          I have a decent job that pays more than 75k a year. My fiance who I am filing for has debt but is working towards fixing it. Will this have any affect on the petition? I am US Citizen, he is Canadian Citizen.

Wrong.....you both only need to submit signed Letters of Intent to marry within 90 days of arrival in the US.

There is no need for titles of anything else at this time.....that being said the intention of the K-1 is to become married and stay that way while permanently residing in the US.

I'd only say the truth, that you're on your way yo visit your boyfriend.

I don't have personal checks because I don't use them. Ordering them would take 2 weeks so if a Money Order works, I'd rather use that.

Yes do that.  It's all part of the packet of evidence that when looked at a whole, establishes both of your presence in the same place at the same time.

 

 

I'm not fabricating evidence. We just would switch from constantly using Skype to using email sometimes. That's our own personal choice, I'm just asking if emails are good to have at this point. I'll try to get a skype call log though as long as it can be only calls and not have anything too personal in it.
I am a proponent of purposefully generating all types of evidences......that being said, it's content that is key to establishing a legitimate relationship or not.  I advocate the drafting of a summary letter (all this for the interview) that can be title "Evolution of Our Relationship".  It should state a summary of the beginning of your relationship, how it evolved from getting to know you, to desire to meet, to desire to marry  and then live together.  Besides the lovey dovey talk (which is to be included a bit IMO since most folks who desire to marry have some degree of affection) to discussions of the details of the visa process to life / planning for life in the US. 

 

I wouldn't put void on it, the birth certificate has special ink that puts VOID COPY on all copies. And it doesn't have a back side.

If the back side if blank then just include a blank page if copying it would create some hidden watermark.

I mailed off my I 129F packet last week. My fiance has never been to the US, and does not have a visa. However, he would like to come and visit me while waiting for the K-1 to get approved. Is it okay to apply for a visitor visa after filing the I 129F? I know others have visited after applying, but mostly on existing visas. Do you think it would cause an issue to apply after the fact?

 

Some get approved and some do not.  Only out the visa fee to try.

As long as they are not yet married and have met within the 2 years, the US citizen could file I-129F.

The child won't need to be included in the petition as the child is US citizen, do the CRBA

 

Yes to the first sentence and No to the second.

 

ALL children must be listed on the G325a (and/or 129f), regardless of immigration intent.  It is on the DS-160 that you would list any children than you wish to receive a K-2.
 

 

 

And yes if you are not married, then the K-1 is the route to go......doesn't matter if you have a child or not....USCIS does not make moral / ethical / religious judgements.

You probably can not.....doesn't matter as the info demonstrated does nothing to prove a legitimate relationship......it only establishes that the two chat names contact each other a lot.....who know what they talk about?????....maybe Tiddly Winks and nothing about a relationship.

 

This is why I suggest folks purposefully generate all sorts of evidences.....and draft a letter for the interview that can be titled Evolution of Our Relationship.

 

In this letter you will describe the first meeting and how the relationship grew (normally following a usual path and dialogue) and then agreement to meet in person...then talk of marriage and immigration and life together in the US.  All the while you would point to specific evidences that bore these facts out...copies of specific emails where you had a specific discussion, etc etc.

 

It's all about content,,,,not quantity.

Only one parent is required.  Yes both file 134s with supporting documents.

 

 

- Is it possible for me to sponsor "my own self" if I have $20,000 (I think the poverty guideline is around that) in saving? or it has to be an income?

I don't believe so, for your country.  I know UK can but most not.

 

- Is it okay to file in Spring (mars/april) 2015 to get married the winter or spring after that? or he should file once he get back from france (august/september)

Personally I'd want to be with my future spouse ASAP.

 

- Once I get to the US, get married and ask for the GC, I cannot get out of the US and come back right?

I included a summary page of a few months from my phone bill that showed our texting.  Of course the content of the texts could not be reproduced....hence the need for many other forms of evidence.

 

What I did do is include a summary letter that I titled Evolution of Our Relationship.  In it I summarized our relationship, how it began, what we talked about, how we talked, how we came to agree to meet in person, what we talked about once we agreed to pursue the K-1, what we talked and planned for once we obtained our NOA2.

 

Somewhere in there I described our nearly daily correspondence, many times only via texting...hence the relation to those summary sheets.

 

All your evidence, when viewed together should paint a picture where a complete stranger, the Embassy CO, should be able to conclude you have a legitimate relationship.

My packet 3 email said they'd snail mail a copy of my approved petition to me. Well, it arrived today and on the first page of the I-129f form under 'remarks' someone hand wrote 'inadmissibility issues'. Needles to say, I'm... not great. Anyone else ever got this? Is it really standard procedure to forward a petition like that?

 

Issues I can think of:

 

1) I applied and was refused a student visa last December. I actually went twice within a week. They asked who I'd be staying with and I said my girlfriend. They asked a few questions about her, then denied my application and revoked my tourist visa. The first CO said he doesn't think I'm a bonafide student but that I could apply again, the second said I don't have enough ties. We discussed our options after this and decided to get married and filed the K1 paperwork on Jan 3rd.

K-1 is for unmarried couples.....if you've become married, then it was the incorrect visa to apply for...should have been for the CR-1.

 

 

2) I got pulled into secondary when I visited her for 7 weeks during summer break last year (I was still a student). We were still only casually dating at that point and not really in a relationship so I said I'm staying with a friend. They didn't ask any more questions about that, but seemed concerned that I would work, which I didn't.

Not a big deal.

 

 

3) In Croatia we distinguish between permanent and temporary residency. I was stupid and only put my permanent residency on the G-325A, even though I was a student in another city in the same country for much of the last 5 years. I'm scared they'll think I wasn't a student and lied (even though I of course had to bring paperwork from uni when I applied for tourist visas), or that I purposefully lied about my residence. I plan to bring an updated form to the interview but don't know how much that will help.

Many folks list a more permanent address if their school address will be temporary.

 

 

Our relationship is genuine and we do have lots of proof: 4 visits, skype chats every day, cards, emails, texts... She's coming to the interview with me.

Have to prove to the Embassy CO.

 

 

I don't even know what to ask. Has anyone had a similar experience? Any word of advice?

Seems strange......so the Embassy sent you this marked up copy of the 129f?   Never heard of this.  Contact the Embassy and inquire.

The embassy will then send your fiance instructions regarding the steps that must be taken prior to scheduling an interview including but not limited to filling out DS-160 which is the actual visa application.

I can't seem to convey to the USCIS phone staff that the trip back to Latvia is unnecessary bureaucratic red tape.

He is supposed to stay here as a visitor until mid-June. There is no reason to go to the embassy in Latvia.

You, or your significant other came from the same area it appears, although it seems like it was during a time period where there werent serious issues there. What would you have done in my situation, honest question. I am just worried that something could happen that would close the US embassy in his home country and then we would not be able to go forward with this at all. 

 

Well.....there was a unique situation in our case that was outside of the Embassy and involved the Russian Adoption agency....whose decision would have made or broke our chances of being together.  In the end ours was a happy ending but we did discuss it and were prepared to live with that decision....what else could we do?

 

And the same in your case.  If the US Embassy becomes closed and/or doesn't hear any visa requests....there is nothing you can do...

 

Definately not purposefully commit visa fraud.

You NEED signed and notarized letter from the ex giving permission for the children to immigrate and permanently reside in the US and to visit back to the home country and then return back to the US.  This language must be in the letter.  You don't need full custody but you need this letter.  Email the Embassy and ask specifically what they will want to see.  This is a deal breaker and it is suggested that you obtain this prior to any filing for a visa petition.

I am submitting our I-129F packet tomorrow and have a quick question.  I am using the intent to marry letter provided by the guides section on visajourney.

 

does the date above 'Dear Sir or Madam' reflect the date of signature?  Or should I also put the date of signing next to my signature??

 

Also, for other copies of evidence such as receipts and copies of birth certificates.. do I need to sign and date these also?  Or just include the copies as is...

 

All official forms have been signed and dated with original signatures..  I'm just not sure about the other copies of evidence if they need to be signed or what..
