Sure, but then she'll go back for the medical and interview.

 

We would be ready to go for the K-1, but don't feel like waiting 5 months for an answer.

And whats the durations of a student visa or internship visa?

If you're a male, then getting pregnant may not be an option for you.  If you are a female, then you could get pregnant.

 

She has a friend that did it and got a faster interview,

Not because she was pregnant.

 

but she says she has 2 other friends that are not pregnant that are waiting, and she said that the wait can be over 2 years for an interview if she is not. I don't think this is a great idea for several reasons.

Not being pregnant does not enter into their cases.

 

My questions are: Would this do any good at all?

No

 

Could this make things more complicated?

Sure

 

Are there other and better ways that can help her to get a faster interview?

No, unless you enlist in the military and get sent to the front lines.

the paperwork process is easy its going to be the cita that will determine u being united with ur love or not. As long as its genuine u shldnt have isues and the questions they ask at the cita will be a piece of cake if u know one another like u should. Just b ready to explain urself if asked.

Proof of having met really just needs to be a picture (or 2) of you both together. I don't believe Sweden is high-fraud, so you shouldn't need too much.

You cannot travel without applying for and receiving AP (Advanced Parole). This can be done for free when you apply for your AOS. You'll fill out forms for EAD (Employment Authorization) and AP to send with your AOS documents. Since they're free, it's best to do them. 

 

Once you enter the US, marry, and submit your AOS (which can be done as soon as you have the marriage certificate back), your EAD/AP can take up to 90 days. Once you have the combo EAD/AP card, you can travel. Your green card (permanent residency) will then take up to a year. Some K1 AOS applicants are being put into the Interview Waiver Group (which we were). This means you may not have an AOS/Green card interview, but the processing will likely take a bit longer as well. 

 

Check out the timelines on VJ to see how other K1's are progressing through London. And, as has been mentioned, always be careful and don't plan your wedding until you have the visa (or have flexible wedding vendors).

Also, once you enter with K1, you'd apply for AOS with EAD/AP (work and travel authorization). This will take up to 3 months from application. There is an expedite option, but I'm not sure of the logistics. Your green card will take anywhere from a few months to a year to receive.

Also, I'd imagine trying to get a non-immigrant travel visa would be challenging with intent to immigrate apparent through your K1.

You have to prove that you spend more time in the US than outside the US or risk abandoning permanent residency status. Continuing to work for a UK based flight crew that doesn't do huge domestic business int he US may be challenging? Perhaps you can fly with their partner American Airlines...just want to make sure you've thought this through long-term!

to be clear, the I-129-F petition requests only proof of having met within 2 years AND that both parties are free to marry at the time of filing. The only relationship evidence we filed was proofs of my entries to Thailand (6 times over a 2yr. period) and photos of us together, mainly with her family(I personally feel this is most important).She  brought phone and text message records to the interview and they would not take them but the consular officer DID look at every additional photo that my fiancée brought to the interview and asked questions about them. The rest of the interview I would equate to a school exam, with the I-129-F being the textbook....re...if you have studied the I-129-F and I-134 then you can ably answer any question the CO asks, he or she`s questions come directly from these forms in one way or another. I know that many "onetime" petitions are approved but I feel that multiple meetings along with many family photos hold the most sway and that a consular officer does not have the time and is not interested in reading page after page of texts, Skype, whatever....my opinion only, im sure others may disagree...best of luck to all legitimate I-129-F filers....

not knowing DR requirements, I would think they will do blood tests and a chest x-ray, his vaccination records help the doctor know what vaccines are necessary, and he will give your fiancée what is necessary. the doctor will fill out a DS-3025 vaccination record, he should submit one to the embassy and give your fiancée a copy. A correctly completed ds-3025 is needed in the U.S. when your fiancée arrives and you apply for AOS. good luck!

I don't think it would affect your processing time, depending on how long it takes you to get all the documents, evidence, and proof together for the I-129F. While you are there, you can fill out the I-129F and the G-325A for both of you and get your boyfriend's original signature on all those documents. You also could get his original signature on his letter of intent.  That way when you're back in the States, you don't have to ship all the forms to him, wait for him to sign them and then wait for him to ship them back.  That is what my fiance and I did on my last trip, anyway.  We wanted to be sure the only thing we needed to do once I was back in the States was prepare proof of our having met in the last two years. 

 

One question though: Have you met your boyfriend in person prior to this trip?  

 

One additional question (the hardest one for me to ask myself)  Do you make enough to sponsor him? Or do you have a cosponsor lined up?  

 

For any immigrant visa to the U.S. you need to prove you can make enough money to support your fiance, usually 125% of the poverty line.  This clause delayed my fiance and I's application by about a year and a half because I had to finish school and get a job in order to make enough to sponsor him.  Does that make sense?

We used third person present tense when describing how we met and ongoing relationship, but I doubt that matters.  In fact, many will argue it's not even necessary to include more than a one line snippet of how you first met.  I just wanted to include everything in the original petition for my own peace of mind.  And then we provided a supplement of evidence for each time we met in person (receipts, boarding passes, statement, pictures, etc.)  Our petition was approved within a month of submission and our visa was just issued. 

 

I attached some samples of what we did (some details omitted of course)- again not saying this is right or wrong or that anyone should do it this way, but its what we did and it worked for us.  Everyone has their own way of doing things, but it might give you some ideas.

You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner?s ability to befinancially responsible for you. You should also submit your petitioner?s most recent U.S. Federal incometax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.
 
So something that will be needed, but not until the interview stage of the k1 process.

USCIS is really only concerned with evidence to prove there has been a face-to-face meeting within the last two years.  Can still include them, esp if you wish to front load your petition, but relationship evidence is better suited for the interview and consulate stage of the process.  Like pictures, they only supplement primary evidence that should be included in the original petition.

London has been saying for about 3 years in the instruction letter (packet 3) to bring a new letter of intent to revalidate the petition if you go past your priority date as they call it. In 2012 and 2013 it also said notarized but I think they dropped that notary part from the letter this year. I haven't seen a letter from this month, so read your letter from London again and see what they instruct you to do.

 

From what I have seen most consulates ask for new letters of intent signed within a month of the interview. 

 

They were specifically asked in my packet 3 info, but when I got to the interview, they weren't interested! :sleepy:

Hi everyone,

I?m amongst the lucky few for which the whole process has been so far way quicker than expected!

I?ve received the packet 3 from the embassy a few days ago and I?m now gathering all the documents needed. Just a quick question to everyone here: I booked tickets ages ago to go and see my fiancé in LA for a week end of August because back then I didn?t even think that we would have heard anything about the I-129F by then. Anyway, I have carefully read all the posts on the topic here and I plan on going with plenty of proofs of my ties to the UK and cross my fingers and toes that it won?t be a problem.

 

But what I would really like to know if when to fill in the DS-160. I thought of doing it as soon as I come back from the US (1st of September) but as my petition is only valid till 23rd of October, will that leave enough time to the embassy to schedule my interview? Or should I fill it in before my trip and give the dates of my last trip instead? And if I do so, am I more likely to have problems at the POE in LAX?

I spent the week before my interview with my fiance in the US. 

 

Just complete the form and give the dates of previous trips to the US.  One less thing to worry about; you can cross it off the to-do list and move onto the next item.  I filled mine out in March, and made 3 more trips to visit my fiance between the submission of DS-160 and the actually interview. 

 

In regards to the expiration of your petition, it will be automatically re-validated for four more months when you appear for your interview, so that date is nothing to really concern yourself with.

Just to give an update: my POE was in Chicago. I thought it was in Vancouver but the officer in Vancouver did not know what to do with my K1 visa and there was no US CBP there in Vancouver when we arrived 4:15 pm. Arrived in Chicago and handed the officer my K1 visa and my sealed brown envelope. All done in 10 minutes.

 

Good to know!  Chicago will be my POE in a few weeks too ... super nervous (and excited!)

I would file now or as soon as you can.  There is SOOO much uncertainty and randomness in this process.  Besides, it is only as quick as you wish it to be after your petition is approved - my NOA2 came a month after we filed, but I didn't do my medical/interview for another 5 months because of work and other things, and I will be moving next month.  We planned on our process taking 8+  months and have stuck to our original timeline.  And after the visa is issued (well after the medical technically) you have another 6 months to activate it.

 

So personally I would ere on the side of caution and get er done!

Hello. I am in the process of sending a copy of everything I've sent to USCIS to my fiance so she can give it in the review at her consulate in Canada. The problem is I was stupid and didn't make a copy of them physically. I had digital copies of them all.

Long story short, I accidentally deleted them about 2 weeks ago without realizing they were in the folder I was scrubbing for space. I've gone through everything to try to retrieve them. They are gone.

 

How important is it that I have the exact originals I sent?

I don't even remember the date I put on the originals.

 

Should I just start the forms over and put in a date I think I signed them as?

 

Copies of what?  What are the "them" you keep referring to.

 

I can't think of what "originals" she would need from the petition package for the consulate stage.

Where did you hear that Nebraksa had a backlog, as well? I just filed the I-129 and NSC is my routed office so any help on where to find this info beyond USCIS's site would be appreciated. Nebraska does not process K1 visas - it is currently TSC (Texas) and CSC (California).  If you are from Chicago, your petition will be forwarded to CSC.

Okay, here's what we have managed to collect throughout the day

  • letter from his employer (he forgot to mention he had that)
  • pay stubs for a year
  • W-2 and wage summery
  • 1040A Form
  • I-134 form completed

 

I have mentioned to him that he should log on to the IRS website to get copies of previous years tax transcripts.  Waiting on him to do that.   So it seems the only thing that is missing is an actual letter from the bank.

 

Has anyone from Canada been asked to show account info?  Could he access his account online and print off a yearly summery?

 

I appreciate everyone's help with this.   This whole paperwork process has caused more arguments between us than anything else!  I guess if we can survive this process, we can get through anything together :)

 

I have read of other canucks being asked for liquid assets (bank statements) if yearly income is close to 125% of poverty level.  Doesn't hurt to include as much as you can ... better safe than sorry!

Let's not give "false" hope that by not providing 1040 will get you by. Apparently, you did provide it...that it wasn't asked for doesn't mean that it does not need to provided. The instructions are explicit...1040 with W2 AND pay stubs. So, let's not set these people up for failure. To say that it depends on the consulate is absolute rubbish! I'd like to hear what others immigrating from Canada have to say about this. I'm sure that your particular situation with the CO that interviewed the beneficiary had enough info not to ask. Failing to provide the info is a guaranteed 221(g)!

They WILL ask and demand it...and give her a 221(g) form to provide additional required paperwork!" which is false information because it really depends on the consulate.  They might and they potentially will ask for it, but not necessarily.  In fact, my interview instruction letter given by my consulate did not ask for any W2s or tax information unless the petitioner was self employed so ...

 

Your instructions may have been explicit and stated in such a manner, but be cautious in the wording you choose as directions tend to be different from consulate to consulate, country to country.  In fact, some places have even been know to let the beneficiary provide self-supporting evidence.

You didn't include the W2's? Did you not read the instructions??? You're likely to get an RFE. Be sure to send your fiance the W2's for when she goes to the interview. They WILL ask and demand it...and give her a 221(g) form to provide additional required paperwork! 

 

A letter from the bank stating that you have an account, how much is on deposit and that you're a member in good standing is fine. I did not send in bank statements and it worked out fine. But, we're K3/Married. 

 

You should know if you are 125% over the poverty level...simple math. Putting your mother in there is not likely to help. Co-sponsors for K1's are generally not accepted. Either you  have the income or you don't. "Technically" doesn't cut it if you don't qualify. Just sayin'! 

 

Pay very close attention to the instructions!!!! As another member here says: This Will Not Be EASY!!!

I was also told 5-7 business days and it ended up taking closer to 10- for me it was because of the big computer systems crash ... not sure if that is still affecting the issuance of visas (was in July).  I emailed the consulate and asked about it and they responded fairly quick, but every consulate beats to their own drum.
