K-3 Spouse Visa Process & ProceduresConfused plz help my fiancee is in New Zealand :)
I agree. You don´t have to wait to apply. Get married in NZ and file the I-130 right away. Make sure you hve copies of all of your documents so you have all the information you need with you (you will probably need the same documents for the marriage, anyway).

The sooner you file the faster your application will be approved. Carefully read the guides and dot every "i" and cross every "t". As elmcitymaven suggests, after you have read the guides, then post any questions in the CR1 forum. It is possible that if your paperwork is filled out properly with all of the necesary evidence, you could get throught USCIS in less than 60 days if your petition is routed through the California Service Center. As you can see at the bottom of our time line, our I-130 was approved 46 days from our NOA-1. Best wishes.

K-3 Spouse Visa Process & ProceduresNoob question about K-3 visa
Your wife´s visa will be a CR-1 since you have benn married less than two years (same situation as ours). I believe those of us with CR-1s will have an addtional step just before the two year period is up to remove the restriction and get our spouse the 10 year green card. Welcome to VJ.

K-3 Spouse Visa Process & ProceduresK-3 vs CR-1
Although our K3 is already at the Embassy, we are only going with the CR1. I expect it will only take a couple of weeks longer and as PUSHBRK noted, it will cost about $700 less. Plus, since Ivonne already has a US SSN, she can work in the US immediatly. We received our I-129F and I-130 approvals from CSC on the same day! Best wishes,

K-3 Spouse Visa Process & ProceduresTourist visa
My wife has a current, valid five year tourist visa, but we are not even going to try. She did visit last summer with her father, but it was before we were married. With her K3 pending, there is little chance that they will let her in now. They ASSUME the pending immigrant will not return, even with a return ticket. You can apply, but it is unlikely that she would be allowed in at the point of entry, even if they gave her the visa.
