I agree with Tahoma. In my case, the NVC received our papers a week after the NOA2 issuance. Give it 1-2 weeks since it's summer in the States. You can schedule an appointment as long as you have your MNL Case Number.

You don't have to wait for the beneficiary to receive a letter from the Embassy in order to make an interview appointment. Just call the Embassy's call center and make an interview appointment. Good luck! :star:

OMG! We have a similar story! Posted Image I was given a 221g form after the interview and I must say, it went smoothly so i was shocked to get a blue form. Anyhoo, I was asked for pay stubs so I personally submitted 4 pay checks a few days after the interview. My fiancé is also employed by his father. Did you call the 301-2000 number? Call to check the status of your case. I learned of my approval by calling and the visa issuance via email though the only reason I received an email was because I wrote to the Embassy.

So i am slighly concerned I am getting all my papers ready for my fiances upcoming interview in CDJ. in his packet i put a copy of my Work photo id, 3 years taxes, 2 months recent paystubs, Bank account verification letter showing the amounts held, and an income verification from my job. Is this enough or do i also need this i 134? i saw they required it from some people. Thank You


From what I know, Evidence of Support should have:
I-134
Employment Letter
Recent pay stubs (I submitted 4 but only 3 were asked from me.)
Latest ITR (I brought two years just in case.)
Latest W2 (I brought two years just in case.)

You also provide supplementary evidence like:
bank statements
investments
property leases

My fiancé isn't on the payroll so the evidence I presented were weekly checks in his name. Can't you show them a 1099? Did you show them last year's Tax Returns? You can include supporting financial documents displaying your assets in order to further build your case. Provide the consul with documents like stock investments, bank accounts, properties owned and such to prove that your lady is far from being of public charge. I understand why I got denied because I work on a cash basis as an independent contractor, and it is next to impossible to prove my income until the end of the year when I claim it on my taxes. I just started this job in January and I gave them all the evidence I could come up with. I am above the 125% poverty line and I have a co-sponsor!
Can they just not give us an opportunity to dispute their ruling? I am an American citizen dont I have rights? Theres a nasty beaurocrat in the Manila embassy who is calling the shots and creating their own laws.
Does anyone have any suggestions? I've spent thousands of dollars and hours of time, and I fear that I may have to get married over there and start the whole process over again with a spousal visa. This is killing us...

As the petitioner, your gross income has to be 125% above the mandated poverty line. You have to calculate yours according the household size. You can only have one cosponsor so choose someone who earns enough in order to prove that your fiancé won't be of public charge.

i am getting much healthier tho and its nothing life threatening at all
My sweetheart is younger than me...he is Canadian..we have known eachother for a few years and became very serious early 2009
he came to be with us January 2010 and stayed 3 weeks(was supposed to be only 2 weeks but an ice/snow storm stranded him longer)..he went home to Canada February
I am now in Canada visiting with him and his family..have been here since June 14..my daughter and i go home August 3, my fiance has round trip tickets to come home with me for about 4 or 5 weeks then he goes back home to Canada
we got officially engaged at Niagara Falls and are very happy together...just cant stand being apart
anyways he has had the same job since about 2004..

what i am confused about is the I-864
my income is only about just over $1600 yearly with monthly income of about $1350 between me and my daughter...and my childhood best friend/roommate only has about $680 monthly(i believe hers is SSI due to a shunt in her head from a gunshot wound years ago)
i dont make friends easily so i dont know alot of people that would have income 125% over poverty level...and i know my parents dont make that much..my brother is questionable but he does have a steady job driving an 18wheeler across country
any input on this would be so greatly appreciated...

it seems everything will go smoothly except for this Affidavit of Support thing..

Have time to call them, ask ur tracking #, u should have one since they gave u AIR21 form. In that way u can monitor, it's one way of knowing if u will have Approved Visa. Once u get ur tracking #, go online for www.air21.com.ph then start to track.

Thanks! anyway, will give u a lil idea.. =) upon doin my search, asking some of the VJ members, if ur on 10th day,always monitor ur air21 tracking#. go online every now and then. If ur tracking # is found, it means that u have APPROVED Visa and u will reveice ur Visa and visa documents soon, if nothing, u will receive a registered letter which is the deny letter of ur visa. That's what I've learned. =)

Thanks again. Wow! Yeah, I told her that if for some reason the CO says something like the Visa is denied because your fiance is not working, then she must be strong and ready to explain my entire financial situation and ensure the CO looks over all the paperwork. I was initially confused about the conflicting information but eventually found out that the requirements are consulate specific. My fiancé used a co-sponsor as back up since he was unemployed last year which resulted to poor tax returns for '09. He landed a job in late December of '09 and his income is sufficient for us both. I intentionally submitted the co-sponsor's papers with my fiancé's I-134 to the prescreener and she tersely told me that the acceptance of such papers for a K-1 visa is upon the discretion of the consul. I was assigned to a fairly polite consul and I was under the impression that I was going to be handed a pink slip but unfortunately ended up with a blue one in stead. He asked for pay stubs and I supplied that last week and I haven't heard a word from them since. I called them yesterday and nothing has happened to my case. They are only good at delivering spiels. 125% would be roughly around $18,000-19,000 or so. MATH! Posted Image That's fine because the consul only glanced at my fiancé's '09 tax returns, '09 W2's and ignored the previous years. I surmise that they require tax returns to look for financial stability and current pay stubs to prove the petitioner's capacity to support the beneficiary plus himself in the long run. Assets are supplementary financial evidence but the overwhelming amount of evidence you have should satisfy the CO.

They do give considerations to those with special cases so the documents should suffice. Tell your fiancée to be ready for some grilling. The consuls have the propensity to ask such ambiguous questions just to see you squirm. Please do update us on your journey. She'll be just fine and hopefully, you get a better outcome than I did.

Thats interesting information. If the Embassy can do whatever they want regardless to the INS/Departement of State Laws/Guidelines such as Section 212(a)(4) of the INA, then why not make the requirement 200% or 500%? I would think someone would have a valid Congressional Inquiry if they got refused a visa even though they met the requirements of Section 212(a)(4) of the INA.

I meet the 125% anyway as I can tell, I just FEDEXd a I-134 with about 50 pages of supporting documents such as 3 years of tax returns, my VA disability paperwork since that is non-taxable, my investment accounts, bank accounts, my grand deed for my house, etc to my Fiancee. I wonder if the CO will look through it?? I am not working now so I don't have any W-2. If they disapprove it because they set their own laws/regulations, Ill be emailing my Senator right away to investigate for me.

You're welcome Yup! I-134 for non-immigrants and the I-864 for AOS.

Regarding the poverty line, it's 125%. Each consulate applies their own requirements regarding that and for the Philippines, it's 125%. My VJ friends and fiancé followed the 125% income requirement. So that's 125% for a household of two unless like I said in an earlier post, you're in the military then it's 100%. If you don't meet the 125%, then you can suffice by having 5x the amount you lack through assets since they are only considered to be worth 1/3 of the income. You can stick with that you know or call the embassy if you're not satisfied with the information you're gathering. It's best to be sure. Good luck!Posted Image

This ultimately lies on the discretion of the consul.) but possible for the next process with the I-864. If you're in the military, they require you to be 100% above the poverty line.

I believe that assets help in a sense that they're supplementary evidence for your I-134 but you mainly have to prove that you're earning enough to support you and your fiancé. Prove that your monthly income can suffice so load up on your pay stubs because the consuls are much more focused on that.

I am confused. I see many replies on this thread that refer to the I-134 as meeting 125%. I had read and/or heard that for the I-134, you only need 100% not 125%. For just the I-864, you need 125%. Is that true?

Also, how do assets affect the I-134? Meaning if your income is low, how do assests make up for that? Is there a formula?

I'm starting to get crazy! :wacko:
When I made the call on 3012000, that's what they told me, they dont have any access on the status of any case, they told me to call that 1-909 customer service here in P.I.. But it's so hard to find a telephone where we can make a call, and they said it's so expensive like Php 50.00+ per minute on any IDD postpaid PLDT phone(most of the phones now are prepaid which you cannot use to call that customer service) One of the way to know your status is try to call NVC in US at 603 334 0700 if ur in US or the 1-888 cust service. I really dont know what to think anymore, everything's hard for us. I'm stressed for 2 weeks now, restless. :(
The CO requested as to submit evidence of current sustained income. Upon reading some of the cases on VJ, there are cases that CO are still unhappy with the papers they submitted, we should really convince them that you are making enough money. It will still depend on the consul who will review our case.

In my case, I am waiting for almost 2 weeks now and no feedback yet, we're so worried, stressed and nervous, don't know what will be our result. I dont know if it's enough to the CO all the documents we sent. In my case after submitting the docs at the embassy, I received a text message from Air21 for about 7 working days. my fiancee called at the embassy after a week but the agent told her that it will take about 5 - 7 weeks. that's because they don't know the real status of your petition. I think the consul will review it after a few days and if it's good, you just wait for 7 to 10 days. just be patient and relax. It's going to be fine. :thumbs:

Hi guys!

I'm so glad that I stumbled across this thread since pink slips are flying around the Philippine forum and I can't help but feel a tinge of envy. I had my interview on July 1, 2010 and received a blue slip so I returned to the Embassy a few days ago on July 6, 2010 to submit my fiance's pay stubs. My interview went smoothly but then the CO just wanted to assure that my fiance has sustained income so I guess that's fair. I'm getting quite nervous since I don't know how long the processing period will take so I've been watching my phone like a hawk just in case I get a text. I'm relieved to see that I'm not going through this alone.

How soon did you guys hear from the Embassy? I asked the lady who received my documents for the Embassy's contact number and she handed me a 1-900 number. I'm thinking of calling them on Monday if I don't hear anything by Friday. I have the local number which was provided by a fellow VJ member so I'll try that as well.

Just to say, this was a messed up topic to bring up. To the Colombiana, Filipina's show more love than anyone. I'm Latino and I have dated my own and other races but my Filipina girl, is the only girl who has shown me more love and kindness more than any other ones. They do make great wives, cuz they're great girls. Smart, loyal, devoted, list goes on...Take it from me, if I had to be with a Beautiful Latina over my Beautiful Filipina, I wouldnt go for it cuz I know she makes happy and will continue doing so. That's why the margin for Filipina K-1's are soooo high then any other ones. END OF STORY!!

No we didn't use any really. What you use to bind or keep stuff together is a matter of preference and practicality. I believe a lot of the VJ members used those materials. smile.gif

What I did with some of our supporting documents was to paper-clip them together (I folded a piece of paper on the top right hand corner before putting on the paper clip because i didn't want the clip to punch a hole in the sheet when the USCIS adjudicator takes them off lol). I stapled my forms (including the Annexes/extra sheets of paper for my extra long answers) and paper-clipped them together also. The supporting documents for bonafide marriage, which were thicker (we are applying for K3), I used those black alligator clips (same thing with a piece of folded on the top corner before clipping...didn't want clip marks on the sheets lol).

For the passport pictures I didn't have clear plastic bags...I wanted to use small ones but couldn't find any here in National Bookstore, so I bought small brown coin envelopes instead. Put labels on them with our name, date of birth, and if we were the Petitioner or the Beneficiary (not necessary, but when you work at a Canadian immigration firm, you tend to pick up a few pointers here and there that could be useful in preparing US applications and documents).

We also had a cover letter listing exactly what we were sending them, and a separate list of what was included in the bonafide evidence of marriage.

They were very helpful to us when we were preparing our K3 and K4 applications.

When you're filling out the forms, just put in consistent information. If data doesn't fit in the form, prepare an extra sheet referencing the form it corresponds with, the question number and the page number.

As for the supporting documents, keep it simple...you don't need a whole whack of pictures, e-mails, text transcripts or chat transcripts...use them sparingly. smile.gif

It does help a lot, thank you. The main thing is to assemble the whole package. Should I just use a manila folder with ACCO fasteners, or 2 punch holes, should I use tabs? and lastly, do I really need to label the envelope that i'm sending the petition in? Thanks.
