IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved but not forwarded to NVC
You are talking about 1 month.

You need to understand this is a long slow process for the k-3 or I130.

They will move forward on it. Just hang in there and have faith.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan K-3 be changed to CR-1?
Just follow thru with the K-3.

Any thing else would cost you a lot of money and you will have to send your spouse back again.

The fees are what the fees are.

Some of you may know about some of the timely delays we have experienced with our original IV bill being lost and our petition being returned to the CSC- well our case is finally complete and our request for an expiated interview was granted (because of the serious medical condition that our USC infant daughter is facing).

I don't know the interview date yet- but as you can imagine I am so thankful and rejoicing.

Thank you to everyone that has helped us along the well and told us to hang in there.

yes you are idiots for getting married to a foreigner, but now that's done its done.

Errr calling someone a idiot for loving someone is a bit out of line!!

past that:

The real question is; how important to you is her ability to work when she arrives here?
If it is important then you should file the I130. A k-3 would have both of you out of work here
and that could lead to a rocky beginning here for you both.

hi,

i pulled this off another thread:

qout: "It would appear that Manila is requiring the CENOMAR for all these types of visas now."

I don't understand this. If you're married and petitioning your spouse for either or CR/IR visa and you got married in the Philippines, how can you get a Certificate of No Marriage(CENOMAR) from the NSO? This doesn't make sense.

We waited a very long time for our CEMAR to be posted to the National Registry. finally we spend 50 dollars and bribed the clerk. Bingo had it the same day.

IR-1 / CR-1 Spouse Visa Process & ProceduresPredicament! HELP!
You will need a co-sponser.

But you also can't just say she wasn't required to file without proving that.

1st: She needs to get a hold of IRS by phone right away and ask for all the transcripts they have on her for the last 3 years.
2nd: If they show any income what-so-ever, File a late return right away. To delay would be to have it come in @ the heart of tax season.
3rd: Get transscripts from the uk side stating her income and have her file on that 2.

You guys sit on this way to long and have boxed yourselfs into a time corner.

Get busy busy busy

K-1 Fiance(e) Visa Process & Proceduresfiance unaware of previous marriage
QUOTE (amesina40 @ Aug 19 2007, 04:07 PM) <{POST_SNAPBACK}>
My fiance's auntie somehow married my fiance to another man from the states without her even knowing it back in 2004, around the time i first met my fiance. This was done for the aunt's personal reasons as no one in her whole circle of family knew about the marriage. We were getting ready to file for the K-1 visa a few months ago, but got lucky and found out about the false marriage. To make a long story short, the guy agreed to file for divorce, and that completed just a couple of weeks ago, so we can now start the visa process. I wanted to get the marriage annuled but that would've been a more lengthy and more costly process.
My question is will this pose as a problem when it comes time for the interview or when they are reviewing the paperwork. Because they will notice she got married in 2004, but my statement will say we met around that time and started our relationship. I'm thinking it's best we just come open w/ all this so we dont have to hide anything from them; we'll state on the papers what exactly happened and that my fiance never knew about the marriage. If we do this will anyone get in trouble?? We have the marriage certificates, and my fiance's signature is not really hers. What I really want is to get her here as soon as possible w/out any problems & w/out anyone getting in trouble. Any advice?

Thanks!

I would suggest you read this thread in detail!

I have a question that seems over looked.

Since it is coming on your 2 year mark.

Is that the last time you have seen your fiance?

If so that would be a problem for you.

The rule states you have to have been with your fiance within 2 years.

If so you should plan a visit with her again soon.

Main thing he needs is his last three income tax returns.

If he does not have them he can call the irs and get the transscripts.

copies of his retire checks would also be good.. Like the last 6 of them

K-1 Fiance(e) Visa Process & ProceduresK1 after divorce
If your divorce papers indicate a waiting period,

The you are not free to marry.

You must wait out the time line.

If you file earlier you risk getting denied. That could create problems the 2nd time you file.

Just wait out the time and use the time to get everything right.

Do you think this is a tricky question? Like: if we say yes, we are gonna get deny it?
Please, share your thoughts and experiences with me.
Tks
Cláudia

I've never heard of this question being asked but if it is, just answer it. Getting parents here takes quite a long time. I don't see how your intentions in this matter are material to being issued a visa.

I would reply we have no immediate plans for that.

Most questions will be pointed to see how well your spouse knows you as a person.
They are fishing to see if the marriage is real or not.

Years and years ago my mom raised 3 children alone.
Not having a father figure around and a mom working all the time.
I got into all kinds of trouble. And I mean a LOT!
Anyway it snow balled into early adulthood. But by the Time I was 21 years old, I was out and growing up fast.
18 years later I planed a trip to Canada.
Driving accross the border they did a random check on me.
Called me into a little room in the back with a stack of old non violent charges and started to go thru each 1
all over again. Finally I reached over and put my hand on the papers to stop her.
I said, "You are refusing me entry right?" Yes was the reply.

I was told I could not return without a waiver from Canada.

I had been out of trouble over 18 years.

I was shocked at first by Canada's action's.

When I met my wife I called and made sure it was ok for me to travel to the phil's before I wasted a ticket and was turned around

hi Rick thanks for writing, We are keeping the faith as you say and we are as tight as ever if not more, We just have so many other issues in our face right now to keep our head screwed on straight.

I sure hope you're on the straight and narrow now with marriage a personal life style has to change since your living two live, yours and your wifes.
I have never been refused entry in the past, I can get into the States now, that is not a problem with a letter from Sharon's father's doctor and a return ticket plus the documentation from the consulate. The border people said that since the offence was over 31 years ago I would get approval from the person in charge.
Right now I am 63 years old and I was 31 when I offended and the offence took place 32 years and 1 month ago. If you read closer to the beginning you will see that I am in agreement with you regarding the law of the land and why it is there.
Rick, you are the American, your past convictions would have no consequence regarding bringing your wife to the States unless the charges were of abuse towards an ex or something like that. I am a Canadian and I need a waiver to go to the States and get married. If the charges were against your wife believe me she would today be waiting for a waiver and you would be waiting for her.
Ron

LOL on the straight.

I fought for and won custoday of my son at birth and he is now 19 years old.
I dd that while obtaining a Electrical Engineering degree.
It has been 25 years since I have had any problems.
I do beleave they call that reformed.

As for my wife.
I have known her for over 3 years now. And have visited her in the phils 4 times.
She is the reason I breath. I am so lucky to have met her.
She was fully informed about everything long before we decided to marry.

I was just offering you the flip coin side of the story.
And yes I read your comments about the laws.
I agree with most the laws, and understand why they are in place.
Had I not just been going to Canada for a visit, I would have filed the waiver.
But only to visit, naaa no need.

as said before

Keep the faith my friend

we are pulling for you

Waivers (I-601 and I-212) and Administrative Processes (221g)Arrested, but never charged....
QUOTE (maxident213 @ Sep 24 2007, 09:06 PM) <{POST_SNAPBACK}>
Hello all

I am new to this site and WOW, there is a lot here to read through. I am a Canadian citizen with an American girlfriend of approx. 3 years and we have been discussing marriage, with me moving to the USA to be with her, if all goes well. I have read through the process of acquiring a K1 visa as well as the requirements that must be met, and I don't foresee any problems, with one possible exception, which I am asking about here:

In October 1999, shortly after my 19th birthday, I was picked up by the police while smoking a joint behind a local bar with a friend of mine. We were both placed under arrest and taken in. They questioned us about this & that and photocopied our IDs before letting us go. No charges were filed, no court appearance, and to this day I have no criminal record. Not so much as a speeding ticket. However, I'm sure the arrest is still on my "permanent record," so to speak, and I am wondering what effect this might have on my K1 proceedings. It will likely appear on my police check, right?

Also, on a related note: I recently took a trip into the USA, and while crossing the border back into Canada, I was one of four people picked off the Greyhound bus for "further questioning" by Canada Border Services. They immediately started asking me all kinds of questions about marijuana. I should mention at this point that I am heavily tattooed and am pretty much used to people thinking I'm a druggie of some sort at first glance. I answered their questions honestly. I still smoke once in a while and admitted this. They asked if I'd had run-ins with the police and I told them what I just told you. After a bunch more marijuana-related questions, they let me go without further hassle. Now, a few days later, I am getting a bit paranoid about what may happen the next time I go across the border. Should I expect harsher scrutiny because of what I told the border guards? I guess I'm now a "confessed drug user" even if I only smoke once a month or less. Should I expect that this admission has been noted on "the record" somewhere, and, if so, is it likely to come up during the course of my K1 processing? I am feeling mighty stupid now for admitting what I admitted, and possibly hurting my chances of getting to marry my girlfriend, but I figured it was better than lying. Anyone have any input on this?

I would really appreciate anything anyone can offer on this subject, I have been a good law-abiding citizen for many years now and just want to make the K1 process as painless as possible. Thank you very much for your time.

- Max

Get a copy of your police report and see what it says. If it says nothing. Then say nothing about it. If it is listed, then you must list it.

So, does anyone have any theories, rumors, or facts regarding what they're doing with I-129F now for a K-3 visa? I inquire only because it is nowhere to be found under any of the regional service centers or the national service center. I know when the new fees went into effect, they instructed everyone to start sending the I-129F for K-3 to whatever service center was processing the I-130, but there is no info on it. Just curious what they might be doing with them now. I personally think its corrupt that they cashed my $170 check for the I-129F and there is probably no intent to even process it.

If you paid the fee and got the receipt, I am sure they will process it.

K-3 Spouse Visa Process & ProceduresI13 / 129F Question?
My wifes I130 & 129F are both approved!

My problem is:

August 27th she has a interveiw in manila for the I130.
Sept 5th they have set her a interveiw for the 129F in manila.

Its a no brainer that we want the I130 over the 129F.
They took her passport @ the physical for the I130.
So she will not even be in possesion of her passport for the 129F.

How should we handel the 129F?

I suggested she take both packets to the first meeting @ the I130 and explain the problem to them.

any advice is welcome

K-3 Spouse Visa Process & Proceduresi need suggestions
You will need your divorce papers.
Your passport.

You will have to goto the US embassy and get the legal capacity to marry form.
If your fiancee is not from Manila, make sure you allow for a couple days stay there with her.

After that you will have to goto city hall in the city your fiancee is from.
(NOTE) If there is a suffix on your name such as Sr. , Jr., III, ect ect that it is duley noted on the marrage certificate
and that time or it will be a major pain to change later.

Depending on her age you may or may not need a letter from her parents giving their approval; at the city hall.
If she is under 21 years you will need this when you arrive.
Also most places require her to take a compatibility test at that time.
And some require counseling. When you have the marrage certificate approved.
It has to be posted for 10 days. After that you can marry your Fiancee.

Congrats

Rick and Roxan

Both my I130 and 129F are approved; we filed the I130 at the end of last December and the 129f about 3 weeks later.

Price on the other hand varies greatly. I got quotes from $10,000 on down. Average seemed about $5,000.

But I found a local immigration attorney that has worked magic and is very open and not stingy with his talk time.
He charged me $1250.00 plus all filing fees. He did all the mailings of the forms at no extra cost to me.

I do not know your location but here is his link.

While no real studies have been done to show weather a lawyer is more effective or not.

I do know when I thought I had everything. He sent me back to get more. Sometimes I thought he was a bit to picky,
But, the fact is that both the I130(august 27) & 129F(sept 5th) are approved and dates are set for both interveiws.

I felt better knowing he had reveiwed each form and had put his Signature on the forms.
In my mind, I felt at least they knew that if they droped the ball, an attorney was over looking the case.

Now all the stated above is my own opinion and not said to belittle any 1 here at this wonderful forum.
They have done a outstanding job here and I have read and read thru the posts here for information.
It has been a great help to keep me on track with questions that I posed to my attorney!!!

Either way you chose...

I wish you lots of luck and may your love be eternal

K-3 Spouse Visa Process & ProceduresI-129F sent to Chicago Question
QUOTE
Not to worry. This is actually pretty comical. Yes, your lawyer knows something you don't know, because he read the part of the I-129F instructions that say when you use it for a spouse, you mail it to Chicago. That's not the funny part. What's hilarious is that a new policy went into effect July 30 that instructs you to send the I-129F directly to the same service center your I-130 ended up at. (California or Vermont) Be sure to get that I-129F fee refunded too because it is now zero, as of July 30 when used for a spouse.

I understand about wanting help with the t crossing and i dotting, but did you really think an attorney would "help expedite" your visa process?

K-3 Spouse Visa Process & ProceduresI-129F or I-130? (Both are approved)
QUOTE (fas550 @ Aug 26 2007, 08:06 AM) <{POST_SNAPBACK}>
Like many others I got the I-130 and I-129F approved on the same day. Do I just forget about the I-129F and go for the I-130? Money is not my concern but getting my wife here the fastest way possible is.

Thanks
Frank

Have they set the date for the Embassy yet?

Both ours was approved @ the same time, but we were lucky and they set the I130 date
for interveiw first. She is in Manila now for the interveiw tomorrow.
The I130 is by far the better Visa.

K-3 Spouse Visa Process & ProceduresWe filed for K-1 but now want to get married
By all means get married for your Mother.

Just make sure you contact the USCIS and tell them you want to abandon your K1!

Good luck and best wishes.

K-3 Spouse Visa Process & ProceduresK3 & the visitor visa.
Not necessarily true... You can file an I-130 and I-485 concurrently it depends on what your facts and circumstances are....

Ok my bad,

It was my understanding that the I130 had to be approved before hand.
