Yes you can file back 5 years.

With it being that low on the income,
You might get a unearned income credit and make out doing that.

I think it depends on the policy of the embassy. Our lawyer just asked for my BC, MC, scan biographical part of my passport and my police certificate. The NVC asked for it.



We got mutiple copies of the police report and included it in everything.

It also appears they intend to make a issue of the fact you were detained at the time of marrage.

Many individuals who come to United States on visitor visa would like to extend their visa. They can apply for extension of stay in US. The extension may granted or not granted depending upon the reason for extension, and whether the USCIS is convinced that the applicant does intend to return to his/her home country after the temporary stay in US.

Please note that you should not apply for extension of stay within 3 months of coming USA otherwise USCIS may conclude that even before entering USA, you were planning to extend the visa which might be in contrast to what you might have said at the consulate or at the port of entry.

The duration for which the person can stay depends upon the expiration date of I-94, and NOT on the expiration date of visa stamp. The date on visa stamp is irrelevant. As long as you apply for extension before expiration date of I-94, you would be in legal status(up to 120 days) and you will not have stayed in US unlawfully.

It should be applied between about 4 to 6 weeks before I-94 expires.

If you are the principal wage earner for your family, visiting United States alone and have left your family(spouse, children) behind in your home country, you really need to show good reasons and proof why you need to stay in US much longer and how your family will be taken care of properly in your home country. Very long separation from your immediate family is not considered too good in eyes of USCIS. You should also show that your job or business in your home country would not be in jeopardy for staying away for so long time. You are employed, you can show a letter from your employer that they are aware of you staying in US for long time.

You can not go to neighboring countries(Canada, Mexico) either by air or road, and come back to get new I-94 and therefore avoid lengthy process of applying for extension. New I-94 will NOT be given. You can't even go to neighboring islands such as Bahamas etc and come back to get new I-94. You will have to actually travel outside of North America and come back.

Extension will be given usually for the duration you ask for and give justification for the same. However, maximum you duration for extension you can ask for is 6 months. Also, you can not apply for visitor visa extension as many times as you want. Maximum you can stay on B1/B2 visa is 1 year.

As long you stay in US legally and do not violate any terms of the visa you are on, you will not get into any trouble while applying for greencard, just because you applied for visa extension.

If you are late filing for an extension and your authorized stay has already expired, you must prove that:
The delay was due to extraordinary circumstances beyond your control;
The length of the stay was reasonable;
You have not done anything else to violate your nonimmigrant status(visitors can not work in US.)
You are still non immigrant. It means that you or someone on your behalf have not filed immigrant visa petition.
You are not in formal proceedings to remove(deport) you from the United States.

Goto any tax filing place HR Block ...ect

and they can help you for a fair fee and get it filed.

Just claim zero.


I would take the letter from the IRS with you. To them. Have them make a copy for their records on filing.

You hang on to the original as you can use it when submitting tax records.

If he gets a new Job.

Have him get a letter from his new Employer (on their company letter head) detailing him the new offer.
Include this and any paystubs with the support.
It would be no problem then.

We'll soon receive the I-864 and information from my dad, who's the joint sponsor, and then we'll be sending in the Ds-230 and DS-2001 (We're doing direct filing in London, bypassing the NVC). So hopefully we'll know the visa interview date this month! smile.gif

Only special conditions would be if the country they were married in had a national registry for marriages.
Then you would need a government issued copy of the marriage certificate that was posted to the registry.

In no case is the us embassy involved.

Make sure it is a notarized copy.

LOL I never intended to be dishonest with them!!


Tell them but if you're smart, you'll make arrangements to continue to pick up mail at the old address if at all possible. A few weeks of inconvenience is better than dealing with a lost card. USCIS is notorious for failing to acknowledge address changes.

Legally you are supposed to notify USCIS within 10 days of an address change.
I think you can do so online.

I emailed NVC about the change and filled out the online change on USCIS.

And made arrangements to have the mail box monitored by the neighbor.


Good but realize you must not put in a change of address order until after you receive all mail you expect from USCIS. If you do, the mail will never make it to the mailbox at all.

I had no plans to file a change of addy. Any Gov forms would be puked @ the post office then, as forwarding is not allowed.

I am not going anywhere!

What is going on with immagration in this country is wrong!

Putting immigrant employment before american citizens is wrong.

Granting people visa's in 2months and making us wait years for ours to be approved is (sorry mods) BULLSHIT!!

I will continue to come here and learn and help people with their problems.

Send photo copies, If they want originals, they will request them.
Normaly you send the originals to the interveiw with your spouse.

The NVC is very slow to respond. In fact, every time they responded to me I already had solved the problem by the time I got their reply email.
