Hey everyone!
I'm new to this whole thing and I haven't got a clue. I would love any advice that you could give me.

My fiance is an Indian citizen and I am an American citizen. We wish to get married in India and live in India. Which forms do I need to file!? I thought I would need to file the K-1, but we do not want to get married in America. Then I thought I would need to file the K-3, but we are not married yet nor do we intend to move to the US. I'M SO CONFUSED!

I would love any advice that anyone could give me.

Get married in India and file for either K3 or CR1.

They dont need to file anything if they are planning to live in India as the OP has stated.

I got that same RFE letter...it was because I didn't provide a copy of my passport book in it's entirety--including blank pages! It doesn't say so in the instructions, but somewhere else I read in one of the other forms it does, so I was anticipating that my file would be returned with a request for more information...

This delayed my processing for about 2 weeks I guess.

Also MENA4LIFE a reminder to keep from telling people which visa to go for, its good to adv to go over the K3 and the CR1 and decide for yourself what is the best. What is best for some is not always best for others.

Yes, it was approved and he started in the month of March, we had to stop because of the whole name thing and the lawyer said it might pose a problem so we are correcting the names and then we will be back on track.

Usually when the petition is being held by FBI, or security checks, they have seen something of interest and could possibly be something about your husband, with all this weird bio on him. And this unfortunaly can take years to resolve before approvals, interviews and visas in hand. Contacting people in Finland will not help you at all, it is a US immigration issue, they will not get involved. Your husband should be constantly on this. It should be one of his priorities. However, there have been people on VJ who deffinatly ended up on security checks for years before anything happened.

If, when logged in you're looking at your account page , you'll see a link about half-way down the page called "my timeline". Click on that, it takes you to the page to enter your information. Approximation is fine, exact dates are not necessary. By looking at one's timeline, people can offer help and suggestions, and it is of great help to other members in estimating their own process. smile.gif

Specific to your case, though...if your senator was able to find out that you're in FBI namecheck, it unfortunately means that that the lenght of time your process can take is uncertain. There is no set time for how long FBI namecheck can take, and you'e going to be able to find much more info than that. I'm sorry. sad.gif

In the meantime...you should look around here and gather as much info as you can for what you'll need for when your petition is approved at USCIS. Your husband filed a spousal petition, and once approved there are still a few steps before you can interview for your visa.

On a bright note (it may not be any consolation, but I'll put it out there) since your process has taken long(er) and if it is two years since marriage, I'd scrap the K-3 visa and go with the IR-1 visa, which will give you the 10 year green-card right off the bat....no need to remove conditions. You'll be a permanent resident from the time you get to he US. smile.gif

There are still MANY MANY members on VJ still waiting for approvals for April. If you say your Notification date is April then that is your NOA1. You should have recieved a paper about that from USCIS.

and yes, if you want to be given the correct help and advise here, you NEED to fill in your timeline. Without it, no one can say for sure if you are out of the processing time and can not give you help.

Processing times always vary. Everyones case is different, and every person reviewing a petition is either more or less efficient than another. Normal processing time is 90-120 days. If you are out of the 120 days then definitely make a call to them. I mean you can call them anytime and check on it, thats your call. But normal CSC processing is 90-120 days. And per your timeline, you're only in the 60 days. So you still may have some time to wait.

oh he got it this morning. He went back to the post office, and took his already angry, touchy, pissed off mom with him. she yelled so much they finally gave her the name and address they gave the package to. When they went to that house, the old lady said she didnt have it. Eds mom went off on her this time. she finally said she had it, but it would cost them $10 to have it. Eds mom pretty much tried to kill the old #######. but ed said no lets just give her the money, i need those papers, and he ofcorse wanted to see the tape of his son. Anyway EVERYTHING was there, except the 2 deodorants i sent and toothpaste. but the visa papers were there, the $200 i hid in a photoalbum behind a photo was there(yea yea i know never send money in a package, wasnt the first time, just the first time he didnt get it hahaha tho THANKFULLY he did get it even this time), EVERYTHING. SO stress gone, we can enjoy our approval now :) :luv:

Lost in the mail?? Just to be safe, call the credit bureaus (3 of them) and have an alert put on your credit. That way someone can't go identity thiefing and all that crazy stuff. Hope the stuff will eventually arrive, though. Sometimes it just takes a while. One time I sent a card to Javier and it took 3 months to arrive.



They said at the Romanian post that the package was delivered on April 27th, Edy said he never got the package. He even went down to the post office and the package was not there. There is an investigation out by the USPS on this (I WILL NEVER USE USPS AGAIN), and i hope something is done about it. The thing in Romania is they never deliever a package, you HAVE to pick it up at the PO, and you have to show proof of identity when picking it up, so i think fraud was involved in this. :(

Does it really take 30-60 days for CSC to send the petition to the NVC???
I just called and talked to a CSR (waste of time including a 10 minute wait on hold) and she told me it takes 30-60 days for CSC to even send the petition to NVC.

Also, i sent my fiance the whole petition pack, in it was the original NOA1, the post office lost the entire thing. I emailed CSC requesting a new NOA1, it was the only thing i could think of doing. The whole reason i called the 800 number was to request the NOA1 and she rudely informed me they are for general information and i can not request anything through them, that i have to email CSC.

any advice on both??

They received my approved petition yesterday (5-22-2006)
I called back tonight (5-23-2006) to ask a question they told me it was already sent to Bucharest TODAY.
you can imagine my shock. im still shaking. :)

Just bc they were the first of 3 on VJ to get an approval is not an expidite. whistling.gif and USCIS wouldnt have expidited for pregnancy just bc she doesnt wanna fly in her 8th month. her timeline says: Your I-129f was approved in 116 days from your filing date....thats not expidited, thats about normal time.

I was just advised by some members here to give it a try cos the USCIS granted my speed up letter. I am an august filer and I got the first among the three filers who got fist approvals.

Is it the NVC that designates interview appointment to a particular case then notify the embassy about it?

I know this is a shallow reason to expedite a case, but what i'm after is the early interview appointment atleast prior to my delivery or so that i can get to the U.S. before airlines wont allow me to board.

All joking aside, all it takes is one email to the NVC and your expidited but I think the process is different for a *caugh* K1 then CR1.


Special case maybe? there have been MANY on VJ who were pregnant and couldnt expidite. Lets also remember its at the NVC, she would need to speak to the consulat for an expidited interview. Do not fill her with high hopes. Just bc YOU were able to do it, whatever the situation, doesnt mean she can. and NO expiditing bc of pregnancy is NOT an easy thing.

Just because your pregnant, wont get you an expidite

and your paperwork wont sit at the NVC prolly longer than a week or 2 before they send it to the embassy, unless theres a reason to hold it.
you can call the NVC however to find out the status of your paperwork.
