I am in the beginning stages of applying for a K1 visa for my fiance. I have plane tickets, passports with stamps in and out of the country, pictures of her and I, but the problem is that we mainly use skype as a way of communication.

 

Relationship evidence is only needed for the interview except some folks and for some countries, including some with the 129f filing is desired.

 

 

How can I prove our relationship without any chat, emails, letters, cell phone bills, if we don't use any of it to communicate?

 

You can't....so start purposefully generating these evidences...plus more.

No doubt this question has been asked and answered a gazillion times, but I just can't find the answer. 

 

Once a Canadian citizen receives the K1 visa, I understand the couple has 90 days to wed. 

No, they must marry within 90 days after entry into the US.  The visa is valid for 6 months after the medical date and must be used to enter the US before expiration.

 

Must they do so in the US,

Yes

 

or can they marry in Canada and cross the border to honeymoon and subsequently reside?

 

No, they they'd be married and the K-1 is for un-married couples.  The beneficiary would be turned back, of this would be caught at AOS time and then they would have committed visa fraud.

I-129F Questions:

- 14a. I have no knowledge of my ex-wifes A-number (we no longer communicate, also I doubt if she knows it as she was only in the U.S about 4 months)

- On Part 2. Information About Your  Fiancee

     4. On her birth certificate only states the village (Kok Dzhar), which is in the city(Bishkek).  For that question would I just put

         Bishkek / Kok Dzhar?

 

That works....they deal with this all the time and will figure it out.

 

     7. On her birth certificate for "country of birth" it says Kirgiz SSR but now the country is known as Kyrgyzstan. Should I put both or

         the name of the country at the time she was born?

Yes the name of the country when she was born.....which may be different than the name of the country where she now lives.  My wife was born in USSR but when we filed she was living in Russian Federation.

 

 

     8. Question 7 pretty much relates to question 8  "Country of Citizenship".  I'm assuming I would put the current name of the country

         (Kyrgyzstan). Probably an obvious answer but I figured it couldn't hurt to ask. 

 

From above.

 

     32a-f.  It asks for fiancée's address abroad in Native Alphabet.  My fiancée does have an alphabet other than Roman Letters

                however she is working and residing in the United Arab Emirates, can that be left blank? (I'm assuming an address cant be

                translated).

I have searched a lot for this and I can't seem to find a direct answer. Is it okay to purchase a Round Trip ticket instead of a one way ticket? I have noticed when researching it is so much more cheaper to do Round Trip, but am concerned this might raise questions at POE. Will this cause problems for my fiance if I buy a round trip for her? Any official links that you know of? Any help would be wonderful.

After much research on the forums here, it seemed understood that it was appropriate to fill in ALL fields in the I129F with either "NA" or "NONE".

After reading the I129F instructions on my I129F form, it clearly states  " Answer all questions fully and accurately. If an item is not applicable or the answer is "none," leave the space blank".

This is conflicting information. I have all about ready to send out my packect including putting NA and None in all the vacant fields on the form. Do I need to start over? 

 

You may have just given yourself the middle name of N/A is you wrote that in that box!!!

USCs can visit any country that they can get a visa to or any that doesn't require them to have a visa, like the UK.
He may be able to visit you but he needs to be truthful in his visit visa comments.

Hi Guys,

 

Just joined and looking at where to start this whole process. I am a Brit living in the UK. My girlfriend (and soon to be fiancee :joy:) is an American and currently back over there but will come back with me after I visit next week. She will then stay in the UK till January - when she will return without me - with the intention of getting married this February, for which I will come over for a few weeks beforehand and then remain there.

 

My current plan is that she will submit the I-129F application ASAP and we will wait for that to return before filling in the K1 application from the UK. My worry is the time scale - is it too short a time for this whole process?

Yes, plan for 10 months total and then be surprised if it comes quicker.

 

My estimates put it at 5 months between initial application and my arrival in the country for the wedding.

Am I able to enter the country before the K1 is returned or even if I am still waiting for the I-129F to return at that point?

Would really appreciate advice, this whole process is pretty intimidating. Takes some romance out of it all, but she's worth it and I'll fight for it  :content:

I am scheduled for the K-1 interview this coming October. Although we have completed our documents and ready for the interview, I can't help but get nervous. I have read some sites about the reasons of being denied of the visa. One of which was:

7. Couple hasn?t spent enough time together in person 

 

We only spent 10 days together and were approved.......and.....had only known each other for 3 months prior.

 

 

Though me and my fiance are engaged for 6 months and only met once, I am not sure if we will fall under this item. We had been talking everyday, and even if I am at work, I still spend time talking to him. Would that be sufficient? We have only spent a week together here in the Philippines. Are there any people out there who has the same experience? :) or maybe I am just too pessimistic and too nervous. Thanks and hoping for your replies.

 

 

 

It always depends on the quality of the relationship and the content of the evidence being able to show the same.

Since we would be petitioning for AOS immediately after I get to the States, the I-864 form would be within 6 months of the I-134 form. Can we use the same supporting documents (tax return, bank documents etc) for I-864 as we did for I-134? Thanks a lot for your input!

Email the Embassy and inquire.  I'm sure you can delay the interview to a later date, many folks do that.

Yes. You can keep whatever property you wish. There is no requirement that you have to sell or give up property in your country in order to live here.

 

Just be aware that if you receive any rental income or have other foreign assets, income, or accounts you may be required to report them to the IRS when you file your taxes.

would like to ask.. how are you guys putting everything together ? do you use the loose leaf fastners ? like where you punch 2 holes on the top of every paper and then you use this metal fastner ?

 

or do just use paper clips ? to clip up each section ? or  do you guys just get a file folder and put everything in there in order with a cover letter on top ?

 

just curious how everyone is packing up the packet ? I know I read somewhere.. you cant or should not use staples...

ok i am/was just worried that if i pay a lawyer to draft it up and get it all done and were not as lucky on the timeframe to obtain approval that they may say its not up to date.

 

It's usually suggested to obtain this approval......before you file any visa petition....since it is a total deal breaker and for some, or some countries or situations, can take a long time or could involve some persuasion to be negotiated.

After reading a thread here, I realized that I may have made a mistake in my I129F, specifically, the translations I supplied for my fiance's documents were the photocopies, not the originals I got from her.

 

What I read was that translations should always be the original.

 

I suspect this would cause an RFE, so is there anyway I could contact USCIS and send the originals while the file is waiting to be adjudicated?

You already have NOA-1, as you said. You and your fiance just wait USCIS adjudicating your I-129F. If they think you are not meet the requirement, they will send you letter intent of deny. If you can passed it and got approved, the next big thing you have to get through is the US embassy in Pakistan. They are well known on VJ is one of toughest US embassies. You HAVE to well prepared. 

 

Of course you can still have a chance apply for B-2 visa while you are waiting for I-129F approval. Someone here got approved for B-2 visa while her K-1 visa was still pending. You are just need to show your NOA-1 during the interview, the reason why your fiance can't travel to your country, and a proof that you will coming back after visiting your fiance in the US. There is always a possibility for everything. You'll never knew how it worked until you tried even though you have to spend a lot money to get the experience. Good luck!

 

OK, so the OP is the beneficiary and it is the petitioner that can not travel.   That was not stated in the original post, and I for one was confused.

 

Yes, you as the beneficiary NEED to exhaust all possible avenues you can to travel to meet him.  Even if you get denied, you will be showing that you, on your end, tried everything legal to meet in person.  The letter from his doctor, and maybe a letter from a second opinion doctor, will help state his case.

 

No guarantees because, especially since you are a doctor, one could construe that he is trying to buy a live-in nanny/doctor.

 

Maybe you already stated, how do you regularly communicate?

We were too young to accept the relationship we never talked till 2010 and now we talk 24/7 and are in Love, unfortunately I could never meet my fiance because of his medical issues he cannot travel at all as he is suffering from Chronic Renal Failure and needs everyday 12 hours dialysis.

If you didn't list specific dates, that could be a concern because that meeting must have occurred within two years of the filing date.

Wrong.....only the place and date where you met in person....not your relationship.

 

 

Since it didn't specifically say describe all the circumstances that you have met in the past two years I didn't put this down.

If you met in person more than once is of no concern, they only want to know about one meeting.  You don't get extra credit for additional meetings in person.

 

I was living over there when I met him and then went back two more times. I'm just freaking out now because I feel like I didn't answer that question well after reading what many other users wrote and now I'm scared they are going to make me do it again. Can someone direct me to the right track to eliminate this doubt? Thank you advanced!

Sure, but then she'll go back for the medical and interview.

 

We would be ready to go for the K-1, but don't feel like waiting 5 months for an answer.

Not an option if you are trying to circumvent a visa to allow permanent residence....it's called visa fraud.
