The way it works in Illinois is that you go to the DMV office, they verify your residence, do your vision test and then you take your written test.  The learner's permit is valid for a year.  Within that time she got her GC and felt comfortable enough to go to the facility and take the driver's test (where you drive around with the instructor).  She passed that no problem (She was very nervous about it and wouldn't listen to me telling her that they give licenses to far far worse drivers !!)

With the learner's permit, you are allowed to drive as long as there is a licensed driver in the vehicle with you.

You are added to the insurance company's list but are not listed on the policy.

 

My wife drove in Moscow but when she came to the US, it was like learning all over again.

 

Of the entire visa process and all the hassles and waiting, the most difficult part of the process is teaching your spouse how to drive!!!

guessing Illinois is one of them?? Saw that is where you live. That is also where I will be living. But not 100 % sure what you mean. I know that to get your license you need to have a car with insurance, which is completely different from my country cause here you pass your test in their car and not the one you bring

Here, the car doesn't get the insurance but the drivers also are listed who are insured to be driving it.

 

Insurance companies allow one to lend your car to someone for a short period but if you are to be a full time driver, then you must be listed.....and must produce that card/document when pulled over by the police.

Still not necessarily valid or use-able in every state.   Then there's that insurance thing, some states require by law every driver to have auto liablity insurance...and their requirements may be more onerous than the state's.

A better course of action, in my opinion, would be to get an international driver's license before arrival and use that until you AOS (or at least until you your get your AP/EAD card which will have a much later date on it)

That depends on the state.  Contact the state DMV and inquire.......but more importantly, can they obtain or be added to auto insurance?  That may be the deal killer.

 

For us, my insurance wouldn't add her with a DL until she had her GC, so we got her a state learner's permit and all was fine.

Do what you can to generate tons of evidence of a legitimate relationship.....or consider withdrawing the K-1 and get married there and file for a cR-1.  Your call, good luck.

Read about the possible troubles you two will have at the Embassy on the MENA regional forum....your case seems to be one of them.  K-1s are frowned upon, especially when the USC is female and a lot older than the beneficiary.

 

Getting married there and then applying for a CR-1 seems to have more success.

I am curious, I will be visiting my fiance for the first time in Nov. Can I file for a K-1 VISA after our initial visit; and then once approved, have her enter the USA to start the 90 day period and then have us both fly back to her country for the wedding (since all her family is in her current country) or is it REQUIRED that we marry in the USA for a K-1 VISA?

Sure you CAN do that but then she'd have to stay there while you file for a CR-1 spousal visa, since she won't have any way to re-enter the US.

 

Yes, you must marry in the US and file for AOS (and the AP) to be allowed back into the US if she leaves.

 

 

The reason for this strategy is we can get the clock started earlier and there is no way to have all her family come over to the states for a wedding.

International relationships and immigration to the US requires folks to not follow the standard paths.

What most do in this case is do a legal marriage before the county judge, AOS and return to the country and have another ceremony/celebration.

Hi All,

I applied for K1 visa for my fiance. She is in Delhi and I am a US Citizen. End of Nov, 2012 my fiance had her visa appointment and she was refused and given a white 221g paper with request to submit listed documents. This included,
* Notarized statement from both of us indicating how we met and why we decided to get engaged.
* Engagement attendee list, with address and phone number.
* Notarized copy of my passport.
* Notarized statement from her parents on their views regarding the engagement.
* Emails, phone, and gift/cards that we exchanged.
* Photos from before, during, and after engagement.
* And Voter ID card with list of last 5 year beneficiary.

In December 2012 we submitted all of the above documents to the consulate. Day after submitting the documents the visa status was showing as administrative processing. Today when I checked the status is showing as refused. Since we have not received an official letter from them yet, it is hard for me to tell any reasons why. But I wanted to find out next steps that can be taken to get the visa approved.

Just my opinion and not knowing the requirements of your country/Embassy but that seems like a lot of information and I wonder what you submitted for them to ask for so much.....it seems that you didn't do enough to prove your relationship.

If your visa is denied know that you will have to jump through extra hoops next time since this cause/action will be on your record. Maybe get married and file for CR-1?

You've listed ALL children on the 129f form, regardless of their ages and their immigration intents.

Then on the DS-160 form you will list only those that you wish to receive a K-2, and the type, To Join or To Follow.

 

 

2.  Am I able to apply for both the K-1 and K-2 visa at the same time and do the interviews even if the K-2 visa is to travel at a later date?

My soon to be stepdaughter is only 12, so I understand she doesn?t need the biometrics or the interview, so it?s my hope I could apply for both so she has the visa in her passport and is ready to travel as soon as we send her the airline tickets. 

 

3.  IF SHE CAN NOT file at the same time, what would be the process to do her K-2 visa? 

You'd email the Embassy and arrange for her passport to be submitted to have the visa inserted.

 

Would she bring the papers to the embassy and arrange an interview or appointment when ready to travel so they stamp the visa in her passport?  \

My hope is the mom follows through with the letter allowing her to travel, we have a legal agreement for custody in their country, but now that they?re coming to the US the embassy requires a specific note from the mom and in theory that will happen.

My only fear is that it may take the mom awhile to come around and they may not be able to file at the same time as I hope, so I am looking at what the process is exactly from other K-2 filers?.  thank you in advance!

It is suggested that this letter from the other parent is taken care of before any visa is petitioned.  It is a deal breaker.

It can be about 2-4 weeks for it to end up at the consulate after approval.  What governs, is not time after the medical exam, but the length of time they issue the visa for.  Sometimes they do 6 months, but sometimes they do 4. 

 

We've seen this a few times......that being said....we have also seen many cases where the Embassy has extended the visa usage beyond the 4 or 6 months due to unique circumstances....yours would certainly qualify.

The only problem is that in the state of Arizona, you must have gone through at least one type of surgery (either breast removal or genital surgery) to have your birth certificate gender marker changed - and that's the only thing unchanged for me as surgery is not an option at this point. I'm just not sure what that leaves me as legally for these forms...D

Hi all, I'm new to the group and I have question about what is required in order to expedite the processing of a i-129F and K1 visa?

 

I'm currently in escrow purchasing a home in the US where my fiancee and I can live together.  I close escrow the 24th of this month (October).  My fiancee is currently 2 months pregnant with my child, and she lives in Tijuana, Mexico.  I'm currently helping her out with her rent, utilities, and medical bills which are costing me $900/month.

 

Every month she is in Mexico I'm losing $900.00.  If we were married than I could place her under my medical plan at work and not have to pay medical or the birth costs, plus the cash spent on rent and utils would go straight into the mortgage and other life expenses.

 

Does anything in my scenario qualify for expediting the process?

I am gathering all I need to get ready for my Interview in London. My fiancée has been getting her affidavit of support documents ready. She started her job early February and has collected all her pay stubs from that date,she also has a letter from her employer. She tried to get a letter from the bank with her account information, but they refused to give her one. There is a 2 year gap in her employment, most of the 2nd year she was at College, but the job she had before the gap was also 125% over the poverty line. So, I don't know if her tax returns will be sufficient. 

 

Will they pay stubs and the letter from her employers be enough?

Hi guys.  Im thinking there's not gonna be a problem but just want to see what your opinion is on this one...

 

I just submitted a I-129F for my fiance. On the form i included her 7 year old son so the child could travel with her on a K-2 visa. Now, on the child's birth certificate there is no info on his father (left blank) and the child is carrying his mother's name (my fiancé).

 

Then legally the child has no father and therefore no authorization is required.  There is no father to authorize anything.

My wife's son has the same BC.

but, according to the OP, he has not worked in 5 years (which leads me to assume 0 work experience considering his age). In addition, the students you refer to typically are in their twenties or in a master's program (based on the limited things I have read here).  19 years old would be very young in the eyes of the CO. How old is the fiance? Where would he plan on living with the fiance? a dorm?

 

The OP asked visa related questions....not life planning related questions.  Would I personally want to marry anyone without the ability to take care of them on my own?....No....but that is just me.  If the cosponsor has no issues with them living with them and taking care of the financial end of things....then their petition is just as strong as the next.  The CO wants to ensure they will be taken care of financially and that they have a legitimate relationship, not if their life choices leave something to be desired. 

 

 

by the way, by no means am I saying his petition is illegitimate, just that it would help him make a stronger petition if he were to think about these things before sending his I129F. Part of this forum is to help those address weaknesses in their applications so they can either find ways to strengthen it or submit alternative petitions.

 

Their petition may just be as strong as the next.  The poverty guidelines are very very low, IMO, and I find it incredible that many live at that level...but again, that's just me.

To me, a giant red flag would be the fact that you are 19, ready to marry, and you have never held a single job in the past 5 years or ever. Any other person on VJ with this experience?

 

It's not a red flag....there are many students that engage in international relationships and desire to marry and live in the US.

Our baby will certainly be born before the interview in Honduras. My question is will they require DNA testing for my fiance (paternity) and of me and the baby to approve the visa and will this subsequently delay the interview or visa??? Please anyone in this situation or previously I would love some info...........

I have Been denied a student visa twice this summer (lack of ties to home country) my boyfriend proposed and we have now filed for the k1 visa. Got our NOA1 yesterday and are very excited, people have told me that I should not worry about my past visa denials. True or not?

Also if I decide to apply for the esta and gets denied (wich I'm assuming cause of my previous denials) will this have any impact of our k1 visa?!

I am wondering how i can (the beneficiary) cancel the I-129F, we have not been approved yet?

There's nothing you can do except not go to the interview, etc.
