a NOA is a "Notice of Action"... They are just letting you know they received your paperwork.. The next thing you will get is a NOA2 it will say "approved" which just means they approved your paperwork to go to the next level whic is the NVC level..

According to VJ Guide:

for the I-864 form: letter from employer confirming employment, the last 3 years of tax returns, plus any documentation of your financial resources if you choose to include this. The rule is, if your income is not 125% of the poverty level for your family, you will need additional financial documentation. HOWEVER, if you read the form instructions carefully, it states that while they do NOT require additional financial information IF you have at least 125% of the poverty level, it says the USCIS can still ask for that information if they want... so in order to potentially avoid future questions, many people include financial information, including bank letter, letter from stockbroker, letter regarding mortgages, copy of deeds to a property, and any other financial assets... etc. It is far better to include too much information rather than not enough.

Just to clarify - you are allowed to 'visit' the US. You are not allowed to 'live' in the US and if the border authorities suspect this is the case you will be denied entry. While Canadians are technically allowed to spend up to 6 months in the US as a visitor, it is up to the border authorities when you cross the border to determine how long you are actually allowed to stay. If they say 1 month, then their decision overrides every other option. If they do not specify a time period, then you have up to 6 months - as long as it is a visit and not living in the US.

Be prepared to show evidence of your 'ties' to Canada during the processing of the CR-1. You need to reassure the border authorities when you cross that you have commitments in Canada that necessitate your return and will not be trying to evade the immigration process by remaining in the US. Letter/contract from your employer, lease/mortgage documents, ongoing utility payments all provide good evidence of ties to Canada. When you have filed for the CR-1 carrying a copy of the full petition and application is also good as it shows your intent of following the correct immigration process.

One other quick comment. You are not allowed to cross the border as a visitor with the intent of getting married AND remaining in the US to adjust status (get a green card). That is considered visa fraud and carries with it severe penalties if discovered. You are allowed to enter the US as a visitor with the intention of getting married, getting married, and then pursuing the immigration process from outside of the US (CR-1). It is the intent upon entry that is relevant on whether you can remain in the US to adjust status after marriage or not. Since you are already talking about entering the US to get married, you don't have that option available now - legally.

Be sure to drop by the Canada Regional Forum as well - there are many Canadian/American couples there who have gone or are going through the same process.

I agree with you on this. We express mailed ours USPS with a delivery confirmation. No signature. You are able to track the number on the USPS website. However, I tried to get it back about an hour later because I thought I had made the cashier's check out to the wrong people. To my surprise it was already gone. We mailed it on a Friday and they received it in Chicago on a Sunday. So in my case, USPS worked great!

I am considering contacting her to see if she could send an email to the Embassy requesting the information. I dont know know if it would be a good thing for her to also state "that one of my constituents has received no replies back to his emails", or if this might cause a backlash when my fiancee has the interview. But, I also would like her to request that they keep her advised of the progress on this petition. I have seen this recommended here on VJ as a way of letting them know that a government official is watching the case. Thoughts?

we just received our package today. The package was all in Romanian. Inside it had the checklist.
It was weird for us though.
Item 1 said to send back the DS-230 form (ok), and in handwriting it stated "+ DS-156 double and 156k unsigned"
I thought it was weird, because on item 2 it said to have two copies of ds 156 and two unsigned 156k.

As for completing the forms, YA get to it, we did them before we got our packet, just have them ready to submit the day you receive.
Now we are waiting to send it by mail tomorrow after my girl asks the embassy some quick questions.

I sent in our DS-230 part I. Mailed and Emailed. I asked the embassy if they got it. They responded so on 9/8 my fiance goes to the Embassy. They will probaby give us an interview date. We also filled out and downloaded our forms. We also got the police record done and in Jamaica you need a letter of impediment which we have gotten also. We have all our evidence so we are ready to go. I think your okay too!

No form is just for "males" - If you are a K1, Packet 3 contains DS-230 Part I and Part II, DS-156, DS-156K and DS-157 all must be filled out. Only part I of DS-230 should be signed. You sign part II at embassy. You sign it after you are sworn under oath.

Did he get his medical for a K1 visa last year? Is that why you're asking? If so, then he will most definitely need a new one for his CR1 or K3 visa you're filing for.

Police certificates are also usually good for one year, depending on the country. So he will probably need a new one as well.

Packet 3 is a checklist which tells you what you need to bring for the interview. Packet 4 is the interview letter. You need to call the Deptartment of State 202-663-1225. They can tell you if your embassy has sent packet 3. If they haven't you need to contact the embassy via phone/email and ask them if they can email you packet 3. I never received Packet 3 and someone was kind enough to email me a copy of what it looks like for my embassy. If you send in your DS-230 part I (signed) and get it to the embassy, that is when youre interview will be scheduled. Hope this helped.

We never received our packet 4. I got the interview date by calling Department Of State 202-663-1225 Press 1 then 0 to speak to someone live and they can provide you with the interview date that Kingston has set

I found out on the Tuesday before our Thursday September 24th interview. It was a mad rush to get Everything in order due to the fact that we never received our packet 4... him or I

I dont know about london specifically but once NVC sends your case to the Embassy, the embassy sends out a packet 3. In our case, we never received packet 3 but someone from my fiance's country sent me a copy of it so we had what we needed. We only had to make sure the embassy received the DS=230 part I. Once they did, they sent us packet 4 (interview letter). Good luck...

We did three things actually, we emailed, mailed and my fiance filled on out in person..... read my time line and you'll see.....

07-15-2009: Case number assigned, Yay!
07-16 to 08-03: Additional Processing, #######????
08-04-2009: Case left NVC
08-07-2009: Case Arrived at Embassy, Yay!!!
08-07-2009: Emailed DS-230, Part I
08-11-2009: Embassy sent packet 3 (Never received Packet 3). Embassy also called fiance and told him to pick packet up on 9-08-09
08-24-2009: Still no packet.. guess He will go on the 8th to pick up packet *sigh*
08-31-2009: Emailed the embassy DS-230 one last time in hopes of getting interview date/called the DOS - no further information from Embassy. They don't even know about the embassy calling my fiance to come on 9-08-09. Oh happy day! sad.gif
09-03-2009: Embassy said they received DS-230, part I
09-08-2009: My fiance went to the embassy and they gave him the run around. They made him fill out ANOTHER DS-230 form... still waiting for interview sad.gif
09-10-2009: CALLED DOS....... FINALLY!!!!!!!! INTERVIEW DATE
09-28-2009: Medical scheduled for 8:30 am at MoBay
10-13-2009: ***INTERVIEW***


Comments : Received NO2A the same day we got engaged, 06-30-09

Estimates/Stats : Your I-129f was approved in 126 days from your NOA1 date

Your interview took 231 days from your I-129F NOA1 date.

As Thompson2B said, you have to get the DS230 pt. 1 to them so that they can schedule the interview (packet 4). You definitely will need two copies of the ds 156, ds 156k and the ds-157.

Those go with you to the interview by the way good.gif
