Is this CORRECT!? I thought the G325A was only 1 page....that they only needed ONE COPY from the petitioner and beneficiary.

Yes. The I-134 was not created to use only for K-1 visas. Its purpose was really for those that would be temporarily in the US, like other non-immigrant visas, and not for those that would be staying, adjusting status and becoming permanent residents. The K-1 is special that way. The I-864 that is required when filing for AOS will become the legally binding affidavit of support. The I-134 is temporary and not legally binding.
 
Question 11 makes more sense for those being sponsored on a temporary basis. That is why N/A - "K-1 visa process for permanent residence" makes sense in the case of a K-1 applicant. If it makes you feel better, check 'Intend' and then put "K-1 visa process for permanent residence" on the line.
 





What answer would the CO SPONSOR put?

Cigarette smoking has nothing to do with medical,
be for real ..if Dr say have you ever taken drugs/smoked marijuana
the answer is NO (if he has not) I've never heard of them asking
about cigarettes if that was so more than half of applicants
that smoke cigarettes would be denied, so talking cigarettes
is like apples & oranges when it comes to this medical, so trying
to say cigarette smoking may lead to a denial don't ring true
unless one's been smoking marijuana & seeking to lie about it with
feedbacks from others to sanction lie-img








As far as I know they do ask at the medical whether or not he smokes cigarettes. He will tell them he does not, which wouldn't be a lie because he really DOESN'T.
If they ask him if he's EVER smoked CIGARETTES then yes, he will say that he had many years ago.
When he is asked about drug use, he wil be honest and state the truth: no drug use at all, ever.

You should never lie. Cigarettes are not illegal. He can say he used to smoke cigarettes but quit however many years ago, which is the truth. My husband smoked at the time he had his medical. Tobacco use is not a reason for a visa denial.

At the medical, in our case Ciudad Juarez Mexico, I'm sure they will ask my fiancé if he smokes (or has ever smoked) tobacco.
He has but not in a LONG time.
Would telling the dr. "yes" be grounds for them to deny or to assume that he smokes other things as well: marijuana?

Those of you whose fiancé/e have admitted to tobacco use, was it an issue?

(we were gonna have him say "no he's not smoked cigarettes but in our initial I-129F petition, I sent some Whatsapp chats where his avatar is him with an unlit cigarette in his mouth. I just realized this so now I'm telling him he SHOULD admit to cigarette use years ago but is no longer a cigarette smoker....any thoughts??)
P.S. Im kinda paranoid about very minute details in this whole process, hence the reason for this long winded post! :)

I didn't realize at the time I sent my I-129F package that I should have made a copy of the entire package :blush:

I'm not even sure they'll ask for them, but better safe than sorry.

I'm currently printing out the original forms and re-filling them in just in case. However, I can't remember what date we signed on. Should I sign as todays date, or not sign at all?

Okay, obviously there is a lot going on for the OP here, so why don't you guys just cut him some slack. People say/write confusing things in this kind of situation because they can't think straight, so I think that explains that. If he filed the I-129 last year and they just got their interview appointment now, that's not the most unusual thing either. Many people who filed last summer had to wait forever for their NOA2.

Let's just calm down and see what he finds out.

In my opinion anyone and everyone is the same boat here as far as visas go. No one can is guaranteed their babe will stay afte the visa is issued. Weather old, young, pretty, ugly there are just no guarantees. Its a gamble at the end of the day. Only time will tell. Love has no guarantees!

Yeah...that site is a nightmare.

 

We ended up paying for home delivery from the courier twice in order to be consistent and get it completed. The first account allowed courier selection and payment, but paying the MRV was never an option. So we created a second account which did not link to the previous settings...so we had to redo the courier in order to get to the MRV page. 

 

We ultimately ended up with one account with courier selected and paid but no MRV and one complete account with courier AND MRV - this account is the one we printed the receipt from.

 

No one is having too much clarity with the site unfortunately, and it sounds like lots of us have had to create multiple user accounts to get everything sorted and paid before the interview. 

 

Be sure to follow the link directly off of packet 3 letter. You need to register for a K1 on the immigrant visa section of the website (otherwise you'll have a whole host of other issues).

If you login later, click on Print Instructions at the top. The site says clearly that you have paid your MRV fee and lists the amount you paid. 

 

My fiance printed this page and took it to the embassy and had no trouble.

My fiance and I met July 2012. He was visiting the US when we met. Since that visit (in the last 11 months really), he's been here 7 times (I've been there twice). Neither of us ever had any trouble at customs on either side as we could always produce our scheduled return itinerary. We also figured that being able to have the K1 notices and prove that we're going through the proper and legal channels in order to bring him to the US would help ease immigration fears at customs.

 

As VJ has taught us so many times, every case is certainly different. But my opinion is that you certainly have incredibly strong ties to the US. Perhaps just always make sure you have your return itinerary to present and K1 paperwork to prove that you've filed through proper channels to bring him here (so you are very much less likely to be trying to sneak into the UK). 

 

Entry is never guaranteed, but it doesn't seem like you should not have much to worry about. All only my opinion, though!!

Can you buy another certified copy of the decree? I know that here in the US as well as in the UK, you can order/purchase additional copies of the decree. That way you could send an original with your packet and still have an original at home.

 

I can't say if a copy will be OK...but if you can buy another copy of the decree easily, I'd go that route and minimize the risk of getting a RFE during the process.

The link that was provided above has all of the information you need. Under the "Assembling the I-129F Package: Checklist" section, is lists out which forms need filled out and by whom. It clearly lists which ones need done by the US Citizen (Petitioner) and which need done by the Non-US Citizen Fiance (Beneficiary).

 

The best advice any of us can give is to follow the instructions on the link provided by agnesb. These are the steps we have all followed and are the forms that we have all sent with the initial I-129f packet.

Hi Juliet& Steeve, my interview will be on oct 15 my fiance is divorce i have a clear photocopy of his divorce decree. Do u think i need to get in advance with the stamp/certtified copy to bring at the interview? We had an RFE before its the divorce decree also, they want a certified copy that time so my F went to the courthouse and was given the same docs we have but that one has stamp and its certified copy.

 In my experience, I have the photocopy of my Fiance's divorce decree, but was asked for the original copy, so better prepare the original copy to make sure you won't wait any longer  if asked to provide them the documents :)


 

Please update us on what happens.  It may be that the consulate is erratic.  I hope that what you have is good enough for them.

 Sure :) I'm hoping that satisfies what they are asking from me. This is so stressful since it has been 2 weeks since my interview and was asked 2 time for these documents.. 1st was a photocopy and now, the original one.

Juliet here,I went to my interview yesterday and was asked to send another petitioner's divorce documents and told to sent it through 2GO.

 

I told Steve what we needed and he sent me the document today through DHL and I'll be sending it to embassy through 2GO as soon as it gets here.

 

I wonder if they also told you to send it through 2GO?

 I dropped the documents at 2GO when I was asked for a copy(scanned) of my fiance's divorce decrees.

 

Anyway, USEM notified me after 10 days of dropping the docs that they had in hand the documents. Someone from the USEM called me the other day asking for the original copy and said that t is ok for my fiance to directly submit the original documents at USEM by putting "ATTENTION IMMIGRANT VISA UNIT". I do hope they are sorting the documents right away so we would noy=t need to wait any longer.

When I became divorced some yeas ago the Family Court sent me a "Final Divorce Decree", dated and signed by the Judge.

 

I thought that was "proof of divorce" and so sent what I had been sent.

 

Now I find that there is a special form that must be purchased here in NH for $10.  The clerk assured me that was the form that the Manila embassy/consulate wanted.

 

So this is just a heads-up hoping to enlighten others that might fall into the same trap.

 

I image that this has been posted here someplace but neither I nor Juliet never came across it, or perhaps we did and never recognized that I had the wrong form.

 

Now we have to wait another week or two for the form to get there.

 

Though this will give Juliet adequate time to fill an extra suitcase or two with her favorite dried fish.  (For those who might not know those from the Philippines only eat dried fish and rice--well, maybe a banana or coconut on occasion... devil.gif )

 I was interviewed last September 12 and the CO asked for the earlier  divorce decree of my fiance. What happened is that I dropped documents (scanned copy) of my fiance's divorce decree and I got a call from the embassy 10 days after that they wanted to see the original copy of the divorce decree. Well, my fiance who has it sent the original copy right away and is expected to arrive at the embassy tomorrow via fed ex (Documents were sent from Chicago). Im a bit worried because the divorce decree we have is the same like "final divorce decree' which was signed by the judge. 

 

I am now hoping that we will satisfy what the embassy needs since they just asked me for the 'original' copy and not the 'other' form/document that they asked your fiance. Else, I would have to wait and wait again....

I agree with hank :) but In mycase, to be safe and sure, hand a copy (original copy) of your divorce decree to your fiance. I have been reading posts and in my own experience, I was asked for the original copy. If i am not mistaken, 3 VJ'ers who previously had their interview in USEM were asked to submit the original divorce decree like me. It wouldn't hurt to make sure. It has been past 1 month since my interview and i still don't have the visa with me, the original copy of divorce decree caused all the delays I have now. I was able to submit the scanned copy but was still asked for the orihinal copy. God bless and god luck

I think if you were to file your I-129F by January 1 2013, you will have time to get K-1 and K-2 visa before your fiancée's son's 21st birthday. We filed on January 3, 2013, and my fiancée's son will turn 21 in mid November 2013. We are now waiting for an interview. It will be close, but I feel confident that we will make it before his 21st birthday.
As to your medical issues, I think that does not fit one of the criteria for expediting.
