No, you can file while you are visiting and as long as you abide by your visa's time limits, then no problem.  Understand that once you file, there is not guarantee that you'd be able to revisit.....some folks do get turned away if they don't show good ties and reasons to return.

No, a USC must file taxes on worldwide income, so a USC who has a job abroad still has to file taxes, but is not qualified to use that job for the affidavit.

 

I can understand about income while living abroad can not be used for support, but if the income was from a foreign company that paid while the USC lives in the US,,,,,then this would count?

 

 

Obviously the assumption is that the USC and the beneficiary intend to permanently reside in the US and the USC have sufficient income while residing here.

The only problem will be your assets later on for the affidavit of support. I'll be returning to the US for the last part of the visa and for the AoS. 

 

One can use bank savings as assets rather than current income....if you have enough.

 

Also current income doesn't have to be domestic income....at least from what I know.

Cellphone bills? I use a pay as I go in Turkey. I dont have ways to prove this.  I have photos but seriousy nothing near the insane amout of stuff required.  There needs to be an easier way

 

Live in Turkey.  If you both want to reside in the US, then this is the way.  You can hire an expensive lawyer who will provide the same list of documents and take your money as they wait for you to compile all documents.

Thanks.  At least some people are being nice.  I dont understand why some people were assuming I didn't even read the instructions.  The empathy helps.  Its just crazy

 

Try not to over-react and help will come.  Read the Guides and Follow the Example Forms (links at the top of this page).

 

Just follow the steps, read the form instructions, assemble all the required documents, don't get caught up in looking at later stages...as stated, your first steps are to assemble your petition file and determine how you will attach the payment.......you can assemble everything and send it to your parents if you wish them to help.

Did you read my original post?  I said I CONTACTED the embassy.  Yet another reason I am asking here is because the embassy here in Turkey only spends 2 hours per week answering questions on immigrant visas and whenever I contact them during those hours I cannot get through. So please stop assuming that I have not read the instructions and copy and pasting things.  Rudeness is not appreciated.

 

Most Embassies respond better to emails rather than phone calls.

 

There is no online payment method, check drawn on US bank funds is the only payment method.  Make sure the check is addressed (Payee) correctly.

My fiance and i live in Turkey. I am a us citizen by birth and he is Turkish. We want to apply for a K1 but I need to file a 129-f. I have the paperwork filled out but I don't know where to send it. I tried contacting the us embassy in Ankara but they only answer questions about immigrant visas twice a week for an hour. I also called during those hours but I was on hold the whole time so they are really a pain to get a hold of. Where do I send it? Also where do I pay the fee,can I do it online?

Then you should be able to do two things:

 

Delay the interview....which will delay the issuance of the K-1 visa.

 

Once issued, you have 6 month within which to use it.  So by my estimate you could delay moving for about eight months.

 

 

 

Why would you need to visit the US during this period?  That option should be taken off the table.  If you USC fiance understands, then they should understand your need to stay a bit to help your mother with her understanding of your future life.
 

 

 

 

Now that I think about it, you have three options:

 

The third:   Cancel the K-1 and refile later when your life is ready to get together with your fiance(e).

Yes and Maybe.......CBP will see the K-1 in their system.  You'll have to provide compelling reasons that you will return to the US before your visit time requirement is up.  You may be turned away.

 

I don't understand?  You've been petitioning for the K-1 visa to immigrate to the US and marry your USC fiance(e) and permanently reside there and now you want to delay that?

No time line to file AOS....the beneficiary just can not legally work and will not be allowed back into the US without a new visa if they leave.

 

 

 

Now......the cost for AOS is widely published....and there is will other costs in the future.  Lack of knowledge is no excuse and should have been considered prior to filing the K-1 petition....but there is no time limit to filing AOS.  Just get married within 90 days of entry.

That may not matter.  You have two things to do, in my opinion.

 

Email the Embassy and ask them if they NEED a BC or will the SC work? 

 

Contact the county clerk where you will eventually be married here in the US.  Ask them what they need.

Usually it's not a big problem, unless the overstay was very long or has other extenuating circumstances.

What form?  You list all children on the 129f and the g325a forms.  You really need to read the guides, look at the example forms and read the sticky notes.  This is not complicated but you are obviously hunting and pecking and not doing your complete homework.  You can use a lawyer, but this is just the beginning of many forms with the USCIS and if you totally rely on others, you'll at least be spending tons of money to have them spoon feed you the request for info. 

 

The other thing is how her country could be in some sort of limbo soon. She doesn't live in Crimea but many other parts of the country could be in the same situation as there. We dont know what this will do to the process.

i am looking at lawyer options. I just am not comfortable with this. the simplest mistake adds months to this ridiculouly long process.

 

There's a lot more you need to do with the USCIS after immigration to the US.  Read the Guides for more than the K-1.

 

It's really easy, especially if you Read the Guides and follow the Example Forms.....however if it is too daunting for you, then you will incur a lot of legal bills beyond the K-1.

Both you and the cosponsor submit 134s plus any documentation you have.  Yours will kind of prove that you need a cosponsor.

 

 

 

It's a typical problem for young folks and/or students.

 

 

Can your parents support both of you for as long as it will take to make amends on the loans and be able to support a family?

 

Maybe delaying the K-1 until you are self-sufficient is better?

Send a notarized letter to both the Embassy and USCIS asking the first petition to be formally closed....you haven't done that.

 

Then resend the entire peition with fee just like before...you have to start all over again.

 

Don't forget to send a waiver letter if requried.

Though conventional wisdom on this around VJ is that original signatures are required for the letters of intent, I believe this wisdom has been rendered obsolete by explicit changes in USCIS's own policies.

When I filled out my I-129F paperwork, the instructions read:

"5.B. Provide original statements from you and your fiance(e) whom you plan to marry within 90 days, and copies of any evidence you wish to submit to establish your mutual intent to marry." [Emphasis added]

Now, however, the instructions read:

"7.b. Submit evidence that you and your fiance(e) intend to marry within 90 days of your fiance(e)'s entry as a K-1.  Evidence of your intention to marry may include a statement of intent to marry." [Emphasis added]

This change seems deliberately designed to take away the original signature requirement for the letters of intent.  The problem, however, is that--as you may have heard around here or gathered from your own experiences--the USCIS is a behemoth bureaucracy that is slow to change and quick to make mistakes for which it will never be accountable.  Instead of risking an RFE from an adjudicator who may have not read the policy change memo, I would probably still err on the side of providing letters with original signatures.

As far as G-325As go, I think the advice of others in this thread is on point.  Original is the safest way, but they do apparently also accept copied and notarized versions, at least in some cases.

What everyone else said - it should take 6 months to a year depending on your circumstances. IR1/CR1 visas (for married couples) are taking longer, but you aren't going down that path, so no worries there!

 

And, unless you have extenuating circumstances, you won't need a lawyer, The VJ (VisaJourney) guides across the top of the site, as well as the forums here will be the best resource you could have.

A lawyer is definitely not faster or in my opinion better(for me it wouldn't be better, I know it's different for everyone) We were thinking about getting one, because we thought it would be easier or wouldn't make any mistakes, but I am glad we ended up doing it ourselves. Reading this forum helped a lot, I would of probably been lost without it. If you decide to do it on your own, be sure to do everything carefully and don't try to rush through it and make a checklist of everything you need to send with it.Good luck with whatever you choose!
