oh well,my forth of entry too was chicago...i met one filipina at Japan airport while waiting for my flight to USA..she is on K1,on the plane i let her sit beside me coz i dont have seat mate...on the immigration,she was falling on line next to me,i heard the IO said to his co Io,"another mail order bride",she refered to my new friend coz she is handling the xray envelop (mine i put it on my luggage)...thats weird,that IO is TSISMOSO! she made pass the IO fast,not much questions asked to her....infact i waited for her for only 2 minutes and we proceed to get our luggage for our next flight.
but i was left behind her coz i need to go to other IO for immigrant visas.

I agree with you, Diana. There are two scenarios:

OP came to USA with K-1 visa knowing that she won't be married to the petitioner. If this is the case, she will likely to be denied.

OP came to USA to marry the petitioner. But after arriving USA, things did not go well, OP did not marry the petitioner, she found another man, got married and went back to her home country before K-1 expired. If this is the case, she will be issued visa.

Just my opinion.

The CR green card - which I have in *my* hands - expires in a few months. That *************************************** cretin has no hopes of ever re-entering the USA, if I have anything to do with it. )

She *attempted* to come back to the USA - but was *DENIED* at the embassy. I've made them well aware of what happened - and that I took responsibility for my problem, and did the right thing.

Basically, tell the truth, and you don't have problems.

Disregard the medical date, if you have it the same time as the interview date. As long as you have the appointment letter, you can go for the early medical at St Lukes (SLEC).

i am on CR1 visa and i am scheduled for medical and interview on Dec 19 2007.. but up to this time,i still didnt recieve my packet but my husband in USA had already last week.
my questions : why they scheduled my medical on the same date of my interview?

Congrats..but i have a quick question. Who sets up the medical? Does NVC or the embassy? Is the medical something that is done during the NVC process? I've read about the processes at uscis (noa1, noa2) and nvc (aos, ds-3032, ds-230) but when should my wife do the medical? Do I need to set this up for her, and if so when? I'm a little confused on this point. Thanks for any help you can give.

the NVC will send her an appointment letter for medical and interview...the medical should be done at least 1 week b4 the interivew and or earlier if she wants and she will need her medical to be done at St. Lukes.she need also need to pay for her medical.
its true that CR1 sometimes are really quick...same what happened to mine,NVC forwarded my papers to Manila end of Nov 2007 and i had my interview last Dec 19 2007..but coz of NSO verification,i am waiting for my visa til now.

She doesn't have a letter saying she has custody, just a divorce paper. Her daughter received a K1 a couple years ago when I did my wifes fiancee visa. Her daughter didn't come with her at the time which is why I'm doing the I130 now. Her daughter has the old unused visa. Maybe I can just send a copy of that?

Anyway, her daughter doesn't need parents consent to leave the philippines. The social works department ammended their laws


on my son's case,NVC asked me a letter of consent from the biological father letting him immigrate to USA with me and or a court order that i have sole custody...its my US citizen husband who petitioned him as his stepfather..and since i dont have any court oders paper so i asked the biological father to sent me a letter of consent,its not notarized but it was handwritten and lucky that NVC accept it and my son interview is on Dec 22 2008.
even she was already granted a visa b4,we still need to go through the same process..to start all over again.
anyways,just asked for a letter of consent from the father and she will be here in USA soon.

Well, there are 2 paths to follow while being processed by the NVC.

1. The first one is send the DS-3032, which will generate the IV Bill (the one you just received) and once they process this bill, they will send you the DS-230.

2. Path two, which has nothing to do with the other path, is that they send you the AOS bill and once they process it, they mail you the I-864.

When the NVC receives all of that from you, they will take about 2 weeks to complete your case and then assing you an interview date. Your son will then have 6 months to use his visa after it has been approved.

Based on your post you still have about 4-6 weeks to go at the NVC because you still have to pay the IV bill and send them the I-864 (AOS) and DS-230 forms. Then add another month for the NVC to process this, complete the case and get the interview, so your son will probably get his visa between October/November, he then has until April/May to use it. So I think you'll be fine time wise.

Form I-864 Affidavit of Support (AOS): The I-864 AOS is required for visa applicants in the IR, F and certain E visa categories complete with copies of your sponsor’s latest U.S. Federal income tax return (ITR) and wage statements (Form W-2s). Please note that your petitioner must provide an Affidavit of Support, even if they do not meet the income requirements and even if a joint sponsor’s Affidavit of Support will be providing all of the actual financial support.

The I-864 AOS is NOW VALID INDEFINITELY ONCE IT HAS BEEN SIGNED (this is a change from the previous requirement
of being valid for one year). In other words, applicants will no longer need to submit a new I-864 AOS or new tax forms due to long processing delays between the date of the signature of the I-864 AOS and the date of the interview.

Additionally, petitioners (or joint sponsors, if needed) filing an I-864 AOS are required to submit ONLY ONE YEAR'S TAX RETURN, THE MOST RECENT AVAILABLE AS OF THE DATE THE SUBMITTED I-864 AOS WAS SIGNED (this is a change from the previous requirement of submitting tax returns from the three most recent tax years).

The actual signed I-864 AOS must be an original copy. However, faxed copies of tax returns are acceptable. The tax return or copy should be signed.

Call the embassy and they will tell you the answer..i also didnt recieved my packet 4 1 week b4 my medical sched. but then the embassy told me to pick it up at the hospital on the day of my medical...but b4 it happens,NVC sent me the packet 4 few days b4 my medical...so just wait and they will send it to you and if not...ask ur husband to send his copy to you!

My wife only had the Affidavit of Support or Form I - 134 notarized. All other documents need not to be notarized. She then mailed it to me thru Fedex, where it was also notarized. You also need to secure a copy (from your husband) of the most recent Federal Income Tax Return (ITR), In my wife's case 2007 W-2 Form and ITR Form 1040, photocopy them or let him fax them to you. The CO asked me for these documents in my interview. Bring his employment letters too.

Just keep that form, you'll need it again when you change your status in the US. I still have to undergo that one so I'll update you with that. The NVC is also responsible for the change of status process. Your're entering the US as a Non-immigrant and your VIsa is only valid for 2 years, so before that expires, you'll have to change your status to immigrant. good.gif

It's not important whether or not the letter shows his hourly rate, or annual rate. The employement certificate is just proof that he is currently emplyed. The most important thing is the AOS (affidavit of Support) that has been notarized, his recent ITRs ( Income tax returns), and W-2s.
