when you send in your packet, you will receive NOA1 which confirms receipt of the i-751 and gives you a one year extension. so her green card (and accompanying letter) would be valid until may of 2013. she would need to have the letter in hand when re-entering the US.

as for the biometrics, it varies but many people get an appt with a month of their submission.

she might want to wait until she has submitted the packet, received the NOA1 and NOA2 (biometrics appt letter), and completed biometrics before joining you. it is possible you could (both) be called for an interview, so keep that in mind as well.

ACINLOVE, since you have have a pending i-751, the processing of this case has nothing to do with the NVC (national visa center). your status says you are a K1 filer still, fyi.




if you were unsuccessful submitting the (two part) AR-11 online, USCIS should take your change of address over the phone. are you certain that you used the EAC# from the NOA2 (letter for biometrics appt) and not the EAC# from the NOA1? you should call the number listed on your NOA1 (for ROC) where it tells you what to do if you move.



AR-11 is for the LPR. i-865 is for the USC. the i-865 needs to be mailed in.


also, i just did the change of address online at USPS. the cost was $1. super easy and it allowed me to do it in advance of my move and just select the day i wanted it to be effective. (good job, USPS!)



my change of address with USCIS has not been cut and dried, but im sure it will be find in the end.

i was able to do the (two part) AR-11 online for the LPR, but we have yet to see a confirmation of that change from USCIS. i have been lead to believe that we should get a NOA for this. i called and they asked me to wait 30 days to see if a NOA does show up in my mailbox.

i mailed in the i-865 for the USC and very quickly recieved an NOA confirming the new address.

depending on when in the fall of 2012 you are looking at the move to italy (for the LPR), you may not have the new green card by the time of departure. looks like you will file with CSC, which is good since at the moment they are processing faster than VSC.

if the green card expires in october 2012, you can renew 90 days before the date, lets say july 2012. i am a july filer and our CSC group is 44% approved at the moment, and its december.

if the LPR has the luxury of being able to travel back from italy for biometrics and a possible interview, this may not pose a significant problem.

i dont think that paper has as much experience with USCIS as most of us who are ROCing. so i am inclined to dismiss their speculation and place my faith in the evidence borne out by vj member reports.

things are not at a stand still. certainly not for CSC, and even pokey VSC is still chugging along.

as for the comment about deportations (GTFOs).... well now youre just being six shades of crazy.

what you dont want is a returned package, so no matter how complete the evidence that you send is, be sure to include a letter of explanation addressing the lateness of your petition to remove conditions. a late petition without the letter may be returned to you by USCIS.

so, yes, send it quickly, but not without the letter.

it needs to be received and processed by USCIS on or before the expiry of your conditional green card.

received and processed means it has both arrived at the service center (CSC or VSC) and your filing has been processed (NOA1 generated). it is NOT the postmarked date.

if it were me, i would send overnight asap. monday would be ideal, though so woulda any day in the past 85 days or so.

dont rush the package too much. carefully look at what you are submitting. make sure you submit more than enough proof of a bona fide marriage. taxes are very important, as is all evidence of financial co-mingling since AOS. send an organized, complete package.


having said that, if you feel like you cant make the deadline, be sure to include a letter of explanation as to why you failed to file within the 90 window. they will send it back if it is late and without an explanation.

you are not helpless! you just need to learn what your rights and responsibilities are as a conditional permanent resident.

and i agree that the support here on VJ is amazing. glad you came here for help! we are all pretty nice here in the ROC forum. (though i get grumpy once in awhile!)

glad you are standing on your own two feet! it will make the transition easier. please look out for yourself. make sure you have a bank account that only you have access to and make sure to get the documents you need to file.

if you are done with the marriage (which it sounds like you are), then go ahead and file for divorce. she cannot threaten you with deportation unless there has been fraud. sounds like you need to move on. i am not familiar with the details of the divorce process and i believe it varies by state. educate yourself and/or get a lawyer.


as for your immigration status, as long as the marriage was entered into 'in good faith', it does not matter if it has not worked out. you can apply for ROC and a 10 year green card WITHOUT your wife. collect whatever evidence you can find that the instructions for the i-751 ask for. (tax returns, bills with both of your names on them, health insurance, photographs, affidavits, etc) even if your evidence is thin due to the deterioration of your relationship, you should be okay as long as the marriage was not entered in to for the sake of immigration.


if you can prove this to USCIS, then you should be able to retain your LPR status, be issued with a 10 year green card and move on with your life without the stress of your wife's maybe-not-so-great choices.

ROC should be a breeze for you now. you've been around the immigration block! assemble a strong packet and send off when the window opens. then you wait, but at least you wait together at this point! still happy about that!

(as others said, not everyone gets the letter, but it isnt reflective of anything. except maybe USCIS' inability to get them mailed to the correct people at the correct addresses. i did get a letter, which was a good thing as my life was very hectic then and immigration issues werent at the very front of my mind.)

I am also waiting for ROC and I have extension letter and even a stamp i551 in my passport that says its valid for 6 months( I just got it 2 weeks ago). I am going out of country, home, for holidays with my husband American citizen, but I need to catch connecting flight in Zurich. My only concern is that my friend told, her friend had same extension letter, old gc, stamp and they (Germany) didn't let her come back to the USA! She needed to with for a few months back home until her husband was able to bring her a new gc, which was appearantlly approved while she was out of USA. After that story, I am really scared. We are leaving in 3 days and I cannot think about anything else, because I need to come back, my job, my school, my life is here, and now I am afraid they won't let me come back... Anyone knows somebody that was not allowed to come back to the USA, while his case was pending?

you should not have a problem. you have valid LPR status in the us and 2 documents to prove it. lots of people travel with the extension letter or the i-155 with no problem. yes, you may spend a little extra time at CBP, but you'll be fine.

there was a recent post about a member's experiences with travel abroad with a pending ROC. ill see if I can find it.

Biometrics : 06/21/11
Opproval letter sent 22/12/11

Exactly 7 months to get the approval letter in the mail without RFE or interview...
So surprised but it's my Christmas gift...

the LPR and the sponsor are supposed to notify USCIS within 10 days of any change of address.

others will offer advice too, but i think you need to rectify the situation (change your address to accurately reflect where you live) and be honest with USCIS about the situation. when you submit your ROC, include a letter that explains the discrepancies.

i am unfamiliar with any cases where not updating an address became a big problem, but its possible it could lead to an rfe or an interview.

cutting it so fine is a bad idea. that comment is directed to lurkers who are trying to find information about how close to the expiry if the conditional green card they can file.

the ROC package must not only be postmarked before the exipiry date, it must arrive AND be processed by CSC or VSC. therefore, latest you should send it is about a week in advance. to be safe, if you are filing late in the 90 day window, it is recommended that you include a letter of explanation detailing honestly WHY you are submitting so late.

based on VJ accounts of late filing, those who include this letter experience fewer delays that those who simply send off a late package.


im very surprised your package was accepted. most people report their packages sent late like yours as being returned by USCIS.

send the letter and youll probably be in good shape.

because USCIS knows that applicants have varying evidence for ROC. not everyone has all of the biggies (joint tax returns, shared financial obligations (mortgage, rent, auto payments) and something else. i cant remember. im sick today. : ( ) so they make allowances for weaker evidence (photos, affidavits, pet adoption letters).

if you have the big stuff, the little stuff is no important. if you dont have much big stuff, the little stuff becomes more important.
