IR-1 / CR-1 Spouse Visa Process & ProceduresDS 230 and I 864 questions

For the DS 230:

On the question:
In what occupation do you intent to work in the United States?

I Put Unknown

Should my husband put "not sure" or should he put what he has experience in?

Also asking for ALL children (#29) they mean children of him right, since the application is for him? Just making sure....
All of his children

For employment (#32) List below all employment for the last ten years.........what if there is a two year break? Should he put anything there?

I put all employment and if there was a time I put the reason. "2005-2007 Unemployed.

For the I-864:

Where you list your income I want to list a small pension I get monthly from a divorce. It is income and I will receive it for the rest of my life. Should I list it as a second employer? I have W-2's from them and also a letter stating that I receive the pension, when it started, how much I receive per month and year, and that I will receive it for life. They're not exactly my employer but I don't know where else to list it and also list the income.

Thanks! :D

IR-1 / CR-1 Spouse Visa Process & ProceduresBefore I mail I-130...

@ Utah

The city is Worb, in the canton of Bern. What would that look like?

@ Harpa

K-3 no longer attainable???
http://www.uscis.gov...000082ca60aRCRD

I'm confused!

Well you can still do the k-3 but when it gets approved it just ends up being the cr-1 anyways. SO go the cr-1 route. :)

Dont go by what I say , please wait for a confirmation but I believe it should have NO effect on your K-1. As they had a legit relationship that ended, and had nothing to do with you. Plus he is the US Citizen.

ok, quick questions... is your son moving with you? in that case did you do a k-2 for him? In which case NO..but if is it just a visit? You will want to get a letter stating that said child is able to visit from 09/10/10-10/10/10. They make not ask for it but better safe then sorry

K-1 Fiance(e) Visa Process & ProceduresDHL Waybill not received at Montreal Embassy?

Hi everyone,

A friend of mine that I met at the Montreal consulate and I are wondering if anyone else who has gone through Montreal received a DHL waybill with a tracking number.

Neither of us received one, and can't figure out how we will know when our visas will get to us.

I did purchase a prepaid envelope from Canada post, the officer at one of the windows did ask for it (took it), however we didn't get a waybill.

Any help would be greatly appreciated!

Thanks in advance :)

Rachel

I haven't done my interview yet but from what you are saying I will go out tomorrow and buy a prepaid canada post envelope as I signed up for dhl mailing. From what I read you should have recieved your DHL tracking number when you got to the consulate, I am guessing yours will come via canada post instead.

I'm wondering why you didn't research the timelines before you made definite plans. You know the saying "No money down until visa in hand."

She probably didnt think of how hard it is to get a visa...Me as a Canadian I never thought about the visa till after I was married, we just "did it" per say. I had never even looked into visas and truely that was the last thing on my mind at the time, however i did do everything the correct way :)

K-1 Fiance(e) Visa Process & ProceduresDo we have time?

Where in Canada do you live?
Anywhere east of Manitoba (I think it's Manitoba) processes at Montreal for K-1s, and west of that is Vancouver. If you are out west, and going through Vancouver, you have a great chance of being finished before next September. Montreal is iffy.
My fiance and I sent our I-129F petition away May 24th, and just received our NOA2 on October 20th, so it took nearly the full 5 months. We received Packet 3 from Montreal last week, and are now waiting for an interview date... we anticipate interviewing HOPEFULLY in March, but I'm thinking more like April. So, in total, that's about 10-ish months.

Your case could fly through the service centre. Ours didn't, which is why the entire process is taking longer than I thought it would.

The wait for an interview with Montreal was taking 4 - 6 months a while ago, and they just changed to a new online scheduling system, and I'm praying that it hurries things along.

Btw I hope you get a date soon, being apart really does suck no matter what the length of time is

I dont disagree with you but from all the people I have just looked up, new, tben, msr, kulk, sleepy, etc. They all were done within 4-8 months, I think yours is more to do with taking the full service center time line as the rest got noa-2's within 2-3 months. Heck on of them was done the whole process in just 4 months. I think it really depends on different things.

I say talk it over with your fiance and let him know it "could" take longer but you two will be apart either way. The decision is yours but if you choose the k-1 I advise you to start it soon :).

K-1 Fiance(e) Visa Process & ProceduresHas anyone heard of being Denied at Point of Entry?

Hey Everyone!!
I heard that people can still be denied access into the US at Point of Entry, is this true? And has anyone heard of that happening to anyone? Thanks guys!!

Yes it does happen...frequently?? No but it is possible. The last reason I heard for a poe denial was a"criminal record" even though the record was disclosed at the interview and the person was approved. When this person "codybanks" arrived at the poe, he was questioned and the poe officer called the embassy and had his visa cancelled. Mostly it is because someone leaves information out or you act like a idiot while poeing, they have to have a valid reason to my knowledge though.

K-1 Fiance(e) Visa Process & ProceduresPassport not stamped

Hi all. A lot of people are saying submit copies of your stamped passport for evidence. Well I went to canada to see my fiance twice, and I didn't get a stamp either time. I went by bus, could that be why? When she came to see me in the States she flew and did get a stamp. I have the bus ticket and baggage claim tickets from the bus, will that be good enough?

Yes that is good enough.. I have one stamp in my old passport and we have both made a good 15 trips to see each other. I did however have 2 planes trips, tickets etc and one greyhound bus receipt. I do not even think that they looked at my tickets but have it prepared.

K-1 Fiance(e) Visa Process & ProceduresG-325A Father question!

Ok so I did some research and people do say that we have to add my fiancees Fathers name and information "She is the one in the u.s" her problem is.. even IF she requests a birth certificate it will only state her fathers name, NOT adress, country or date of birth.
she has never met her dad, he left when she was a little baby and she does not know where he lives or DoB, she can get ahold of the name.. but can she put the other questions as N/A ? or should she just not fill in the fathers info at all.

any sort of insight would be helpful, thanks

K-1 Fiance(e) Visa Process & ProceduresComplicated Love Story - Help!

Just one question - what do you mean by 'in the nature of an affadavit?" Does this mean notarized? I was just planning to have her write a letter, than says "I, __name___, hereby state that __my name___ and __my fiance___ met at my apartment, and that we were indeed a couple, etc etc etc...." And then she was going to sign it. Do you think this would be enough?

No, I wasn't going to say we met in Italy. We met in France, and that's what I'm going to say.

However, it would be much easier to prove if we say that we "met up" briefly, for a day, while I was in Florence with my family. That way, I have proof of being in his country of residence, and it would avoid all the hassle.

Yes that means notarized..it will definitely help your case :)

did you met up in italy? IF yes then mention it if not then don't as it would be a fib.

K-1 Fiance(e) Visa Process & Proceduresk-1, married after filing, before VISA interview

Does anybody have experience with filing the K-1 and then going to the beneficiary country and getting married in the meantime? I am planning on marrying my fiance while we wait out the Visa. How do we deal with this in the interview? Will it make a difference? I hope they don't reject and make us start over because we are now a k-3 or something horrific.

If you get married the visa petition you have going will be abandoned due to her now being your wife....you will have to start over and do a cr-1 spousal visa as she will not be a fiancee anymore.

K-1 Fiance(e) Visa Process & Proceduresincome levels different if self employed

hello, i may not be the confirmation you seek but, a friend of mine is self employed, not doing a visa, but he bid and won two $80,000 dollar contracts last year, looking at his deposits one could say he made $160,000 last year, but after he paid workers, equip. rentals etc. he made about $17,000 on each job. So you see theres a big difference, did he make $160,000 or $34,000?

Now that I just read that ...I am positive it is correct. You have to remember that you only pocket part of it and they will want to know what it is after expenses.

I now have a notarized statement from my ex stating our agreement, I also have the last 3 years of mortgage payments documented. Hopefully that will work. My ex is not the easiest human to deal with. Getting him to change this agreement would take a court date and lawyers. He's just difficult. I do believe I have found a co-sponsor who will help. As you have mentioned Gary, I've done all I can and now I just need to wait.

K-1 Fiance(e) Visa Process & Proceduresfeels like the end before the beginning...

Believe me.. I know.. I've been working night and day. I have not had a day off since June of 2009, and will not until Colin gets his AOS and a job. I understand that and I'm more than willing to accept that. It's more than worth it in the end. I've just seen way too many people get denied lately and it frightens me. I apologize for being an overemotional woman, it's a weakness. I'm just terrified of getting to that final interview and having it all gone to waste. Granted.. Colin is from the UK, which is one of the easier consulates. But you never know what someones mood is on that particular day. My apologies.. it's been a really rough day.

From what i can see you will make approx 39,000.00 this year not including child support.

For your household size that should be more then enough.

2 person $18,212.00

3 person $22,887.00

4 person $27.562.00

5 person $32,237.00

even at a six person household it is $36,912.00.

I wish you luck and am sure he will do just fine and be approved.
try not to worry , although I went through the same thing and worried all the way up to the minute I got through the POE.

K-1 Fiance(e) Visa Process & Procedurescan we expedite our k1 processing?
If your pregnancy is normal then you have a slim chance.
I am not being mean but There are tons of people pregnant who have to do it all on their own because they cannot get an expedite. I know a lady on here that went over due and had a c-section. (i would hate to be pregnant alone, who would do my icecream and pickle store runs?)
They didn't seem to take into mind that she was pregnant, she talked to numerous people and stated that her due date was coming up. they still booked her interview around the same time as her due date. Due to this she had to reschedule her interview twice. Being away from a newborn child has to suck! Just my opinion lol

Good luck :)

You will need to research the country specific answer. In Canada A notarized letter from the other parent given permission or a Court order was needed. (I took the long road and went to court)

From what I can find via google. You need a the fathers notarized letter just to visit outside of the country, I would contact the embassy and get all your questioned answered. As this may take some time if needed.

K-1 Fiance(e) Visa Process & ProceduresDon't want to get married anymore....

It is a 90 day buffer zone, where the foreign bride begins her adaptation period to the USA and her new man. There are TOO MANY cases seen on this board, where the relationship implodes prior to the 90 day marriage deadline period. Sorry you don't see it that way, but if you were a man whose Filipina flipped out on him, stole money, went out with other guys, by day 55, and then you could send her back home by day 60, then maybe you would have a different perspective. Oh, and to quote a guy who did CR1 Visa, and had the latter happen to him, "Gee, I wish I had a 90 day K1 Trial Period. "

Best wishes to you, though.

:star:

I am not saying its a trial period but at least these people have found out that it will not work out in the long run.... Heck I give you an A+ for asking for advice as some people would just marry the guy to stay in the country. I think k-1 visas are great, if you find out its just not working then you can go home without much problems. Relationships dont always work out no matter how you feel at certain points...some people are happily married and the next day wanting a divorce so she could have thought/knew that she wanted to MARRY HIM and then something happened that she could not change and it affected her mind/heart so she no longer wants to marry him. Some people turn out to be the opposite person that we think we know. However I do not think it is right for anyone to use the system in anyway, there are a lot of us true legit people here who had to wait quite a long time to live with our husband/fiancee.

Hi All,

I have an issue. Me and my fiance are having problems in every area in our relationship, and our relationship is on the line. I really don't want to get married to him, but I don't want to go back home (Europe) (I don't have anything anymore).
Is there a possibility to stay in the US, get a job and take care of myself.
I just came over 2 months ago and needed to get married within 90 days.

Hope you have some good advice.

Precious

Sorry to hear that it hasnt worked out, but be thankful that you are not married already. As far as I know there is no way for you to remain in the states without marrying your fiancee. However you could search for employment and go back to your country to try to get a work visa or study visa maybe :)
Good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresConsulate Question
Alright thanks! That is slightly ridiculous, seeing as I live on the West Coast :( I don't have much of a timeline yet, as we are really still in the process of trying to figure out where we want to get married, either here in Canada or down in the USA.(However we do know that we would like to reside in the USA). We like the idea of getting married here because I have a large family, most of which probably wouldn't be able to travel if we got married somewhere other then here in Canada. I mean clearly all the different Visas have their pros and cons, as does where we should get married. I guess its just really deciding which is best for us.

Thanks Again

I am from Canada and my Finace is from the United States and we have been discussing where we would like to have our wedding. And we have decided that we would really like to do a destination wedding (if we can), most likely in Hawaii. What we would like to know is if we want a destination wedding do we still apply for the K-1 Fiance Visa and would this visa allow us to get married in Hawaii even though he is from another state? Or do we have to get married in the state that he is from?

Thank you all for the helpful replies. I have already read all the forms several times over. And I will probably read them a few more times, and then a few more times when we start filing :) I know that my income will not work for the support and that he has to prove he can support me, which is fine. I was just wondering if it would help at all. I am from Western Canada (a ferry ride away from Vancouver).

K-1 Fiance(e) Visa Process & ProceduresStressed Out
Hello Everyone,

So as my topic title states I am fairly stressed out. I have been reading about all this Visa stuff for quite a while and I am still utterly confused. (Moderators feel free to move this to its proper location, if it isn't correct. Was not sure where to post). I am from Canada and my other half is from the USA. And I am struggling as to what Visa would be better for us to do. Should he file for a K1 Fiance Visa so we can get married down there and technically be together right away? Or should we get married sooner (either in Canada or the US) and apply for a marriage visa. I am seeing alot of pros and cons to both. And quite frankly I am a little terrified and I am a bit of a perfectionist and I like everything to run smoothly (haha don't we all though). I mean to be honest the faster the better, because really...I just want to be with him (L) :) I mean I guess my biggest question is: If you get married first and apply for a marriage visa after, how soon should the paper work start being filed? Does it take about the same time to process a marriage visa compared to the K1 Visa? And is it easier to get denied? And as for all the paper work and forms you have to send in for either of the visas, I look at all of them and I really have no clue as to what part he does and what parts I have to do. For example there are a lot of forms related to the K1 Visa, do all of those get sent in right away? Again, I am so confused :( Also one other question... For the Affidavit of Support, I realize he has to prove he can support me, can I also send my own information that I technically can support myself. Recently through my bank that I am with here in Canada I decided it might be a good idea to open up a US bank account. So I have both. Can I send in papers/info as well showing them this when we start filing for the actual Visa? And after a super long post I have one last question. Our plan is to buy a house, but we aren't sure if we will have one before we would like to start filing for the visa, is this going to be a problem? Because I see that you have to state an address of where you intend to live when in the US? Can we put his parents address down and change it later? Or would it be best to actually have a house and a permanent address before filing? Any help on all of this would be much appreciated. I realize I wrote a ton of ####### here. But I come on here everyday and try and wrap my mind around all of this stuff and today I just decided I couldn't hold back any longer and would post and see if any of you could maybe clear some of this up for me. Thanks so much :)

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports25 year age difference....Older women marrying younger men
Ok so I am bored and feel like jumping into this conversation, I am a 6 years younger then my husband which is a great thing because he is so much more mature then any guy i have ever dated. I was in a long term relationship before him that lasted for a few years and ending up going no where because the guy was immature booo lol. My husband is an amazing person, we all have flaws dont get me wrong lol.
Anyways to what I am getting to, I agree that love is not something you choose, it just happens however you can choose who you date.
I am not bashing, let me give you my experiences....

My Nana married my grandfather 2 years difference... married 17 years 2 Children married mostly happy then divorce,
My grand father marries his new wife 17 year age difference, they were married 20 years before he passed away, Greatest lady I have ever know.

My mom marries my dad(dad older) 7 years difference they have two kids (me & Brother) married 14 years, horrible marriage,

My mom meet my Step dad 10 years younger (mom older) They get married, married 5 years.

My mom meets her NEW current long term person he is 15 years younger, they have been together for 7 years now.

Point being, a age difference does matter sometimes due to immaturity, and other problems.

However Whether you know someone for years or just months, time will only tell the true outcome. Love is not based on a time line, if you work at your relationship and communicate, things will most likely work out. (based on a non fraud relationship)

Ok my two cents hehe

Cougars need lovings too :)
