not use the K1 that is already in my passport.

Aint'goona happen.  The K-1 will be used.  You have no choice.

 

 

I've only found one thread about this online but no reference to rules or personal experiences.  

 

 

So!  I would like to ask you all 2 things:

 

1 - Does anyone know of any policies about this that they could link to or reference?

K-1 trumps all other visas.  Email your Embassy and ask about it.

 

or 2 - Has anyone actually done this?

Never have I read about this.

I think the concern would be that he (based on what I've read) knowingly indicated that he was born in the Dominican Republic when in fact he was born in Venezuela.  The reason that the CO may have indicated that they now don't believe that the relationship is valid is because to them, it looks like he has knowingly lied about something as significant as his birth, so why wouldn't he knowingly lie about the validity of the relationship.

 

Now, that may not be reality, but it may be how the consulate views it.  Did he indicate on the application that he was born in Venezuela or DR?  If he put Venezuela on the application, that's a good thing, because there's less a change of a misrepresentation charge at the end of all this.

 

Do what you can to obtain the birth certificate.  Is there a Venezuelan consulate wherever your fiance is? Usually you can try to obtain vital records from the consulate offices themselves for foreigners living abroad.  That's another possibility.  Then document everything you've done so that if there's a change that you can't obtain the BC, you can provide a timeline of everything you have done in good faith to get it.

I was worried about my k1 visa petition as well. We had our cita march 25 and it was approved.
I had filed a k3 visa from my previous realtionship but we broke up after 8 years and then 2 years later I met my fiance. Me and my fiance have twins together and I filed a k1 visa for him.
Our interview went smoot h and of course my ex was brought up but if ur relationship is genuine then there shouldn't be any issues. I was worried my past would affect the outcome of my future but it didn't. As long as u havea genuine r elationship ur good.
I brang tons of evidence and wasn't asked for not one thing. So it all depends case to case. But I was prepared for whatever they threw at me.

The short answer is Yes, it would be a risk. Processing times for visas are always changing, so there is no way of knowing how long the K1 will be taking by the end of 2014/beginning of 2015. 

 

You can always plan to have a "Big" wedding in September 2015 and be sure to apply for the visa plenty far out. If the visa is approved before that, you may have to have him move and legally marry in order to meet the 90 day requirement of the visa, but you could still have your big Sept. 2015 wedding with friends and family, even if you have to legally marry at the courthouse before that date.

You cannot enter the US with a K-1 visa if you are married. End of story. 

 

You cannot legally marry anywhere outside of the United States. That's the whole premise of the K1 visa.

 

If you MUST marry in Nigeria, then you'll have to abandon your K1, marry, and apply for a CR1 visa (which will be all new fees, new paperwork, and another 12-18 months).

I am away for two weeks in June and someone would be checking the mail in any case.

 

So if I try and schedule my medical appointment, and get all other paperwork together prior to me going away in June, then I should also complete the DS-160 and try to schedule an appointment with the embassy for some time later in June if possible?

 

As I said in my earlier post, I really don't know how quickly the Embassy is running from submitting form of readiness submission to granting K1 interviews. But I would expect your interview to be about a month (or so) from submission of the readiness form.....but that's just a guess.

From what I have read, it is up to the IO at the border if you can enter on VWP or must use your K1. I would hold off one submitting the readiness form. Or, request a later interview date. Will someone be checking your mail while you are away in case something arrives?

I'm not really clear on how far out London interviews are being assigned right now. I'd check the timelines and mail in your readiness form accordingly. And I agree with above poster...I would do the medical before the trip.
