I have my interview this Wednesday (1-15) in Guayaquil. I am submitting my pay stubs, letter from my employer, and proof of enrollment in a graduate program. I am a nurse and make enough money but I only worked a few months in 2012 while I studied so my tax return is well below the poverty line. I really do not want to submit that tax return and raise any alerts.

 

Are tax returns required? It is just listed as an example of proof you can provide in the instructions.

 

My mother is also co-sponsoring us, she provided a letter from her employer and 2012 tax return which is well above the poverty line. She prefers I do not share the tax return unless it is required.

 

What do you think? Should I wait for them to ask for tax returns or just assume they are necessary and submit them without prompting.

 

I may be over-thinking this. Any advice will be appreciated.

If he's aged out, his dad may not have the ready immigration value that you think.

I don't think her fiance is in the U.S.  He is in England, right?  So coming here on a tourist visa with intent to marry and adjust status would be considered fraud.

As far the Nigerian guy goes.....it's not a new relationship....we dated long before, and I know him like the back of my hand. He genuinely loves me. I know that people will do anything for a green card but he has plenty of ways to get here to the USA (including a father that lives here already). We have mutual friends that would marry him illegally in a heartbeat to get him here and he refuses. He was so heartbroken and torn when I married the guy from Ghana.....(he never really moved on with his life), but when I called him to tell him everything he was an pure angel. I know I hurt him and caused him a great deal of pain.....but we have this connection. He is definetly my best friend before anything, even gave me the money to pay for my divorce. He just wants my happiness and I wish I could tell you our entire history prior to the breakup but it would take entire book report and several cups of coffee lol......We both genuinely love each other and to be honest HE DESERVES BETTER but he gave me a second chance at love and this time I just want to do things right.

I would agree with the Postmaster, you have two guys which are from country whereby marriage fraud is rampid, Nigeria and Ghana. I cannot speak for the state of Illinois, only for the state of Texas. In Texas you can get re-married the same day that you filed for a divorce. I am marrying my 2nd Filipina. I divorced my 1st wife (who was Filipina), and the day that I got my divorce papers, I sent off my K-1 Visa paper work for my 2nd desire. I believe what I have read that USIC will begin to frown and investigate on the 3rd K1-visa petition. So, you may be good however, "MAKE SURE!!".
I learned a lot from my 1st marriage, and became very wise the 2nd time around. So, go for it, provided you apply within the scope of the laws within the state of Illinois. But please put your emotions asside and be certain, else you will find yourself being used again. Men from Nigeria and Ghana are natorious for scamming American women. My 1st wife was 99.9 percent of what I wanted however, she didn't want to work, so that changed the dynamics of our marriage and I filed for divorce, some people may call the cruel, I call it being realistic and sticking to the agreement. It wasn't personal it was about the business of having a successful marriage and I'm not one of those men who just need a woman in my life.
So, proceed with caution, be skeptical, and do your research about the person. I actually hired a Private Eye to investigate my 2nd choice, sound creul but I learned my lesson from my 1st marriage. So, BE CAREFUL!!! and since he is male, TEST, TEST, TEST, TEST, TEST Him for he may already have a gf in the U.S. or he may even just want what the 1st guy got. I don't know too many men who would accept such a mistake, men are just not that patient by nature. I'm sure that's not what you want to hear but I'm very pragmatic.

The Ghanian guy never got his papers, I immediately divorced him when I learned of his cruel intentions.

  Having helped the first husband get his papers and immediately divorcing ( not that it was your intent to help Mr Ghana )    it will appear that you are marrying for profit.  Expect the CO to treat the relationship like this.  Be honest and be prepared for what I just said.  If your relationship is honest it will survive but your path may be less than smooth.

So hey everyone...I have been searching for a place that could give me some much needed answers and advice...and I think I finally found the place. Yayyy :) Okay here's the story (I'll try to keep it short lol) A few years back I felll in love with this wonderful guy from Nigeria.....he was attending school in London and I went to visit him a few times there. While on my last visit he proposed and we were all set to plan a wedding....then suddenly things took a turn for the worst and due to  distance and frustration of my work schedule and his school schedule constantly conflicting we seperated and stop talking :( While seperated a year later I met what I thought was another great guy from Ghana (Who came to the USA on a tourist Visa and lived in Chicago during his stay) and instantly feel head over heels.....He propsed to me within only 2 months of dating and stupid me *I already know no need for bashing :( * went and got married to him, only to find out he only married me to get his papers.......I was so pissed at the idea...I immediately broke things off and filed for a divorce. Meanwhile, guess who was there to support me and be by my side the entire time (MY EX from Nigeria) he was so caring and understanding and the experience drew us back closer together. A few months later after filing for the divorce me and my Nigerian love have been planning our lives together. I know for a fact this is the man that i want to spend the rest of my life with, but i know it will be hard to explain this to Immigration (seeing that he does not have his papers either and I want to apply for a K-1 Visa). I never applied for any type of documents for the guy from Ghana....but I want to apply now for my fiance that is from Nigeria. On the G 325-A (Biographic Form) & the I 129-F (Petition For Alien Fiance) it asks about Prior Spouse info such as when the marriage started and when it ended (The marriage lasted approx 2 months and we seperated but we couldn't file for divorce until 6 months after our seperation due to laws and restrictions in Illinois, in which time I reconnected with the guy from Nigeria). Do you think this previous marriage that was so quick will affect my application process in any way and if so how long after my divorce should i wait to apply for the K-1 Fiance Visa or would it just be smarter to go ahead and get married and file for the Spousal Visa?? I know this all seems complicated and crazy but...mistakes were made i have moved on...and i would love to words of wisdom instead of criticism..Thank You Soooooo Much In Advance... Any questions feel free to ask i will respond honestly :)

I just have a quick question about filling out the I-129F form.  My foreign fiance has a child, however the child is not filing for a K-2 because the mother has custody.  Do we still put the child on the I-129F form?  It says put children of alien fiance but I don't know if that is just if they are applying for the k-2.

I'm filling out the G-325 form and I've lived in more than 5 places and had more than 5 employments in the last 5 years. I know i need to attach an additional document but should I fill out all the spaces I can on the form and then in in the space say "see attached" and on the attachment just put the last 2 addresses?  OR do I put "see attachment" in the first box and put all the addresses on the attachment?

I think our situation might be quite unique. We met in an online dating site in December 2012. We haven't met in person. I mailed out our package on Wednesday October 16, 2013. Included is a letter signed and notarized by my employer (of almost 14 years) stating that I can't get time off of work because my boss was in the hospital for 2 months and is already scheduled to go back in and have more surgery. It also includes a signed and notarized letter from a nursing home where my long time friend resides. I'm her legal guardian and need to be here for her. It describes that I need to be here to make decisions and support her emotionally etc. It also includes a letter from my pastor about his knowledge of my relationship with Stephen, our plan for him to council us for marriage etc. I'm just wondering what the chances are that will get approved for the exception of not having met in person??? Any thoughts?

Immigration to the US is a privledge, not a right.

 

Go meet in person, doesn't have to be in his country, and withdraw that petition and file another.  Very simple.  If you follow the process, then you can get together.

Since you have not filled in any profile or timeline information, it will be hard to help you since certain Embassies (countries) are "harder" than others.

 

The money question is legitimate.....at least in the region we are from, one of the cardinal rules is to never send money to anyone you have not met in person first.

 

All you can do is write a letter stating your entire timeline, how the relationship began, how you corresponded, why you don't have some past documenation, and hope for the best.

My fiance and I just received and RFE because our lawyer did not include or inform us that we needed a statement of intent to marry  within 90 days of his entrance into the US. cray5ol.gif Needless to say, I do not trust a word that my lawyer tells me anymore.

 

So we both have to write and sign these affidavits of intent.  Does anyone know if this document has to be the original copy?  Or can my fiance just fax or scan/email me his signed letter?  I ask because I want to submit this as soon as possible and not wait for 3 weeks while his letter arrives, from the Ukraine, in the mail.

 

Any thoughts will be greatly appreciated and more trusted than my lawyer's opinions.

I am Singaporean and my fiancee is the petitioner so he's American.

Let's say that I am in the States when we receive the NOA2 successful approval.

 

We're wondering if it's possible for me to choose not to fly back to Singapore for the consulate interview and do it somewhere else instead, for example the US Embassy at Canada?

It is absolutely compulsory that I fly back to my home country for the consulate interview and from there, fly back to USA with a Fiance Visa?

It's probably a No but we figured we might as well throw out the question smile.png

When sending the initial I-129F packet, they're looking for proof that you've personally met in the last 2 years. They're not all that interested in proof of the ongoing relationship. They want PRIMARY evidence which are things like passport stamps, boarding passes (not just copies of itineraries) etc. Photos are considered secondary evidence. They want irrefutable proof that you were in the same place at the same time when you met

For the interview, compile as many different types of evidences (you CAN purposefully generate different evidences) as you can.  Plan to tie them all together with a Evolution of our Relationship letter which should describe how your relationship began and followed the normal steps in the evolution of a relationship leading up to the desire to become married.

Once you enter and them become married, you can file for AOS and the EAD as well.  The EAD will take about three months to process.

Yes this is for meeting in the past 2 years. We have boarding passes from our Moscow trip, and I have my boarding passes when I flew to Astrakhan her home city. We also have Hotel confirmation for my Russian visa that we stayed in during Moscow last week as well as a printed receipt from the hotel.

 

I just also wanted to include withdrawals and purchases on my debit card and credit card to give them everything. So that there is no chance for an RFE. I am wanting to make this go as smooth and quickly as possible.

 

Sure but only if they detail places where you claim you met.  Personally I brought US cash and kept all my currency exchange receipts and used those as part of my proof of being in Kiev during the time period we claimed.

 For the ?Proof of having met in person in the past two years?, I have sent the following:
  • 20-24 pictures together including our trip to Egypt.
  • Airlines tickets that I have been in Russia and Egypt, including my fiancée?s airline tickets to Egypt.
  • Photocopies of my passport pages with visas and stamps showing entries and exits in Russia.
  • Photocopies of train tickets (in Russian language) of both, me and her traveling to her town in Russia.
  • History calls from Skype to her cell phone, Facetime and Viber.
 
I would like to know what I should send to the USCIS. 
 
I travel to Russia to meet her and there aren't stamps on her passport. We also met in Egypt (May 2012) and recently in London (last week of October 2013). What we have are train tickets to her town in Russia which I already sent them. Should I include an English translation of the train tickets (train tickets are written in Russian) to her town?

We have 2 questions. Calling all senior VJers / experts please.

 

1. Fiancee has an existing B1/B2 visa. Will that be automatically canceled if and when the K1 visa has been issued?

2. We understand that K1 visa holders can't work until EAD has been given but what if the company she is in now is offering to absorb her in their US main office, will it still be the same? 

 

Yes, still the same.  No legal work until the EAD or GC is in hand.

 

Someone from NVC said she can keep both visa and working immediately is possible (just tell the consul) but we don't want to risk anything at this point. We're okay to wait for 2-3 months until EAD if ever. Just thought of throwing the question out there.

 

Wrong info.  Have to wait for the EAD or GC.

God willing everything goes well and be issued a visa, I plan to have my son a "to-join" status since i want him to finish this school year here before he follows me.  QUESTION: for to join k2 can I we process our visa together or at the same and just wait for him to follow? since it is stated that for to join they can apply a visa within a year upon my issuance of k1 visa.

I will be doing my medical exam in Vancouver with Dr. Cheema and I'm wondering if I will be asked if I have used drugs in the past. The answer would be yes, but it's been a while. I absolutely want to be honest answering any questions.

 

Does any one know if that question will be asked? If I am asked that, will an honest answer hinder my chances of obtaining a the K-1 Visa? Should I have a drug test done and bring the results with me?

Answering as you intend has had negative results for many folks.  Consider the intent of the question and whether you fit that exact profile it is intended to vet out.

 

Many of us were in college once and are not drug users now.

Only certain Embassies don't allow co-sponsors.  Email yours and inquire.

 

 

he does not work, he graduated last year and hasnt been doing much of anything... but we have many people who are willing and ready to co-sponsor me. 

 I do not work.

 

So neither one of you works.....even if a co-sponsor was to vouch for your petition, how will you two live here in the US.....with no one working?

I read on the USCIS site that you, "must provide the signed, written consent form that the IMB obtained from your beneficiary authorizing the release of his or her personal contact information to you."

 

What if they never did this? I don't know what to do, neither does my fiancée. Getting really agitated how nit picky this process is becoming.

 

Maybe then EM is not an IMB since they did not execute this mystery form.

I will just put that we met online at EM, we did not have to sign a written consent form and that I gathered no personal information about her through the site but only through after speaking. I will put the address url of EM and then move on.

I don't remember anything about the consent form, so maybe that is a new thing on the form.  Ask your fiance is she had to send any information to EM prior to joining, she may have consented online.

Great! We have established that EM is an IMB and follows IMBRA guidelines. Now about the written consent form, she never signed anything to give consent of me to have access to her information.

 

Is this something we have to find and pursue? Or do we just list EM and the address and not worry about this written consent?

 

That's all I did....list their address, etc.  There is not written consent form but I do believe we needed to answer some information before we joined? ....was a long time ago....anyway not an issue.

I met my fiancée on Elena's Models a year ago. I am filling out the I-129F to send in next week and came to this question. I have researched the forums for a clear answer but had trouble finding anything of solidity.

 

Is Elena's Models an IMB? If so, she and I have no idea what this IMB form that she was supposed to have signed is. Is this something I need to find and print and have her sign? Is EM not an IMB?

Same here.  It is not am IMB but on our petition I did list it as one.  Wasn't a problem.

But doesnt the I-160 form need to be e-filed? I can do that but i am worried about him filling out the one form online. Sorry i am new to all this. Thanks for all the help and advice.

 

No, there is no e-filing.  You complete the form online and then print it out from online so it generates the bar code.

 

I did all my wife's forms and then sent them to her for signature and transport to the interview.

There is no internet where he is currently at. And he can go where there is but you have to pay by the hour and its alot. This stuff just cant be alittle easier at all.

 

You can complete all the forms yourself and send them to him and have him merely sign where needed.
