She will have lots of problems if she is still married. I doubt the USC understands or knows this. They are not married, she can't legally marry someone while being married. Your friend needs to get a legal divorce which will probably need the help of the USC.

She is not single, she is married. Just because she didn't register the marriage in the Philippines/ did not file AOS does not mean she is/ was not legally married to husband 1. There are three possibilities here, none good but some better than others:
- The US ex-husband got a divorce from her in-absentia. If this happened before she got re-married in 2010, she is ok. She will be in some trouble for not declaring the first marriage on her spousal visa paperwork, but she can submit a corrected copy and copy of the divorce papers and while they will give her a hard time, she will probably be ok.
- The US ex-husband got a divorce from her in-absentia, it was final after she married husband 2. That means she was not free to marry and thus the current petition is invalid. She needs to cancel the interview, admit she made a mistake, get properly married to husband 2 and have him re-petition her.
- She is still married to husband 1, no divorce was ever finalised. Big trouble for both her and husband 1.

= essentially, she needs to get in touch with husband 1 asap and find out what the story is. She should NOT go to the interview untilo this is sorted, she will be slapped with a material missrep which is a lifetime ban.

Yes she is going to have trouble. Whenever they find out that she is already married to someone else, she will be banned from the US for life. There is no statute of limitations on that, so it could be now, before he gets her visa, or in 2 years. She will be deported and never able to come back the the US.

She needs a good lawyer, and needs to get divorced to her old husband. Bigamy is a crime in the US.

i mean no adjustment of status and she is single here in the philippines she got cenomar but she was married last 2010 with the petitioner right now there i 130 was approved... is she gonna have a trouble they have a baby already 1 year 5 months old

hi guys it's me again, i have a girl friend she meet a guy online before and they hook up the guy visit her here in the philippines and they are boyfriend and girl friend to make the story short the guy petition her under k1 after couple months she was approved in july 2006 then she leave philippines august 2006 when she arrived there in USA they went to las vegas to get married before the the k1 visa will expired....but then too bad they didn't get along well they have fight she always caught the husband dating another girl here in the philippines trough online where she meet him and then she got feed up after the hubby never stop what he's doing so she decided to come back here in the philippines last january 2007 even though the k1 visa still good...she don't even know if their wedding is valid because they are not doing any papers...so when she is back here in the philippines she meet another guy USC and they married over here last 2010 and they got 1 baby and they are filing the IV too and it was approved and she will having an interview sometime this year she is kinda a worried what if she will get denied on her visa because of that failed marriage in the states? is that gonna be a problem??? the ex hubby in the US is already married and got kids too....


so i have no idea i can't answer all her questions..that's why i'm asking for your help

Is it true that aside from the medical fee ($213.35), visa app fee ($131), and visa delivery fee, we also have to pay for the documents verification fee which is 650php? If so, where did u pay for it, and to whom did u pay it for? Are there any other fee I that i don't of?

i've didnt see any atm machine inside SLEC when i had my medical as far as i can remember.but there are atm machines nearby.good luck on ur medical good.gif


oh that's really bad! Hospitals here in Cebu have at least 1 atm machine inside the building and the big ones have 2-3 atm machines.

Well some says they got theirs within a week and some for a month or so. That's exactly why I started this topic, to know which way could I get my visa faster?


It's a case to case basis, some got it in a few days, weeks, or mos. I talked to the Air21 agent inside the USEM and he said that USEM usually releases visas 1-2 working days after the interview, and the Air21 delivery takes a day. My visa was delivered 3 days after my interview. I was never asked if I wanted mine picked-up or delivered. BUt I think they wont bite u if try asking.

Expect a hard copy of NOA1 in the petioner's mailbox. With that a reference number is given and then u can view the status of your app on the uscis website.

She would like to apply for a work permit so she can work during the time until we are married. If I am understanding this correctly, she can't file for an EAD until she files for an AOS, and she can't file for that until we are married. Am I understanding that correct?

Once the app is already forwarded to NVC, the case status is not updated online anymore. My fiance had to call NVC to get our case number. He also received a letter from NVC informing him that our case was already forwarded to the USEM.

If both of u really want to start the processing now, better if u find a secondary sponsor since during the USEM interview u will be asked to submit ur fiancee's most recent tax return and u can't be sure if her would-be job with the better earnings will already be reflected on that tax return by the time u will be interviewed.

In my case I put my ID number. In Venezuela, all the citizen must have an ID (is not the license) this ID has your name, photo and date of birth. Also has a number and is one for every citizen. This is the number I used

Hi Everyone,

I just became a member today and already i feel for everybody that has posted topics on this site and it warms my hart to read about everybody going through what i am going through.

So anyways, I am an American National that fell head over heels in love with my beautiful pinay wife. I met her 1999 on vacation to my mother's homeland. My vacation was supposed to be for only 3 months but it ended up being 3years! We got married in 2001. I have 2 gorgeous angels that i am so so so in love with!!! in 2002 i decided to go to the US after realizing how difficult it was for me to make a living and support my family. I petitioned my wife and waited and waited and waited after a year of not being able to see my family i left for the philippines and have been here since 2003 teaching english to korean and japanese nationals. I ended up neglecting my family's petition. to make a long story short 2008 rolls along and i receive a termination letter that blew me away. Now im determined to give my family the american dream! Im not sure where to start and i really don't want to be away from my family for another year or two.... Any suggestions to help me expedite getting my family there?
