Hello,

 

Sadly my relationship has ended as i decided i didn't want to move to the USA and leave everything behind.

It hasn't ended well, we are not on speaking terms.

I am wondering how i can (the beneficiary) cancel the I-129F, we have not been approved yet?

There's nothing you can do except not go to the interview, etc.

I don't believe that most CO`s have the time, interest.or inclination to read thru page after page of Skype, emails, texts etc....good luck to all where ever you are in your journey!

 

Correct....and most relationships go through a normal evolution....the content of your evidence should also track this same evolution...what you talk about in the beginning and toward the petition filing should be quite different.

 

So send in specific evidence that supports each phase of your evolving relationship.

How can anyone prove to a total stranger of a legitimate relationship unless you show content of what you talk about?

Just showing a call log doesn't tell anyone what you talked about.

Got some great news yesterday--the visa interview is scheduled for October 21st. Woo hoo! However, that is way earlier than I had figured, and my fiance was planning on coming to the US to visit me in November. If the visa has already been issued, can he still come just to visit?

No the K-1 would be used first.....so no visiting, just immigration to permanently reside in the US>

 

 

I know he has 6 months to use the visa, but since it's supposedly printed in his passport, it could raise some questions. He wasn't planning on moving over permanently until January. 

Then he waits until that time to come over.

 

Any help would be much appreciated! Thanks all!

I've been following the processing time charts on VJ waiting for our NOA1 day to show up as the 'applications from this date are being processed' - is that the date you would expect an NOA2 to start showing up, or is it when they start looking at your file?

 

When they start looking at your file.  Read the Sticky Notes, you'll discover, on average, it only takes 15 minutes to adjucate a petition......so after waiting many months, it only takes 15 minutes......think about that and the backlog that must exist.

 

Does anyone have an idea of the over/under between the date on the chart and an NOA2?

 

Some petitions, especially those qualifying for an expedite take 2 months, some take 10 months, the average is 5.

Ive searched and searched and ended up totally confused.  I guess this has been answered before, please forgive me

 

When my fiancee and I apply for the K-1 visa I understand that process and I have to be there and married within the 90 period, my confusion arrives with AOS.  

 

After marriage, I have to stay in the USA and apply for AOS, I cannot leave in that period until AOS only with a AP, whats the timescale for that please ?  

You can leave at any time, you need either the AP or the GC to be able to return to the US.  The AP is about 2-3 months after filing the AOS.

 

Also when I receive a Social Security number - does that then allow me to work in the USA ?

No, you need with the EAD or the GC to legally work; your SS card will have a statement on it something like Work with DHS Authorization.  Once you get the GC, you can have a new card issued without that statement.  The EAD is the same timeframe as the AP.

 

What I am asking, I guess is when can I legally work, whats the timescale please  ?

2-3 months after filing AOS.

The confusing part is The IRS-issued proof of payment. What does this mean?

 

IRS Tax Transcripts.....free from the IRS.....Do a Google search.

 


 The issue is I no longer have any of my tax returns or W-2's on hand.

 

You can ask for transcripts from any prior year.

I heard that some people pay for its expediting but I failed, nobody wants to expedite in a town where i live.

 

 

Then you can email contact the Embassy and reschedule the interview.  The police certificate requirement should have been known for a long time and is valid for a year.

What do you mean extension?  Emailing the Embassy can yield a change in the interview or an extension to the 6 month use of the K-1 once issued.

khurram01...unfortunately, it would have been better if you applied for your S.S.# before marriage. Your next steps in the process are to file the I-485 adjustment of status form with all the required documents along with it...also,along with the I-485 you should also file the I-131 advance parole and the I-765 work authorization, this will give you a card in 60-90 days that will allow you to work and travel while you wait for the AOS approval,the I-131 and the I-765 are free when filed together with the I-485, unfortunately, the cost for the I-485 is $1070.00. read the guides here, they will take you thru the process step by step....good luck

It took us about 30 days to receive the letter from the NVC after receiving the NOA-2. (California Service Center), Texas Service Center is said to be sometimes slower but you are within the normal timeline....good luck....stevie and songsang

it DOES disqualify them if there is a previous I-129-F petition that was not canceled by that first petitioner. I am well aware of who files an I-129-F, I only meant to state that she cannot be petitioned again without the first petition being canceled.

I believe that if the petitioner does not cancel the petition than you, the beneficiary, will not be able to apply for a I-129-F at a later date if you so choose.

The subject of required/recommended/needed  evidence submitted seems to come up a lot here at VJ. Researching your home countries U.S. embassy requirements (what previous filers submitted) is probably the best way of getting a feel of what to send. The only evidence we submitted with the I-129-F to U.S.C.I.S. was copies of my 5 entry and exit stamps to Thailand in the previous 2 yrs. before filing and 12 photos of us and her family together. For the interview, I brought text and phone records for the previous 4 months, the embassy would not take them but they did accept a  photo album that Songsang brought and the CO went thru all of them and asked questions about them. The interview I would equate with a high school exam, if you read the book...(if you know the information on the submitted forms)...then you will "pass" the exam. While any supporting evidence can be faked,(hence scammers), I believe no evidence can point more to a bonafide relationship then pictures with family. Once again, I understand that different embassies may require different things but I think that sometimes people overthink the "frontloading" aspects of a petition, I don't believe that most CO`s have the time, interest.or inclination to read thru page after page of Skype, emails, texts etc....good luck to all where ever you are in your journey!

Hello Most Excellent TBoneTX!  I really appreciate your organization skills and keeping these forums ship shape, but I was kinda hoping to direct my question to all interviewees as a whole?  As far as I can tell, things are pretty similar between what Cambodian applicants have to submit and what everyone else submits. I was more interested in how people in general are organizing their final interview documents.  Everyone has to submit proof of their relationship right? I was most nervous about where to put this in relation to everything else. But Mon is probs right. I'll bet they rearrange everything we've spent 8 months preparing anyway. :)

Hi all!!

 

My fiance and I have our interview at the U.S. Embassy in Phnom Penh next Monday!!!! We couldn't have done it without our VJ community!!

 

However, we have one final question. 

 

For our interview we are bringing the following:

 

1. Everything required under the Packet 3 checklist

 

2. Perfect replica of everything submitted for our I-129F, including evidence of our relationship.  

 

3.  A perfect replica of everything submitted for the I-134, including supporting documents

 

4. Updated evidence of our ongoing relationship (facebook, phone records and so on)

 

All total, this adds up to be almost 7 lbs of paperwork, over 3 inches thick.  

 

I was wondering if anyone has advice about how I should organize it?

 

I have everything listed in a cover letter at the moment, with the following order:

 

1. Packet 3 stuff (medical, police records, receipt from paying the interview fee)

 

2.  I-134 replica with supporting documents

 

4. Brief timeline of our progress and relationship

 

5.  Perfect replica of our initial I-129F submission, which includes evidence of our relationship, our scanned passport pages,  pictures together, plane ticket, itinerary, bank account statements showing purchases made in Cambodia,  a large number of letters of support and so on

 

6. Letters of support and blessing from both our parents

 

7.  Evidence of our ongoing relationship

 

My question is, should I organize things by how they appear on the Packet 3 checklist, meaning I would pull out all our relationship evidence from the perfect I-129F replica to put on top with his medical, police records and so on?  

 

Or should I leave things how I have them? Goodness, we are so nervous,and so excited. Any advice helps. Thank you all!

We are using a lawyer for our K1 visa application (please no judgement, we started the process and paid the lawyer before we found VJ! Invaluable after-the-fact advice found here).

 

Here is an excerpt from my communication with her that I wanted to check the accuracy of:

 

It can be about 2-4 weeks for it to end up at the consulate after approval.  What governs, is not time after the medical exam, but the length of time they issue the visa for.  Sometimes they do 6 months, but sometimes they do 4. 

 

It was my understanding that it is standard to have 6 months to enter the US from our medical exam date?!? Is she on crack or is this a possibility?

 

It wouldn't normally matter, we have been long distance for a couple of years already (what's another few months!) but my USC fiancé is currently serving overseas and not due to return until next year. We are trying to time it with his return and looking at the earliest possible date to send the application. We don't want to have it expire before he gets back obviously! 

 

Any thoughts on the matter?

It is the medical exam - my K1 expires on Jan 8th, even though it wasn't issued until the 22th of July (computer issues @ Vancouver consulate).  My interview was on July 10th and the medical was on July 8th.

"Packet 4" isn't really anything besides the consulate providing the link to book the interview and approved doctors for the medical.   I think the medicals out east take a lot more time to put the package together so make sure you look into booking the medical asap.

I need to try and understand all the different dates with the I-129/ K-1 visa:

Lets see if I get these dates right:

  • I-129F is good for 4 months once approved and can be extended by the embassy (up to a year)

This expiration date is nothing to worry about.  As others have stated, it's "automatically" extended (actually I don't think anyone does anything about it) and as long as USCIS or NVC or the Embassy has your case, it's open.

  • K-1 visa is good 6 months from the medical exam, plus you pass the interview (no extensions)

Yes, good to use to come to the US.  There have been cases where the Embassy has granted an extension.

  • Once you step foot in the US you have 90 days to get married (no extensions)

Yep, exactly 90 days.

 

I keep see this:"It is important to file for the AOS before the K1 expire date, otherwise you will be out-of-status". So may questions is, what is the expire date?

 

There is none.  You can AOS whenever you want....or never.  Until you do though, you are out of status or actually have no status.  You can not legally work and if you leave the US you won't be allowed back in without another visa.

 

If you wait 5 months and 20 days to set foot in the US you have 10 days before the K-1 expire date and you are out of status?

 

No, once you POE, you have 90 days to marry.

Draft a detailed letter titled Evolution of Our Relationship.  It should detail the development of your relationship and how it went though the "normal' steps that all relationships go through.  Reference different forms of evidence that will describe each step....cards are nice but emails showing real dialogue (what you talked about in detail, not just a log) are best.

 

If you don't have this, then you may have to withdraw the petition and generate more evidence and file all over again.

No

 

Would it be better for us to wait to submit after I go over there in December or can we just go ahead and submit it now without expecting any issues because of the length of time we've been together?
