Has your CEAC status changed from Immigrant Visa to Non-immigrant visa yet?

 

I was also told 5-7 business days and it ended up taking closer to 10- for me it was because of the big computer systems crash ... not sure if that is still affecting the issuance of visas (was in July).  I emailed the consulate and asked about it and they responded fairly quick, but every consulate beats to their own drum.

After my interview last week the lady said that you CAN go to the US as a visitor without activating the k1 visa but you must be VERY CLEAR at the POE that you are only entering as a temporary visitor.  I personally wouldn't take the chance, but it is possible to do it.

I forgot to make a copy of my I-129F package that I submitted to the UCIS. I included some original copies of photographs and visa slips as part of my package. Will the original package be sent to the embassy after NOA2 and will I potentially be asked for furnish a copy of the package i sent it originally? Can I request a copy from UCIS if one is needed for the intervie

 

No, the original copy won't be needed for the interview, as far as I know.  However, as the beneficiary, I found it helpful to have a copy for my own records. 

 

If you are really worried you could prepare another 1-129F to keep as a reference.

What was the misdemeanor for?  If it isn't within the three categories specified on the i-129f instructions you do not need to supply any info (domestic violence, murder/rape/kidnapping. more than 3 drug/alcohol convictions, etc.)

Will you be going through Montreal or Vancouver consulate?  The I-134 and supporting documents won't be needed until the interview stage of the k1 process and the consulate will send you more information about what they require.

 

I went through Vancouver and only brought an employer letter and pay stubs from my fiance - Montreal might be a bit different.  Regardless, it is current employment/salary that is important- my fiance (well husband now) was unemployed for two years before we submitted our application and it made no difference.  When he got a full time job we started our process.

My foreign Fiancé ........ and I .......... met online via a dating site ?Caribbean Cupid? after few exchange e-mails from Caribbeancupid.com we migrate to using Skype where we talked for 28 days consistently before meeting in persaon on ( date ) in Jamaica.

Our second time meeting was on  ( date ) in.........We then flew together to ...... on the ( date ) where we spent 4 months and 27 days there together.

Our next time seeing each other was on September 9, 2013, we met in ( date ) where we are spending 343 days together. After this I will be returning to the US and my Fiancé will be going to Jamaica.

 

How is this?

Expedite only means they begin to process your application quicker than others.....the actual adjucation process is the same...and if any of the parts of that process take longer than normal....then they take longer.

 

Most petitions are adjucated in about 15 minutes...assuming all the parts fall into place.  There may be some part of your process that is not normal.  Nothing you can do about that.

Most waivers are granted; I can't remember reading anything about any that did not.......now visas being denied at the interview phase, yes we've seen that (some based on the belief that the petitioner was engaging in visa fraud multiple times and some others believed to merely protect the beneficiary from the petitioner).

No.  If the baby is born before she comes to the US, the you have to pay for a K-2 visa, unless you can wait to obtain CRBA citizenship for the child.

I've said it before and don't mind saying it again.......it's not about quantity, it's all about content or quality.

 

Photos together are great but are secondary since they can be altered.  Summaries of chat logs or emails or phone calls do nothing on their own except to say you two email a lot, for example.  They don't say anything to what you talk about.  Most relationships follow a normal course of events.  Your evidence, when all put together, should be able to prove to a total stranger, the Embassy CO in this case, that you have a real and legitimate relationship with the intention to marry and permanently reside in the US together.

 

So the evidences you submit should show snippets of the evolution of your relationship....the initial getting to know you phase, to the more serious let's meet in person, to the even more serious about intending to marry and follow the visa process to the planning of the move and the future lives together.

Depends on what you already submitted and how it can prove you have a legitimate relationship.  Your word alone in not good enough.

Printing out a summary of your emails works just as well as a call log for proving communication/relationship. It shows how often you communicate and for how long you have been doing so on a regular basis.

 

Don't mean to harp but to just point out......quantity of communication do NOT speak to the validity of the relationship......only that you communicate about something often.

 

Content of the communication is key.....and therefore a summary listing does not address that.

 

 

Show BOTH, the summary and then select emails to verify content.

No.....just printing out a summary of the emails does nothing to show a legitimate relationship exists....it only shows you email a lot.

 

Understand?

 

ALL of your evidences, when put together, should show to a total stranger (the Embassy CO) that your relationship has evolved through the typical normal process and has become one where you both want to marry and live permanently (and for a long time together) in the US.

 

So print out select emails from all stages of your relationship that should show what you talked about in the beginning is very different then today....they should be different, I would hope.

The I-797 NOA form is used for many other USCIS purposes......for the K-1 process, those dates are meaningless.  Once the NVC and then the Embassy have your case, the dates are automatically and seamlessly extended with no involvement required on your part.

ok, so my fiance finally got her visa!!! yeah!!!!

 

But now I am a little confused. What is the next step(after her actually flying here)? I was thinking it was getting married but I read online she needs to apply for a SSN BEFORE we get married?

 

Maybe I am stupid or whatever, but i thought that after she arrives the steps are

 

1. Get Married

2.Send out forms for Green Card, with paperwork for AP and also paperwork so she can work.

 

But am I wrong? are there any more steps besides that. especially stuff BEFORE getting married?

also, how does the whole work situation work? I know she can file a temporary work visa or whatever until she gets her green card, because that can take a while, but how long does the visa last? does it last until she gets her green card or does it last for only 3 months or so?

Yes, you've met within the last two years and you both have to send in a signed Letter of Intent to Marry.

Our thoughts on this are...I have two kids, this will help them adjust instead of just a couple weeks at a time, which I only have them every other week. They know her, we all talk on skype and they've met her the last couple times she's come.

Noble thought but may not be enough to convince them.  Brazil is not thought to be a high immigration risk.

 

She'd be able to prepare easier for the wedding, getting all the plans made, selecting a venue, etc, and we get to hang out while we wait.  

Not an factor.

 

Honestly she wants to go back so she can be with her parents during the whole in country processing deal, that gives her a couple of months to say goodbye and tie up her loose ends there.

Many fiances can not even get any other visa to enter the US.  If she gets denied, then you two will deal with it.

Hello all,

 

I have just received my K1 visa in the mail today and a letter that states to carry the X-Ray in the suitcase. I have never received the X-Ray however. The doctor's office mailed everything to the embassy and they did not return the X-Ray to me or put it in the K1 visa package. 

 

Will I be asked for the X-Ray? I am actually flying tomorrow. 

X-ray will not be asked for at POE.

This evidence. along with all the other evidences you'll be sending, should support the evolution of your real relationship.  Most relationships follow a normal path and the conversations between the two follow suit.  Choose specific conversations that support that stage of your relationship....such that when looked at in total, a complete stranger, the Embassy CO, can determine you have a real relationship.

My question is, I read that I have to have all my police records and I am currently living in Mexico, but I have lived in the US for more than 7 years as well. I read online that present and former US residents do not need their records but I want to make sure I am correctly informed. Will I or will I not, need both police certificates from Mexico AND the US?

 

The US doesn't do police certificates.  The background check will take care of that.

ON the 129f form and the G-325A form you list ALL of your children.

 

Then when one of you completed the D-160 online form, you will list which of your children you wish to receive a K-2 visa.  Then you pay for their medical along with yours and the visa fee along with yours and they will accompany you to your interview if they are coming with you.  If they are to join you later, they will do their medical and interview prior to their select date to travel (which must be within one year of your K-1 visa issuance).
