Im in America an am a American citizen my wife is Filipino, im filing a cr1 visa for her now. I gathered up all the required documentation and sent it to her, she gathered the rest of the supporting evidence and went to the Certificate of Birth Abroad appointment i had booked, i could not go because of my work here. When she got there they said that the LCR birth certificate she had for our child was invalid and they needed a NSO birth certificate, and that all her papers were perfect but she needed a nso birth certificate, well my baby is 2 months old and the NSO will not issue our child a birth certificate till she is 3 months old. I can handle that but then they said once my wife gets that info that a DNA test will be required, im so stressed out right now can someone please please tell me how do i get my dna there? What will happen? How long does it take? And how much does it cost?

Bring the birth cert (especially if you were present for the birth and so it has your signature on it), but I would not bring the child if she has reliable babysitting/ isn't breastfeeding. Your wife may be waiting a long time, outside at first standing, then inside, it can be loud and stressful by itself, let alone with a newborn to care for.


she is breast feeding exclusively, imgoing to have my wife bring her paperwork that shes going to use for her crba appointment in january, except i dont want them to take the paperwork cuz we will still need it in january, and i want there i was working in america at the time of my daughters birth

My wife is going to her visa interview alone because i am in america and am working, should she bring our daughter to the visa interview? Our child was not mentioned on any of the paperwork during the I-130 process because she was not born yet. I would think it would be beneficial in prooving our relationship. I would guess that they would want to ask many questions about our child, so bottom line, would it be beneficial for her to bring our 2 month old daughter to her visa interview?

About a year ago I co-sponsored my friend's wife when he brought her to the US from Russia. She currently has conditional permanent resident status. Now it looks like next year I'll be sponsoring my future husband for a CR-1. I make well above the income requirement, but will I have anything to worry about?


I dont think so as long as you can support, you, any children you may have, your friends wife, and your future husband and any kids he may have at 125% of the poverty level for a household of that size.

when i was going through my visa process i looked up all the rules for a joint sponsor and im 99% sure that if they have a house in the us and are a US citizen than even if they are outside the country for long periods of time they can still be a sponsor. Btw even if your family dosent make enough money you can file along side your sponsor and together you should have more than enough, providing you are over a 125% of the poverty leve for a household of your size, remember that they are looking for the amount b4 taxes not after.

I have another question. This is probably a stupid question but.............. when it comes to the poverty guidelines, is that our actual net salary, or is that before deductions and taxes? Because before deductions (health insurance, disability, etc,) I make over the 125% but after deductions I make less. I'm really worried about this!

I have another question. If I moved to Ireland during the process and had a job while over there which met the requirements in the US would that suffice? And one more thing.... I have no tax return filed for the last couple years because I was a student and I wasn't working, and last year I was traveling the enitre year and never worked. will there be an opportunity for me to explain this or will I automatically be denied? I'm really worried about that part of the process.

Hi, I just sent in my I-130 (February 12) and I have a dilemma. I understand that to qualify for the visa I have to be making an income of 125% over poverty level for our household size, and I currently do, but I want to quit my job. I hate where I'm working and I'm completely miserable, especially with my husband in Ireland :( . My question is, considering all goes well with the i-130, at what point in the process will they check whether or not I'm working and when they do this how will I have to prove it?

I received our NOA1 today and my timeline says

"Based on timeline data, your I130 may be adjudicated between June 14, 2010 and June 27, 2010." (does this mean until the noa2?)

Does it REALLY take this long? How long after that does the process generally take? And while I'm waiting for the Noa2 should my husband and I be preparing for the rest of the process? Can we send anything else in or do we have to wait for a packet in the mail?

I'm sorry, I know all of this has probably been answered, I'm just extremely nervous, excited and a little confused. Any h help would be very much appreciated!

Same things you will need to supply and don't forget their proof of citizenship. You will still need to be the main sponsor, even if your income doesn't qualify you. You can start gathering documents together now, because things like your 2009 tax return will not change, but keep in mind that paystubs and employment letters should be dated close to the interview date, wherever possible.


I didn't realize they would need proof of citizenship. Would that mean I would have to get an orgiinal brith cert off of them? Or what would suffice?

hi, Nothing seems to be going right for me right now :( today I got layed off from my job (which I have only had for 3 months), So I realy need to know a few things so that we can weigh our options.
If I get a job in the next month or 2 can I still be his sponsor (considering the salary fits criteria) or do I have to work at the job for a certain period of time?
If I do get a co sponsor, what exactly would be required of them? will they have to know exactly what type of visa they would be co-sponsoring? I ask this because I would want my father to co-sponsor my husband, but we eloped and he has no idea we got married (we couldn't afford to have the wedding we really wanted) and I don't want him to find out this way. Would a co-sponsor have to do anything other than fill in paperwork, and give pay stubs and tax returns, or is there more to it?
One more question, If we do get a co-sponsor, could I live in Ireland with my husband while the visa process is going on, or will I have to stay in the US?

Any help would be soooooooooooooooooo much appreciated!!!! I'm so stressed out it's ridiculous!

So, I lost my job a few weeks ago and had been planing on visiting my husband for a couple weeks. Since my circumstances have changed, as I don't have a job and will no longer have health insurance as of April, both my husband and I think that the best situation would be for me to be with him in Ireland during the process. I have found a co-sponsor who more than qualifies and also have all my papers in order (everything for the rest of the process). My questions are, can I live in Ireland with him during the visa process, or is it necessary to be in the US for a majority of it even with a co-sponsor?
Also, for anyone who has had a USC partner come stay with them in Ireland for an extended period of time, was it hard going through immigration at Dublin? (I'm really nervous) Will I need anything besides our marriage certificate, passport and other relationship qualifying documents? WIll there be a problem with getting an Irish residency stamp in my passport for his CR1? Because of the Irish "right of residence" I'm assuming it wont be a problem, is this wishful thinking?

Hi, I'm kind of in the same situation. My husband is in Ireland, and I lost my job a few weeks ago. So I decided to go be with him in Ireland during the visa process. I got a Co-sponsor, who is a family friend and meets all the requirements. As long as one of her parents meets the requirements (125% over poverty line for household size, Tax returns for 3 years, w2s for three years... I'm sure you know) Then you should be fine, at least that is what everyone keeps telling me. Make sure your wife still fills in the I-864 even though she has no current income, and if she didn't pay any taxes while in school or currently, she needs to write a letter explaining why. This is the website that has the information for her if she didn't pay taxes so she can quote it http://www.irs.gov/p...rs-pdf/p501.pdf As long as you have all the documentation then you should be grand.

I have a question for you, I'm going to Ireland and have a degree in Journalism. Why did your wife have problems using her degree in Ireland? I would love to get freelance work while I'm there, so if I'm going to have issues working i'd love to know now. Did you guys have any other problems with immigration in Ireland or was that your biggest issue? Will I have problems at the airport in Dublin? I'm going April 4th and I'm really nervous. Any advice would be greatly appreciated.

Pictures together throughout our relationship (we put a description on the back of each with a date)
Airplane Itineraries when we flew together and to visit each other.
3 Affidavit of supports from people who attended our wedding stating that they were there and were a witness to our relationship.
Anything joint, our bank account, an investment which I put his name on...

btw I don't think a marriage cert is a a form of evidence because it is required in the packet anyways, and it proves you got married but nothing else about your relationship.

We didn't add phone logs, or personal emails, but you can also do that. The more evidence they receive the better chances are that you will prove your point to them

When it comes to traveling to the US during the process, I've gotten conflicting answers. what I have gathered is this.... You're not supposed to travel to the states during the process, but if you can provide enough evidence (lease, utility contracts, work letter stating employment) that you'll be returning to your country and only staying in the states for a short visit, then you may be able to do it. I heard some people have gotten away with it and others haven't. So, it's a choice you have to make, risk it or not.

I we just got our NOA2, and i was wondering when we could go get his medical exam done. Also, My husband (Irish citizen) has a medical card, so his GP visits are free, would his medical card work for this Medical exam also?
