Just have your fiance contact the senator in his state to see if they assist people with immigration petitions/cases. If so, they will probably send your fiance a waiver form or something, then they can be the liason with USCIS and give a call to the office there.

According to an interview with a former adjudicator, senatorial or congressional inquiries sometimes force a pull of the file. It could cause them to just work it and get it done. However, you would need to wait the 5 months before doing this. So between 5 and 6 months I will use this resource if necessary.

You are not outside service times until you hit 6 months officially, then you can have them look at it, which can take another 30 days. Or you could then put in a service request which could take up to 60 days.This is an American Holiday weekend, which means there are probably people who have been on vacation, or who will be on vacation this coming week.

sometimes the more eager you are the longer it takes and drives you crazy. its best to keep yourself busy and be surprised that its already in the mail the next day.



Yea thats what i think too..but its impossible not to think on that..whatever i do i always check USCIS and visajourney...i even sign up for gym to loose some time but then i take my lil phone and check again and sayin to myself "maybe they did something today"...and get disappointed like always...im going crazy...I even start praying which usualy dont help at all...I just hope in next two weeks we will all get somewhere...

Definitely. I really hope we see a flood of approvals these next 2 weeks to compensate for this slow down. I really don't see how they'll have any other option because if they don't speed this up, god help everyone who filed after us. I can't imagine how backlogged they'll become. There was a pretty significant number of petitions submitted in the Spring and the summer will only get worse for them.

I would if I were you take a second look at the G-325A as well as the I-129F Part B, Q#9


If you read the IMBRA law it appears that you do not. There is some question as to whether the USCIS is adjudicating properly.


My reading is similar. I would say you need the waiver letter because USCIS is not adjudicating as the law is written.

I don`t know what is the argue about here...
Are you saying that denying someone a visitors visa just because there is a K1 in the process makes sense?
The same person could maybe get a visitor`s visa if not being processed K1.
I am just pointing out how ironic the situation is.

And what does matter if many other countries don`t allow importing fiances? That doesn`t mean they are right for doing so.

And as far as lying goes - yes it is not the good thing to do. Not good at all - in any situation in life.
And I won`t go to embassy and lie thanks to good people who helped me here.

But don`t judge me here for thinking about the option and asking about it. I am desperate in the situation that I am in where I haven`t seen my fiance for over one year.
And whoever looks down of me because mentioning the idea of telling the lie could try imagine how would they feel being separated for over a year without seeing each other - by the time I get K1 it will be year and a half and even more.

I already went through this procedure once with the same girl, but I had to go home before we got married - so I know how to play by rules, believe me.
I am going through this for the second time.

But that's just the way it is.
As I said before, you can attempt to visit her but you must show strong strong ties to your country. A letter from your employer stating you will be returning home on such and such date, property that you own, bank statements, etc, etc.
Even then, it comes down to whoever is on the other side of the counter. They could deny you and you are out the flight money.

It's hard to be apart, she can come visit you though...why don't you try doing that if possible?

Don't do anything that could mess up your chances of being with her in the long run. It's not forever, it's only a few months to a year...hopefully much less and then you'll be together the right and legal way.

Thank you guys for the help. As I said - before the fiance visa I tried to get a tourist one, but as soon as they have found out that I want to go visit my fiance they denied me a visa saying I should go for a fiance visa and not a tourist visa.

Btw, couple of months ago I tried to get a tourist visa before we applied for a fiance visa, and I was denied because I mentioned I have a girlfriend in USA so they were afraid of my illegal stay.
The only way I see I could get it is to lie not mentioning my fiance at all but saying I am coming because of something else. But I am wondering if they have records me where they can see I do have a fiance there.

I was wondering if anyone has experience with that? Can one travel on tourist visa while being processed?

Probably it is hard to get a tourist visa if mentioning that one has a fiance in USA. So , what if one lies at embassy about that and they discover it. Can it have an influence on the fiance visa that is being processed?

Let`s assume I manage to get a tourist visa though. Will they let me across the border with it since I am in the middle of process of getting the fiance one...

Does anyone have experience with anything like that?

Marry, file to adjust status, and file for AP (I-131) with AOS. Typically it takes less than 90 days to get AP, you can then use AP to take care of things back home.

Dear all,

I am searching for certain information and was hoping someone here can help me.
I am thinking of traveling to USA on my fiance visa to meet with my fiance but I don`t have all things solved in my home country so I will need to get back before we get the chance to get married. I just want to spend time with her now. So then I would be applying for another fiance visa right away after I am back to my home country. The question is - will government make me any problems about that. I have read somewhere that waiver is needed if you apply for 2nd fiance visa within two years. So was wondering if anybody here had experience - is that waiver hard to get?

Mi smo poslali papire krajem 9. mjeseca i bili smo odobreni krajem 1. sljedece godine. Bili bi i ranije, ali smo dobili RFE. tongue.png Mi smo bili valjda medju zadnjima koji su odobreni od September filersa. Neki su dobivali NOA2 nakon 2-3 mjeseca. Papiri su nakon odobrenja pruhujali kroz NVC i u roku od par dana stigli u Zagreb. Odmah sam obavila lijecnicki i dogovorila intervju. Dobila sam vizu negdje pocetkom 2. mjeseca. 

Sad se ceka nebulozno dugo na odobrenje...predugo.

 

Kad sam ti rekla za papire, mislila sam kako ionako moras prevesti i ovjeriti svjedodzbu zavrsnog razreda srednje skole, dilpomu s faksa i maticni list. Te dokumente trebas za bilo sto sto mislis ovdje, raditi, studirati, ici na magisterij ili doktorat. Najbolje ti je obavljati sve odjednom da ne ides dokument po dokument.

 

Sto se tice papirologije oko CR1 vize, kao sto rekoh, drzi se Ivy. good.gif 

Ivy je sjajna, mislim da bez nje ja bi jo? bila izgubljena u svemu tome,ovako mi bar netko mo?e polako i po redu re?i ?to i kako treba raditi.. smile.png

pa dosta brzo je to sve kod vas pro?lo, brzo si ti mogla oti?i tamo i biti sa svojim dragim, i ja bi da mogu tako sad.png ja sam mislila da taj proces traje isto oko 10-12 mj kao i za CR1.. ali nema veze, taman mi treba ta godina dana jo? da zavr?im faks..

U medjuvremenu dok cekas, mozes priprediti svoje papire koji ti trebaju ovdje za posao. Ja sam sve svoje dokumente prevela, ovjerila i apostilirala.

mi smo se isto dvoumili izme?u K1 ili Cr1, pa smo se odlu?ili za CR1 jer ja jo? imam jednu godinu da zavr?im faks, pa zato mislim da je to bila bolj opcija za nas.. Koliko je va? proces ukupno trajao? Vidi?, za te papire za posao nisam ni razmi?ljala... ja sam sva u organizaciji vjen?anja i tak neke stvari mi ni  ne do?u u glavu dry.png koji papiri ?e mi trebati za posao, da ja to ve? polako po?nem sve pripremati?

Nije bas da imas samo lijecnicki i intervju, ali kako ja nisam bas neki expert za to, najbolje ti je kontaktirati Ivy. jer su ono slali svoje dokumente nedavno i ona ti sigurno moze pomoci oko svega.

Sto se tice pitanja minimalnih primanja, pretpostavljam kako je isto kao i za K1 vizu.

ja sam pisala na forumu prije par mjeseci i raspitivala se za vize koja bi bila bolja opcija (K1 ili cr1).. i tako smo se dragi i ja odlu?ili za cr1. imamo vjen?anje u 11 mj..goofy.gif  i sad ja ve? pomalo prou?avam ?ta ?e nam sve trebati od dokumenata, pa sam vidjela da prvo on pokre?e cijeli postupak i sve obavlja tama, ja samo imam intervju i lije?ni?ki pregled. nego, htijela sam pitati da li postoji neka cifra, neki minimalan iznos pla?e koju on mora zara?ivati da bi nam odobrili vizu ili to nije bitno? biggrin.png

Blago vama kad se mozete vidjeti svaka 2 mjeseca na 2 tjedna! Mi smo se u pocetku vidali jednom godisnje, sad se vidimo dva puta godisnje. Nismo jos rijesili vizu, nismo niti poslali papire. Cekamo ljeto, i ja studiram do 2014., upisala sam diplomski nakon vjencanja.

Prosjek je 10-11 mjeseci, ja racunam na 12 mjeseci. Naravno da mozes studirati, zasto ne. Kad se sve zavrsi, odes u Ameriku, na ulasku ti postambiljaju pasos i salju Green card doma. Dode kroz dva-tri tjedna obicno, a do onda mozes koristiti pasos kao GC. On salje papire, ne ti. On uvijek zapocinje proces, on trazi da njegova zarucnica/zena dobije dozvolu da dode u Ameriku.

ja studiram u zagrebu socijalni rad.i jedva ?ekam po?eti taj postupak da znam da smo onda bar malo bliže kraju te udaljenosti..
mi smo trenutno u procesu dogovaranja na koju vizu bi išli.. dragi je rekao da ?e još istražiti sve o tome pa ?emo odlu?iti.. ali nekako se ?ini da nas sve više vu?e ta CR1.. ?itala sam da treba dokazati postojanje braka i da je on pravi (dokument da smo vjen?ani, svjedoci, zajedni?ki ra?un i takve stvari), a da li treba i skupiti sve dokaze o tome koliko se dugo poznajemo (slike, mejlove, karte)?

On pokrece postupak u Atlanti, salje peticiju u USCIS. Ne znam da li je prerano sad, ovisi o tome koliko treba da se viza dobije. Gledaj ovako:

Sve je cca i u mjesecima:

Vrijeme od slanja papira do dobijanja vize: X
Pretpostavljeno vrijeme trajanja vize nakon dobivanja: 5 (viza traje 6 mj od medicinskog pregleda)
Zakonski rok za svadbu nakon ulaska u Ameriku: 3

Dakle trebala bi zbrojati x+5+3 i toliko mjeseci je oduzeti od 9/2014. To je najranije sto biste trebali slati papire.


Zbog toga sto nikad nisi sigurna koliko ce X iznositi (hoce li biti spori, brzi, hoce li vam izdati RFE) preporuka je da se ne planira svadba prije nego sto ti je K-1 viza u pasosu.


Mi smo pred godinu i pol dana bili u toj situaciji i odlucili smo da necemo ici na K-1 jer je CR-1/IR-1 bolja viza. Isla bih ponovo na tu opciju i tebi bih je preporucila. Ako se udate ovo ljeto, on posalje papire, oni trebali bi biti gotovi do sljedeceg ljeta i ti ces doci u Ameriku i odmah moci traziti posao, putovati, sve. Ne treba ti AOS, ne trosite jos vremena i novaca na to. Onda mozete u 9. mjesecu imati crkveno vjencanje za njegove.


hvala ti puno na savjetima i odgovorima.. razgovarala sam s njim o tome, i mislimo da bi bilo mogu?e da imamo vjen?anje ove godine do 10 mjeseca ako se odlu?imo za tu vizu CR-1/IR-1... jer ovo ova udaljenost je preteška, i preskupa jer on svakih 2 mjeseca dolazi tu na 2 tjedna...da li si ti ve? riješila svoju vizu?
možeš li mi re?i malo više o toj vizi cr-1/ir-1? zna?i ako bi išli na tu opciju, on bi mogao samo do?i tu u hrvatsku da se vjen?amo i onda poslije vjen?anja pokrenemo postupak za tu vizu? ja bi mogla studirati dok ?ekam papire i kad su papiri odobreni oti?i tamo i ostati s njim u Atlanti? da li bi onda ja morala tu pokrenuti postupak ili on tamo? koliko traje taj postupak?

mene je ve? strah svega toga iako još ništa nismo ni po?eli.. ja sam toliko zbunjena i neupu?ena u sve to i ve? par dana tražim po internetu sve što trebamo napraviti kako bi se vjen?ali i što prije bili zajedno.. i ispri?avam se unaprijed ako budem dosadna sa svojim pitanjima ali ne znam kome bi se obratila a vidim da ima ljudi tu koji su ve? to prošli i znaju bolje nego ja šta treba sve raditi. tako da sam bila presretna vidjeti ovaj forum.. zna?i, mi smo se odlu?ili za K-1 vizu i ne znam kad bi trebali to po?eti raditi i slati sve te dokumente.. uop?e koji je prvi korak? i da li on prvo mora u atlanti (moj dragi je tamo) mora pokrenuti taj postupak za mene ili ja tu u zagrebu? mi planiramo vjen?anje za idu?u godinu u 9 mj u SAD-u, jer taman ?u ja završtiti faks tada.. pa ne znamo ni kad da po?nemo taj postupak. sad ili je još prerano? znam da imam puno pitanja, ali samo bi htijela da imam sve informacije prije nego po?nemo da ne bi nešto zabrljala... :) :)

hvala puno.. mislim da ?emo se odlu?iti za K-1 vizu ipak.. znaš li možda otprilike koliko dugo traje taj proces da se dobije K-1 viza? i da li ja mogu nakon dobivanja K-1 vize i nakon svadbe se vratiti u Hrvatsku na par dana jer planiramo i tu napraviti bar malo slavlje za moju rodbinu i prijatelje koji nisu u mogu?nosti do?i u SAD..

molila bi za savjet nekog od vas, jer ?itaju?i forum vidjela sam da ste više informirani nego ja.. naime, imam zaru?nika koji je ameri?ki državljanin, nema nikakve veze sa Hrvatskom ni Balkanom ali eto sudbina je htijela da se upoznamo i zaljubimo dok je on studirao u Zagrebu:).. i sad, nakon 2 godine smo zaru?eni i ne znamo koja nam je bolja opcija- da li prvo tražiti zaru?ni?ku vizu i oti?i u SAD vjen?ati se ili vjen?ati se u Hrvatskoj? dosta nam je ve? razdvojenosti i rado bi da što prije to riješimo i po?nemo prikupljati papire i sve što nam je potrebno.. pa molim ako ima neka dobra duša koja bi me malo uputila u to i dala korisne savjet.. bila bi jako zahvalna..
