Did you come over as a Cr-1 visa? removal of conditions as in "2 years after you got here"?
I believe your "residency" doesn't count till after you remove your conditions so you would not be able to apply for citizenship till 2012 or so.I am looking for where I saw it.

We will be applying for removal of conditions next month. My wife and her daughter came over on K-3/K-4. I adopted her daughter ,who is over 18 years old, at the county courthouse and had her name legally changed on the adoption decree. Can anyone give me suggestions about how to change her name with Immigration during the Removal of Conditions process so that her 10 year green card has her new name on it?

Thank you. Just to clarify, He got his conditional greencard shortly before we met. He and his wife went to the interview. She put him out right after that.

I have no experience but i feel the need to tell you to hang in there.
It is very much possible that the OP thought you two were together before the seperation between his wife and him. That could
make a op feel odd about your relationship and deny you.
I do feel sorry for him and wish that there was something I could say to help. I mean having proof of the abuse should have
been enough at least I feel it would have been enough but They were seperated quite quickly.\

Not sure about the affidavit, but as for the court records yes you need to send it in again. I hope you have more copies because you wont get it back and will need to send in another one if and when you go for Citizenship.

Hi smile.png Sorry your going through this! I got called back for fingerprints at the time of my biometrics appt as they couldn't read them. I was told that with women sometimes its common but not to worry. ( They are used to it ). I would go to a precinct to get it done. Yes to notarizing an affidavit.

Now I'm wondering if I too will get an RFE

The worst part is, I did my fingerprints both digitally and on paper as she had a hard time getting a good print. Sucks that I have to now go to a local place and pay to get it done. I will have to look into notary publics around here.

I got a RFE today as my Fingerprints failed to be read. I now have been requested to send an affidavit and a police record check. 

 

ANyone have an example of a affidavit in response to a RFE?

Do i need it notarized?

I have had no record since coming here (or for oh 10 years lol) do I include my Juvi record in the affidavit or do I address it in another page?

 

Secondly close to the bottom It says if a law enforcement officer has ever filed charges against you then you must send an original court document. I had a Juvi record so I would have to send that again correct?

Removing Conditions on Residency General DiscussionReceived RFE for police clearance, how do we answer?

Hi everyone,

 

We received a RFE today for police clearances because my wife's fingerprints were unreadable... The same thing happened at AOS.

 

I anticipated this already, so we got a police clearance in April from the city police department of where we live now as well as the California state department of justice. I also had a police clearance letter from 2011 from the two other cities we lived in California. We never lived or returned there since the date on those letters.

 

Can we go ahead and submit these documents or is there going to be an issue because the date of the police clearances isn't current?

 I just did sent in my RFE last week. I would say that the police check from april should still be good as long as it is statewide. 

 

If yours reads like mine did, I sent in a cover letter, the notice of evidence,a affidavit stating no criminal history, and the state criminal check.

Dumb Question but does the letter you get ( noa1) extend your greencard for a year or does it extend it from the noa1 date?

Like I filed Aug 20th 2012 but my greedcard expired on October 31 2012

So would it be October 31 2013? I have a trip coming up on october 10th-16th and if I don't have my greencard by then I'm not sure whether to go get a stamp or wing it .

No .

I applied for I751 in august 2013,
did my biometrics in Sept 2012,
May 2013 was told new fingerprints were needed
June 2013 sent in fingerprints.
July 11th 2013 called to see why it was taking so long .

Today I revieced an email referencing my phone call on Friday saying my greencard was in production now. So five weeks since I sent my new prints to my approval

Hi everyone, 

 

 

We applied for removal of conditions (I-751) in late January 2013, and within days got an NOA Extension letter for 1 year. Then I went to get my biometrics done in mid-February 2013 I haven't heard from USCIS since, but I knew my fingerprints had failed, as they sometimes do at the USCIS (surprisingly not at other departments).  

 

Now- 5 months after my last biometrics appointment I received an NOA to go back for a 2nd biometrics appointment in mid-August. Has anyone been through this during their removal of conditions ?

 

We have planned travels to see my family in October, and I'm worried that if they require us to come in for an interview we'll miss it. I'm curious if others had to wait this long for a 2nd biometrics appointment, and if so how much longer did you wait for your interview or green card ?

Find yourself lucky, I waited 9 months before i got a RFE for new fingerprints except instead of a new Bio appointment they made me go get one from my local fingerprint place (50 dollars later). 

 

I just put in a service request on friday and it seems I was approved after 5 weeks.

If you originally filed July 2012, it's already been a year, which means there are a couple of things you can do:

 

1) You can contact USCIS and file a service request because you are officially way beyond their normal processing times.

 

2) This also means you have now been a legal permanent resident for more or less 3 years. So your window for citizenship must have already opened or will be opening soon (you can apply for citizenship as early as 90 days before your 3rd anniversary of residency - assuming you are still married to your USC spouse and are otherwise eligible). Many people have done that, even though they had a pending I-751. Because you need to be approved for removal of conditions before they can process you for citizenship, that forces them to look at your I-751 petition and make a decision quickly. Most often this decision is an approval of ROC, and then they proceed to processing the citizenship petition which takes much shorter, usually 3-4 months start to finish. Many VJ members have done that when they were in your situation. It's an almost sure bet to speed things up and it seems to work every time. Of course if you're not interested in becoming a citizen or if you're not prepared to spend the hefty $680 fee at this point, then this may not be an option.

 

Also, if your one year extension letter is about to expire, be sure to make an InfoPass appointment to have your passport stamped, so that you can have proof of your legal status in the country.

Received a letter from the Newark, NJ office of USCIS responding to our service request. Looks like we are in for an interview. unsure.png My wife is gonna freak out because she desperately wanted to avoid another interview. Not sure why it took so long, from May 6 until July 22 (2.5 months), for them to transfer our case from the VSC to Newark and why no one said anything to us until we asked for a service request, but I guess we can't really do anything about it. :(

The letter says "Your petition/application is still pending consideration and has been relocated from the Vermont Service Center to the Newark Field Office for interviewing and processing. We regret that we are not able to give you a timeframe for when we will complete the review of your petition/application."


Awe I'm so sorry to hear that, I think sometimes they need that device request for them to get back on track.

I hope your interview date comes quick and that it's over soon. Best of luck

Congrats, Canadiandggal! FYI, you didn't update the total number for Vermont to 24 of 31 applicants approved.
 
I was just curious what made you call USCIS so soon, since you'd only responded to the RFE on 6-12, a little more than 30 days earlier? I wish we would have called sooner, but we thought we had to wait 60 days.


Simply because we had been well over the usual timeline. I actually called just to talk and see if they had any information, the rep told me we could file a service request so I did.

Getting really nervous now. We responded to our RFE on May 4, 2013 and haven't heard a word since. ClockWatch2.gif In fact, there's been almost no activity for August filers at the Vermont Service Center since early May, with the exception of a single person whose ROC was accepted.

We just made flight arrangements to go back to the Philippines, which is exciting since my wife Karen hasn't been back in the 3 years since she's been in the US. But now we're getting a little worried that we may not have a new green card by then. Not only that, but the I-757 was issued in November 2012 and only extends the green card for 1 year. Will USCIS give us a problem letting Karen re-enter the country when we come back on Nov. 25 with only her green card and the I-757?

 

I did a service request on Friday and got a responce today via email. However nothing has updated, both USCIS phone and Website still say that im in initial processing so we will see if it's true

BOO! i got a rfe today as my fingerprints were unsuccessful. I had them done both digitally and old school. 

 

On my RFE it says I now have to go get a police check done and send that along with an affidivat..

 

Really why did it take them almost 9 months to decide my prints were #######...

I would just take the letter for 9/26 when you go on the 25th, both of you go to that appt, and see if they'll let you do a walk-in...seems like it would probably work instead of going back two days in a row.


Yeah Thats what I was thinking of doing, Since he is going to be with me anyways. I dont see why the couldnt take an extra 5 minutes to do his too.

I've got nothing so far for my step-daughter. My wife's NOA 1 says nothing about my step-daughter. We did however get Biometrics for both. I'm going to wait 30 days and then do an infopass.


Hmm My noa1 doesn't say anything about My son, we got a second letter that says That I have included a child in my petition and then says his name a the very bottom. At least you got the biometrics for both which means that they must know shes included, hopefully you see it soon. :)
