How far is Medisys in Montreal from the US consulate? We are coming from Alberta for interview? It would be hard for us to go there for Medical and come back again for interview. I was wondering if we could be intervied the same week as the actual inteview date?


people sometimes do the medical 2-3 days before the interview. Montreal does 2 day service, say you do your medical on Monday you can pick it up Wednesday. Just realize that you will have to be in a hotel for at least 3 days.

My experience with court,
To be honest my experience with court was rather easy and probably not everyone's experience, My ex seemed to think if he didn't show up they wouldn't do anything... Wrong. I only went to court once when I did the "custody" as he didn't show up and they put him in default. Not to mention he called 5 minutes before the actually court hearing and told them that he didn't have transportation and that he was served only days before...tsk tsk tsk When you are served they show the date and signature lol. I waited , waited some more and then finally heard word from my lawyer that the custody order had gone through. My experience with court in this one was easy as pie, I saw my lawyer more than anything. On this court order I have sole custody,permission to travel for vacation outside of the country, Permission to get his passport without a fathers signature, Visitation when i choose, He cannot remove my son out of the city I live in without a note as well as call or interfere in my raises of my child, and finally child support which I did not even want because he is broke. I have seen 120 dollars in 2 years and he owes me something like 4500.

Getting my court order amended was much harder. I got a new "classy" lawyer (damn expensive, probably could have used a less expensive one). We wrote up a huge file,information about my husband and his life, what he could provide for us, what my sons life would be like, then stuff about the ex from face book pages,Notes from friends,emails,lack of visitation. From there we had to find him (we hadn't talked in almost a year) That was fun,searching around for a person who you would rather not find, calling old friends whom you would rather never talk to again, and then last but not least hiring a private detective to find him.
He was served and my court date was set, when I went to court they automatically changed the date to a few weeks later as you have to give a respondent 30 days. My lawyer had never done a case like mine and somehow thought you only had to give 12 days notice. I went to court 3 more times and basically just sat in the court waiting area, on the 4th time the Judge wanted to hear my case directly from me and ask me some questions. Most were about my plans for the future and my husbands plans. By then my son was calling my husband Daddy which was probably a good show of the bond between them. The judge seemed to be quite content with what I said but didn't give a answer right away.I waited another 4 weeks and was told me were granted the order.. MY life began LOL

Court was easy. The waiting sucked. I am horrible at telling stories so If you have a direct question or questions that i can answer let me know lol . I wish you luck. One day we will file for adoption and that should be the really Fun part lol..

Same thing for my case, I had to go back to court and get the phrase "Allowed to take <child's name> out of Canada to live" or something like that, and I too had full custody.

I think they (the consulate) take the business of child custody, parental kidnapping, etc pretty seriously nowadays.


I have sole custody and although I could have asked my ex to sign a notirized letter (He wouldnt even sign for my sons passport 2 years ago)
I figured I would go straight to court and get a order to do so, I have a regular court order for sole custody along with it saying some pretty awesome things like they took his right away to sign for a passport etc. Then They added the "order to move said children to the United states or any other place".

My lawyer was extremely expensive though, so If the dad is cooperative I would say that could be a great option otherwise go to court. You can probably get a lawyer for alot less then I did. Mine cost 6300.00. In the end he was worth it, Although I Think I did most the work outside of the courtroom.

My 4 year old son had his first Hep b shot from his family doctor, I had to go to the pharmacy and buy the twinex vaccine to get him to do due to them not liking to give the shot to children under 12. My son just got his second shot yesterday at the maryland health department, one more to go.

Nope you would go to Toronto to have it done. Nice people there. I came from Oshawa on the train to toronto for the medical. I am pretty sure they will still want to see him but I do not think they will do anything , let me check...

All members of your family listed on your appointment letter require a medical. This includes infants and children. Children under 15 are not required to have blood tests or an x-ray.

Thanks guys its just all so overwhelming right now. Its nice to not have any expensive surprises etc. The fact the kids come with me to the interview was kind of a shock. Montreal is only 3-4 hours away but who knows what my 4 yr old will say..i can see a serious toysrus trip after for best behaviour..and ill def see if my fiance can join us.

its the medicals x3 but the $50 mail fee and i guess they wont mail all 3 for 50..lol that gets me...

and i got passport photos for the g-325 done so can i use the extra for theset of 3 ill need or do they all have to match? the place today i asked about the 3 and they only sell in 2s so thats 28 x3 there..lol the little stuff is annoying..

what do they do at the medical? how invasive is it? i hate drs..

Montreal is quite boring for a children, mine was running around hiding under tables and constantly staring out the window , he also "pretended" to read a bunch of booklets (he cannot read yet).

The mailing fee for the medical is stupid so I decided to pick mine up a few days later due to being only an hour away.

At the medical the do a chest xray (for you not children) blood work (for you not children) , they check your lungs, heart,eyes,mouth, and then the doctor touches your stomach. then a nurse comes in does a breast exam and peeks at your groin area. The children will get a much faster look over more like a regular check up at your family doctor. They will go over immunizations and that about wraps it up.

hello - where are you located in Canada? That will determine where the interview is. I believe the answer is yes to medicals and attending the interview for both children (someone correct me if I'm wrong). You fiancé is not required to attend the interview, although he can for moral support. Many folks have not had their fiancé attend (due to work or scheduling or whatever) and it's fine. How it works for Canadians seem more relaxed them for some other countries - perhaps because we're in clsoer proximity and have the ability to visit our significant others more often.

Depending on where you are - you will be able to schedule your medical once you have Package 3 and before the interview...there are several p



Agreed...children will need to have medicals and be at the interview. (Why? I do not know but they do, they didn't even ask my son anything).
Having your fiance there could be helpful and definitely for support but It is not required. Mine did not come with us and it was not a problem.

Medicals and interviews are usually within a month of each other.

The "you currently have no appointment scheduled" is no problem as all CR-1's are scheduled through NVC so it does not show up on the dhl site.

However there should be application information?
did you guys pick the dhl location etc?

Mine had my name, passport number and a reference number I believe.

I wouldnt be very concerned about Ap, she will probably be fine, my only concern is that she is originally from india correct?

Ahh.. this is so nerve wracking.
My wife's interview is tomorrow and she left with my mother-in-law about half hour ago from Toronto on a bus. I hope I sent her all information required..and enough proof of our relationship and of my financials :P
One thing I hate is that her cell phone plan charges $$$ for incoming when she's outside the GTA area..so we cant talk much today or tomorrow :-/

Hoping it's a quick easy interview..and no administrative processing (She's Canadian citizen now but was in India till 2005). I hope to drive up come back down with her on 5/8.

The woman who interviewed me was definitely not a retiree; she was young. She fits the description of the lady who interviewed lots of other folks on here (nice, youngish, blonde). She seriously didn't give me ANY indication that there would be additional delays. She gave me the welcome letter for goodness sake--and said to expect that passport back "in about a week."

I'm encouraged, at least, that you did evenutally get the visa in your case...and at least it was one month and not 6...but still, not fair!

One thing maybe worth saying is that my second wedding anniversary is in one month and a few days. So maybe I'll end up with an IR-1 in the end (in stead of CR-1)? With my luck, though, I'll get the CR-1 one day or something before the second annivesary :(

Even if you get it before your 2nd anniversary, If you do not cross till your anniversary or the day after you should be able to mention it at poe and they will change it for ya. Give you a Ir stamp not a cr stamp... I almost got a ir by mistake lol dammit :)

I have yet to see anyone with an august date sorry...

I can somewhat relate to you however. When I was going through the process (cr-1) I ended up with a rfe, due to this all my friends and people with my same time line got there interviews 2-3 months before me, not to mention that when I did case complete it still took 4 months just to find out my date. I was jealous of everyone while I waited in My Nanas apartment with my 4 year old son. It was not pleasant

Well another 4 hours straight of clicking refresh.... Seeing as Montreal seemed to have closed the system for bookings in early April, that they will open it again in early May :)

At this point i'm getting sooo frusted. When i received package 4 in the mail i was so excited! We filed the inital Petition in August 2010... This is taking so much longer than i hoped. I get jelous of all you guys with your interviews in the last couple dates.

At this point even if i get a July or August, i think once i get the interview booked i'm gonna pack up my truck, my weiner dog, Mr. Weenie. And drive 3900 KM to Utah to see Matt for at least a month or so.

I sold my condo back in February and have been living with my parents since, I NEED OUT! :)

Sorry for the venting, but Matts at work so i can't complain to him...

I would definitely start calling to speak to an actually person by Monday, It shouldn't take that long for them to say that they have received the "checklist" and then should only take a few days to "case complete". Your situation is a little bit different as they seem to have lost all your stuff, someone was slacking off somewhere.

Nvc can be a pain in the ####### at times. Due to my rfe which really they didnt even need at the time , I lost a bunch of time. All my friends on here ended up interviewing months before me as I got stuck in the backlog from Montreal, took 4 months for me to just get my date. I understand your frustration and all I can say is hang in there and call to talk to a actual person daily :)

If you did not have your finger prints taken at the crossing when you entered on your CR-1 then you get a notice for biometrics because they should have taken them at the border. OR if you did get them taken it means they couldn't read the finger prints they took and they need another set from you before they can issue the green card.


I think Inky is correct.
Pretty sure someone else got a letter like that not too long ago.

They are suppose to take your pointer finger print when you poe but it is possible they forgot or that it did not take well. I remember at the interview I had to keep redoing my fingerprints as it wasnt going well.

I would try calling the number on the sheet if there is one. I am sure it will all be ok :)

Thanks for responding! So I have sole custody, but unfortunately in our final court order have a clause that says I can't move and if I want to it has to go back to the courts. So he's agreed to sign whatever so we can move (seeing as he hasn't had ANY contact with him for 4 years) it's just a matter of getting the documents back from him, he lives 4 hours away. So now i'm wondering if I should just arrange to have a notary meet at his cafe and show up there with a letter of consent and have it notarized and be done with? Instead of going back into the courts? If they really want the letter from the other parent rather than the court documents (which I read on here somewhere that they were more concerned with the letter than the court documents?) However, if he consents to the move and removing all access would that make the court move quicker because he consents to the amendments?...so many questions.....Oh my son is 14 also 15 in September which may be around the time we get an interview.

We just came back from the Toronto Embassy to provide all the originals for the I130 and they've sent it off to Montreal today, so we're rolling along and I don't want to waste too much time on this issue.


Would it be easier to get a notary to go by his place and get a sign document stating this sure, AS long as he doesn't change his mind. Montreal may also ask for an Updated "document" if your interview is awhile from now. If he is a good guy and is really willing to let you to move (I dont see why he wouldnt, seeing how he doesnt have contact) then I say go for it. he will still have to go to court If you did take him to court but the letter might help.

Which is why I went to court lol I figured there was no way he could back out if I had court papers.

CanadaConsent Letter for Child of previous marriage

My situation may be a bit different than yours...

My son was 15 at the time of our interview. His biological father had never had anything to do with either of us. I truly don't even know *if* he's still alive. He never paid a dime of court ordered child support, no birthday/Christmas cards, phone calls - nothing. My original custody document was from 15 years ago - it stated "Mother has custody of said child and father has reasonable access at reasonable times". When we had our interview, my son came into the interview room, was sworn in and the interviewer asked my son if he had any type of relationship with his father. My son answered that he had never met him, never heard from him, etc. The interviewer thanked him and sent him back to the waiting room.

Then I was told that my son wouldn't be allowed to move out of Canada without one of the following:

1) Letter from the father stating he gave permission for me to take my son out of Canada to live. That letter had to be notarized and a copy of his ID (drivers' license, passport, etc) had to be included.
2) Updated custody documents from the court stating that I had SOLE custody and that the father had NO ACCESS. (the interviewer was very specific about those two phrases).

Since I truly haven't had any contact with my ex for 15 plus years, I thought the easiest thing to do was go to court. I lived in Alberta so I went down to the provincial court house, there was a family court assistant that showed me which documents to file, what proof to bring along, how much to pay, etc.

I got all my proof together, went down to the court house, presented all my stuff and they scheduled a time for me to appear before the family court judge. I think it was two weeks later, I went to the court house, presented the evidence to prove that I had no idea where my ex was, that I had had to raise my son alone, and that now we had a chance at happiness with my present husband, in the US and that my son would benefit from being allowed to live with us in the US.
The judge agreed after reading my evidence and issued the new custody document on the spot, the clerk of the court typed it up and gave me 4 extra certified copies.

That's what I had to do.

In my case I had a sole custody court order already stating that he had visitation when both parties agree then I went and got an add-on that said. Devon M yadda has the right to move said child "dylan yadda" to the united states of america or anywhere seen fit by mother.

Not sure whether or not you're still around sweetcheeksss but i'd love to talk to you about how you went about changing your court order. That is the last thing that I need to take care of and i have no idea what i need to do and I don't want to have to get a lawyer and spend a fortune.

My son's dad has agreed to allow him to move to the US (he stopped us 7 years ago so the court order now states that I can't move out of the country) seeing as he hasn't seen or talked to him in 4 years (just 3 years after he put up such a stink when I originally wanted to move on a K1, instead USC hubby came here and we got married).

Anyway, sorry long rant, I would love to hear from some other parent's about consent letters and court order amendments. I don't know how long the process could take and getting letters from his dad are almost impossible because he can't take 5 minutes to sign something and send it back!

Anyway, any thoughts, advice or experience would be great!



Lol Now I see what you were looking for. I used a lawyer and I did not see any way around it. However you could definitely call around and find a good lawyer at a small price and then tell them that you are willing to do most the leg work. IE having him served,finding evidence etc. I did most of my leg work and yet paid for it lol. If he is anything like my ex it would be an open and shut cases. Please let me know if I can help :)

It will take some time to accomplish though, court for me took a good 6 months from start to finish so the sooner you start the better.

correct... you are looking at 9months to a year but I would definitely put the year in mind as thinking 9 months could end up making you frustrated when it turns out to be longer. My time line was about 11 months from start to finish.

Otherwise there is no reason for for taking so long.


The reason it is taking so long is because he had to send in His passport and another document before they would issue the visa. When this happens it is up to Montreal to open there mail, which could happen at anytime but they do not tend to "rush " to do it.

The Montreal consulate has had my passport and another document that they required since March 15th. I already had my interview and they told me I didnt have to travel to Montreal again. Just send your passport.
Since I haven't seen anything yet posted on the website (DHL), when can I expect to see something.
This waiting is driving me insane.

To be honest you have already been waiting almost 8 weeks and it could be up to another 8 weeks. Montreal is extremely slow paced at times and I feel for everyone that is in your predicament. I believe I have seen a few people get there passports back around the 10-12 week mark. Keep calling DOS to inquire if they have gotten your passport and/or printed it, as well as sent it via dhl. I hope that you get it soon. Good luck.

Thanks Canadiangal. You have been a great help to me and many others on here. I was just reading what is needed for montreal. What is proof of domocile in the usa? I have never lived in the usa. And support of AOS, is that just the tax papers and such he sent in with the original AOS or do we need more?


Proof of domicile in the usa is rental/lease agreement,letter from current employer,car lease etc but it is only for the us person and really is only needed if you spouse has lived outside of the US.

I think you mean for the affidavit of support correct? That would be letter from employer, w2's/tax returns or tax transcripts for 2008,2009,2010. I did Electric Processing so I just brought the original stuff and a copy of it all.

Do not get too stressed out over it all, it seems like a lot of paperwork to bring and I am sure you will be asking tons of questions but once it is over with it will feel like it was a breeze. I will be waiting for a APPROVED from you :)

CRA Sucks with direct deposit, I had the same problem a few years back, If and when you call back due to not receiving the check I would ask them why it was not put in direct deposit and if there is anyway to have it sent that way so it does not get LOST again. 14 days doesn't seem that long but I have had many things come from CRA and other companies before, child tax,tax refunds,gst, etc and they usually only take 7-10 business days at the latest. Most the time their letters are dated for a few days before however maybe it stopped for some timmies along the way... MMMM Timmies.

Ugh, that's super annoying. I would be so pissed. I'm guessing the bank has a right to take the money somehow in their fine print.

I would call and find out how long it takes to unfreeze your card from missing the payments. They don't freeze it forever once you catch up. When you know that date, I would call the lawyers office and work out a date with them. I'm sure they'll be okay with a later payment date if you give them a heads up.

I am so angry and disappointed and I feel like a piece of ####### at the same time.

Long story short I had a 6000 dollar lawyer due to my custody battle with my sons sperm donor. I have paid him off and im down to 695.55 YAY. So My Nana puts 600.00 into my CIBC account on Thursday so I can send My lawyer a large payment to pretty much pay him off.. Seeing how on friday I have to pay a few thousand dollars to refinance the damn car, I dont have the money for the time being.
Anyways I wake up this morning to send my lawyer a email bank transfer of the money to find out that my CIBC account balance is 0.00? HOW?

When I moved I had a credit card from cibc which I have been paying but I have missed the last two minimum payments and really haven't thought about it.. SO much going on right now.
Anyways The CIBC VISA department sent me to credit collections and therefor they took EVERY cent of my money, not just the two minimum payments EVERYTHING. IS it my fault YES because I should have just paid the damn minimum payments but seriously they can just random transfer money from your checking accounts. Now I have no clue what I am suppose to do , Call my nana and tell her that her grand daughter is a complete idiot and that I screwed up? Tell my lawyer that im a tard and cannot afford to pay him for the next few months.

CanadaAny Suggestions on Hotels?

I stayed at the Holiday Inn Express - Centreville (not the tacky one in Chinatown). The front desk staff was extremely friendly and bilingual. And most importantly the hotel was clean. I paid in advance for my room ($109 not including tax) and it came with a little kitchen (which I didn't asked for but it was nice to have a fridge). Like most Holiday Inn, free breakfast was served :D

Mine had a bedroom, a office , a bathroom and a kitchen. I would have loved to be there for longer :)

I talked with my fiancé again and well im stopping by my lawyers today,
my fiance said i would need a 30 day extension to get the papers to them but that i would need a time extension to bring my son since we wont be able to leave the country right away
my lawyer is either too damn lazy or really saying he cant do it , but says he cant push back the court date until that actual date.
this is cause me so much stress everytime i think about it feels like my x bf is controlling my life by a string because of my son .. i am going crazy here
i dont know what will happen is i dont go to my court date if it cant get pushed back and i dont want his dad to claim im kidnapping him when actually he or I cant leave the country until we get an advanced advanced parole ...
sorry for venting here but this sucks and never would i have thought that problems like this would arrise when i first started this .. sometimes just seemms that itll never happen the way i want it to.


I agree my lawyer could not change my date until he actually went into court however he showed up and explained that I was unable to make it back due to family issues (i was visiting the hubby and we got scammed lost some money, was the hubbys fault lol)

You could send your lawyer via email or mail a copy of the noa1 and a copy of your marriage certificate to show that you did indeed get married but are unable to leave until you get AP. Heck look up the process and print it out for your lawyer as well. Also you could Register your son in school and send a copy of that as well, heck send anything that proves you are living there happily.
Judges tend to be people to and things happen that people cannot exactly control.

So my opinion is continue as planned, get married, try for expedited AP, send lawyer tons of paperwork to hopefully get a change of court date. :)

Don't get me started on ex's controlling your life lol.. Mine was the biggest pain in the ####...Hadn't seen his son in a year but wouldn't give me custody, then fought me by not showing up for anything, then when I took his butt back to court he wouldn't tell me where he lived and would not show up again. Took me hiring a damn Private detective to find him ... Yet he tells the world he is the greatest dad and I ran off with his child... How so? I legally took him to court for two matters and he didn't show up? But I stole his son..hmm lol Errr

I think you have a chance of getting expedited AP but you likely not get it in time without the expedite. If you are not getting married till the middle of June that gives 60 days IF you receive your marriage certificate the same day. Im not sure if a court date is considered an emergency but its worth a try... Is there anyway you can get it set to another day, I remember having my court date for "custody" continued to a month later. I am also not sure what the court date is for so I cannot really give any advice

What country are you from? that makes a difference about AP.


A) I agree with Inky, If you are originally from a different country they usually (not always) will put you in AP for a short period of time. So are you from a different country?

B) Yes in most cases visas are delivered in 2-7 business days but I can almost bet that you are looking at the time line for a k-1 or cr-1 visa maybe DV Lottery visas take longer to process and print.

C) Unless you are in AP for missing paperwork there is not much you can do. If it was for missing paperwork you would receive some type of notification.

D) Continue to call dos on a daily basis and check up on your case, there is not too much that you can do but wait it out.

Yes, this incident was covered under the YCJA. I will def. keep on bugging them. Do you think that the court info I have will be sufficient for the interview? It is the exact copy of the court documents that they give to you, minus a court seal (I guess it didn't show up as it was a photocopy?).

You guys have been a huge help! :)

Edit: I know for the future having all those extra court copies will be necessary, I am just wondering what the odds are of me getting denied because I might not have those two items... :/

heres what I did, Im Not sure where you are from but I called the court house multiple times eventually I got a hold of a court clerk and she gave me her extension so Every time I called I talked directly to her. Weeks later she called me to tell me that one of my files was "missing or destroyed" So she got me one court file but for the other she wrote a lengthy letter stating what the crime was,sentence etc. Both had the court seal.
You will not get denied but you will be put in ap if you are unable to get the court papers before your interview. In this case I would still bring what you have because who knows maybe they will take some pity but it is very unlikely (at my interview they wanted Police records as well but I got away with out em)

You will need to get the court document with the seal, just take the form you have to the court house and they can use the info on it to track down the records. I had to really push them to find mine. Did you ever get the fingerprint check back.

And for those of you who said that if the cpic came back clean you don't need to do the fingerprints is wrong, the US does not care if it was a crime in your youth or if the records was expunged in any way. It states it very clear on the forms.

I agree that they would not know unless it has already been disclosed BUT If one day they do find out that you have been charged in the past even as a Juvinelle. IT can go badly for you.

If you are interested, Call the court house again daily if you must, then if all else fails explain to nvc that you are waiting on the files so this will not slow your case down. Just keep calling and bugging them :)
