I agree that they would not know unless it has already been disclosed BUT If one day they do find out that you have been charged in the past even as a Juvinelle. IT can go badly for you.

If you are interested, Call the court house again daily if you must, then if all else fails explain to nvc that you are waiting on the files so this will not slow your case down. Just keep calling and bugging them :)

Thank-you! These are the kind of answers I was looking for. Yes I was arrested/the whole nine yards. But it isn't showing up in the CPIC check (with just the name). The head officer at the records branch says all that info was destroyed. What do I do now? I have no problem getting the check with fingerprints, but if it isn't going to say anything, what do I tell them? How do I obtain records that should have been shredded? Expunged means just that-expunged. Non-existent.

The other question I had was can I put the check I already have in the packet 3 and bring the fingerprint check with me to the interview or, do I not send in Packet 3 until I have the fingerprint police check?

I was charged when I was a teenager (conditional discharge) and my files were expunged at 18. I called the local court house that I had been sentenced at and told them I was in need of court records from my juvi charges. I did not know my charge dates so I had to contact my old lawyer who looked them up for me. I had some trouble with the first lady I talked to at the court house but eventually she told me it would take 1-3 weeks to retrieve the files from Toronto (where all the old files go). About 2 weeks later she called to tell me that they could not find one of my records and instead she ended up writing me a court document stating my charge ,sentence etc. SO in the end I had one court record and one letter. I also got 6 copies of them :P

They may tell you your files are not obtainable to you because of the new Youth Justice act but just tell them they are your records and that you have Identification to pick them up. Also mention that the US does not consider expunges/discharges/sealed, they still see it as you had a record.

I hope you get them easily.

Here is a question and I am not trying to pry but were you arrested? charged? sentenced?

I am asking because As I said I would get the fingerprint version however IF you were not then you should be ok with the regular one.

Not to scare you but if you did have a record, were charged, you may also need the records. That is not a fun time, I had a charge from the age 14 and had to go around in circles to get what they needed. (I received a RFE for the court records).

I am sorry to tell you this but Your lawyer is correct. You should go get the fingerprint one, I know you have no record. Neither did I but IF you Have ever been in trouble even as a Minor you need a Fingerprint one.

My bag was about the same size, as long as it is open they usually will let you through no problems. I did take all my stuff out a few times and was sooooooo glad I had the bag with me lol I brought everything but the kitchen sink (and I seriously thought I might have needed more).

I have to agree with everyone , The one way ticket is probably what did it. I think you guys would have been ok if you had sent
her the money for a round trip. I flew from toronto to Maryland more than a few times and I know from searching for the best
deals one ways tend to cost much more than round trips... (I even went crazy and took a one stop trip just to save some cash.)

I read all these stories about people being denied and consider myself extremly lucky because when I flew I never had any ties
to Canada (at that point I had not found VJ and we were just dating). When I/we started driving across I still did not bring
any ties. Only when we actually filed the I130 did I find out that I needed to bring stuff with me. From there I brought a
letter from my mom staying I stayed with her, bank statements, filing papers for the spouse visa, and any custody papers.

I think that it will probably be best if you file the k-1 and just visit her for now.

I know for sure that there wasnt any at that time because I drove up to North York on Boxing Day before the snow started to fall here in NJ. I didnt see any snow from Dec 26th to Jan 3rd when I drove back down.


That sucks lol ... In 2008 My husband drove down in the horrible snow storm. We avoided going back to canada at xmas last year to avoid the snow and the snow stayed away lol. Pa and NY seem to be the worst to drive through at that time of year.

Speaking of snow.. I was surprised at first at how little it snows by my wife up in North York/Toronto. I live in North NJ and we get slammed by snow almost every winter (especially this winter and last one). We got a 30" from a single snowstorm (on Boxing Day) and I'd be surprised if they got even 3" off of any snowstorm this year.


North york doesn't usually get "too" bad but i do recall walking in some pretty deep snow piles the year before last. However my mom did tell me they didnt have much that stuck around at xmas.

Hi everyone,

I've been debating whether or not I should post this, but really, nobody in my life really could understand me like all of you. You've all been through this immigration stuff, or are about to, and I guess some people might relate.
The first thing I'd like to say is that I am happy with my husband, and in the grand scheme of things, I'm glad I moved here so we could be together.
But...
Man, some days I hate it here!!! One of the main thing is that I've been looking for work since January, only had 5 possible interviews and 2 that were worth going for. I was very naive thinking that since I'm canadian, people wouldn't be prejudice, but I've come to the conclusion that people here are prejudice. I can understand that it would be a leap of faith for them to hire me since all my work experience has been in Quebec, a place that for some people here seems as far as Botswana (no harm intended). But I was hoping for a little more open-mindedness... I'm 27 years old, my savings are gone, and I don't have a job. I feel like the biggest loser. I would have such a great job back home! All my friends have either houses, families, nice cars, a LIFE basically... And here I am, at home, doing not much, trying the best I can to find work. Seems like the only thing lined up right now is making biscuits at Hardee's... I could have a job tomorrow, doing retail, but I've kept two jobs while going to school so I wouldn't have to EVER do retail again. Here I am though, back to square one!!! So frustrating!!! And it's not like I can talk to my family about it, because I'm sure that in the back of their mind, they're waiting for this to happen so they can tell me "told you so!" And I really don't blame them!

Second thing, Chris and I are living with his parents until we can buy a house. I don't see the point of renting something for 1000$ a month, when we could be saving money to buy our own place. Plus, we have a dog, and a lot of places don't accept dogs. His parents are great, and I can't say that enough. But at the same time, I want my OWN place. I don't want to have my life limited to a room, and feel like I can't really do what I want because it's not my house. It gets hard on us, and it affects several things of our married life (read between the lines...) But that's not gonna happen until I find a job!!! (catch 22, anyone?)

Also, I'm having a hard time dealing with some people here. I don't know if it's specific to the south, but people here are kind of ignorant (again, no harm intended, I'm venting here). The way women are treated here makes me furious! And some women make it worse for themselves!!! I feel like I moved back in time to 1984! And most people are pretty racist! And this f*cking mentality that because "I'm American" I'm entitled to cheap gasoline, and who cares about the environment anyways, let me throw my trash out of my car window... Oh and let me go to the TT bar for lunch because women are meant to be looked at and used and do my laundry and clean my house. I feel like I can't have a meaningful conversation with anyone without it going back to Jersey Shore after 5 minutes...

I miss home like crazy, miss my people... I don't really have any friends here that I met on my own... And some of Chris' friend's girlfriend worry to much about their nails and hair for me to give a cr*p... I wish someone would have told me how hard this was gonna be. I thought it'd be easy to adapt and find work... Turns out I should have saved enough money to pay my bills for like a year and a half! What an idiot I was!!!

awe, You seem like you have a ton on your shoulders right now. I can understand how you are feeling and totally get the catch 22.
I myself have been looking for work for 5 months now since the week I got here, now I am 4 months pregnant and I am pretty sure not only will I not get the Job because I am not "American" but also because I'm going to really start showing soon. I too thought that cause we are Canadian finding a job wouldn't be that hard but out of the last 5 months I have had 4-6 interviews 3 of which went great until I said I was Canadian. I am pregnant and live in a tiny apartment with three dogs,my husband and our son,we really need to get a house sooner rather than later. BUT we cannot If I am not bringing in some sort of income. Hell I have applied at every fast food place possible and still nothing... If they can hire a 14 year old kid, why cant they hire a 24 year old adult? how much more experience can a damn 14 year old have?

I also understand the "friends" situation, All the gals i have met so far have their noses pointed straight up in the air, constant nails,hair and shopping. My husbands friend from work kept inventing us over for a BBQ but also ended up canceling. Finally we ended up their a few months ago and it seemed great, his wife was nice but something seemed a bit off. When we got home I found out that she is the "controller" type, actually in most cases I would say hell yes to that but she was like "monster" in disguise.

I miss Canada so much, I miss the few friends that I have and most of all my family. The worst part for me was I had no clue that I could sponsor Chris to Canada without any Income and that was mainly the reason we went from the Cr-1 because I thought I had to have a large income to get chris to Canada. Chris had told me from the start that he would gladly move to Canada, he use to go to his parents cabin in rice lake when he was younger and loved it. Now Chris has an good job making more money than he ever has (still not that much lol) and I cannot see myself just picking up and moving back to Canada until I am a Us citizen.

I wish at times that this all was easier on us. Err lol

Do not beat yourself up about not having a Job, I have my days where I feel like a complete failure because I have found nothing and worst of all Chris does not realize that its not that easy to do.

I don't plan to hire a lawyer for documentations/filing. I went thru the US naturalization processing without one and I was just fine.

I might consult on the extension of stay while CR-1 is being processed..


I think that trying to get a b-2 visa is a waste of time and money lol

Also make sure she has some good ties when she is planning on coming for a 6 month period, its legal to come for that long but I am not sure how a Poe officer will think. Atleast she can tell them you are currently waiting on a cr-1 petition.

What do they charge you to withdraw money from your CIBC account, always heard theres been a pretty hefty fee associate with using your bank card in the states.


I looked up my cibc account I took out 390.00 US and is was 392.65Can from my bank (think we were pretty par at the time) then I was charged a 3.00 teller charge. Thats it However when you go to a bank machine you can usually check your balance before taking anything out that will tell you how much you are losing on the Trade.

Another quick question for ppl who have already crossed, my last check from my current employer will be deposited into my account after I have crossed already, I bank with CIBC, any suggestions of what the best way to get it into US funds would be? I guess I could transfer it to my paypal account then into my fiances account but I'm pretty sure they have a high exchange rate. Any ideas?


I go down the street to the corner atm(MTB bank) and take out the money from my CIBC account using my bank card lol. My family still occasionally sends me some cash so its the easier way for them and me. Pretty simple.

How long does Montreal take for processing 221(g)? it has already been more than six weeks since I mailed my passport and document. DOS says they still do not find any record. Does Montreal provide any other status information before the final approval for example pacakge is received etc.?

Unfortunately it could take a few months for them to just open your package let alone issue the visa. I know that the wait is usually in between 6-16 weeks. Im sorry but I suggest you keep calling dos and try your best to be patient. I know it sucks but really there is no way to speed up how long it takes for Montreal to open the mail in the mail room... WHy? who knows lol

The I-94 is attached to the passport before you receive the green card, correct? I should be asking for this at my POE?


Yes the fingerprints are done at the Interview but when you poe they do a quick one using your pointer finger I think lol I cannot remember.
The i-94 should be given to a k-1 , stapled into the passport when you do the poe so make sure to clarify that you got it.

You mean in case they dont give them back or in case they haven't been forwarded to the Consulate? Ontario birth certificates take 6-8 weeks to come through the mail so its not like I would be able to get these before my interview in 3 weeks.


Not if you order online. Usually takes 5-10 days at the most. When I ordered In Canada I had mine within 3 days, when I ordered from The United states It took 5 days. (I did not use the premium service)

Thought I would share my border crossing experience last night. I have been crossing the border a couple times a week to see my husband, and he does the same into Canada. I have never had an issue. I carry all significant ties to Canada with me as well as paperwork from our CR-1 journey. Last night I was told that while my petition is pending I am not allowed to be crossing the border. He went on and on about how they would think I was immigrating to the US illegally. I explained with full confidence that I have been crossing into the US since we have started the immigration process and I have NEVER had any tell me that. As well he kept repeating "while your petition is pending" and I kept correcting him that the petition has already been approved and I have all the paperwork to prove so. He then says "well, someone may deny you enty based on your pending approval, but have a good night." He hands me my passport and I leave.
The thing that really pisses me off about this is that he is practically lying to me. I know, as most of us do, that you are allowed to visit your spouse while the immigration process is in proceedings. If this was such a problem: 1) pull me in for secondary questioning, 2) not ONE border guards has said this to me before, 3) why just let me cross then, if this was such an issue. I have actually had other border guards say "its great you are doing it the right way" or "it must be hard living apart" then you have this guy.
I realize that he was either trying to trip me up or just intimidate me...but it makes me more anxious to finally have this process over with and not having to deal with issues like this anymore.

First off hes wrong there is no rule about visiting your spouse through the process :bonk:
However They do have say whether you get across or not and depending on what kind of mood they are in it is possible that they could deny you at any moment. (stupid). I do not think many people end up being denied entry but it does happen to the best of us.

Awesome congrats!! We were going to POE today but I had an accident on the way up with the truck/trailer that I borrowed to help move all of his things. It's a long dramatic and tiring story, but I'm ok. Going to try again with a different truck tomorrow (pretty much wrecked the front end of the one I borrowed >.< ). Hopefully we'll get better results this time. :)

Nope the cr-1 visa and stamp are valid for one year so you can use the i551 to travel back and forth till you get your greencard.

cr-1 is a multiple entry visa thingy lol

Correction...... 3 years for all spouses... you must live and be married for 3 years to apply NOT five.. Ir-1 and cr-1 is not what matters. The only difference is a cr-1 will have to ROC after 2 years and an Ir-1 does not have to.

Unfortunately your never know lol sometimes within days sometimes after you already receive your visa. use the reference id from the canada.usvisa and use it at dhl.ca. This site usually updates.

May take a few days though
