We sent photocopies in and I was concerned about the very thing and a USCIS agent said that it doesn't specify so send in what I have. We are now near the interview phase....


yes when my fiance sent me g-325a i signed all the 4 forms, signature and date... but wait didnt heard about this blue ink... i used black ink hope we will not get rfe bcoz of black ink....worried now... unsure.gif unsure.gif


The instructions for the G-325A do not specify what color ink to use. I think the suggestion to use blue ink is to make it obvious that the signature is original and not a photocopy or scan. People have gotten RFE's for sending photocopies of signed G-325A's.

The instructions for the I-129F specifically say to use black ink, but I've never heard of anyone getting an RFE for using blue ink on the form. I doubt USCIS cares much what color ink you use, as long as they can tell that the signatures are original.

You know this just reminds me of several things to tell my kids:

1. ALWAYS keep records of your immunisations / medical records;
2. Paperwork is important. Hold onto it. Now we have computers SCAN IT;
3. Keep track of everywhere you live (it took me AGES to get together that 10 year list for one of the forms, I moved a lot for Uni)
4. Voting is mandatory in Australia, so "change your address" with them (turns out I was "invalid" for 4 years. Usually they fine you but luckily they didn't.. maybe too many people to worry about)

I started a blog a while back (for myself) to keep track of things I've learnt that I wish I'd known when I was a kid. Silly stuff like what I want in a car, or other random stuff like that :P

With my immunisations, I had one at Uni, don't remember what date, no-one kept a record. Measles mumps and rubella it was. No record. UGH! Luckily my mother kept my baby book, and my home town still had my records from when I was a baby, and then in high school (around 95) when I had boosters. Saved me LOTS of money!

Ugh. If only we knew then right?

to the OP. I talked to my husband about your situation. He said if you've tried the clerk where you got married and they have no record, then it's likely it wasn't even legit. In Australia (and I thought here) that an address was needed in order to "serve" divorce papers so if you don't remember that, then could she really have filed for divorce? I know you can after a while of someone being "lost" but hmmm...

I am thinking that in the interest of honesty, that I would write a letter explaining your current situation as succinctly as possible to go in the file.

"Dear Sirs,

For the period of X - X I was involved with a woman called X.

We had a marriage ceremony around X of X "where a "friend" married us in their living room. I don't remember whether I received any official documents relating to that. (explain how it happened).

After finding out she "married" me for money, we separated and she was going to file for divorce.

After carrying out extensive searches and having spoken with the clerk at the court house (perhaps include a letter from them stating no record exists?) who advises no record of marriage exists, this leads me to conclude that our marriage was never official. I have also attempted to search for divorce records to no avail and have attempted to locate my ex but after so many years I have no idea of her current name or location. As it was so long ago I remember little about her.

Following my relationship with her, I re-married X and subsequently divorced in X, documentation of which is enclosed."

Something like that. Or ignore it altogether. However if anything is found, then you might get into trouble and the letter shows you were trying to be honest. However if you honestly believe that it never "really" happened then you're not lying. Someone lied to you years ago and luckily you got out unscathed (hopefully).

Also, you could write an email to them seeking their advice in the same sort of form, and then keep that email, and that reply as evidence of you being honest.

Maybe even the email could be simple like:

"I believed I married someone around X of X.

I say "believed" because the ceremony was in their lounge-room and a friend who was apparently a pastor. After extensive searches, including at the courts where the marriage would have been registered, I am unable to find any record of it. My ex was going to file for divorce for default judgement however I can find no record of that either.

What can I do in this situation? I now do not believe that this prior "marriage" actually was official however I don't want to mislead USCIS.

I have been married and subsequently divorced since then, and I have the marriage licence and divorce decree to submit with my application."

Whether you do it "quietly" or you tell them your info so they can keep the email on file (like when i was running late for my interview) is up to you.

Helpful hint - this is something I did. After I completed a form I had a close friend or family member review it completely. Its always good to have another set of eyes review to see if they see anything that looks incorrect. Also, dont spend to much time at once going over and over the forms. Fill it out then come back after a day and read it again. I found that I made little errors that I didnt notice in the beginning becuase I was straining so much and worrying too much. Always good to come back with a fresh mind and eyes. There are many wonderful people here that are willing to help so keep the questions comeing. If one is not familiar with your particular question or type of file others will certainly follow that can help based on their experiences. Good luck and best wishes!

Just a suggestion:

If you can include him as much as possible in the process. Show him the paperwork. Explain to him the rules. Show him the guidelines here on visa journey. He may be scared because he doesn't know what this entails because if he did he know that tourists visa are very hard to come by. K-1's are different. He has to be willing to go through the process together or it won't work. Knowledge is power! It can't be a one-sided thing because you are going to need certain things from him. Most of all just reaffirm your love for him. Let him know this is scary for you too but the love you have for him makes it all worth it! :thumbs:

I'm confused. If you are fine as a couple but he's not happy in NYC, then you're undoing about a year's worth of effort and relationship strain and then add at least the same again if you decide he should come back by not just getting married by a JoP and waiting to AOS (however without adjusting, he can't work...)

Why stay in NYC? There is so much to the US, beyond big cities and dense populations. I honestly don't think there isn't something for everyone. In fact, it's a part of American history - the way immigrants would set out into the unknown, and stop when they got somewhere that reminded them of home! Take a day trip out to Ellis Island and look at the migration trends of different countries, and where they ended up. It's a really interesting exhibit. I realise that you probably have to work to support the 2 of you, but could he approach it as a project?

Get online and research different states, the scenery, the culture, the climate. Take a couple of long week-ends if you can, and visit a couple of different ones when airlines are offering cheap fares and explore America. Find where you like and plan to move. If you treat life like the adventure it is, you get so much more out of it. And if this guy and you genuinely feel that you are 'for life' then who better to go on that adventure with?

I do know how difficult it seems though. When my fiance and I first met and realised this was the real deal, we planned for him to move to England. He spent nearly 6 months here on a tourist visa and discovered he hated living here. The climate, the food, the distance from all things familiar. He's far more of a homebod than I am but it took him a long time to tell me just how unhappy he had been. It nearly broke us up until I said, "No biggie, we'll go there." It's not the logical way of doing things for us but it's the necessary way if we are going to be happy as individuals and therefore successful as a couple.

Yes, you absolutely should report the ceremony. In fact, you should provide detailed information about it with the petition package, and make it absolutely clear that the ceremony was not a legally binding wedding. This may be your only chance to explain it, since the consular officer isn't required to accept any evidence or listen to any explanations, nor is there any requirement that any evidence offered or explanations given at the interview be placed in the case file.

In every case I can remember, where the beneficiary was denied a visa for having had a wedding ceremony prior to the interview, the wedding ceremony was discovered during the interview and not declared in the petition package. This makes it "new" evidence which USCIS didn't know about when they adjudicated the petition, and therefore grounds to deny the visa.

There are two government agencies involved in this process - USCIS, which is Department of Homeland Security, and the US consulate, which is Department of State. Each agency has it's own role, and cannot assert it's authority over the other. USCIS is responsible for determining if the petitioner and beneficiary meet the minimum requirements to apply for a visa. The foreign consulate is responsible for determining if the beneficiary is inadmissible or ineligible for the visa. Neither agency can override the decision of the other. USCIS cannot force a consulate to issue a visa, and a consulate cannot revoke the approval of a petition.

When a consulate denies a visa because they've discovered a wedding ceremony took place, they are claiming that the petitioner and beneficiary are not free to marry because they are already married. They are also claiming that the petition never should have been approved because the petitioner and beneficiary didn't meet the minimum requirements. However, the consulate doesn't have the authority to revoke the approval of the petition, so they send it back to USCIS with a recommendation to revoke the approval of the petition.

This is precisely why you must declare the wedding ceremony in the petition package.

If USCIS approves the petition, in spite of the fact that the non-legal wedding ceremony was declared, then they have determined that this fact does not make the beneficiary ineligible to apply for a visa. The consulate cannot readjudicate this decision, and it would not be valid grounds to return a petition to USCIS for a reason which USCIS had already determined does not disqualify the petitioner and beneficiary. In effect, this disarms the consulate by taking away a potential reason for denial. This is one of the strongest arguments for 'frontloading' a petition with evidence to explain anything the consulate might determine is a red flag, or potential reason to deny.



A qualifying sponsor must usually have income which is at least 125% of the federal poverty guidelines for their household size (which includes the beneficiary). Active duty military only need income of 100% of the federal poverty guidelines. You can see the current guidelines here:

First, congrats to you. Just to make things clear, your petition has been approved not your visa. You still have to go through NVC and Consulate...

You do need to get the interview letter from the embassy before you schedule your appointment because you need to take it with you to the medical.

Slow down a bit. You are getting a little ahead of yourself. I just don't want you to get to the NVC stage and be frustrated. You still have some time to go before the embassy. For example, we got stuck in AP for a little over 2 weeks. I don't wish that on anyone.

In the meantime, you will need to start gathering things for your interview at the embassy. Try working on those things. You are going to need a police report, passport photos, and certains forms to bring with you. We needed a non-impediment (a document showing you've never been married) Not all consulates require it, Just prepare yourself so when the embassy time comes you're ready.

4. They will give you a biometric appt once you they have received your documents. Some places allow walk-in bio's. You need to have the bio letter that uscis issues to you to take with you to the appt., along with passport/visa.
5. Sign up for case status on the uscis.gov website
6. Play the waiting game to be approved or have an interview, or just receive your stuff in the mail without notice.

Your case has a chance of being transferred to CSC (california service center) If this happens, usually no interview and you just continue to wait for your gc, ead, and ap.

Most importantly, read the guides above! They help tremendously!!!!

Welcome to VJ.. I would start reading the guides and trying to gather the documentation you will need for the next steps. Don't fill out forms too prematurely though because when submitting forms you need to have the latests revision of the forms.. but just start looking at what you will need. I see you are a K-1 so there are things you will need for the next step of your journey!

But I don't want my tax dollars to become the co-sponsor for people who weren't financially able to support themselves.

@Carol and Bruno: that was the general plan back when I opened this thread: http://www.visajourn...rty-guidelines/. However, it was seriously advised against as putting three times her annual income into her account would raise a red flag with USCIS. Even if that assertion would be wrong, it would be pointless to move the money into her account now as the money needs be "seasoned", i.e. it needs to have been in the same account for at least 6 months before it can be used towards the I-134. In that regard the long delay towards NOA2 is a blessing as the money did not get into my U.S. bank account until March. Given that everyone says to stick with the K-1 we should probably do just that. We will investigate the CR-1 option though. Someone here pointed out that we should be able to use my personal assets towards the K-1, given that it is all in the U.S. (I've owned the house for 3 years now). It's unfortunate that this is such a grey area. It would make sense, to me at least, to allow the petitioner and the beneficiary to prove that their combined income would ensure that neither of them are at risk of becoming a burden to the State. Bureaucracy should not stand in the way of the heart.



It shouldn't but in this game called life and dealing with the government it does at times. It's up to us to decide to play by their "rules" or we get nothing....

You have been given alot of sound advice here and it seems like you are still hell bent on doing a K-3 even though members have told you that it has been phased out and to continue on the K-1 path. You are in such a rush to do things, but you need to understand that nothing with the government comes fast or easy.

Personally, I would rather take the time to read the guides, do some investigating, listen to other members here and find out what is what. If you don't make sound decisions you may wind up banning yourself from the USA and then where will that leave you? Instead of typing response after response, re-read what others have said. We are here to help but if you don't want to listen, then a bad judgement call may wind up seperating you two for a lifetime.

Again, just an opinion.. best of luck on whatever you decide.

Lesley, first of all congrats to you for your bravery and love for Patrick. This process is definitely not easy. My husband came from Jamaica and yes in a sense he was a "burden" on me, but I didn't even care because I love him. He came to the US on 11/2009. We married 12/2009 and the very first job he applied for he got it on 7/2010. It's a good one I might add. A couple things that helped him when he was "sitting" at home is that I have teenage kids, who would take time to show him around the neighborhood. They would literally go by foot and just venture all over. The second thing that helped him is that over in the Yardie forum, we are a pretty strong group. I started having small 'link-ups' as we like to call them. I wanted my husband to see that he wasn't the only one going through some issues. It also gave him a chance to speak to other Jamaican men in his position. Some of them live close and they've actually become friends. I also made sure to find Jamaican markets so that he could have some products from his homeland. Since we live on the outskirts of Philly, we would travel to NJ, DE, MD, VA, NYC by car. The first night he arrived we stayed in AC for a total of like 50.00. (cost of the room, gas, tolls and breakfast, we ate dinner at home before we left) Hubby has been to about six states since arriving. Do we have money like that no, but my theory was as long as we had gas, tolls, cheap fast food, and our LOVE lol we could do it.

It helps tremendously when the petitoner can find things for their spouses to do. Projects around the house, taking walks (if possible) around
the neighborhood to get familiar where stores are, asking family members to pick them up and take them places with them. Things of that nature. It shows you care about them being lonely at home and it also gives them something to do and a sense of accomplishment.

I arrived to US on K 1 a month ago. We got married and now I am assembling I-485 package. I have a few questions concerning form I -693. I had my medical checkup in Armenia and according to the instructions I am not required to have another medical examination as long as my I-495 is filed within a year of my arrival. I also know that most of the fields of I-693 form need to be comleted by civil surgeon who will also certify the form and seal it for me.

In Armenia I received my vaccination documentation worksheet and a sealed envelope my chest X-Ray. I used civil surgeon locator on USCIS website to find surgeons in my area. I called different clinics and got slightly confused. Prices for checkup vary from 50 (if vaccination documentation worksheet is available) $ - 300 $ or higher if vaccinations need to be performed. Some clinics told them they still charge the same price weather I had my medical checkup in my coutnry of origin or nor. One of the clinics told me that to cetify vacinations, they will charge me $ 15 only but they won't certify the whole medical examination, only vaccinations. But the clinic mentioned that I need to make sure that only my vaccinations need to be certified, because sometimes people call their attorney and he/she instructs them to get the full medical examination.

Could you please shed some light what exactly do I need ?

Is there any way you can contact the hospital that gave you your vaccinations and get a copy of it to take with you to the Civil Surgeon so they can determine what you need? I actually did this for my husband in Jamaica. I had to type a letter for him and have him sign it saying that it was okay to release a copy of his vaccinations, even though he had his vaccination card, I wanted to see for myself what they filled out and they emailed it to me with no problem.

It varies from place to place about the I-693. We only had the vaccinations transcribed for 35.00. He needed no medical (he had it done in Jamaica before arriving in the US) He needed no shots. We had no issues.


I also suggest you read on some of the forums about the I-693. There has been a lot of conflicts with it. Good luck to you!

After doing some digging on the web and VJ I've found other forums regarding emails that are identical to the one I received (for a few different kinds of visas though). The reply these posters have gotten have all been saying that this means they won't have to go through an interview and such...but this couldn't possibly be true, could it? Rationally I'm thinking it must just be a mistake but, at the same time we have a very uncomplicated case (no divorces, no criminal records, living together, no children, he has been granted a visa before and has half brothers with dual citizenship)...etc.

Ah I'm doing my own head in with this....I'm definitely calling tomorrow! :wacko:



Ginger the posts you have most likely read are when you get to the AOS process (after marriage) Getting your case transferred usually means no interview. You still have a long way to go sista! My case got transferred for example and we are awaiting the greencard.

Ginger, let me just give you a little friendly advice, its just too early in the game to get this worked up. Have patience and let USCIS do what they need to do. Actually its GOOD they are corresponding with you. At least you know where your case is. There are people who have gotten their case lost and have to re-file. Be lucky you are not one of them...

Nothing in this process is easy or fast. What you could be doing is looking over other forms that you will need for the interview process. Read, read, read the guides! Familiarize yourself with the process so when the time comes you can do what you need to do. Look at the requirements for your particular embassy above under "Embassy Info". The more prepared you are, the better off you will be! Most of all, good luck and breathe!(F)

I did not need to lie to get my citizenship since my deceased fiance was not a US citizenship. I came here to the US in 1978 as a refugee from Laos. I don't think that I am a citizen of Lao either so if push comes to shove they will deport me to Cananda LOL. I did hired an attorney to help me with my I129F. I am going to call him today but he is a one man operation and hardly anwers his phone. I will also consult with other attorneys and see how it goes. I thank you all even if you slammed me I still honor your ideas and thoughts.

I wished I had learn about this website before submitting my I129F....

What I did for my fiance (husband now) is type up the letter for him and scan it. He signed it, scanned it and sent it back. Or, you can type it and mail it to him have him sign it and then date it when you get it back. You have to be careful with the G-325 form because you need to have the most current edition when sending your paperwork in. I agree with Thompson2 about coming over to the yardie forum. Great help there!
