We did the CRBA process for my son last year. My son was conceived in wedlock.
My BF and I were not married (thus being out of wedlock). My BF did not attend the interview as he was studying and because of work.
We were not asked to do a DNA test. We did the CRBA process when my son was around 4 months of age.
We brought with us all the required document, notarized all documents that needs to be ie ALL pages of ALL passports of USC. Proof of relationship before conception.
The interview went really well. my son did great.
The CRBA and passport took about 2-3 weeks to be delivered.
Also, you can apply for his SSN (for free). give it 7 days to be delivered.

OK so how often are non US citizen mothers that go without the father to a CRBA appointment required to provide a DNA test? If they have all the required documents. Im the husband(the us citizen)and cant make it to the appointment and im wondering about how much im going to have to pay if they request one and how long its going to take. My daughter is 4 months old btw.

i just sent her my original birth certificate and a copy of my highschool diploma, it should be there in a couple of days, so those in addition to this list, plus im telling my wife to include 20 more pics of her during and after pregnancy. i havent seen my child yet only through skype, she was born 4 months ago and i need her to get this appointment completed so i can go pick them both up.

Maybe get/ order a Certified True copy of your birth certificate in Archive/Vital Records in the state you were born?

i dont have time to do that but i got a a copy of my original notarized, sealed and stamped that it was a true copy of my original, i also go a copie of my drivers licence and a copy of my w-2 notarized the same way, as well as every page of my us passport.

btw i dont know if i should or not but i included the affidavit of parental consent that my dad had to sign saying he was a US citizen and i was his son and where we lived and that he gave consent to my marrage because i was under 21 at that time, that was notarized as well

On one of the links I gave you they ask that you have all original docs and a copy of each, they may ask to see the original. I may sound like a stickler but having everything as required is what got me through the process.

This is my list of documents that I submitted to the US embassy in Manila for CRBA.

DS-2029 with 2"x 2" full face passport photo with white background. (child)

NSO true copy birth Cert. (child)

Passport application. (child)

Proof of parent US citizenship.

1) US passport.

2) True copy of live birth cert. with original seal of vital records office. A must have!

3) High School transcript .

4) True copy of NSO Marriage cert.

5) Proof of physical presence in same location at time of conception. Airline tickets, copy of visa stamps.

6) Proof of mothers pregnancy, ultrasound, pre-natal records, hospital billing statements, and pictures.



Acceptance of evidence will be at the discretion of the consular officer, and depending on the circumstances, the consular officer may ask for additional material.


If your not attending the interview you'll need additional forms see the CRBA CHECKLIST and make sure you have everthing on it's list

EDIT and the DS-11 Form for the child

IMO the W2 and drivers lic. are weak docs it really doesn’t prove U.S. citizen parent was physically present in the USA for periods totaling five years prior to the child’s birth, at least two of which where after their 14th birthday. However your high school transcript and US passport would.

i did not have a spare original birth certificate to send so i copied the front side of it and had a notary notarize that it was true copy of my birth certificate
also i had the notary stamps/seal/notarize a colored copy of every page of my US passport, dosent my wife having a CR1 Spousal visa to me, proove that im a US citizen?

If you have all the necessary documents you should be fine I have seen many on this site do just fine with out the US citizen parent attending the interview. However it is recommended the US citizen parent attend.

It's all about the documents and if the U.S. citizen parent meets the requirements to transmit citizenship to her/his child.

to prove im a us citizen i sent a notarized copy of my, passport, drivers license, w-2, and birth dertificate. I was born in the US and have lived here my whole life. Also our child was first concieved after we got married so our child was born in wedlock. Also my wife got her CR1 spousal visa in December last year. When you say youve seen many people not have troubles, do you mean not have to take the dna test? Because thats the only thing im worried about because its going to take lots of time and cost me lots on money.

1. Physical Presence/Residence in the United States (this is where you prove you've lived in the US long enough to pass it on)

2. Legitimation/Legal Relationship (explained here: http://manila.usemba...itimation4.html the child is "legitimated" by virtue of your marriage)

3. Blood Relationship (Filiation) (explained here: http://manila.usemba...lationship.html there is NOTHING that says "just because you're married we're going to assume the kid is yours).


I'm not trying to be offensive when I say, there is no proof your wife didn't get pregnant to someone else and you married her to get her child USC. Or that she didn't tel you she was pregnant and you just think the child is yours. They can accept proof that you were there at the time of conception (the dates matching), they can decide that it's a bit suspicious and instead ask for a DNA test. Being married only makes you married, and makes the child legally yours, it doesn't prove the child is biologically yours.

If it helps, it's rare (but not impossible) to see a child conceived and born in wedlock require a DNA test, but if the child was conceived out of wedlock your chances are higher for a DNA test. Not 100%, but higher. Depends on the CO and on your relationship.



for number 3, what would i need to send to prove that without paying 600 dollars for a dna test and waiting 4 months for the DNA test to get sent to the us embassy in manila?

i dated her for 10 months b4 a went and met her in the philippines, we got married on our 11th month.

Are you wanting to get a CR1 visa? This is for people who are already married and it's the quickest way for your spouse to be able to work without getting the work permit. You need to first apply for an I130. This can take up to 5 months for approval, but I hear on average it about 3 months. After that it gets sent to NVC (national visa Center) where you send in the rest of the packets. At this point your spouse is not supposed to enter the US. I have heard of people trying to enter and not being allowed in. I have also heard of other people who come over and bring documentation (lease, work letter, etc)that they will be returning back to their own country. Your husband cannot live with you during the process. I know it's unfortunate but it's the way our wonderful country makes this entire ridiculous process even more stressfull.
You have a lot of research to do, it doesn't seem like you know anything about the process at all. Good luck!

He sent the package to remove conditions in, got an appointment for the biometrics, then I thought he had his interview that day too, which was October 2013. Then a week or so later we received a letter in the mail stating that the removal of conditions had been approved and that he was temporarily extended for a year, while the 10 year green card was being processed and to keep the letter as proof, since the stamp in his Passport is expired ( expired December 20th 2013). So now, he cannot find the letter that he was supposed to save and he needs to show proof that he is able to work since the stamp in his passport is expired.

 

This process is so confusing!

Hello,

 

My husband did the interview to remove conditions and biometrics in October 2013. He quickly received a letter in the mail stating that a year extension had been approved while the 10 year green card was being processed. Today my husband started a new job and went to look for that letter as verification of the extension since that is all he received and he cannot find it. Will he need this for his I-9? and if he does need it, how can we quickly get a new letter or confirmation of the extension so that he can complete his I-9?

 

Also, how long does it normally take to receive the actual 10 year green card?

I may be having the same problem, we expire July 12th but still haven't been given a interview date, SOOOO it could put us in July, but I really hope not!!! But if I were you I would also call the embassy!
