Both need to be legally free to marry.

 

Some states require a period of time after divorce before another marriage can occur (same as being legally free to marry).

 

Also ensure your new fiance knows all about your past marriage(s) and the timelines involved; you are turning fiances over quickly and that may cause some issue with the interview.

You the sponsor needs to file a I-134 too because you are the petitioner you are filing for your fiance. So you and co-sponsor should have done one.

Each, both of you submit separate I-134 forms.  Your cosponsor shows the financial backing and yours will show that you need the cosponsor.

 

Until you get these documents in they will not approve his petition so get the forms filled out and send them in. I guess you can make another apointment to take them back in or send them in which ever one you choose.

I have been reading threads about denials from Manila for lack of genuine relationship, and I ask advice on how to avoid pitfalls.

 

I have lots of photos of us together, phone records, Skype records, Yahoo Messenger records (we chat once or twice each day as our respective employment allows), visa stamps, boarding passes, etc.

Those in themselves do not establish a relationship.  It is the content and quality of the evidences, when all put together, should be able to convince a total stranger, the Embassy CO, that you have a real relationship and desire to marry and stay that way.

 

 

But the big weak point is that we only met once in person. 

My wife and I only met once.

 

The second weak point is that this is my third I-129(f).  I submitted the application for the waiver of course.  Neither of the first two failures resulted in any sort of visa, nor were either one my fault, as my ex fiances broke both of them off..

Shouldn't be an issue.

 

Will they worry that I will not be able to support her because of the cancer?  I have plenty of income,

What sort of questions can Candy expect as a result of these weak points?

Questions regarding the other petitions, for sure.  If you keep harping on your medical issues, that in itself could lead someone to think that you are just buying a caretaker or that they believe that you will be passing soon and just glombing onto your fortune.

 

When I was in the Philippines, we stayed at her parents' house, and they threw us a huge engagment party.  I mean huge, to the tune of 300 people and at a cost of over $1000.00  I thought about affidavits from her parents about the party and about how they witnessed the genuine love we have for each other.  Is this a good idea?  I figured the strong family oriented society of the Filipino people would give her parents good creditibilty; hence the value of the good word from them.  I have pictures of the party as well.

Says nothing to the content and itnentions of your relationship.  It's part of the story but you must tell that yourselves.

 

Any other advice?  I thank all of you in advance.

It's OK to purposefully generate different kinds of evidences.  Remember, it's the content that is important.

My fiance lives in Colorado, and after sending in the documents requested for the RFE we were denied the visa. If indeed, it ends up being due to lack of proof of our ongoing relationship and desire to marry, and we simply need to send in more information,

 

 

it seems as though it is not wise to appeal it as an appeal is only necessary if we feel they have not done their process correctly on that end. So, if we have to reapply, will there be any problems re applying for the same fiance?

Do they ever just request more information from you after a denial or do they just deny you and that's it...you have to start again.

I've seen people on here say that for the RFE you should send in way more than they are asking for. We sent in two photos of our time together along with the original plane tickets and receipt for the flights.

What you describe is only proof of meeting, not of a relationship.

 

They were not very specific on what they wanted, but I would think that would have been sufficient. It sounds like next time we should send in records of our telephone calls and emails as well. I wish they could give people the benefit of the doubt and allow them to send more information if they haven't sent enough.

Nothing personal but it seems you FUBARed this to the max and didn't even come close to sending them near enough or of sufficient quality to prove a relationship and desire to marry..  It is OK to purposefully generate different kinds of evidences that will describe your relationship and your intentions.  Canada is such a low fraud country to get denied on the basis you describe means you really really didn't do yourself justice.  Best to re-Read the Guides and the Sticky Notes before you submit another petition.

You have to use it to enter the US before it expires. Once you enter, then the 90 days to get married clock starts.

 

 

2. What is the difference between Visa Expiration Date and Petition Valid Date?

 

Visa expiration is when the vise expires and becomes useless.  The Petition Expiration has no bearing with the K-1 and is meaningless.

After receiving my K1 Visa, I decided to buy my flight ticket to be finally reunited with my fiancé.

I decided to by a one way trip and found a really not expensive ticket between Xmas and New Years Eve. I jumped on the occasion and booked it with Opodo.fr. 

On my confirmation receipt: everything is fine, it is considered as a one way ticket. But on the itinerary, the company booked me a round way trip with a flight back home that I have never asked for... Of course, I called the booking company to understand why they booked me a round way trip and not a one way trip like I ordered. The nice customer service guy told me on the phone that they booked me a round way trip in order to provide me the lowest price, the only thing I have to do is to not take the plane back home. 

 

Do you think it could be an issue at Port of Entry?

Hi everyone.  I have been with my fiance for almost 8 months now and we got engaged when we met for the first time in Vancouver for a 10 day vacation because they wouldn't give her a tourist visa to come to the US.  We have lots of pictures, our boarding passes and hotel itinerary.  We write and message on facebook everyday.  I'm in the US Navy and shouldn't have any problem showing ability to support her.  Neither of us have kids or have been married before and I am 29 and she is 22.  Do you think we would have a good chance to get approved for the fiance visa?  Or do we need more time together?  Thanks for your help.

Yes...if your intentions are to marry and stay together in the US.  Your evidence should be able to convince a total stranger (the Embassy CO) that you are legitimate.

OK....but still there was something there....or something missing.....in your relationship evidence to cause the CO to deny the petition.

 

I'd focus on that and determine if you should refile after this case is closed or marry and then file CR-1.

The evidence you mention just proves that you are good at planning a wedding and pay attention to all the details.  It does nothing to attest to the legitimacy of your relationship.  Yes one would believe that spending time together to go over these details is a signal of a real relationship.....but then again.....it could also be a ruse by two people to circumvent immigration laws just to gain permanent entry to the US.

 

I'm just saying; I don't know your details.  I do know that the COs are highly trained and that they usually don't go about denying folks unless they are good reason to.  I do also know that certain countries have higher incidence of fraud and that certain Embassies key on different things (and seem to issue more denials) than others.

 

Maybe all this wedding pre-planning actually hurts your case because it seems presumptive that you'd actually be successful for the visa....if that makes any convoluted sense?  All are told to make no plans or purchase any airplane tickets until you have the visa in hand.

 

I don't know the content of the evidence you provided but wedding planning does nothing to speak about the relationship.  Your evidence obviously wasn't sufficient enough.

 

Maybe draft an "Evolution of Our Relationship" letter that describes how your relationship came into existence and how it blossomed into a real relationship and how the evidence describes the different steps of the evolution of a relationship that leads to marriage and the desire to remain that way.

Maybe you had a lot of evidences BUT when all put together it was not of sufficient content to convince the CO that you had a legitimate relationship worthy of having a visa issued for permanent immigration to the US.

Hello All....kind of a dumb question, but I am a little confused....I am gathering up together our I29F package for my fiancee who lives in Ukraine.  My question is, when does the "proof of ongoing relationship" come into play?  Should I submit this proof now with the I-129F, or is it more important when she goes for her interview in Kiev?  I was planning on including SOME proof of our relationship, like copies of our engagement announcement on Facebook, phone records showing international calls/texts and the engagement ring receipt.  Thanks!!!!!

We plan on getting married at the local courthouse and the n having an actual wedding ceremony and reception at a later date. Our reasoning being that we want to move the whole process along as quickly as possible.

 

That way, we will still have the wedding that C wants, however we won't have to worry about waiting to save up for it and timing my entry so it all fits in. Plus we are well over being apart.

 

Smart thinking.  That's what we did, some family members were a bit confused but when it was explained to them about the unique K-1 requirements and the need to conduct our affairs outside the norm (a fact of international dating, immigration and marriage), virtually all were understanding.

Sorry, this may be a dumb question, but nevertheless, I'm curious.   Does USCIS count the 90 days as calendar days, for instance, our wedding date is set for July 12, 2014 and I'd really like my fiance to be here on April 12, 2014 because it's my niece's bday and a good chance for him to meet the family.  But if I count 90 calendars, he'll have to be here April 14th and not april 12th.  But if we're looking at months, 3 months from July 12th would be April 12th.  Does that make sense?  Of course I'd rather have him miss the birthday party so he can actually be here for the wedding, but if I can have my cake and eat it too, life would just be so much better smile.png

I believe that there is a limit...$10,000 cash that you can carry with you.  When we entered Detroit, I was asked how much cash do I have with me.  It was below the limit but the officer did not ask to see it.

 

What I read here previously, one woman opened a dollar account with Citibank locally and then she just maintained the account in the US.  She could withdraw the money from there.

You CAN NOT hae two petitions processing at the same time.  They will take your money from the second and then when they discover this, they will deny your second filing and keep your money.

 

This process MUST be done properly.....and you have been directed by many as to exactly what to do..Note that all of the advise from others is the same.

You need to meet in person somewhere....can be for only a few minutes between flights in some airport....but you need to meet in person.

Mine were all digital.

I printed them out, large, in color onto a sheet of paper, 4 per each sheet.

I typed full names, dates and short descriptions beneath each.

I then printed the same sheet again but at the top stapled a baggie containing actual photos I had printed out at the Walmart print shop. Onto the back of each photo I hand wrote in marker, the full names and dates.

I submitted both sheets of paper plus others since I sent in about 10-12 photos total.

He wrote his letter of intent yesterday and has the top part as the U.S. Department of Homeland Security in Texas, per the template on here:

^ Is that correct? I am confused by the template that says you have to put the Department of Homeland Security at the top. After that, he just starts with his letter using the same language as the template.

 

** On the G325-A, the addresses of his places of employment don't all fit into the box. And he has more within five years than are allowed on the form. How can he accommodate this? Can he just write it on a separate piece of paper? Are there any formatting instructions he needs to follow?

 

** Also, for some companies that he worked at, the headquarters are in Moscow, but he worked at a branch outside of Moscow. Which address should he put -- the address of the headquarters, or the address of the branch that he worked at? 

 

** Also if we are paying for him to FedEx the above two forms to me, is there anything else that he will need to potentially FedEx down the line that you think he should include so we don't have to pay shipping twice? Any copies of documents, etc.? =)

The address is fine.  It's the statement and his original signature that they want.

 

Separate sheet of paper.

 

I'd list the different addresses, but could be convinced to just use the corporate address.  This info is really not so important unless he puts down KGB or Russian Military or something else that could trigger extra scrutiny.

 

This should be all he needs to send you.  You will be sending him more stuff when he has the interview scheduled.

* I noticed the sample "letter of intent" on this site has U.S. consulate and U.S. Department of State info set as the return address. Is this necessary? Can he just skip the return address part and write about the intent to marry within 90 days? Does anyone have a completed letter of intent that got approved that they could show me? smile.png

* In a block at the bottom of the G325-A there is a place for an alien registration number. What is that and how would he have that at this point in the game? =)

 

This form is used for other visa petitions.  He has none, at this time, so leave this blank.

 

 

* I have seen mention here of 4 page G325-A forms, but the one I found is 2 pages. Do I have the right one?

 

The old form was 4 pages, the new form has less.  Use the form found on the USCIS website.

 

* Russian mail is very slow to the U.S. -- on average 4 weeks. Does anyone have any expedited mail ideas from Russia to the U.S. so that he can get his original signatures to me quicker? Oh how I wish I had gotten them while in Russia! =)

 

I always used FedEx.  The cost was understood and the total cost for foreign immigration and a new life in the US was well understood.

Hello All!

 

This is my first post here. I am beginning the process of filing a K-1 fiance visa petition. I noted that I need my fiance to fill out a G325A. A couple of questions --

 

* Where it says for him to write his name and address, can he write in Cyrillic or should he write using the English alphabet / transliterated versions of these things?

 

Yes in English and I believe there's a place on the form where he would write his name in his native language if  it doesn't use English letters.

 

* It doesn't say on the actual K-1 instructions that I need to have an original signature for this document. Has anyone run into trouble if they use a copy / scanned version of the signed document?

 

Original signature which shouldn't be a big deal since he has to send you his Letter of  Intent with an original signature.

 

I'm hoping I can do all of this myself and won't have to get a lawyer. =) All the paperwork is a little intimidating to me. Thank you to anyone who can help!

Going through the checklist again I found out that there are 2 points on the evidenche which are:

 

1)Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question '34.a' of the I-129F. Make sure to sign and date it.

2) Proof of having met in the past two years.

 

Just wondering if these two are the same or the are slight differences and are needed in different pieces of paper.

They are the same thing.  The answer to the question should be as big as the box is on the form; a long dissertation on a separate sheet of paper is not required.
