US Embassy and Consulate Discussionmystery envelope
I told him not to worry about it, because no, its not open enough to get paper in or out. Its not easy for him to get back there. Hed have to hop on a train at 4 in the morning and its alot for him to get there. I told him not to worry about it, because the opening isnt big and he should be fine, but if he wanted to fix it, to go to the embassy the day hes in Bucharest to get on his plane (by train schedual he has to be there 1 day early and sit around the airport anyway) to go ahead and take it back to be resealed since he will have a whole day.

Ed said when he got home he noticed the embassy gave him his mystery envelope not fully sealed. he said the corner isnt sealed. Hes freaking out, he said he didnt tamper with it, or try to open it, but since it is under half opened, hes afraid it will cause problems for him at JFK customs. Any advice???? :(

US Embassy and Consulate DiscussionHello

My fiance is in Italy working. Once he becomes a permanent resident, can we re-open the K1 petition and have it re-routed to Italy from Iraq? Or will we have to start all over again?

WD,

If your fiance is legally present in Italy (work visa?) he doesn't have to become a PR to have his visa processed there. Did you put his Italian address on your petition?
Usually the Consulate requires tht the applicant have 6 months forward legal stay in a 3rd country before they accept the case. Is your fiance scheduled to leave Italy soon? Can he get a further year's extension on his work permission?
If he is not there legally, he will probably have to interview in one of the alternate posts---Ankara or maybe Nicosia? Are they even conducting interviews in Iraq right now?

Mr./Mrs. meauxna... to be honest, my fiance WAS in Italy legally to work. When his work visa expired, he stayed illegally. Now, his passport is stolen and he is afeared to return to Iraq to try for interview because he is ascared that he will go to jail because he overspent his time on the work visa. So he said to me that he wants to try to become permanent resident of Italy now. ONce he becomes permanent resident, he can have another passport. Will we have to do another K1 petition? Or will we have to wait 2 years like as i read?
Thank you.

US Embassy and Consulate DiscussionNew Article on Consular Denials
Yea I hit 2 of the red flags, I havent seen my fiance in a year and 2 months and that was because when I left in Feb of 05 i was 6 months pregnant and now i dont want to take my son on a plane so young, and my divorse wasnt final until 4 months BEFORE filing the petition, tho it was the SEVENTH time i filed for the divorse in 10 years, i hope they take that into thought as I wrote it in a letter.

US Embassy and Consulate DiscussionUnsuccessful Interview - Now What?
After two days of interview, my fiance was denied travel visa.

What discretion do they have at interview stage to deny visa when all paperwork has been presented on K1? What course is advisable from adverse interview decision?

thats the question in form here? was your fiance trying to come on a k-1 or a travel?
OR
was your fiance trying to come on a travel while waiting for the k-1 visa??

if your fiance was trying to get approved for a travel visa while waiting for a k-1 visa, your fiance would be denied, as far as i know you can only apply for one visa at a time. if yur fiance already had the travel visa that would be different,. but can not apply for both at the same time.

maybe we are all confused, could you please verify what you are fully asking :)

US Embassy and Consulate DiscussionCo-Sponsor Question

You will be fine. My mom cosponsored for me and Ed bc i had just had our baby boy and was not working. She met the poverty line and we were approved just fine.
You will be ok :luv:

Hi,

Since my fiancee in the US and I are in a similar situation (she is not working because 1 she is a full time college student, and 2 about to move and her step-dad is the cosponsor) I just wanted to ask if you still submitted an I-134 yourself. I read somewhere that the US fiancee has to be the primary sponsor, hence provide an I-134 as well.

Thanks,

Phil

Yes, i still had to submitt the I-134. But not having income on there didnt hurt me bc i had the co-sponsor, and in my intent to marry letter i had it all in there about why i wasnt working bc it was in there about me just giving birth to our son. weather they read it or not, i still had to file the I-134

To clear things, even tho you have a cosponsor, you still have to file the I-134, you are the sponsor, the cosposor is just helping you. You still have to file the I-134

US Embassy and Consulate Discussionmy calling card
Call the customer service of the calling card you are using, they usually can pull up records of the calls from the pin numbers. It might take a little while but its worth a try. I know i did that and got the call log from my calling card pin numbers, i only asked for 5 of them, didnt want them all, it was too many. I know someone else who did this as well. And the call logs are not a big deal anyway, honestly its good to have, but not all of us can produce the call logs for calling cards. If you have ever called on your cell phone, you can get the call logs for that as well.
Good Luck

And i agree with pingo being a good company

US Embassy and Consulate DiscussionK1-Stressing Out About 125% Above the Poverty Line
QUOTE (GJen @ Jan 20 2009, 10:38 PM) <{POST_SNAPBACK}>
A Bit of Background:
After doing a bit of research, I've heard some people say 100% was needed and others say that 125% was needed for the I-134.

I don't want to take any chances. If the Fiance Visa is anything like the Tourist Visa, (Rejection= No Refund) I want to be for sure that money wondn't be any source of a problem for being approved. My fiance applied so he could visit and meet my parents, but it didn't happen most likely because they didn't believe he had enough money.

My yearly salary for my full time job is roughly $2,000 under the 125% poverty line. I figured that I only needed $45 per week to make up for the difference. I also do some waitressing. I figured out that I could work 7 hours there in addition to my full time job and I would be covered.

A Few Questions:

I've looked over the I-134 form.. I only see one blank to put in your job. So how would I list my other one?
What is considered a good amount of money to have in savings? I've just finished school full time and this is one of my first jobs. =/
Will I be frowned upon if I don't have any personal property or real estate?

thanks!!

If you do not meet the requirments for poverty, you can get a co-sponsor like alot of us did.

One thing that will help you meet the guidelines is to have money in bank...I have heard that they consider it at a rate of 3 to 1 so if u need $2000 to meet minimum threshold u need $ 6000.00 in bank.

US Embassy and Consulate DiscussionIs there any way around a co-sponser?
QUOTE (Nich-Nick @ Feb 9 2009, 12:40 PM) <{POST_SNAPBACK}>
You probably don't understand that when/if he gets to the US, he will not be allowed to work immediately. You have to first marry, thn file for his green card and work authorization which costs $1010. Then you have to wait months to get that work authorization. There's no way you could know he would start work on x date.

Thats not true....depending on his POE...if given a work stamp as my husband was given at JFK...he was able to work the week he got here.

QUOTE (Cailyn10289 @ Feb 9 2009, 06:36 PM) <{POST_SNAPBACK}>
My fiance just got packet 3 and he gave me the link to the website listing all the documents he will need. When I read through the site I saw:
"An I-864 is not required when applying for a fiancé(e) visa. An I-864 will be required at the time the fiancé(e) visa holder applies to adjust his or her status from nonimmigrant to conditional resident with the United States Citizenship and Immigration Services(USCIS)."

Does this mean I won't need to fill one out for the interview? We'll only need one after he's in the states? Can someone who has gone through the London embassy please let me know if this is true?

yep, thats what it says. It isnt needed for the K1 fiance visa. Once you are in the USA married, and adjust status, then you will need it.

It's unfortunate the OP didn't execute the I-134 the week before he became unemployed.

So, what purpose does this post serve the OP, Pushbrk?

like most of his posts lately...it serves NO purpose at all.

to the OP, unemployment is concidered an INCOME, and if it exceeds the poverty line, then no you dont need a co-sponsor, if you want to get one anyway, who are we to say no.

Your fiance is not here yet, and not living in the household, therefore she wouldnt count him as being in the household yet. therefore bringing you to 3.

When it comes to meeting the poverty guidelines the OP and her mother both have a household of three.

Petitioner

1. Self
2. Child
3. Intending immigrant.

Mom/co-sponsor

1. Self
2. Son
3. Intending immigrant

Mom needs sufficient income for a three person household as shown in the 2009 125% of poverty guidelines reference table.

i know...I JUST SAID THAT!!!! i dont need you to explain what i just wrote and already know
