IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - October 2014

Good morning all I have a question for all that have sent in the IV package...I am the petitioner and I am a us citizen. My husband lives in Jamaica. We are currently waiting for nvc to assign our file with a case number. They received our case on oct 1,14. Since it appears that we will need to send my husband in passport, his birth certificate and police clearance, im trying to see how I can get these items to the Nvc w/out much delay since he has them and if he has to send them from jamaica, it will take weeks for nvc to get them. Im assuming all these docs will need to be originals. Im just confuse as to how we can get these documents to them w/in a one day turnaround time. He has all these docs right now except police clearance. He should have that by Nov 1. How was everyone able to send their iv package so quickly?

you will assign yourself as his agent or he will choose you as his agent. he should mail you a copy his passport bio page, his original birth certificate, the police certificate and any other things you may need. NOW

you will be submitting them as his agent from the US.

there is no need to explain job loss. if today you have a job that meet the income guidelines you have nothing to worry about.

If you already have your case #, call again and ask for your Invoice Identification Number (IIN). Once you have those two, you can log into the CEAC website and if AOS and DS-261 are available, you can fill out DS-261 and pay AOS fee.

You will also receive a Welcome email from NVC.

When you say he ordered his online, do you mean he printed them off the IRS online website or he placed an order for copies to be mailed to him?

it does not matter, tax transcript printed online or received through the mail contain the same information that is required by NVC and is accepted by NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresRE: Evidence of a Bonifide Marriage

Can anyone please let me know if both my husband and I will need to complete a letter for Evidence of a Bonifide Marriage? I am not sure at this point and I am getting ready to send him a packet of forms that need to be signed and sent back to me. I don't want to have to forward more than one package. I know that I need to do one and have others do one, however not sure if I need one from him as well.

Thanks :)

IR-1 / CR-1 Spouse Visa Process & ProceduresForgot something on i130 will I be denied??

On my husbands i130 I put the address but on the second part I forgot the city, state and zipcode but on the bottom part where it says where does beneficiary intend to live I put the entire address and also on my g325a I put the entire address do you think they will deny it or send me a RFE??

call the 800 number, give them your receipt number and explain your typographical error and they will correct it as a minor error.

IR-1 / CR-1 Spouse Visa Process & ProceduresBetter to use tax transcript for AOS (split topic)

So, my husband will just send the IRS transcript then, he don't need to send the 1040w and W2? I am right?

just download and print tax transcripts. thats all that is required, no w2s or 1040s

IR-1 / CR-1 Spouse Visa Process & ProceduresIs renewal of current passport to include married name necessary for NVC?

USCIS stands for UNITED STATES CUSTOM AND IMMIGRATION SERVICES. Immigration officers work for USCIS which is under DHS. Immigration officer is also a custom and border agent and an immigration and custom enforcement agent. thats the job title in dhs. CPB IS A PART OF dhs. DHS is an umbrella that covers uscis, fbi etc. created after 9/11.

Do not tell people green card comes in passport name. THEY DO NOT. green cards come in the name on the I 130 application. NO ONE WOULD APPLY FOR I 130 IN MARRIED NAME AND VISA IN MAIDEN NAME. and name in passport has nothing to do with it unless it is not your maiden name or married name.

my wife is a green card holder with her married name on said card and travels with her maiden name passport.

No to the bold.

CBP, Customs and Border Patrol, dictates who can enter the USA.  The USCIS does not, but both are part of the Department of Homeland Security.  The NVC and the Department of State is who issues the visa.  The visa is ALWAYS issued in passport name.  If the passport does not have the married name.  The visa will not have the married name.

The green card always comes in visa name.  Please show me an instance where it has not?

However you can change it after the fact using an I-90 and a $450 fee to change the green card after it's received.

Also in IR1/CR1 cases upon entry the visa is endorsed by the CBP.  At this time the visa becomes a temporary green card and is valid for up to 1 year.

As long as the passport has the married name before interview, you should have zero issues and it will not cost you anything extra.

No it's not

Your visa issued in passport name

your green card is issued in visa name.

If you want your green card in married name, get the passport changed before interview.

a visa permits travel to us, entrance to us is dictated by uscis. uscis assigns an alien number to the name on the i 130 before visa is contemplated or issued. a maiden name passport and a marriage license suffices for and proves your name(married) for entrance into us once passport is valid.

IR-1 / CR-1 Spouse Visa Process & ProceduresIs renewal of current passport to include married name necessary for NVC?

Hi VJ family,

My husband and I got married in October 2013. Since then, I have been slowly changing out my documents/ accounts/ IDs to reflect my married name. I am yet to do my Driver's Licence and my Passport. Seeing that the Passport is more important, I decided to do that one first. My husband filed our I-130 petition in April and we now await its approval, which going by USCIS snail pace, we are looking at September for NoA 2. In the mean time - and between time - we are going about gathering all the documents that we will be required to submit, once our case is sent to NVC. At the NVC stage, (hopefully with no RFE's) is probably going to be another 4/5 months - January /February 2015 (we are hoping for December :)  )

your green will be issued with the name used on the i 130. you could use the maiden name passport until it expires even at nvc. when doing interview your passport must be valid for more than 6 months after interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresEmailing Vs Mailing AOS and IV packages

hello

I have established email communication with NVC , Case number and process was emailed to me ( the petitioner ) , today I paid the AOS fee online

my question is can scan and email the AOS and IV packages once payment is clear or I do have to send it by mail to the national visa center

I'm currently overseas visiting my wife ( the beneficiary ) so DHL is my only option ...

Thank you

if case number starts with GUZ(certain types), MTL, AKD, AMM, DMS, GZO, MEP, or SAA you can, otherwise snail mail or express mail.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan taking unemployment affect spouse visa ?

Can taking unemployment affect spouse visa ?

If the process is currently with NVC am i eligible to take unemployment.

It does not affect process and yes you are entitled to unemployment insurance if unemployed. You  paid for it.

IR-1 / CR-1 Spouse Visa Process & ProceduresDefinition of "charged"?!?!

you were sued by an individual and won your case in a civil court. the only way to be charged, arrested and be convicted is through an action of a government(state or local) by its law enforcement authorities.

K-1 Fiance(e) Visa Process & ProceduresOriginal Documents Collected By Custom Officers at JFK?

First time posting. Hoping someone can help me. My fiancee arrived 2 weeks ago at JFK airport on a K1 visa. At the airport, she was directed to a room to fingerprint only her right 4 fingers and here she handed in her sealed envelope she got from the Guangzhou embassy which contained her original birth certificate, pictures, and forms. We had forgotten about envelope, but now that we plan to apply for the marriage license we realized we need the original birth certificate. I called the JFK immigration office and they said they send it to USCIS and then it gets sent to my address on file.

My question is - when does it get sent? Time is of essence as we only have 90 days on the K1 visa.

Also is there a way to track this? I can't seem to find any information on this online and the part of handing those documents in were never part of any flowchart for the k1 process. Any info is greatly appreciated. Thanks VJ!

get married in a state that does not require a birth certificate. contact your fiancee's embassy and see if they process application for birth certificate..
