Greetings Everyone,

I am new to this forum. I would like to say that going through this site has been an eye-opener for me.

Anyways, ive read the previous topics about the medical examination that will be conducted for people planning on migrating to the United States and ive also read the PUBLIC HEALTH SERVICE, DEPARTMENT OF HEALTH AND HUMAN SERVICES text which states: (cool.gif Communicable disease of public health significance. Any of the
following diseases:
(1) Chancroid.
(2) Gonorrhea.
(3) Granuloma inguinale.
(4) Human immunodeficiency virus (HIV) infection.
(5) Leprosy, infectious.
(6) Lymphogranuloma venereum.
(7) Syphilis, infectious stage.
(8) Tuberculosis, active.

It does not mention hepatitis b which is a communicable disease. My concern is for my filipina wife who contracted the disease through blood transfusion in the early 90s. Will this in anyway affect her in obtaining a k3 visa?

Actually, if your fiancé file I-129F petition for you (this is step one of the k-1 process), and you go abroad for 6 months right after that, you will be fine.

A petition takes 5 to 7 months (now it is even more about 8) to get approved by USCIS. After that, it will be sent the US embassy in your country, and this is when you are going to need to be in your country. In the 5 to 8 months that the petition needs to get approved, nothing happens for you, so you can be abroad, no problem at all.

Now, if your case gets in the embassy while you are still abroad, you can just hold on to packet 3 (what the embassy send you) for a while. This will delay the date of your medicals an your interview (please check this on the regional forum, this is and embassy specific issue). You have to be careful to be able to schedule and interview before the Approval notice of the I-129f expires (NOA2- Usually expires after 4 months if I am not wrong)

You will have to go to an interview at the US Consulate where your petition is being forwarded (assuming it's approved by USCIS). You'll have to take a medical exam and submit that envelope at the interview. You will have other documents to collect, like criminal background checks. I don't know how you will do those things if you are out of the country.

The K-1 visa, when issued, allows you up to 6 months to enter the US. Then once you enter, is good for 90 days. You have to marry within those 90 days, then file for adjustment of status.



Oh 6 months is not enough time.

My fiance and I have plans to meet soon and file for K-1 visa later on.
I wonder if me going abroad to work (short term 6 months or so) while waiting for the K-1 visa approval will be acceptable and would not affect the approval. I understand that I must go to the US 3 months upon the visa approval.
If I am already in another country when the visa is approved, is it okay to go to the US not from my home country? How does it affect my entry to the US?
Any advice is greatly appreciated.

My American fiancé is wondering whether when can we file for a K-1 visa.
His income from last year was a little short of the income requirement. He has never been married and has no kids but he didn't have much income in the previous year because he was doing some freelance work that did not turn in stable income. He had jobs in the middle of last year but he decided to quit because he wasn't earning enough. Fortunately, just a few months ago (less than 5 months ago), he got stable jobs that are turning in good income. He is sure to be way above the income requirement for next year. Our question is, do we have to wait until the next income tax filing early next year or can we start processing the K-1 now..? Is the US government going to check the ITR of last year 2012 or are they going to compute based on what he is earning in his current job.. ?

hey..before i start telling u. please calm down.. I am a nurse. I am not saying that I know the process in st.lukes but I am pretty sure I know what you are talking about.. first things first. the culture and sensitivity may took a month or two, that is correct. now, why we ( medical prof) are doing this? its like planting a seed and till the seed grow, we do not exactly know what it is. Now, if at the earliest possible sign, we know its a mango, then we call it a mango, otherwise, we will have to wait few more months until everything is evident. I am not saying you have TB. i am just telling u a fact. second point, the operator has truly no right, to tell u what is the diganosis. that is beyond their scope of duty and according to the Law, only doctors can tell a diagnosis to the patient, unless with certain circumstances and with proper ruling. third point, if it is tb positive, then so be it. and do not worry. TB IS TREATABLE.!!!! IT MAY Take a little while if you are positive before the visa will be issue. but its actually a win win situation. you wouldnt want to scare the hell ouf of all american people as TB in their country has already been eradicated. and if you go there and have TB, you can imagine the public discrimination u will have., and its for your own good. the reason why we have this medical examination is for physician to determine your current state of health. they are not there to deny you of your visa. and I know, doctors dont want that. all they care is Your health. ..

I had my medical at St. Lukes but they saw a slight scarring on my chest x-ray and they had me went through sputum smear test for 3 consecutive days,(Sep 15,16,17) after 2 working days I went back for the result and it was negative for TB. As we may all know, even if the smear test came out negative, one has to wait for about 2 more months for the sputum culture result. I was given a specific date when to call the clinic to find out my sputum culture result, it's on Nov. 16, but just less than an hour back I received a phone call, a lady from St. Lukes telling me that the result is ready, but she cannot disclose whatever the result is over the phone, may it be positive or negative. She further told me to come personally since it would be the doctor who would tell me the result, and she didn't tell me to bring anything, a passport or what, she just asked me where I am from.

I didn't expect this call, all I knew is that I was told to be the one to call them to ask about the result...I don't feel nervous, but I was confused...SHOULD i FEEL NERVOUS BY THIS??? Is this alarming?, Do I sense some bad news from this?
And as I was browsing about this, I read somewhere in here that when you got a call from the clinic much ahead of the date given to you usually spells a bad news...grrrrrrrrrrrrrrrrr AM I TB POSITIVE? #######...........
The lady asked me if I could appear on Tuesday next week (Nov. 9) at the clinic since the results are erady, I declined I told her I can't just leave my work anytime, if it could be I would go there on the 3rd week of this month as I am scheduled to call on Nov. 16, she further said I don't have to wait that date given to me, but I insisted I cannot leave my work anytime especially next week. so she then said I just have to call them so they can set appointment for me, that ends our conversations.

I am not nervous but scared lol...grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr...
why does it have to be this hard?
I'm about to give up when I knew I failed in my x-ray, it's too much hassle...

Hello and welcome to VJ!


The vaccines are included in the medical exam fee. You don't have to be so concerned right now. St. Luke's will ask about your vaccination history, age, whether you already had chickenpox or not, and other related questions. These will help in determining what shots are for you.


The vaccines will have time intervals. As for my experience at 22 years old, I had MMR, HPV, and Tdap shots in SLMCEC. Right before my AOS, I went to a civil surgeon for the I-693. He didn't give me new shots because according to him, my MMR was complete, HPV was no longer required by the USCIS, and Tdap comes in an interval of 5-10 years.

I'm a newbie here, I've been visiting this site until I decided to become a member...
I have a few questions, please help me with this one, this is regarding the vaccines/shots one needs to get during medical for K1 visa...
I have read the list of shots/vaccines in the US Embassy guide, my question are the following:
Do I have to get all those listed there? I know I have taken a few of those shots in the list before but I can show no record, nor I have access to get my record (it's impossible)...
We have just started the petition, we received NOA1 2nd week of March 2010, I think it would take months as to how long the petition be approved and sent to US embassy Manila, but my fiance wanted me to work on those shots or vaccines needed during medical,could this be possible? or should I just wait til the day I have to go for medical?
what if I am required to get al those, can I opt to just get those at the US during AOS?

Hello everyone.

I have a few question that have been bothering me...I'd appreciate answers to these...

my fiance filed k1 visa for me and the NOA2 validity is 06/11/10 to 10/11/10...
my interview schedule which was supposed to be last Sep 15, 2010 was postponed and instead from Sep 15,16,17 I had my sputum culture test...it was found in my culture test early week of November that I'm positive of TB, and St. Luke's contacted me and wanted me to report immediately. As to the extent or status of the Tb I have no idea if it's active or latent...Works hinder me from going there, though I really have plan of pursuing the visa but things are not that easy for me to just leave and go there for the treatment, it wouldn't just jeopardize my work, also me...so it's been almost 4 months now from the time we learned about the result and I am procrastinating, it does jeopardize my health lol...

Now my questions are:
does it disqualify me to continue my treatment in St. Luke's since it has been 4 months now since the culture result and I never had reported there from the time they contacted me...
I read somewhere that once k1 visa petition is approved it has only 4 months validity to process and obtain visa, does my fiance need to file another petition again? or does the consulate re-validate the validity period automatically?
what's gonna be my status now as to about my treatment at St. Lukes, will they provide it free for me when I go there for the treatment.

I am just so confused and tired of this, it's the most unexpected things, so horrible for me...
it's sick and tiring...

It's very funny to think that I of the same name with you and probably your hubby with mine stepped into the same situation. Well I am Grace and my fiance name is also Michael, Mike for short. The main reason I send you email is because we have the same situation. I think we're not just lucky to have the lawyer filing for our petition. My fiance on the other hand is currently in Iraq and finishing up his deployment. We were hiring a lawyer which also didn't care about our application. Now, just today I was very disappointed because I was waiting patiently for the result of our application yet, I got a notice asking for an additional evidence which will delay our application...RFE...I was very very disappointed. I know I am not alone with this situation and I've been looking your profile since I became member of VJ's, I just didn't thought I could be in your situation, and now I am! :-)

I would like to ask some advice from you since you have already experience this thing. Please tell us what to do. What errors your application had? I know our RFE will be sent to my fiance mom and I still want the lawyer to finish up his mess. He asked us to send the RFE to him ASAP, do you think it's a good idea? He's a lawyer from Hawaii and my fiance told him before that if he's not doing well on our case he will look for ways to file a complaint with him regarding his performance. He did not answer my inquiries and all not unless my fiance would send him an email. He's a damn lawyer....

What evidence does the USCIS needs from you and how long it takes to receive this notice? Please help us... I am really really down and sad.

Dear Gracie,

Thank you for your email. To start off my, let me give you a big heartfelt hug. Please know that I share with your emotion on this situation.

I think there is no need to tell you our VJ story, as you may have already read everything, including the responses we got from our fellow VJers. The people here have genuine concern for us, not like our hired attorneys, who are just good in the beginning. As soon as you have paid them, they won't bother to show the least bit of concern.

I am pretty sure you agree with me that:

The reason why filers opt for legal advice/service is to eliminate the possibility of mistakes. We want to make sure that everything goes smoothly, BECAUSE WE DO NOT WANT DELAYS. A lawyer's role is to check all the documents and ensure completeness and correctness PRIOR to filing, so that the case will NOT be blocked by an RFE.

Now you and I and our two Michaels are actual walking proof that attorneys could really harm rather that facilitate smooth sailing of a case. But what can we do? We only wanted the best, and at the time we were starting, it seemed that to pay extra to an "expert" will get us worry-free. Now we cannot undo that, it is too late.

Let me tell you what Mike and I did (and it sure worked fine):

1. Be extra nice to your attorney. You probably hate it, but really, you are trapped in that situation where you and Mike will have to kiss your atty's butt. See, if you diss him/her, you won't get his cooperation, and you will end up waiting longer. So just play nice to the atty and politely "request" him to send the ORIGINAL RFE to Mike's address via express mail, and tell him that you will just mail the RFE compliance directly (from petitioner to CalifServiceCenter), to save time and money.

2. DO NOT SEND THE RFE BACK TO THE LAWYER! Once you get the RFE and have the documents ready, send it directly to the CSC using express mail, but there is something you need to write on the envelope. I will ask Mike tonight, ok? It is very important.

3. at this point you wait again. But don't worry, CSC will pick up and resume quick, you'll see.

Ok now for the possible "things" they ask for in the RFE. I say "things" because it doesn't necessarily mean major documents. Check if you have submitted the documents lised here: http://www.visajourn...mp;page=k1guide
If you have, then and RFE could probably be as little as a missing signature, or, in our case, Mike didn't have passport-style photos (which is a slap in the atty's face because how can he miss this? we even asked him over and over about it. he said it's not needed. darn!)

Gracie, do stay prayerfully positive. It will be an exhilirating feeling once your case lands in the NVC. From then, things will be flying, they say.

For now, just be nice to your atty (yeah, it sucks!) to just get that RFE. After that, you don't ever have to communicate with him anymore. No use firing him or telling him of your complaints - it will just give you a headache.

Hi Gracie - This is Mike I'm Graceys hunny. I've read your correspondence with Gracey and I just want you and Mike to know that if done the way I'm about to outline that your case will not on average be delayed more than 10-12 day's. CSC seems to be a lil quicker with RFE's than VSC. As you may or may not already know attorneys have no control over the speed at which your petition is processed once it leaves their office and is sent to the service center. In just about every case they slow down processing for several reasons. Here are a few pointers concerning attys to keep in mind.

Attorneys rarely prepare the petition themselves. This is usually farmed out to someone else on their staff, usually an aid that lacks personal or professional experience and frankly doesn't have the care necessary to ensure everything is prepared correctly and the attorneys often times do not follow up on it prior to it being sent to make sure everything is correct. When you pay an attorney to prepare your I-129f (K1) that is all you are paying for. In other words all they are doing is putting all the documents that you sent them in an envelope and sending it to the the CSC. Immigration attorneys are necessary for complex immigration cases, but not for a simple I-129f petition. We had to also learn this all the hard way.

I could go on and on about attorneys, but none of this is going to help your current situation. Here is what you need to do starting NOW.
Ask Michael the first chance you get if he ever signed a release for all mailing notices to be sent to your representative (attorney). Just about always attorneys will make you sign this. So more than likely your RFE will be sent to him rather than you. There are two things that we want to accomplish before we can tell the attorney anything nasty. First we must get the original RFE in hand (a copy might work, but don't chance it). Second we need the original approval letter (NOA2). This means since the attorney will likely be the one getting both of these you have to be nice to him and try to undo any past negative threats you have made against him. Remember your fate rests in his hands along with the USCIS, NVC, CO, ect.

If you do not receive the RFE in a reasonable amount of time (3-5 business days) then it went to his office and we must get it! So politely ask him to overnight mail it to you. We don't want to take a chance on him sitting on it for weeks before he sends back whatever it is they are needing, not to mention the time and money you loose mailing it back. Now one thing I just now thought of is Mike is in the gulf and I can't remember if there was anything on it to sign, but I don't believe there was so ask the attorney this before he mails it out to you along with what it is they are needing so you can have this ready to send to the CSC the same day you get the RFE from him.

IMPORTANT: Mail it out next day mailing service keeping the tracking info and write on the envelope using a magic marker in big bold letters ...."RFE REPLY ENCLOSED" along with your CASE RECEIPT NUMBER.

***THIS DOES NOT HAVE TO BE MAILED BY THE ATTORNEY***


CSC will pick your case back up for processing in an average of 12 days from the date it was delivered to them. The online case status page has not been working properly at all lately so don't rely on this. Call USCIS often to check if it has resumed processing. Here is a trick I have learned after many dozens of calls I have made to them. Mike needs to be the one to do this if he is able because level 2 support will not give you the info you need. After you get the option menu press (1) for english (2) for question about your case (3) for NOT knowing your receipt number. Option (3) will get you a level 1 support person. This first level of support is useless all they will do is read from the online case status page which I'm sure you have read a million times. Mike will need to REQUEST to be transfered to level 2 support. I usually just tell them that their online case status page is not dependable and want to be transfered to an officer (LV2)....This always works for me.

Once they resume your case you will be approved in no time. My best advise is learn everything you can from the forums on VJ and make friends here on VJ. Your support group for July filers is located here

Hello Fello VJs,

I would like to ask your advices... Please help us. The last time we had the RFE was November, 14 and we're asked to submit additional evidence. The documentation needed is the Original divorce paper from Japan since my fiance was married and was divorced in Japan. Now, the RFE needs to be completed in after one month but our lawyer is so slow working the papers. Just today I got an email from the USCIS that we are denied... I am so mad, sad and broken. I could not understand why these things happened.

Is there anyone from VJs who got this problem too? What's the best thing to do? Can we still asked for an extension so we can continue with the application or we need to start from the beggining (which I hope not)? We paid our lawyer a big amount so he will take care of this but he's no good. He's just collecting our money and doing nothing. sana maaga ako manganak...kasi pag hindi magpa induce ako sa thursday or friday before may due date...


naku nahihirapan din ako matulog..sumasakit yung left and right side ng ehem ko...specially mag change ako ng position..

dec. 29 last ultrasound ko...yung baby ko 5 pounds and 14 oz na siya...sabi ng ob ko..hindi maliit at hindi rin malaki baby ko...im looking forward for a normal delivery...

hay sana sa akin normal lang delivery ko...at ang tagal ko pang maghihintay kasi january 31 pa sa akin...ang layo pa...sana healthy din si baby, and im excited na makita ko na siya...iniisip ko tuloy sino kamukha niya...sana yung ilong niya hindi katulad sa akin...sana hindi naman lahing pango..heheheh...

pumunta ako sa doctor yesterday for my check-up... thanks God ok naman baby ko.. so next appointment ko may next ultrasound, hay i can't wait na makita ulit baby ko..sana ok lang siya...

im nervous and excited for my delivery...hopefully wala problema at normal lang yung delivery ko...plan namin if hindi ako manganak before my due date January 31... magpa induce ako...ayoko mag overdue...

Another check-up ko naman tomorrow..sasabihin ko talaga sa ob ko..sana may ibigay siya sa akin para mawala na itong pain nararamdaman ko ngayon...naku ang hirap pala maging buntis...at sumasakit pa yung ribs ko, at hirap huminga, nakakapagod...

hello mga mommies !!


kakauwi ko lang galing doctor for my glucose exam and regualr check-up... so far everything doing good sabi ng ob ko....so start narin ako every after 2 weeks yung check- up ko...binigyan din nila ako ng h1n1 shot today...naku ang likot na ng baby ko kahit sa araw at gabi.....

so far, natapos narin namin yung nursery room ng baby....mostly ready na lahat ang mga kailangan niya...


ito yung nursery room niya...ako ang gumuhit, din yung husband ko ang naglagay ng paint...

Diyan namin nilagay ang crib...

Hay naku...glucose exam ko na next week.. sana wala problema...palagi pa naman ako kumakain ng matamis...
Nakakapagod yung baby shower ko..at last natapos na...marami mga gamit ang ibinigay nila sa amin...like bottle warmer,wipe warmer, boopy pillow, onesies,sleep n play, snow suit,car seat,burp cloths,teether,warm blanket,recieving blanket, damit, diapers at marami pa iba...
