This is my instinct, too. My main frustration with the RFE, as I mentioned above, was they didn't specifically ask for anything. The list of types of evidence they sent me in the RFE is the exact same thing you'd read on the USCIS website, and I'd already included many of those things. I'll send them a few additional things that might help, but I wonder if I should also explain in a letter why certain things, such as the mortgage, are the way they are.


It wouldn't hurt to attach a letter to your RFE response explaining why you DON'T possess certain documents that other people may have.

As to why your previous evidence was not enough, there is always the possibility that some of it was lost from your file. So re-send your old evidence along with any new.

To the OP -

At this point, do try to gather any other paper evidence you have which shows co-mingling of assets.

More importantly than that though, get three notarized affidavits from three people who know you and your husband. These statements need not be wordy. Each statement should testify to the person's knowledge of your "couplehood". For instance -

"My name is ________. I live in _______________, the same town in which Mr. and Mrs ___________ live in. I have known Mr. and Mrs. ____________ since _______. I have had dinner at Mr. and Mrs. __________'s home and attended other social events with Mr. and Mrs. ____________________. They are in every act of my knowledge a legitimate and bonafide married couple and active members of our community"

These types of affidavits are not necessary for every ROC case. Given though that you have been RFE'd for evidence, such affidavits are powerful evidence of your marriage.

*For future readers (and on another tangent), a simple legal document that shows co-mingling of assets are reciprocal Last Wills and Testaments.*

I read once that you should not do anything in your life just for immigration purposes. Do not change your house deed. Go through the list on the RFE as I did and provide them with as much possible evidence for each question as you can. If there is something you can not provide like the names and addresses of every living relative of yours living in the United States, just list the ones you have. Many of us have gotten a three page list of an RFE and answered to the best of our ability and gotten our NOA2.


OP states her husband is not on the mortgage due to his "minimal credit history". Which has nothing to do with ownership. It sounds as if the OP and husband would have had joint ownership originally were it not for trying to seek a particular type of loan, or a particular interest rate.

If the OP can add her husband to the deed, I don't consider that "doing something for immigration purposes". She knows the answer to that better than you or I.

The OP could contact a qualified real estate attorney to find out if adding her husband to the deed somehow violates the mortgage. In most cases it does not.

Meh, I don't know about that.  Pretty much every K1 ends up being out of status while they wait on their greencard.  Those who file before the K1 itself expires are in a better position than those who file after the 90 days are up.  But I've never heard of "gap time" causing ineligibility for the VWP.

The answer to your initial question is 'yes', the oath ceremony is mandatory in the sense one must be sworn in, to become a US citizen. Public or private, the oath is a requirement.

If your husband does not want to do the flag waving and all he can simply attend the ceremony, recite the oath and be done with it.

Having said that, citizenship is not a requirement nor is it mandatory and one of its conditions is that the applicant do so of his/her own volition, so chances are your husband may be looking forward to the flag waving experience and all the accoutrements.

My husband is not a flag-waver in his own country.  Although he does water up at any particularly good rendition of "Land of Hope and Glory".  :P

I was petitioned by my USC mom so I had to wait 5 years of residency to apply for citizenship. I would have liked for my ceremony to be longer, the opposite of you

 

I had heard of some places that take 2 or more hours long, but it also depends if there are a lot of people taking the oath at the same time, like hundreds

Just for the record, I am a US citizen.  It's my husband who is foreign born.  And he's been eligible for citizenship for .......oh two or three years now.  When we first entered on his immigration journey, the filing fee for citizenship was only $200.  Now it's over $800 with biometrics.  Seems to me they should charge less for all that flag waving.

you aren't a USC until you have the oath ceremony. you will give up your GC, swear to defend and protect this country, become a USC and at the end of the ceremony you will receive your certificate of Naturalization

CanadaComplicated situation

I have been shopping for a lawyer getting free consultations and we are trying to decided if it's worth the 2500$ that most of them charge. So far with the consultations they all say I have 2 choices. After I get married, apply for the CR-1 from the US or from Canada. Drawback from the us application is that I would have to stay in the US for a few months without leaving the country before I can resume travels. I could get a leave of absence but that would be expensive. The Canadian route, although longer would "allow" me to travel to the US at the discretion of the border agent.


You are talking to the wrong type of attorney if they don't know that once you have activated your CR-1 (entered the US) that your green card arrives within a couple of weeks. Green card means (of course) that you can work.

Google Stuart Folinsky or Matthew Udall. You can probably email them about a telephone consult. Your sources so far don't sound very knowledgeable.

I do think you need an attorney consult. A good attorney may tell you he's not really needed to process your case once the issue of your travel for work is cleared up.

Or speaking with the consulate like the PP suggested, maybe they can give him a 12 month period instead. Can he get a letter from his dad's doctor stating his condition? And I wasn't suggesting the consulate might issue a visa for a 12 month period. I'm suggesting finding out if they ever extend the visa should it not be used (for good reason) during the six month window.

I've read the rare claim of persons coming over on the VWP without using the K1. As stated, the report is rare and really can't be confirmed.

The expiration date on the K1 (six months from date of issuance) is the drop-dead date to use this SINGLE ENTRY visa.

Consulates can choose to re-affirm the visa if the applicant has returned to the home country prior to the six month expiration date. But it's a tedious process and strictly case-by-case.

You have three reliable options. Marry as soon as he arrives and file his adjustment. Or he remains in the UK as long as possible (he has six months to use the visa). Third, contact the consulate and ask if in these extenuating circumstances, if they would possible consider re-issuing the visa if it has not been used by the sixth month deadline.

In my opinion your fiance needs to stay with his Father till he passes. You have your entire lives to be together.

I'm sorry but I agree with everyone else in regards to contacting the embassy. It is HIGHLY LIKELY that he will be denied entry if he doesn't get this fixed because it appears as though he opened and tampered with the documents. He probably DIDN'T but the envelope is his WHOLE file.

For this reason he should definitely call/email the embassy to find out what he can do BUT I'm sorry to say that the embassy does not keep a copy of the documents so I'm not sure if that will even help because how can they be sure? I am not trying to upset you but instead warn you. Like someone else said it will probably take several weeks if they agree to do it. To triple check everything.

I honestly can't see how he didn't notice the HUGE sticker on the front of the envelope, or the USCIS seal over the "opening". I also don't understand why he would open something not knowing what it was, until he had looked over the whole envelope.. thus noticing the label "do not open"... I'm not trying to be mean but I just honestly don't understand that part. Maybe his country has a different system. But like everyone else said, I was told several times not to open it AND the letter I was given when I was approved said the same thing.

Either way, it is a United States Consulate. So it matters not to the applicant where the interview takes place. It's more convenient for you. An American will conduct the interview and make the decision. That's all that counts.


I presume you're aware of DOS practice of interviewing the beneficiary in the country of their residence? The OP doesn't live in Ireland. He lives in Northern Ireland, which is part of the United Kingdom.

As I said earlier, it would be lovely if NVC/DOS has decided that residents of the North don't have to leave the island for processing. But since they don't seem to care (for example) about Canadians having to go thousands of miles for interviews, then I believe what we have here is an error.

London case numbers start with LDN.

If the NVC have already shipped your case to Dublin, then there isn't much you can do now except wait until it gets there and contact Dublin at that time. I agree that they'll likely ship your case to London once they realize the error.


Right but the coding I'm speaking of isn't the consular code. There is another 2 alpha (not 3 alpha) code which is used to designate country.

Now, I will admit to not knowing WHEN the code is FIRST used (ie during visa processing, after US entry, etc). But I know it is used as an identifier for production of documents and I know the coding is supposed to match the alien's passport.

Well, that's the North for sure. I was pretty sure you knew where you lived :lol: but I couldn't resist asking because this is indeed the first time I've ever heard of this. The usual ritual is for residents of the North to be begging NVC for the case to be sent to Dublin (or Belfast) to ease travel, and firmly being denied.

USCIS has country codes by which they classify aliens. And a lot of people in the US don't know their geography. When your data was first entered into their system, you may have been improperly classified. The codes consist of two capital alphabet letters and relate to the official name of the country. "UK" in the USCIS system is not the United Kingdom - it is the Ukraine. I do not exactly recall the alpha codes for "Great Britain and Northern Ireland" (which is your proper designation) or the code for the Republic. But at any rate, if some dolt who doesn't recognize that the plot of mud on the map known as Ireland consists of two countries, you may have coded wrong.

I only relate this story for two reasons. The first reason is because it's been known to happen before and cause green cards to be produced with the wrong nation listed. Secondly (and more importantly for you) the case could be shipped to the wrong consulate which causes delays.

If this is a new policy of NVC, it'd be lovely for all. But if I were you, I'd be checking further before it got shipped off to Dublin. Unless this is an official policy change, Dublin will end up packing the case off to London, which will slow your process down.

You should prepare your own affidavit even if another person is acting as sponsor.

There is no such thing as a "primary" sponsor for the I134, just as there is no such thing as a "joint" sponsor. Read the instructions for the form and you'll find no wording pertaining to anything other than ONE sponsor when this form is used to adjudicate financial sponsorship.

Some consulates will want the petitioner to prepare an I134 even if the beneficiary is producing an I134 from another party. Some consulates will not. The CO needs only ONE I134 to satisfy DOS requirements for sponsorship of a non immigrant visa. Some consulates however will have internal policy which requires an affidavit from the petitioner even if they do not meet the financial thresholds themselves.

So best to be prepared with both. Even if yours (petitioners) will be binned after the interview.
