My husband has been to six different states since arriving here back in November. Never to states where we think CBP would be an issue. We just always drive and he hasn't flown on a plane anywhere. He has his AP and EAD. Just waiting on the GC. We aren't going out of the country until we know for sure he has his GC.

USCIS is all screwed up. Here is my senario the only thing we are waiting for is our I-485.

3/26/10 - Filed for AOS
4/10/10 - Case transferred to CSC
9/9/10 - Last touched (Still in initial review mind you)

9/4/10 - Our I-129F petition for fiance visa touched (WHAT THE HELL????)

Wrote a letter to our senator. They advised us to wait 30 more days. Next week makes 30 days.. If these so and so's don't produce my green card in the next two weeks, they are going to hear my mouth very professionally and verbally!!! :angry:

I agree with this particular post. If it 'appears' to be a wedding, the reason they probably didn't look at everything is because they believe you are already married, which in this case would mean you would need to do a CR1 visa instead of a K-1 visa. Secondly, I am 16 years older than my husband and we were approved. We filed a K-1 and the only hold up we had was at the NVC stage and most likely they were doing a background check on us. I have several clearances and my husband (then fiance) record was clean. Yes, they do suspect age sometimes, but other times, its not a problem.

I also agree with other posters who suggested you tell them its an engagement ceremony and to refer to her as you fiancee not your wife.

thank you mrstee, i asked my fiance to call last night and they informed him it was sent off yesterdat, i don't mean to complain sometimes but the waiting is just frustrating and its like your whole life is on hold.

I dont see it as complainning, you are justified to feel the way you do. The process in and of itself its hard enough to deal with and you just needed answers. That's great if your case has moved on to the embassy, now things are going to kick into high gear. Make sure as soon as he starts to work on the police report and non-impediment! Sometimes they place you in AP (Administrative Processing). That happened to us. I kept calling everyday just to see where it was. First you should always have a history of phone records - For instance, when I was with a cell phone company ( I think sprint) I found out that for about a year and a half they were billing me 10.00/mo for free nights and weekends. It ended up totalling 250.00 that they owed me. They fought me to get it back so I told them, they either refund it or put it towards my early termination fee because I would not deal with a company who charged me for "free nights and weekends" I got the money back after talking to 7 different people!!!! - This wasn't even for immigration purposes..


Secondly, I agree with most here about hiring a lawyer, no this process is not EASY but its EXPENSIVE! Just think about all the money for the different documents, airfare, phone calls, medical/vaccinations, incidentals they all add up... Money for a lawyer could be spent on your spouse/fiance in a better way.

Just my opinion, food for thought! Good luck on your journey!:star:

I think the phone call will be better than wasting gas, tolls and whatever else.... After our case went to NVC we were placed in AR (Administrative Review) for about 25 days. I just kept calling everyday and kept a log of who I spoke to and what time I called. Unfortunately, all you can do is wait it out and keep calling. Good luck!

For what it is worth, I was approved on June 30th and on Friday, the NVC still had not received it. I did manage to get a hold of the VSC and was told last thursday that it "had arrived in the mail room" on that day. On one call I was told 90 days by the NVC too, but on other calls told 2-4 weeks. After having waited 4+ months to get an approval to have them not bother to mail it promptly is very frustrating...




Our NOA2 was approved June 30th as well. I am with the VSC and I called the NVC. The lady I had was very nice and helpful. She advised me to wait 2 to 3 weeks for my case to arrive from VSC and then call back. I think we all have a case of the jitters because of the wait time from the first NOA to the second NOA. Let's have faith everyone.. Things work out better when we have patience, trust me I know because I usually don't have any!!! Good luck to all my fellow VJ'ers!!!

I also think you should be persistent and keep calling NVC everyday. My situation was a tad different, I was stuck in AP for 25 days. I kept a phone log, names, times and dates. Sometimes I would get the same person every couple days and I would say, "I called on xyz day and I believe I spoke to you at xyz time and you said xyz" I don't know if it helps but they had to keep opening my case. At the very least I pushed them to do their job (so I think, lol)

Just checked DHL...two packages were delivered to the US Embassy Manila this morning at 10:30 a.m. Goodness I hope our cases are one of them...am going to call the 1-909 number to see if our file is in the system already...hopefully I can schedule the interview then.

Woah, lot of negative comments in this thread let's not shoot the poster for venting.

Say there is 30 guys, they have to process 2000 K1 visa's so they divide the workload, some of them work quicker than others, take less time off than others some possibly take cases home so unless a single person is adjudicating EVERY file there is no way USCIS could possibly process files in the order they receive.

Planning can be done during the process, I knew my now husband for 4 years before we walked down the Aisle, The visa (K1) took about a year from applying to actually entering the USA but we planned, we debated weather to have our big wedding in the USA or Scotland (we had a courthouse wedding here for legal reasons leaving big wedding/Vow renewal for Scotland)

Talk about the future or the process will drive you crazy. Update your timeline to get an estimated approval date.

Len says it all the process is not fair, it is what it is. Without Negatives there wouldn't be any bloody positives.

I also didn't see anything in Danu's post saying you were Lying, this site may save you alot of heartache try to be nicer when replying to members posts smile.gif .

I agree with you. I just started the process and our plans are to just have a quick ceremony at a wedding salon one year and our reception the following year.
