I would like to take this opportunity to thank every one of you guys , you made me feel that I have a big loving family , even though I don’t have a big family …. Thank you so much … there was a days which I use to cry infornt of the computer seen people who Failed on July and getting approved same month … I was like that is so unfair for us for each one of us here who has been witting … that use to depress me so much , and to be honest I didn’t find any answer why was that …. Even though this people NOT a Military member , or they are special case ..

Been in a military it doesn’t change or even make different in your case …and if you guys look at my time line …. That is 125 DAYS … so where is the it shows that we been approved earlier because we are a military … and to make you even feel better he just got back from 6 month deployment and guess what he might be sent any time soon and we chose not to use this to get us approved faster then anyone here because its not fare for everyone failed before us ,

So am really sorry that we got approved earlier then some of the guys here believe we don’t know why and we have nothing to do with it .

Plus am really happy right now I got to get married to my man and spend sometimes with him before he get sent back for another deployment ..

Am praying for all of you guys my thoughts are with all of you .

Nora

I think it is just an assumption that petitions from a military member are approved earlier. At the time we sent the papers to VSC my fiance was a Air Force officer, he got out this month (which makes me happy) and work now for the Federal Government and I don't think we are going to be approved earlier then any non-military petitioner. This thing with military having a priority is stupid. I wouldn't like to be military wife, no way!!

But at least we have bszooom back together with new list! Go VSC!!!!!!

Nice post Nora. Sometimes I think I would feel bad being approved before people with earlier dates but maybe it just depends on officer that gets the case. It is hard for all of us and it's normal that there is so many emotions involved in the process. But hopefully we are all going to be with our love ones soon, just hang on guys..

I really don't know ####### is wrong with VSC! I can't plan anything. Since we've send all the papers I finished my Masters, moved from Germany back to Croatia and now I'm stuck in waiting process! It doesn't make any sense to apply for jobs here or to start to do anything. My life is on stand by and I feel like I'm wasting the days God gave me! But I guess they don't care!

"I am not trying to dampen anything. If anyone wants to assume that petitions with late May NOA1's will get approvals this week because there were 4 K1 NOA2's (NOA1's of 5/2, 5/9, 5/17 & 5/17) and 3 K3 NOA2's (NOA1's of 2-26, 3-8 & 3-22) last week they are welcome to do so.

As #118 on the most recent K1 pending list from bszoom, I can't get too excited about a pace of 4 K1 NOA2's per week. At 4 per week I will be waiting approximately 7 more months to receive my NOA2.

As to the possibility of the older VJ timelines being abandoned, yes that is possible. However, there have traditionally been very few members who abandon their timelines. For September 2006 through February 2007 the average VSC K1 & K3 combined average dropout rate was 2 1/3 filers per month.

I think we should all remain optimistic and hope for the best, but at the same time be cautious about assuming that happy days are here again before there is clear evidence to show that is the case.

Bill"

I did some checking and found that since March there are only 15 K1's still waiting NOA2's.
Out of those 15 2 have RFE's and 1 Denied leaving 12 waiting for actual NOA2's
Out of 12 waiting still with NO word, 3 are MIA for over a month
Leaving 9 waiting
Out of those 9 waiting 4 haven't been back since the first two weeks of August to update...maybe waiting?? maybe RFEs?
Out of those 5 left waiting ONE seems to have an approval but didn't report the NOA2 on the timeline
That leaves 4 waiting...

So with THOSE numbers combined with the dates that VSC has worked up to (noas of May 17th) I think its fair to say the next NOA2S we can expect will be some from those with noa1's of May 17th. The average that these are approved over all in the last 3 months is 95 days. If you look at individual timelines you can see where most are approved a minimum of 2-3 weeks before the estimated date given on VJ. Once again if u combine all the numbers of days waited for both K1 AND K3 you DO come up to the estimated VJ date. I've done ALL the numbers...and thats how it seems to be working to me. SO...I do feel confident in saying a lot of the people with noa's from May 17th on can expect to start seeing their petitions approved. If you go by those NOA1 dates..in most cases you only get a few a week...remembering that some get RFE's, some wait longer, and some just don't update timelines. So, I DO fee confident we will continue to see petitions approved steadily over the next weeks and maybe faster as fall approaches. I wasn't speaking of the last week or two only...but am looking at the whole picture.

The information below is a summary of those K1's still waiting noa2s. Just look in the timeline data base to verify.

3/23/07 Last seen 10 days ago, may or may not have approval or RFE and just not updated
4/07/07 Visa Denied 7/31
4/11/07 Last seen June 8 Seems abandoned to me
4/11/07 RFE 7/30
4/17/07 Last seen 8/6 May have it..may not RFE?? Who knows Russia
4/24/06 Last seen August 10 waiting still?
5/01/07 Waiting - China
5/01/07 Waiting Vietnam
5/04/07 Last Seen August 4th
5/07/04 Last seen July 26
5/08/07 RFE
5/09/07 Waiting Peru
5/09/07 Waiting Ukraine
5/09/07 Timeline says NVC Left 8/1/07 no NOA2 info submitted though??
5/10/07 Last seen July 20

good job!!!! thank you!!

I’m new here and VJ has helped a lot. My honey left to the States 3 days ago and I’m going crazy because I didn’t think it is going to take such a long time because when we looked here processing times where much shorter. We met here in Germany where I was doing my Master and we hoped so much to go together to DC. I even got all the papers in Zagreb in June (btw. it took me 1 day!! to get all of them).

I’m really optimistic person but this is way too much.
Anyway, I’m glad I’m not alone, it helps a little bit.

For info, I learned yesterday that our file was sent to Bern, Switzerland the day before. 31 days after NOA2

Since we have done all (police, medical) things required (low volume of emigrants from Switzerland, we got the package 3 before by just asking before the NOA2). We just need to negotiate an interview date, since my fiancée is in Los Angeles with me...

Will keep you posted

Stephan

See, this is interesting. In some countries you can get interview date fast, like I did (there is also low volume of petitions) but it's the same thing with Germany and I know there is a high volume of petitions because half of US military is stationed there.

NVC received our case two days after we were approved but it was stuck there due to the change of embassy and my address. Finally, it was sent out to the embassy in Zagreb on Friday. I'll call tomorrow, they should have it. I should get my package 3 right away, and i don't have a clue what should happened after that. I guess I'm going to have to wait for the instructions about medical and the way interview is scheduled because there's hardly anybody on VJ from Croatia.

Hi everyone,

i'm new here and after reading a lot i would just like to ask few questions. We decided to take lawyer to help us with everything (after i discovered this page and saw that its maybe better without lawyer). Lawyer sent all documents at May 20 and we received case number at June 3 (i saw that at their page). Since then nothing sad.gif Papers are sent to Vermont. I'm croatian and i would like to ask if somebody from croatia is right now in the process? Our lawyer told us that usually takes up to 9 months until interwiev, is that right?

Thank you for all answers,
Tihana

Hi Tihana, I'm from Zagreb, Croatia and went through the process, you can see my timeline in the signature, if you have any questions I'll be glad to help, just send me a message. There's only a few people from Croatia that recently went to the process.

Am another May filer and just wanted to say hi to everyone and that we have got to be SO close to getting our NOA2's!!! Every day of suspense seems incredibly long, but our day is coming---I think it was C.S. Lewis who said "The pain now is part of the happiness then". God bless all of you as we wait it out together and look forward to being with our loved ones again soon!

On another thought, have any of you made any **wedding** plans yet? Have any of you set tentative dates, or are you waiting til later to do all that? Has anyone else struggled with trying to arrange the minister, caterer, and make reservations etc when you really can't give a sure date? Maybe all that is premature, but a lot of wedding venues/people/places require several months in advance to reserve them---so my fiance and I have decided that small & simple is the way to go as far as the wedding hoopla goes. The main thing of course is the MARRIAGE, not the wedding, but I was just curious as to what everyone else is doing/planning.

Godspeed the USCIS!!! good.gif

Hay!

I and my fiancé decided to have a small civil wedding when I get there and then later a big church wedding somewhere (Croatia, US or Dominican Republic) for family and friends. I’m sure small weddings can be nice.

Middle East and North AfricaCultural Shock

My husband had done a lot of traveling throughout Africa and had seen quite a bit so there really wasn't much culture shock once he was here. The only thing that still makes him (and me too sometimes) is the lack of transportation here. He could ride a bus, but he has to walk 1/2 mile to get to the bus stop. The fare for a taxi is outrageous here. So now he cannot just walk out of his house and go someplace like he used to. Oh, and the fact that everything closes around 10:pm here kinda freaked him out, but I don't consider that culture shock. :star:

Yup! If you don't have a driving license better get one if you want to live there :D . Public transportation is not so good in US. I’m in Germany where everything works so good that you don’t need a car at all, ever. The same is in Croatia, where I’m from. Anywhere in Europe is so easy to get anywhere without a car.

IR-1 / CR-1 Spouse Visa Process & Proceduresphilippino spouse To Germany
Here what I got as an answer from my sister:

"Sofa card can be a stamp, but it is stamped when dependents obtain no-fee passports prior to assignment to Germany. That is the case for new passports (they get stamps in the same time as a passport) and it is for US citizens. Sofa is also obtained as a card in a case of already having no-fee passport or for nationals with a foreign passport. It is not stamped in foreign passports. I know that in Germany, passport agents and in some cases personnel offices issue Sofa cards. However, for certain countries only 1st Perscom in Heidelberg can issue sofa cards. Not sure what countries. Either way, sofa cards are obtained prior to travel to Germany. If there is a passport agent on base in Korea, he should be able to issue Sofa card. I wouldn't recommend travel to Germany without it, but sofa card can be obtained after the arrival. Not sure what are travel restrictions to Germany for Philippines citizen. "

So I guess she should be able to get sofa card prior coming to Germany. Can't you get it somwhere in the States?

IR-1 / CR-1 Spouse Visa Process & Proceduresphilippino spouse To Germany

I am a Solider stationed in S.Korea. I am having a really hard time trying to find out how to bring my wife to Germany. I Deros in October we will go to the states first on her CR1 visa for a month and I do have her on my orders to Germany but my question is how do I get her from the states to Germany I know I need a sofa visa but I was told to send her visa to 1st perscom, Germany to get the sofa stamp which I do not feel comfortable with at all(sending it half way across the world). Do you know if i can initially get her in Germany on orders alone and her id card / Philippine passport then get the sofa visa or do I have to sent her passport to 1st perscom, Germany before I can bring her with me.

Thank You For The Help

IR-1 / CR-1 Spouse Visa Process & ProceduresAdministrative processing after denial on interview
QUOTE (chaingang @ Sep 27 2007, 10:34 PM) <{POST_SNAPBACK}>
Respected visa journey peeps ,
i hope everyone is fine , i was denied on march 28 2007 and i post my story what they did to me and how i was rejected , i was rejected under section 221(G) and they said they are going to send my case back to NVC for further recommondation , that it be revoked, in short letter of revoke,

cant forget 28 march that how did i feel on that damn day , but it was hard time, after that i didnt waste any time and start working on case with full effort , and i am thankful to my wife she was and she is playing the best role ever a wife can play , we worked as a team , and start working on our case, my wife came to pakistan after my denial and she stayed there for 2 months, we enjoyed alot , it was one the golden days of my life,

here her stay in pakistan we did work together what should we do i start gather all necessary proof , like property papers affdavit of supports, medical papers, comingling financess ,phone bills, ,new pictures, there were tons of stuff, we gathered in pakistan,

having all those things in my wife hands she went back to states, and from there i start searching for a lawyer with the grace of Allah i found out a very nice lawyer she took keen interest in our case, and guiding me what should we do ,

I and my wife thought that our case is sent to uscis and we were waiting for NOIR, coz it was like 4 months passed and we havent got anything

Thanks to our lawyer she found out where our case was, it was not in uscis not in nvc it was in damn islamabad pakistan us embassy , and i was shocked that's unfair that they kept cases for that much long time, but here the famous saying whatever Allah does , does for good, she contacted them and ask them about our case, they simply said that this case is going back via route nvc to uscis,

she tried to covience them that they do have bonafied marriage and coz of my ignorance i was not able to provide enough evidence, this negotation was going on for like 4 weeks, and in those 4 weeks our lawyer told us that send me all proof u guys have, she gave us list of proof, well Allah has already put in our mind that we need to gather proof, i gave my proof to my wife and she already was working on proof in united states just like me like support of affdavits property papers, medical papers, and all those things.

so we sent our proof to our lawyer , like i said she was talking to embassy and she was trying to tell them that we deserve another chance to prove our point, finally they got agreed and said that u can send us proof via normal postal mail .

our lawyer made a full file along with all proof attached, and send it to us embassy islamabad pakistan,
they got the proof, and inform our lawyer for that , that we have received the proof and it is been forwarded to the immigration visa unit,

After that we were in waiting process and praying that they should give a look to our proof, and another thing happened, that they start calling my wife's job place that is she really working or not , she is working in the hospital plus she was going there for her pregnancy checkups. so they were kinda in doubt working in same place and doing job , so they called and confirm that .

After that like i said that we gave them really alot proof ,to be honest if they deny those proof they will deny every damn thing on earth

we have joint property in pakistan as well as in united states, that is a very big pluss point for us , no 2 my wife pregnancy is on the biggest proof, and then with all other supportive documents, that i have like affdavit of support, pictures, insurance papers, phone records of 7 years, email records of 7 years chat logs,
my bad luck i didnt took interivew serious i thought it would be normal thing i didnt know how hard it can go ? anyways i didnt give them enough proof on my interview and when my lawyer send them tons of proof obviously they had a doubt in their mind that how come it is possible same guy came here to intervew and he was unable to prove and now same guy giving us that much proof, so it would create a doubt.

AFter couple of weeks 2 investigations officers came to my wife house asking questions that how did u go to paksitan , why u got pregnant, asking about us in the neighbours, confirm our property papers that yes this is the truth,
they simply ask every thing that was sent to them from a to z, but like everyone knows there way of asking questions are different ,

now after long wait , they sent an email to our lawyer , it was about one month ago , this is what they said

"Currently this case is pending for an administrative processing. We will contact the beneficiary in this case once this processing has completed and we are ready for the final processing of this case".

i know my story is little long , but i needed to know what does it mean exactly are they going to send me another interview letter ? coz i know onething for the fact that when u get denied embassy will never contact u in anyway and indeed i tried to contact them but no success, and here they are saying that they will contact the beneficary , and who is beneficary obviously me , so i have strong faith in Allah that they will give me a call for reinterview,

but i needed to know from u guys why they are doing administrative processing now coz as far as i know it happens after ur approval , they will let u that ur case is under administrative processing and when it is done they will contact the beneifacry for visa.

so in my case it is completely different and i need to know the comments of u guys what u guys say and wat u guys can take out of this all story , i will be waiting for you guys answer

thanks for reading long story i hope no one is bored lol

Ok, I have to say this although I may be wrong. I think this all happens just because you're from Pakistan and it's sad that we all have to live in this world the way it is today.

Thank you all for posting replies.
We are just applying for the visa for the second time so we haven˙t filled in the forms yet. Where on the form should we use A Number?
On the form itself it says that it is a field for USCIS use only.

It is for the same fiancee. Do we need a letter requesting a waiver?

I would if I were you take a second look at the G-325A as well as the I-129F Part B, Q#9

If you read the IMBRA law it appears that you do not. There is some question as to whether the USCIS is adjudicating properly.

My reading is similar. I would say you need the waiver letter because USCIS is not adjudicating as the law is written.

Thank you all for the help.

Nice!!! I'm not the only Croatian here laughing.gif Sretno!

K-1 Fiance(e) Visa Process & Proceduresfaxed I-129F Expedite Request this morning

I’m currently in the US Air Force based in Germany. I’m due to return to the U.S. in Oct 07. My fiancé and I currently live together at my residence in Germany.

I originally applied for an I-129F in Mar 07. The California service center denied my application saying that because my current location was overseas, I must submit my application to the nearest American Embassy. I then contacted the US Embassy in Frankfurt Germany and was informed they do not process I-129F Visa’s.

After numerous phone calls and emails to the US Embassy, US State Dept. and USCIS, (which weren’t very helpful) I was advised to re-file my application and use a stateside address on the petition. I did so in Jun 07. A few weeks later, I finally received notice that my application was received and being processed.

Clearly the I-129F application refers to U.S. Service members living overseas (I-129F part C question 1). For this reason, I feel that my first application should not have been denied. Had my first application been approved (submitted Mar 07), the process would have most likely been completed before I was due to return to the U.S. in Oct 07

Yup! They definitely made a big error! My fiancé was stationed here in Germany (he left 3 days ago) and we applied for a K1 visa in May at USCIS in Vermont. That is the way it should have been. I don’t understand them, it’s not like you are the first person applying from overseas, especially from Germany.

K-1 Fiance(e) Visa Process & ProceduresNationality and Permanent Residence of Finace
QUOTE (sunray21 @ Sep 27 2007, 07:51 AM) <{POST_SNAPBACK}>
My fiance holds a German passport. She has not been in Germany for years, and travels quite a bit. This means she is not a permanent resident of any country. She now lives in Canada ( last 6 months) but is a temporary resident for a three more months until her temporary permit expires. Then she is traveling again. I am a US citizen and putting a K1 visa application for her. What address should she use as her address? Which counsular office should process her Visa? One in Canada or one in Germany?

So far I have read one article that briefly mentions that permant residence and then nationality is used to determine the counsular office to use. Also counsular office can agree to do this on a case by case basis.

Thanks for you help,

sun

Hi! I think she needs to put all the address’s she lived on in past 5 or 10 years, I don't remember. It doesn't matter if it's her permanent or temporary address and also how long she lived on that address.
With a German passport, she should be a permanent resident of Germany. But they have some regulation about when a German citizen goes abroad for a longer period of time they need to say in local office where are they going to live abroad, again that's just what I think.
If she's not staying in Canada it is better to put consulate in Frankfurt because process is really long and according your statement that she travel a lot, who knows where she is going to be once petition is approved.

K-1 Fiance(e) Visa Process & ProceduresJust telling our current K1 story
QUOTE (Bibi&Tanoah @ Oct 30 2007, 10:04 PM) <{POST_SNAPBACK}>
So, it took 5&1/2 weeks for them to send our petition to Frankfurt, but it's on its way. I called them a few times before I found someone nice enough to take the time to find out where and when my petition was. I hope this helps anyone waiting. Be a squeaky wheel and you will get some attention or information to help your nerves.

Our is stuck at NVC also but we changed the embassy from Frankfurt to Zagreb. First we called every day in order for that to be changed. Finally they changed it on October 22 and send the letter with the same date that our petition will be forwarded to Zagreb within a week. Of course it didn't happed. We call every day in order to try to get some info and it's a hard job!

K-1 Fiance(e) Visa Process & ProceduresRFE FOR CRIMES NEVER COMMITTED!!!!
QUOTE (archie07 @ Nov 6 2007, 09:25 PM) <{POST_SNAPBACK}>
I agree with Rebecca on this one. You received an RFE and havn't even consulted the lawyer. Why take a chance with something so important when one petition has already been denied? Seek legal advice and have the lawyer sort thru this before you get denied again.

It's easy to say consult the lawyer but it's hard to find one that can finally help, personally I hate lawyers that don't do their job the way they suppose to.
I always like to take care of the stuff by my self, I don't trust just anybody.
