Yes you can apply for K1 while in US. He would not have a problem entering the US as long as he can prove he has strong ties to home.

The other option you might want to think about is get married while in US and file for CR1 instead of K1, it is much easier for person to adjust to US when entering on CR1 over K1.

 

Thanks for the tip. I wasn't wanting to consider the CR1 because of the longer wait time, from what I have read, in the total scheme of things CR1 vs K1, the K1 is 3-5 months faster at getting the foreign fiancee AOS and Employment Authorization. Correct me if I am wrong?

We actually will not start the application for K-1 until she arrives in the USA, that is why I am worried what she should tell the officer at POE, should she just say she is coming to visit her fiance and while she is here we will apply for the k-1? Would that not raise a red flag and have them think we will misuse the tourist visa? I am trying to find a way of not having her get denied 6 months and even worse, not have issues at the POE. She is thinking of just saying she will be here traveling and visiting friends she has visited before, but that seems like a 90 day type of trip...if she mentions all the details and mentions me, it would make it a better possibility for her to get the 6 months, but at the same time, depending on the officer, they may complicate things for her...this is very worrying...I dont know how to go about it...last time she visited she did a medical observership for 4 months (no patient contact)...she might say she will do that again (because she probably will again)....to get the 6 months limit....

Yes, you can apply for a K1 while your boyfriend (the non USC) is in the US. That is how we did it. The thing is that he will need to return to Paraguay before the visa is issued because what happens after the NOA2 has to be done in his country.
About entering the US on a B2 (tourist visa) and what to tell the officer at the POE, my advice is just to be honest. I had been to the US several times before that one that I was going there to get everything ready for the K1, and of course he started asking questions such as "why do you keep coming to the US so often?". The moment I told him that this time I was going there to file for the K1 together, everything changed. He was very nice, asked me about how we met since I am from Argentina (explained that my boyfriend live down here for almost 3 years, blah, blah), he gave me six months on my I-94 and wish us a happy life.
That's my experience, but I'm pretty sure yours will be very similar. Good luck! :thumbs:

 

 

Hi, I am planning on applying for the K-1 while my girlfriend is in the USA on a tourist visa, I understand it takes several months for the NOA2 to come out and while we wait for that time we want to be together. I am worried about how much time she will be given on her tourist visa (3 mo, 6 mo?), I would like for her to stay with me for 4-5 months while we wait for the NOA2 to come out. Did you plan on only staying 3 months and they ended up giving your 6 months? She will be taking a break from work to come and be with me and I don't know how the best way of getting the 6 months allowance...

 

Did you show a return ticket for more than 3 months after your arrival, why do you think you got 6 months?

CENAMOR is just for single people who never been married before , so you won't need to get that . What you need to present to them is your marriage termination papers (divorce decree nissi) where is your recent residence country? your petitioner (US citizen) will apply the visa for you  in USA not you who will apply. then once the petition approved they will send to the US consulate of country you are residing in.

My divorce papers here in Hong kong which is also translated in English is the one we used filing our K1 visa, You don't have to get a cenamor in NSO from the philippines since you were married before already.

Hi, my partner and I have sent in the paperwork for myself (English) to marry my partner in the states. He has since come to visit me for a few months and I have just found out I am a few weeks pregnant. Out paperwork is still in the states and is chugging along and so far no hiccups.

My question is what do I do now? Do I need to inform someone? I read all kinds of from him needing to write a letter to say he still wants to marry me - if so who do we send the letter to? The immigration services in the states or here in the UK to needing DNA testing.

I have read that being pregnant makes no difference and that it depends on when and where the kid is born. What I cannot seem to find is an official link to what to do now.

If any one has had this problem or can point me in the right direction I would be most obliged.

Yup. Like Badgerella and Kim, I'm another AP@NVC (still there....day 47). I also have never been given a reason for the extra attention lavished on our case. I did some stats a few weeks ago - they're posted on the NVC thread if you're interested. Anyway, upshot is that NVC does not appear to be picking on particular countries to hold back files for AP. The distribution of AP cases by country is roughly what you'd expect for the total distribution of VJ cases at large. Of course the sample space I used is only VJ K1/K3 cases where members filled in their timelines with NVC Received/NVC Left data. So that is not necessarily scientifically accurate. BTW - the AP distribution by CSC/VSC also mirrors the general population (about 60/40 split).

All this to say- NVC doesn't seem to predispose certain countries - High risk, MENA, etc. - for AP that a naive guess might think it would. You're as likely to get AP at NVC from Canada as from Cameroon.

However, AP @ consulate almost certainly does single out the high-risk and Mideast countries that common knowledge (and frankly, common sense) tell us fall under extra scrutiny.

No, Q18 wants you to describe your meeting in person (within the past two years).......NOT about your relationship (that's for the interview).

 

Again, your meeting in person proof is what you want.  For Q 18, just list the dates and place where you met and then include evidence of that meeting.


   HELP US PLEASE !!!!!!!!   I met my Filipino fiance on a website on March 1, 2011.  I flew to the Philippines and entered the country on January 2, 2012 and stayed with Caren for 4 months.  I then returned to the USA on April 25, 2012 and hired an immigration attorney to help with all the papers needed.  A relationship letter was called an intent to marry letter.  Both of us had out letters signed and dated on the same day and submitted to the USCIS.  Passport stamps, boarding passes, Photo's, even a few YM chats were included.

   I was assured by my attorney everything was fine.  So I returned to the Philippines on November 6, 2012 to be with Caren as we waited for approval.  USCIS approved us March 6, 2013.  I had to return to the USA on May 8, because my mother was admitted to the hospital.  Caren's interview was a week later on May 15th.   SHE WAS TOLD SHE WAS APPROVED.  THE EMBASSY TOOK AND KEPT HER PASSPORT TO ATTACH THE VISA.   She was told 2-3 weeks till she actually had her visa in hand.

 

  3 weeks later and nothing.  We contacted the embassy via email and calls only to find out that our case was returned to the USCIS for disposition..     Some lame excuse about not enough proof of a relationship.   How can there be any question when I proved I was there 4 months, then returned for another 6 months.  I called the USCIS with her MNL #, name and birthday info, and they have no record yet that it has been returned!!!!!!!!   ####### is going on?   They asked what the letter of denial said?   WE NEVER GOT A LETTER OF DENIAL!!!!!!!!   USCIS said after they get the case back it still takes another 6 MONTHS FOR REVIEW !!!!!

 

Does anyone have a clue as to what has happened?  May as well go to Mexico and sneak accross the border than to be legal and pay the fees.  This is rediculous, and it is the government who is at fault.   WHAT DO I DO NOW?????   I AM FLYING BACK OVER THERE TO BE WITH HER,  WE ARE BOTH EXTREMLY UPSET.

Are you wanting to cancel the actual K-1 application or the I-129F petition? I am guessing you meant the I-129F petition since you said you just got an email approval. There is no K-1 application until the foreign fiance(e) applies at the consulate in their country after the I-129F has been approved.
 
You cannot cancel by phone or email. You must ask to cancel in writing. A letter to the USCIS service center that was processing your case would have worked, but with the approval, it will be sent to the NVC and onto the consulate from there. After it is at the consulate, send a withdrawal letter to the embassy in Australia. State that you wish to withdraw the I-129F petition and provide your case number.


Send notarized letters to both the Service Center and the Embassy. Easy peasy!

As I stated that expiration date is meaningless, in the K-1 visa process.....the I-797 Notice form is used for other purposes where those dates on it mean something.

 

Once NVC and the Embassy have the case, the date (there really isn't one ni the K-1 process) is automatically and transparantly extendec.

 

Do email the Embassy since they may be able to look backwards to help find the case.

Hi guys, 

 

I need some advice...because honestly, me and my fiancee have exhausted all (and I mean ALL) means of help, and here we are, a few weeks from the expiration date of our approved K-1 petition, with the actual physical file somewhere in this world; but not at NVC!

 

It was approved on March 13th, yet it was NEVER forwarded to the NVC!...three months later, and we've just recently learned that it's 'in transit' to the National Records Center to be archived sad.png It's expiring in a couple of weeks, and we're clueless as to what we can do now..

 

We contacted the congressman,

and went to infopass appointments,

we talked with tier two...

and NVC supervisors...

 

and now I pretty much lost all hope.

 

Any help guys, and I'd be forever grateful..

 

I really, REALLY don't want to start this process from scratch!...we filed last July, and to get to the point where we are now (approved but lost petition! sad.png ) has been torture.

I am almost ready to submit, just a few more questions.

 

Is it necessary to include a separate page for question 18 (on explaining how you met and how you've sustained a relationship).  I feel like I summed it up in the box, I am just wondering how important or how much more detail is required.  Has anyone had success without the additional page?

 

Also, in terms of proof.  I have about 4 or 5 flight itineraries and pictures from each trip.  Is anything else necessary?

Choose one meeting and describe that and included evidences of that meeting.  No need to mention any other meeting until the interivew.

 

It's really that simple.

 

You do not get extra credit for mentioning other meetings.  Just one.

I'm a Feb 2013 filer of K1. I have been reading the master RFE list and one thing I found out yesterday is that on the form I-129F on Part C, Question #3, everyone who has not checked any boxes seem to be getting an RFE for this.

 

Here's the question.

 

If you have provided information about a conviction for a crime listed above and you were being battered or subjected to extreme cruelty by your spouse, parent, or adult child at the time of your conviction, check all that apply to you

 

(1) I was acting in self-defense

(2) I violated a protection order issue for my own protection

(3) I committed, was arrested for, was convicted of, or plead guilty of committing a crime that did not result in serious bodily injury, and there was a connection between the crime committed and my having been battered or subjected to extreme cruelty

 

Since none of this applied to me, I didn't check any boxes. It does say check all the apply. How can they send an RFE for something like this? This will create unnecessary delay.

I didn't need to check any boxes and merely followed the Example Forms.

 

 

Now, that being said, USCIS has access to records about you that even you don't know about.  You would get an RFE if you didn't check anything but they found something in your past that made them suspect that you should have checked something.

Where do I even start. All of this makes my head spin.

 

Here are the basics:

 

I'm American. My boyfriend is British. For almost 2 years we lived in Grand Cayman together. I have recently returned to "set up shop" here in NY. I am hoping that once I begin working and settle in, and we save at least $5,000 dollars that we will apply for the fiancee visa. K-1? 

 

Lee is from the UK, and has been in Cayman for 15 years. He was previously married but his divorce went through over a year ago and we have the documentation. 

 

How many of you went through a lawyer? I feel like it may be our best bet because I just don't want to get denied. I couldn't handle it. Being apart is hard enough!

I am preparing to file an I-129F to bring my fiance? to America from Thailand. We have had major trouble (repeated failures) with trying to get him a tourist visa and seen a lot of warnings that everything must be executed perfectly when doing a K1, so I am thinking that I should hire a good immigration attorney to help us.

Has anyone here been successful with the K1 process without using an immigration attorney? If it?s advisable to go with an immigration attorney, can anyone here recommend a good one in the Olympia/Seattle/Tacoma WA area? Has anyone here used LIH Law? If so, would you recommend her for helping with a K1? Are there any other same sex couples trying do the K1 here?

 

We did it ourselves.  If you can read English and follow instructions (and the Guides) there is no reason not to do it yourself.  Attorneys, except in rare and complicated cases (complicated histories), are only good at taking your money. They do slow the process since you have to provide all the documents and then send them to them and wait for them to send them to USCIS.

does she NEED a letter of employment from me? does it HAVE TO BE an origial, or can i scan and email it to her for her to print? i find a disagreement with this because my W-2 and tax papers should provide sufficient evidence of my employment and assets. 

 

No, not NEEDED, but does help.  Scan and email like above.  Your annoyment is only due to the fact that you've waited this long to procure and produce these documents; now your scrambling.  This is only the beginning.  As soon as the interview is over, start researching AOS.

i don't know how many people that have completed their K-1 process will remain active, but those that do, or know for a fact, please chime in. please chime in. the information i am finding on this website, are inconsistent with what the embassy instructions state:

i understand different embassies have different processes, but moscow's embassy does not mention to bring the noa2. and it does say to bring a letter of employment, but i'm wondering if not taking it will become a problem.

I think it is too long. Keep it brief: after meeting Willa on FB in nov. 2011, I flew in to meet her and her family in Nov. December 2011 and April-May 2012.

 

Yep way too long.  The size of the box is the size of the answer they expect, about two sentences.

 

Only describe ONE meeting.  You don't get extra credit for extra meetings.
