I also looked at her timeline and it appears the same to me...PETITION approval. Not VISA approval. That would explain the missing envelope. laughing.gif The OP should be prepared to lose her money for the plane tickets, or at least the re-schedule fee.

DO NOT buy plane tickets or make any other plans until you have the visa is hand, it will be in his passport. Look in his passport, if you do not see a full page, K-1 visa in there with hs photo on it, DO NOT buy plane tickets.

And not to rain on your parade, but another reason not to purchase ticket is you could possibly get hung up in AP (administrative processing), which if that happens, there is really NO way to know when you are going to move on to the embassy level. This journey is a very long tedious process.

I came to this website and posted this HOPING to connect with other people in SIMILAR situations such as mine. I did NOT expect people to pass judgement and post their opinions about Illegal Mexicans not having a right to be here because they broke the law. I asked for other peoples knowledge, answers from experiences and nothing else. Forgive me for having an attitude towards people who throw stones from glass houses and think their situation is high and mighty because they are doing something in a way that they THINK is the right or legal way. Not one of you knows how or why my Husband came to be in this Country, YOU all assumed that because he was ILLEGAL, that he came here that way. Judging us without knowing all the facts..but it's funny that everyone posting is from Countries where Immigration is COMPLETLY DIFFERENT. I agree laws should not be broken, and if they are there should obviously be consequences. However, I do believe that people should be given second chances and the right to make amends. And people forget that it's our own Immigrations laws and Government that let illegal passage happen every day. And if it were so easy for Mexicans or any others to obtain Visa's so easily and lawfully, don't you think more would have them and not cross illegally? I never came here for a "p1ssing match", but feel I have every right to defend myself and others I know. I came here seeking advice, not assumptions or judgments, but obviously I came to the wrong place. Thank you for those of you who did not judge and offered your opinions and thoughts. From what Ive read from previous posts and my own fiance's interview experience. You need to provide them with proof of a bonafide relationship. Letters, pictures, maybe letters from others who can vouch for you guys. Proof that you've visted one another, things of that nature. The more you provide, the stronger your case will be.

The US consulates in various countries vary a lot as to exactly what forms they want, how they want them, and when they want them. In Canada, where I did my application, there are two consulates: one in Vancouver and one in Montreal. Even they have significant differences in their application processes, and they're both in the same country.

You haven't yet indicated from what country you are applying in your profile, so it's very difficult for us to know which consulate you are dealing with.

I found, as I was applying, that I was able to get the best, most authoritative answers for this part of the process from the consulate itself. The US consulate in Vancouver has an email address specifically for visa application questions, and they are usually very good about providing timely, authoritative answers to visa application questions. Unlike USCIS, for whom it is very difficult to reach someone authoritative, I found dealing with the consulate very easy. You should check to see if your consulate has a similar email address. If they do, dealing with them may be the easiest way to get answers for visa application questions.

Additionally, if you fill out your timeline and profile, so that other people here can tell which country you are applying through, other people who have applied through your country and have more immediate experience will be able to tell you their experiences: what they did in similar situations and how it worked out.

All, my fiance just received his packet 3 instructions and I am a bit confused on the first letter it states, complete the DS-156 and DS-156k and dont sign.
Then on a paper a few pages in title DS-156 it state complete print out and sign and send it in order to have an interview?

I understand the DS-156K is taken to the interview but what about the DS-156? Should we send in a copy with the returned DS-230 Part I just in case they want it?

We had to mail in the DS-230, Part I signed. That is the form our embassy needed before they would schedule an interview (packet 4). We emailed it to, but as of now Kingston is not accepting emailed copies as attachments. We made two copies of ALL the DS forms and brought with us.

Either the consulate or USCIS can keep the petition open. The California Service Center has been allowing returned petitions to expire without reviewing them, but the Vermont Service Center has been reviewing returned petitions. Unless you receive a notice from USCIS that the petition has expired without review, then it's risky to presume you can go ahead and file another petition. If the consulate denied the visa because they believe the relationship is a sham for the purpose of immigration, then there is an accusation of misrepresentation against the beneficiary. If USCIS ultimately decides to agree with the consulate and revoke the petition approval, they should send a notice to the petitioner, giving the petitioner an opportunity to appeal the decision. If the petitioner ignores this notice, thinking they are ok since they already filed a second petition, then the accusation becomes a finding of fact - as far as USCIS and the consulate are concerned, the beneficiary is guilty of misrepresentation, carrying a possible lifetime ban from the US. By this time, the second petition may already have been approved and sent to the consulate. The beneficiary might not find out about the ban until they show up for their second interview.

The lesson is to always follow through and find out what happened to the first petition. If USCIS decides to revoke the petition approval, then be sure to file an appeal with evidence. Ignoring it can be a costly mistake.

Bottomline is I've seen MANY people who regret not having attended the interview.
LOTS that regret they didn't.

i was unable to attend the interview with my husband and he made out just fine. In a sense it was good that I didn't go because I probably would've screwed it up lol... If it eases your mind to go, then why not be there. If you have complete faith in your SO then thats your answer.

My fiance is in Jamaica and has been waiting 2 1/2 weeks to receive the packet 3 in the mail. It has been sent from Kingston but he has not recieved it yet. Does anybody know what is in this packet and how or when do we go about getting the appointment for the interview? I have been on the edge of my seat for 2 weeks and I need to make arrangements at work to get time off etc. Thanks to anyone who has info!

Hey, thanks for your quick response, and yes you did answer me before. The information was really helpful! I did complete the DS-230 and sent it to my fiance. He signed it and sent it to Kingston. The post office in Ochi told him they couldn't send it priority mail or next day service or anything like that. He mailed it from Ochi on March 30 and the embassy says they haven't received it yet. Do I just keep emailing the embassy until they get it? I just don't want to get lost in the shuffle, know what I mean? So, when they do receive it will they automatically set up an interview date for us and will they send a letter with this appointment date to him in Ochi or to me in the states? Oh, I have another question for you. He has to travel to Kingston next week to apply for the police certificate and he is trying to obtain his old vaccination records from family in Portland. Does he really need that record to have the medical exam and if he doesn't receive the packet 3, is there a specific form he needs in order to get the medical exam? Thanks again for your information! It is so helpful!

If you look at this link which is found above when you click on the "embassy" tab, you will see two email addresses for the consulate...you can email your inquiries to both. One of them has 5 days to respond to your inquiry. I didn't have too many issues when I had to email them. Once they notify you that they have received the DS-230, they will send out packet 4 (Interview letter) You can also call the NVC to ask what the interview date will be once you are sure that the consulate has received the DS-230.. Those two offices keep in touch with one another. They(consulate) will mail a copy to you and the original letter to the beneficiary. Make sure you bring it with you to the interview.

I'd like to make a suggestion that was very helpful to my husband since I was unable to attend the interview.

1. Purchase an accordian file... one that has at least 8 to 10 slots. Label each slot ex.: NOA 1, NOA 2, Letters of Intent to marry, G-325, Non-impediment, police report, etc....

2. Make a copy of ALL documents, one for you, one for hubby and one you are going to present at interview. If you are going to the interview, Take your copy with you, (even though fiance has his)

3. Sit down together and go through each document, both of you check to see if you have everything that is required. (I did this with hubby over the phone) believe me two heads are better than one...

Yes you need the non-impediment stating he has never been married before. You can get it from this site:

I recommend that you go pick it up though, mail service is very slow in JA.

I think I answered you before and sent you the link to what is in packet 3. You really don't need to physically receive Packet 3 because honestly, I don't think you will get it. Alot of us in the yardie thread never received it. Your best bet is to do your DS-230, email to your fiance, have him sign it. Make at least 2 copies of it. Mail one from Ocho Rios to Kingston (however you want fed-ex, snail mail, whatever). We even made an appt at the consulate and they allowed my fiance to fill out is DS-230 right then in there (of course they charged him a small fee, we haven't figured out that one till this day) As soon as you do that, I guarantee Packet 4 will find its way to your fiance. You need to know that NOTHING in this process is fast. You can send the DS-230 as many times as you like, they will schedule your appointment when they want to. It stinks but thats the way it goes.

I am NOT a good interviewer either, like if I had gone with my husband to the embassy on the K-1 interview, he might not be here today... :blink:

However, the mind-set that I have is that if you want something SOOOOOO bad, you have to man up and deliver!! Like someone else said, keep practicing. Make a song out of it, a game out of it whatever it takes to be with the one you love. Lots of prayer and faith helps too! Stay encouraged! (F)

Remembering how much money we are spending on this process keeps me motivated too!

Packet 4 isnt a "packet". It's the actual interview letter.

While I thought long and hard about searching the embassies reviews to prove to you that the information that fellow JA poster had given you were correct, I proceed to do just that. I will post their review and you can decide how you wish to proceed with this factual information.

Review Topic: K1 Visa

Arrival
We arrived to the Embassy around 8:15 am for our 8:30 appointment. We approached a long line at the front of the embassy and was greeted by a consulate officer. She checked our paperwork and highlighted the areas where corrections needed to be made. She then asked us to go to the front of the line and show the security officer our paperwork. We then entered the building and had to go through the medal detectors. They do not allow cell phones, so the only items we had with us were keys and paperwork. I would also suggest that you bring a pen because we had to borrow one on several occassions.


Entering the Main Building
After we made it through the medal detectors we had to stand in line for the main entrance. There were applicants for visitor and other types of visas sitting on both sides. They were allowing about 5 people into the building at a time. We had to step out of the line to make the corrections to our paperwork, however, we were allowed to get back in place after this was complete. After we entered the building, we stood in a line to give the consulate officers our DS forms and in return we received a number. We were then asked to enter the building and sit on the right side.

Part 1
After about 20 minutes our number appeared and we approached the window. We were asked for his birth certificate, non-impediment, police certificate, and his paasport. The Jamaican officer was very rude and it was very difficult to understand what she was saying. She was asking for my 2008 paperwork, but I wasn't sure exactly what she wanted. I had bank statements, employment letter, etc. so I wasn't quite sure what she wanted. She got so frustrated that we didn't understand her that she made us stand to the side for over 10 minutes while she helped someone else. As we were standing to the side, my fiance eventually translated what she was asking for. We stood patiently and she eventually called us back to the window. I then provided her with the I-134 form, employment letter and 2008 W-2s and tax returns. She then asked us to go to Window 17 for fingerprinting.

Part 2
After fingerprinting, we returned back to the right side to wait to be called back for the interview. During our wait, we saw over 5 people receive blue slips. We could not totally understand everything, but most of the blue slips were for family-related visas and they seeemed to be due to a lack of paperwork. After our friends, Eric and Jew made it through their interview with an approval, we felt a little more optimistic. We were eventually called to the window by the blonde officer. She looked through our paperwork and asked the following questions:
1.) When did we meet?
2.) How did we meet?
3.) How many times had I visited?
4.) When did I know I wanted to marry him?
5.) Have I met his family?
6.) Has he met my family?
7.) What was my occupation?

She never divided us up and all of the questions were asked as we both stood at the window. She then looked through our pictures that were provided in original application and asked if they were all from the same visit. We told her no and indicated that they were from my visits in June and August. She then handed my pictures to me because she said that we may not see them again. She then told us that he was approved and told us to go to the DHL window. She also told us that we had 90 days to get married upon his arrival to the US. We thanked her and he went to the DHL counter to setup shipping arrangements.



Great example! Folks don't listen.... go ahead and go the interview without it. Mostly likely you will be "blue slipped" for not having it! We are here to help but if you are dead set on not taking VJ'ers advice (who have been through this no doubt) then you get what you are asking for. Good luck!

Then we went through my N400 application form in detail, question by question, and I was reaffirming my answers that I had put on the N400 form. I signed a form, then he said I was approved, and asked if I wanted to go to the oath ceremony next week. He didn't ask for any other documents and there was no chat about off topic things. He gave me back my passport, GC and driving license (he kept the old GC and EAD and stapled them to my file).

He gave me a white form that said I had passed the reading/writing/civic test and that I was recommended for approval. He then printed out my blue oath letter - September 23rd in Baltimore good.gif - and then I was free to leave.
