NSC got it on April 30 and the check was cashed on May 3. Pretty fast on getting the money... Now let's see how long it takes to get an NOA...

We filed our joint I-751 Petition today and this is what we put in it:

1) Copy of Wife's Green Card (Front and Back)
2) Copy of 2005 and 2006 Tax Returns as Married Filing Joint
3) Copy of Car Insurance Declaration Statements showing both of us as authorized drivers
4) Copy of July and January Bank Statements showing Joint Account for 2005, 2006 and 2007
5) Copy of Deed to House showing my wife and I as tenants by the entirety
6) Copy of Mortgage for Home Equity Loan showing us as joint borrowers
7) Copy of Driver Licenses for both of us
8) Copy of Tax Receipts from Charities showing that we both jointly donated to the same charity
9) Copy of Visa Statements from July and December from 2005, 2006 and 2007 showing us a joint borrowers
10) Copy of Life Insurance Documents showing each other as primary beneficiary
11) Copy of 401k and IRA Statements showing Wife as Primary Beneficiary

I submitted my I-751, got a Notice of Action and had my biometrics appointment. I've been tracking my case status online and even though it was "touched" few days after my biometrics, the status still says "petition to remove conditions of permanent resident status received". The date show's 3/29/07. Does this mean that my application has been approved and it's in the processing, or do I have to wait for approval before they start to process it? My case is with Texas Service Center.



It is not approved.. you're in line for it to be adjudicated... Expect about an 8 month wait from the date of receipt at TSC...

Yes...

Regardless, the extension NOA from the SC states that your PR Status is extended for one year and is valid for travel and employment purposes.

Yeah.. a DL and a Unrestricted SS Card is enough for the I-9. The employer has absolutely no right to ask you about your PR status or for your PR card if you have the DL and Unrestricted SS Card. If they give you a problem, you can get the Department of Justice to give them a call to set them straight... I'm sure they would love it.

Did you get an updated social security card without the restriction to work phrase on the back?

No, I did not get it and I think I see the importance of getting it now. I judt didn't know that the SSN card without the restriction is a valid proof for the I-9. I found out by chance this issue with the I-9 form.
I thought the extension letter (I-751 receipt) was enough to work but now I'm not that sure.



You can still get it... go to yourlocal SS Office and with the Expired GC and the extension letter, you will be able to get an unrestricted SS Card.

Each ... dependent ... listed under Part5 of Form I-751 is required to submit an additional biometric services fee of $70 ....... regardless of age.

2) Their service goal to processing I-751's is one year. They have now brought how they report processing times on I-751 in line with their other family based petitions.

Zyggy where did you get this info? What about those of us who were on the verge of getting our petitions processed (like our situation where they were a month away from processing our case before going backwards from November 06' to July 06')...are we just screwed over and they're going to process the other service centers July 06' petitions before they get back to ours? If so that is unbelievably unfair (is it even legal?)!!!



It's a very educated hunch based on what happened with I-129F's and I-130's in the past few years. WHat you are seeing happened with those petitions in the past

And you're not understanding what this means. IF your petition is already at a SC, it will stay and be processed at that SC (and very likely have more people put on them so they can get them out of the way and focus on other petitions). What this likely means is that starting July 1, When a petitioner sends their petition to the SC that covers the area that they live, that SC will input information, cash your check and then send your file to VSC for adjudication.

The new date doesn't mean they just stopped and went backwards.. What this means is that they have a year to process it and don't bother calling USCIS or your senator or congresspeople for help until their service goal date passes. In reality, they will be processing petitions well before the date posted on their website.

And USCIS can do whatever they want with your petition to get it processed... there is no "legal" right to having it processed at a particular place at a particular time... and life isn't fair and USCIS isn't fair either. The way they see it, you're a PR.. you don't lose any benefit by waiting for a I-751 to be processed. When I first started posting here, it took USCIS almost 2 years to process an I-751. Usually it took applying for Citizenship to get a I-751 processed and then it was processed at the DO when you were sitting for your Natz interview.

If USCIS made a service error in giving you a 10-year card instead of a two-year card, you are still responsible for filing an I-751. What you plan to do is exactly what you should do...

If they return it to you and they tell you you don't need to file it, then keep a copy of their response in case you have any difficulty when you naturalize...

As in the other thread.. this probably means two things based on what happened with I=130's and I-129F's in the past couple of years...

1) All I-751's will now be processed at VSC probably starting July 1 (the ones already at the SC's will stay there with probably some accelerated processing of some sort to clear their inventory and use the adjudcators for something else) This is in line with their goal on the service centers processing from a certain geographic jurisdiction perspective (One SC processes all petitions from a certian area) to a functional jurisdiction perspective (i.e. CSC processes all I-130's and I-129F's, NBC processes all I-485's, NSC processes all Asylum Paperwork, etc.)

2) The processing times reflect their service goal of one year to process an I-751. This is no different than how USCIS reports the processing times of the I-129F and the I-130.

Yeah.. there is no additional extension. In order to get an extension, you're going to have to make an Infopass Appointment, find out about the status of your case, and ask for an I-551 stamp for your passport.

Yes, they work on Saturdays... Usually Tuesday to Saturday...

And the biometrics letter and the NOA are two different things. Anticipate getting your NOA extending your ststus in the next few days. We got our biometrics letter two days before we got the NOA for the I-751.

Your petition wasn't accepted until all the required fees were paid. Sorry, if you sent in the biometrics fee after the date, then you have to pony up for the increased fee. You have to pay the fee in force at the time the petition is accepted.

Green Card holders shouldn't have much of a problem getting Schengen visas. I wouldn't worry about it. It's what was said before, fill out the application, provide proof of your perm residency in the US, pay the fee, and send your passport to the nearest Spanish consulate.

Why did you wait so long... you should have filed the N-400 as soon as your were eligible. 90 days before your 3-year anniversary.. July 2007. You may have been a citizen by now...

File the N-400. It will force the adjudication of the I-751.

There was a couple of people who had late December NOA dates that were approved in the last few weeks. It looks like the dates that are posted on the website are pretty real, their pace looks like two weeks of progress each month. So when the dates past on Nov 15, we should be about Jan 15 or so.

You're going through NSC.... The lastest info is that they're approving very early January and late December cases right now. You're on schedule so no reason to worry right now. Right now they're approving at a pace of about two weeks worth of petitions per month. Just sit back and relax, your petition will be approved in good time.

If the time comes that you're been wating for more than a year, you need to make an Infopass apppointment at your local DO and get a passport stamp as proof of your continuing PR status.

That's right. We did the same, changed address online and mailed the sponsors change of address. They sent a confirmation letter to the new address. I didn't ask for a transfer, I have never heard of anyone doing that.



Are you going to file N400 soon with CSC? I wonder if you i751 is still pending at NSC and you file your N400 at CSC, how will the service centers handle the A-file? Assuming the A-file is with the pending i751 application at NSC, now that they see your new N400 application at CSC, will they just move the A-file from the i751 queue at NSC to join with the N400 at CSC. I read that you are supposed to have 1 and only 1 A-file at any given time.



Yes, this is exactly how it works...once you file the N-400, your A-file will be forwarded to whatever SC has your N-400. The I-751 will now be processed with your N-400.

I will definitely contact my congressman. I think all of us in this situation should contact our representatives. What worries me is if I need to apply for a new job. With an expired green card and a paper (or stamp) that says you can only work for a year beyond its expiration date, how attractive are you? I know it’s enough to show SS card and driver’s license, but with the competition on the job market I’m afraid I wouldn’t have much of a chance if they have several qualified candidates to choose from.

I hope you are right about the 30 days. I guess I have to call them and ask.



Why should it matter... you don't have to tell them anything about your PR status and they can't ask anything more.. they only need to know that you have it. Documentary proof of your ability to work is satisfied on an I-9 through a unrestricted Social Security card and a Picture ID. If you don'thave these things, I suggest that you take the time to get them.
