Why would that be negative point? Sending money is normal if the other is schooling or their pay is just too low. If you are afraid that is a negative, just don't submit that as a proof

 

It's considered neutral at best and negative at worst.  It can be seen as possibly trying to buy the the fiance and/or that the fiance is trying to scam money out of the petitioner. 

 

Its is always suggested to not include this.

The wedding is pretty concrete unfortunately with people coming from everywhere to attend. Would getting a workers visa from an employer in the US while filing for the spousal be a good route?

 

You most likely wouldn't be given one since they will see the K-1 in their system.  They would think you are just trying to circumvent the regular visa process, which you would be.  Could be risking a permanent ban.  Think very carefully while you cancel the wedding.  Period.


Move the wedding (or have it be a party, not a wedding) and immigrate on the K1 in a couple of months.

 

 

 

That's a great idea.  If the folks attending do not understand why you must follow the immigration rules and why you can not have the 'traditional' wedding, then whose best interests do they have in mind?

We just received our interview opportunity for the k-1 in Montreal but its 2 and a half months after our wedding. Should we still go ahead with the fiancee visa or just get married and file for the spousal?

 

Delay the wedding.  If you get married, you'd have to withdraw the K-1, wait for that to become official and then file for a CR-1 and wait another year.  Doesn't make sense..especially if you're planning to live together.

I say that language is unnecessary and can only muddle and confuse USCIS.  We all know that to use a K-1, the couple can not be legally married and that marriage must be performed in the US.   And we all know the ceremonies and other may be performed prior to entry to the US.  This language, IMO, serves no useful purpose and can only lead to possible RFEs or at worst a denial (and loss of fee).

 

If the USCIS wants this language, they will ask for it.

Hi everyone,

 

I have few questions:

 

1) My fiancee in China is working for a US company, and could potentially have a business trip to US during first 1/2 of I-129F/K1 visa  processing period, and will be back in China for the second 1/2. 

 

What I am wondering is, if she comes here on business travel visa, and then extend it to take couple weeks of vacation in US, and return back to China, would that in anyway complicate the K1 visa processing?

 

No to your direct question but to a question of whether she would she would be allowed to come to the US on the business visa while the K-1 is processing is unknown.  There could be a chance that she is denied entry wince with the K-1 you have notified USCIS that there is intent to rmmigrate to the US.

 

2) Also, I have just submitted I-129F packet to USCIS. Is there something I or the fiancee can prepare now to shorten her side of processing with local

embassy?  

 

Besides getting all the necessary documents toegether like police certs, the process takes the time it does.

 

3) Any important tips from your experience you can share?

I don't think so.  I believe mine wasn't addressed at all, just a statement on letterhead and signed by the appropriate HR person.

Hello! 

My boyfriend and I have been approved and now I have to apply for a K.VISA at the Naples consolate.

Unfortunately, he can't file an Affidavit I.134 form to sponsor me, and I don't know anybody elese in the U.S..

Is it possibile to sponsor myself and how I can maintain myself in the first 3 months?

If yes, what amount do I need on my bank account?

It really is his responsibility as USC and petitioner to find a cosponsor.  You can not sponsor yourself, you can transfer a bunch of money into his bank account and he can use a % of that as bank assets to offset lack of income.

After getting divorced in November to a woman I married after a K-1 visa, I am happily engaged again and we are wanting to file a K-1 visa. There isn't any wait time to get remarried after a divorce in my state but how long should we really wait to file with receiving less immigration scrutiny? I spoke with an immigration officer and he seemed to think it didn't matter a whole lot, but mentioned waiting 3 months after the divorce would be best. My fiance thinks maybe we should wait longer to file but I really want to get things in motion.

Hello all,

As many of you know my fiancee and myself have always been ready for each notification to reply back immediately.  Well today I can tell you that we got scheduled for our interview.  Yeah but bummer at the same time.

 

As soon as NVC said the package was sent to the embassy, I printed packet 3 and she gathered everything.  Went to medical and within 3 days of being recieved at the embassy we replied that we have everything and our ready for the interview.  On November 29th we sent this and scans to the Jerusalem embassy.  She received a call 4 days later saying she is scheduled for the 1st week of January.  Very vague but said they would be sending a letter.

 

Well today has come and the letter says January 29th at 8:15am.  Literally by the time the visa is issued our NOA 2 would expire.  Two months to schedule an interview seems a bit odd.  However, if we had to wait for police reports or anything then the NOA 2 would be expired by the time they could schedule us.  Is there any way to bring this interview date up?  I wrote them saying the papers expire however, haven't heard anything back yet.

 

Any advice?

 

Teh NOA2 expiration is meaningless for the K-1 visa process.  The NOA form is multi use; you are good to go.

Many of the cases I've seen where this happened were due to ignorance on the effect that such behavior would have on the visa process. People did what they thought was best, was customary to that country, not knowing how it would look like later on. Even though CO's supposedly are to take local customs into account, the fact is many simply don't.

 

And to add.....and to the lack of realization early in the relationship process that international dating and immigration to the US and the need to abide by those rules, requires a relationship to be conducted differently than "normal".

 

Would my wife had liked to first be married with a big ceremony in her country....yes for sure. 

Did she and I realize this would not be possible, yes, early on.

Did we discuss this....yes.

Did we discuss this with our family and friends.....yes.

Was everyone in full agreement with our plans....no.

Did they still support us and only want what was best for us.....yes.......we both have great families and friends.

It's not about if its worth it or not but a event that we as a couple want to hold for his family and friends and its not economically viable to do after getting married in the USA. Also the fact that we'd have to wait until he gets his green card etc.

 

 

One more thing is it even better to hold this event after we have recieved our K1 visa?

 

No, waiting until after the K-1 is issued runs you the same risk at AOS, or ROC or at Naturalization....you can end of being denied any of those, and at worst run the risk of deportation and/or a ban for visa fraud if discovered later.  Don't do it.

IR1 is the best route for you.. ANy route you take.. Please have good documentation!! GOOD LUCK!!

K1 and IR1 take about same time.. Not much of a difference.. Dont forget ISlamabad embassy famous Administrative processing that could be months to year.. take a safe route.. Have her come to Paki.. Get married than apply for IR1..

You are dealing with Islamabad embassy.. I highly recommend getting married in Pakistan and apply for I 130 this time instead of K1 :) I will be surprise actually shocked if you get a K 1 Visa again!

You should check with other people from Brazil before you spend $$ and time for an interview. Many U.S. consulates and embassies won't let you in. In Moscow nobody extra gets through the door. But pictures together can be a help. I had two cameras with me and pictures of us together in both Russia and Turkey. They only asked her 1 question at the interview.

Me and m y fiance are awaiting our interview date n we were planning on bringing his son from a previous rrlationship. However the mom doesn't want to give permission to take the boy. So I understand that if that's the case his son will stay but still will have an option to come within a year from the date my fiance get hia visa correct?

Each case is different and is up to the immigration officer upon entry into either country. 

 

BUT, you should be fine. Just make sure when each of you goes to the other country that you bring evidence of strong ties back home (lease, car payments, employer letter). You may be asked for these. I'd also bring the NOA1 or NOA2 to prove that you're going through the proper legal channels and aren't looking to illegally immigrate. 

 

I went to the UK once and my fiance came to the States 3 times after we submitted our I-129f. Neither of us ever had any trouble and were actually never asked for any proof of ties or further evidence than proof of a return flight ticket.

I agree with what everyone else is saying. London doesn't want to see tons of chat logs. Send pictures and proof of flights/having met. That's what they really want to see. We sent some pages from Facebook through the part that shows our interactions. But I can't imagine they looked at it or cared since we had photos and lots of flight proof. We had no RFE and no issues with our process with what we sent.

     Good afternoon all and thank you for all of the advice and positive responses. I'm sorry to keep everyone in suspense but I needed some quiet time after an emotional past couple of days. As I said the reason I delayed bringing Kelly to the United States was I lost my job during the visa process. I still haven't found work (I'm surviving on unemployment and savings) but I decided at the end of October to bring Kelly to the US so the visa wouldn't expire. Kelly has been very supportive throughout my ordeal (she has been out of work as well). When I arrived in Colombia and Kelly told me the visa expired earlier than I thought my first instinct was to get on VJ and ask you guys for help. As I was on the internet trying to change our flights I started thinking about the life in America I was bringing Kelly into and how my father told me a long time ago to get your financial situation straightened out before bringing a woman into your life. I'm not working and I'm living in my parents house until I find a job. My parents said it was alright for Kelly to stay there but it's not an ideal situation. After much thought I decided it would be best to not bring Kelly to America and figure out our best option to bring her when things get better in my life. I knew this decision would be risky because Kelly would have every right to break up with me after being so patient and supportive throughout this process we started in August, 2012. When Kelly arrived at the hotel I tearfully told her in my best Spanish my plans and expected her to be angry and end our relationship. To my surprise she said even though it's a last minute decision and she's disappointed, she understands my reasons and she said she wouldn't leave me and she'll wait again through another process. She knows how hard I've been trying to find a job and she is not the type of woman to walk away from a man she loves and treats her so well. We both cried and I thanked God for blessing me with such a special woman. I won't let her down again! This morning we discussed the benefits of the spousal visa and talked about me returning in a few months and getting married in Colombia. I have 2 job interviews this week so maybe we'll receive the blessing we've prayed for. Of course, I will keep VJ updated on our immigration journey.      



Good luck with everything. You guys seem like a very sincere and strong couple, so I know the VJ community looks forward to hearing and helping with next steps! Although unfortunate the path things have taken, it's wonderful to see you guys being thoughtful about priorities through this difficult time.

It sounds like your I-129f petition has been approved, but you have not yet been approved and granted a K1 visa. Your one-time entry and countdown do not matter until you've gone through the medical and interview at the embassy and they approve your K1 and you have the visa in hand. Once you DO have the K1 in your passport, it will be for one-time entry into the US and you will then have 90 days to get married.

Always send copies unless the form instructions specifically ask for originals. Everything you send gets put into your file, and you won't get it returned to you! Copies of passport and birth certificate are all fine.

Yes only one visit is a red flag.  In some countries, it would not be a major deal but you are going to have to convince the most difficult US embassy in the world to get a visa through.,...  I would strongly recommend making more visits, preferably at least 2- one asap and one for the interview.
