Hello everyone!

 

I have a question regarding i134 affidavit of support.

 

if my fiancee's (US citizen/petitioner) income is not enough to support me, can she seek help from her real sister to co sponsor me ? IF so, should they both sign i134 ?

 

The petitioner and the cosponsor will both complete a 134 form.

 

Some countries do not accept co sponsor for K1 visa, while US laws do not disallow this. Can this be done if the co sponsor is a very close relative and lives in the same house as the petitioner?

 

Doesn't matter as far as relationship.  Some countires just don't allow cosponsors.

 

I shall be very happy to hear your views.

1. I cannot fit my fiance's Peruvian address in the fields they have provided.

  Yes  - to attach it on a separate sheet of paper (signed and dated?) and say "see attached" in the field.

 

 

- But I also read not to staple anything because it will get arranged as they please, so should I include it in the table of contents that that paper is inserted in the application?

 

Correct, no staplte.  Paper clips and binder clips only.

 

2. On that note, I read I should keep the story of how we met short enough to fit in the field they provided instead of attached a sheet of our story?

 

No it's a statement on when and where you met, just once, in the last two years.  Not about your relationship.

 

3. Birth certificates. For some reason I can't determine the certificate number for this. I know everyone's birth certificate's are different. I found "Birth Number" on mine. Would that be it?

Yes.......and yes the evidence of proof of meeting in persion also is proof of the relationship.

 

6. Translation - If I include our conversations (face time screen shots with date stamps, e-mails, scanned christmas card, etc.) should I get them translated? Would it hurt if I did? If anything is translated, must the person who translated be certified and sign something?

 

Yes anything not in English must be translated unless your Embasy specifically states otherwise.  You yourself can translate them, yiou just need to include and sign a statement.

 

7. Proof of relationship in general

- I've been reading about front loading vs. the minimal items needed for the application. I really want to front load and be as detailed as possible. Is this a bad idea? I even have a screen shot of the conversation of when my fiance sent a picture of the ring he bought for me to my best friend for her to see. Another idea was including my parent's itinary flight to Peru back in March when they met him for the first time (I have pictures of that too). I thought of this because I sent gifts with them and they brought back gifts from him. I read that gift receipts are good to scan, and even thought there was no paper receipt to prove this exchange, my parents are the proof.

 

OUr proof of our meeting in person was also used as part of our proof of a relationship.

 

This last part has got me so nervous! I don't want to give too little proof but I don't want to give too much if they frown upon that. I'm reading some people have had great experiences with giving just enough, but others say the more the better...

Another question that may be odd:

 

My fiance tried getting a tourist visa twice, once in January then once in February of this year and got denied because of the lack of evidence that he would return to Peru. I'm not sure if that will hinder us, but it is obvious that the USCIS will see that correct? The reason he tried for it was to visit me and get to know me. That is why I then decided I should go to him and when he proposed. So it plays apart in our relationship but I'm not sure if it would be wise to include his rejections in the proof packet as a sign that he attempted to see me? Plus they are going to see that in his records anyways.

It does look bad.........you could be seen as attempting to "buy" a fiance.

I currently live in the UK and my fiance is in the US. She has been legally separated from her ex for 8 years but has only just got divorced a few days ago. We have been together now for 2 years and we are very much in love.

Will the fact that she has only just got a divorce, and we are applying for a K-1 Visa a few days later affect the decision being made about us? Even though she has been legally separated for 8 years!!!!

So some visa pages I read say you need some vaccinations for the K-1 visa, but then I read this from the London Embassy home page, and note what it says about K visa applicants:

 

 

"Immigrant Visa applicants, regardless of age, require a medical examination and certain vaccinations prior to the issuance of an immigrant visa.  The medical examination consists of a chest X-ray and blood test, which includes testing for venereal disease. The blood test and X-ray are generally not required of persons under the age of 15 on the date of the appointment.  On the day of the medical examination, the physician will be required to verify that the immigrant visa applicant has met the vaccination requirement, or that it is medically inappropriate for the applicant to receive them.  Note: K visa applicants will not be required to meet the vaccination requirements at the time of the visa interview. They will, however, be required to meet the requirements at the time they apply for an adjustment of status with the U.S. Citizenship and Immigration Services."

 

 

Thus, my query to the experts here is do you need the vaccinations for a K-1 visa and entry in U.S. at a POE, or not?  Thanks!

We have been in a committed relationship for the past 7 years and spent a great deal of time together during this. I have much more ducumentation available for the past 7 years than I do for the past 6 months (we were together in Thailand during the past 6-9 months). Would it be helpful to show proof of our long term relationship preceding the most recent visit within the past 2 years?

Are you a US Citizen? Did you meet her in person within two years of filing? You don't have to prove you were dating to meet the 2 year requirement. Having dinner at her family's home with some photos showing the two of you together would suffice. It is a Muslim custom to not "date" but is also required that you see your prosective spouse prior to marriage. A chaparoned meeting is most certainly permitted. Even a meeting with the Imam to discuss the prospective marriage would suffice, all you need is proof. Photos, plane tickets, etc.
The problem is not with the system, not to say it is perfect or fast, the problem is with not following the rules which are there for a reason. I don't agree with all the rules and laws but if you want the visa for your fiance you will do as the government says and shouldn't be surprised when you are denied because you didn't meet the basic requirements.


I don't understand why this is so hard?
You've received many suggestions.
Cancel the filing, go meet in person and document that very well and then apply again.

After you recieve your NOA2, you wait about three weeks and then contract NVC for your case number.  Then you wait about another month or so and contact the Embassy or use the online service some Embassy's offer and schedule your interview.

 

In the past NVC send you a letter with your case number but maybe they don't anymore.

 

The affidavit of support and it's documentation (and your new signed letter of intent) are sent to the beneficiary to take with to the interview.

Hello!

 

I was trying to gather information for "proof of ongoing relationship." After reading this forum I see that a lot of people print out things from skype, fb, and viber for proof of ongoing relationship. However it seems like too much to me! Me and my fiance talk everyday, all the time! And not just on skype. We go back and forth from viber, fb, and skype! Also, I use my ipod touch to skype with him, and the screen is too tiny for screen shots and it takes WAY WAY longer to scroll up to previous conversations then on the computer....my mom and his family sees us skype everyday. I don't know if a personal statement from them would help?!?!

 

Any advice on how to provide "easier" and/or a less condenced form of "proof of ongoing relationship"??

 

Also,

I am going to visit him for a month in September and will be providing a copy of my flight itinerary, is this proof as well?

PUrposefully generate all kinds of evidence.  A flight itenerary is not proof of a relationship, just proof of a potential booking (boarding pass copy is proof you were on the plane).

We got our NOA2 on June 28th and now waiting for our case to go to NVC with many others. In preparation for the interview for my fiancee, I was trying to put some documents together and had some questions.

 

1. Our case hasn't even reached NVC yet and we don't have a case number and are not sure when will the Consulate receieve it. Would it be too early to send the I-134 and supporting documents to my fiancee? Should I send them once we receiev the case number from NVC?

2. Is case number from NVC is required to schedule medical or to get Police certificates in Sydney?

 

Can't answer the first part and no to the police certs.

 

3. How long back the medical and police certifications can be considered valid?

 

Valid for one year.

I would like to add that one real good way to organize all that you will need to bring to the interview is to keep it in a tabbed binder that is no bigger than 1-1/2 inches thick (so it can easily slide under the window opening) and have a table of contents in the front page, breaking it down into major sections - official documentation, evidence of support, and evidence of bonafide relationship.

They will be impressed with that. See my example in my link below.

Anything too big to fit in there of course can be brought in a separate package, referenced in the binder.

They are asking you for the following 3 things:
1) intent to marry statements from both the petitioner and beneficiary
2) a statement of how you met (online, through friends, chance encounter while vacationing, however you came to know each other)
3) proof of meeting with the 2 years prior to filing (boarding passes, passport stamps, etc)

Hey guys! First off, I love this site it has helped me tremendously! Okay...to the business...

 

I'm a May filer for our K-1. After the wait is over and all is said and done and he get's here we want to just go to the court to get married to get the other paperwork rolling. But my question is once he is here and we get married can we fly back to Jamaica to have the actual ceremony? I want to have the ceremony there so his family can attend. It's easier for my family to just get a passport...get my point? Or does he have to wait to go back to Jamaica until his "citizenship papers" (Don't know the correct wording) is done? I want to at least start my planning if we can do it there.

He can leave the US whenever he wants.....but if he wants to get back in, he must get married and then file for his AP along with the AOS.  Once he has either the AP or GC, then he can return when he's left the US.  AP takes about 3 months after the AOs filing which is after you get married.  That's your time frame for the fly back to Jamaica plan.

Question 1:

From checklist, i can't send the package in until these documents are complete.  My fiance needs to certify with a letter of intent to marry in 90 days after arriving in the US and fill out the G-325A form. My fiance speaks very little english so she would have hard time filingl them out.  These two documents, do I need to mail it to my fiance and have these documents fill out and send back to me?  I assume "yes", but just to be sure I rather ask.

 

Yes.  You can complete the forms and mail them for signature and return or email them, have them print them out and send back with original sigs.

 

If yes, can I fill out most of the information and have her sign/date send these back to me?  Yes

 

Question 2:

I read in other threads concerning US customs, to be honest, this part make me nervous.  Say, if she arrives at customs, would she need to do or say (she knows little english)?  She will have the documents from the US consulate if she passed the interviews, is that enough?  I plan to go get her after she pass the US consulate interview.  

 

You'll be with her so no need for fear (you can be with her in the line).

Her middle name was misspelled they stated it was a nonissue and it was. The K-1 visa is cancelled out and replaced with a I-94 at POE and nine if this info is used moving forward with your USCIS journey.

About the form G  325. I know that we need to fill them out. Both of us.

It says A.

I researched and some of them says put NONE. Some of them has answer(9 digits)
On our RFE letter we have

A 201..... something in 9 digits
EAC139..... something.

What does it mean? Did they gave us File Number before NOA2?
Because I read that you only get the Alien Registration Number when you get NOA2
Should I put the nine digit on the RFE starting with A on the File Number field?

Hi there,

Im currently in a limbo between USCIS and NVC, USCIS computer monkeys reading their scripts saying they have accepted my application and sent it to NVC & NVC folks stating they have yet to receive the application.  Its been more than 8 week now and I have contacted my elected officials, anyways .. to my question...

 

I see my approval will be expiring in mid August and after doing some calculations and checking the average time the Islamabad embassy is scheduling interviews (obviously depending on my file actually being found), it looks as though the I129F will pass its expiration date prior to my fiance getting her interview.  I wanted to see if this is an issue I need to be aware of? Im certainly going to bring this to my elected official so they bring this up when the file is passed to the embassy, but is there something I should do.  The last thing I wanna do is try to resolve another issue though USCIS "customer support".

 

Has anyone experienced this before?

 

The expiration date on the 797 Notice form is meaningless for the K-1 process.  The form is used for other visa types where that info is more relevent.  Don't worry about it.

Ask around the neighborhood or at your local church.

 

Their decision is for your best interest as those income levels, which are quite low, are designed to ensure that there is some minimum with which to work with to get the new immigrants to be settled into the US.  If you can't find enough, then you have to withdraw and wait until you make enough and file again.  It's all for the best and this requirement was known before you began.
