Second, and totally random, thank you for asking this qn! I checked my form to double check what I did and noticed I didn't fill in my "last employment" so I went ahead and did that a noticed a MISTAKE!! I had the year wrong (apparently I worked from Aug 08 to Jan 08 and because I then go up, it was Jan 08 to Jul 09 that I worked at the next job.. which is totally wrong :P). lol. So thanks :) Helped me notice a mistake :D

hey everyone,

i read many topics in which is discussed what could happen if the foreign fiance would visit the us fiance in the u.s..i know that it is not advised but also that many people take the risk and end up not being denied. i was wondering, what if the u.s fiance visits the foreign fiance? would that also be a ''problem" or a risk? my u.s. fiance wants to come visit me in june in the netherlands, but our petition would be in process then. we actually do not want to take any risks but we just wondered if there will also be much difficulties when its the other way around. can the netherlands also "see" that our k-1 is in process?

Not a problem regarding the dates you signed the G-325A and the letters of intent. Just remember, you will need more currently dated and signed letters of intent for the interview.

hello everyone,

has anyone had some problems when checking their status on the uscis website? i usually check a few times in a week and sometimes i have problems when logging into my account (i think it said something about 'internal service error' as i remmeber correctly). i usually have to try to log in a couple of times at that time before it actually logs in. when i wanted to log in today it said:

You must correct the following error(s) before proceeding:

Dear all,

This summer I got a trip plannend to see my girlfriend/fiance. We havent started the K1 Proces yet.
The trip will be from July 1st untill Augst 31st, its during my schoolbreak.
I would like some advice on what to tell at the POE in Chicago.
I was a exchange student who played (American) Football for a year in Kansas. Should I tell the POE officers that
I am visitingen my friends (what I am ofcourse going to do) or should I say that I am visiting my girlfriend.

I really dont have any intention to stay because I have to finish my senior year after this summer.

Please give me advice, I am so nervous for the POE :(

I just wanted to say that I was in almost the same exact situation last year! I am also from the Netherlands and I visited my fiance last year also from July 1st to Aug 31 (what a coincidence!). I also used to be an exchange student in Wisconsin. My POE was Minneapolis. Just in case, I had a letter from school stating I had to be back for my Introduction Week starting September 1st also to finish my senior year of college! I was one of the first in lines and I got through with no problems. She did not even ask me my reason for visiting. She just checked my passport and wished me a good trip.

For previous visits, I have also never had any problems. Either they did not ask me anything or asked me my reason for visiting which I usually answered with going on vacation and to see my friends.

Don't worry too much, I am sure you will be fine. Just don't say anything untill they ask you something. Also if they would ask you who you are visiting and you feel better saying your girlfriend instead of friends or some other reason, there is nothing wrong with that. You are not doing anything wrong, and if any, you are doing things the right and legal way. Even if they have further questions or suspections, just tell them you are aware of your possibilites; k1, k3..etc. Show them you are knowledgeable about your options. Keep in mind that visiting each other is only better proof of a bonafide relationship. However, I am sure it won't come to this anyway! Again, you will be fine :)

Have a great and safe trip.. its wonderful to be with your fiance for such a long summer :).

Our I 129F petition got approved a month ago (may 26) but we decided we do not want to go through with it anymore. My ex fiancee (beneficiary) already received a letter from the U.S Consulate in Amsterdam about 2/3 weeks ago with further instructions on how to proceed (letter packet 3 i think?).

Is there anything we still need to do? Do we need to deny it somehow or can we just leave it like this? Will the beneficiary ever get troubles when she wants to come back to America for a visit?

Good afternoon,

I became a US citizen through naturalization in February 2012. I am now going through the process of filling out all the information necessary for the I-129F to bring my Canadian fiance to the US.

Since I only recently received my US passport, most of the passport stamps proving travel on the dates when we met in Canada are only available on my Canadian passport. Is there an issue with copying all pages of my Canadian passport and including them with the packet as proof of meeting?

Would it be better if I send in all pages of my American passport additionally? I am already sending a copy of my naturalization certificate.

The reason why VJ suggests adding another sheet for question 18 is that you must explain the circumstances under which you have met your fiance within the past 2 years.

For instance, I used the space to list every date and location where my fiance and I have met in the past two years before the interview and proceeded to attach the evidence of meeting during those times in the following pages, each page with it's own explanation of where/when we had met and a list of the evidence I included.

When you say she has to maintain residency requirements, what you mean? can she travel outside USA during that residency requirement period?


As soon as she has her green card or advance parole document, she can travel without problems.

By residency requirements I meant that she will not be allowed to leave for extended trips of over 1 year without requesting a special re-entry permit from USCIS. She also must not have been out of the US for 18 months or more (cumulative, not consecutive) during those 3 years or the "clock" will start over.

You did not lie and therefore this should not cause an issue.

Since you will have to fill out a I-134 for the visa interview at the consulate, they might ask you why there is a discrepancy but as long as you meet the minimum 125% above the poverty level to sustain your SO, you should be fine.

Alright. The US Embassy in London received our petition (K1). Now it's time to fill out the affidavit. I work part time because I'm a student. My mom is willing to be our cosponsor, but I'm a little confused when it comes to these forms. From what I've gathered, it's my understanding that both my mom and I will fill out the I-134 and send it to my fiance for packet 3. It will not be until we apply for AOS that we each fill out the I-864. Is this correct?

Hey everyone,

I sent off the completed packet 3 to the US embassy in London recorded delivery. I tracked the packet and it was received on the 19th of March, just over two weeks ago. In the meantime I've had my medical examination, but they're waiting for some further information from my GP before they forward the information to the embassy.

I haven't heard anything back from the embassy so far to do with Packet 4/an interview date, I was wondering if this was a normal length of time and whether I'm just being impatient? :P

Any information would really be appreciated :)

Hey everyone :)

We're now at the stage of waiting for the interview date at the US embassy in London but have a couple of questions regarding the I-134 affadavit of support.

Both my fiancée and her mother (co-sponsor) have filled in a form each. However, we only have evidence from my fiancée as she's the main sponsor (e.g. pay stubs/tax returns). We're wondering if that was satisfactory at this stage, or whether the co-sponsor was also required to furnish evidence if the I-134 form wasn't enough. If they do, do you have any examples of the kinds of evidence that may be required?

Any help would really be appreciated!

Exactly. That is why you hired one. She just delayed you because she didn't do HER job and make sure every t was crossed and i dotted before she mailed in your packet. She owes you a refund.

Well, I should say she POTENTIALLY owes you a refund assuming everything you gave her *SHOULD* have been correct.


Ya your probably right, but I think I will wait til her job is done, because part of the $500 fee is that she files all the paperwork for her once she is here, then maybe I'll chew some ####, but then again its only $500 compared to me filing it all wrong and delaying her more to come here.

well the one thing I did notice after the packet was sent was that I forgot to sign my permission to marry and she signed both of them, I asked the lawyer and she said it shouldnt be a big deal, and maybe it is, I hope its something that simple, but who knows. I just sent bank statements showing that I can financially support our situation. Well I guess I need to learn patience,but that I doubt will ever happen, Ill keep ya posted.

Without the actual RFE - hard to say.

Did you get the first NOA at least?

Did you file within two years of your last meeting with the benificiary?

Did you make a copy of everything you sent in? Was everything signed (as appropriate)?

Can't say on how long this will delay you - they can take up to 60 days to go over your RFE evidence.



Yes back on december 7th, and I was there last August, and I have a copy of everything. Well 60days is better than 5months. I was hoping that it happened before winter because she has never saw snow and is a christmas nut so it would be cool for her to see the first snowfall, and she is going to have to get used to cold wisconsin winters!

Hello, I recently recieved an email stating that my case is now at the request for evidence status, I filed with a lawyer back in december, and included many pics, chat history, western union receipts, emails, plane tickets, bank statements, intent to marry, birth certs, you name it we made sure we had it in there, I havent recieved the letter yet but should in the next couple of days and am wondering, what it may say? and how long does this delay the process? They told me that once i send the packet back with the info they need I will get my spot back in line and then I have read on here it goes to the NVC and that process is about 2-4 weeks, then off to manila which is about 90 days til interview. I would like to be there for the interview but its very hard to pinpoint when that will be until she gets the call, so realistically how much longer would you guess that she would be here if all goes well? I was thinking like September?

Well last week I called the embassy and they had only received the email from the NVC and wouldnt let me schedule anything so I called tonight and it must be all good to go because they let me set up the interview for later this month, which works out just great because we were trying to get ahead of the game by getting the medical all done, she flys to manila tomorrow to spend a few days doing that and also some seminar she claims to have to attend(which I havent found anywhere), but just wanted to thank all who have given me advice, and want to know if there is anymore that I should have? I am mailing out the final pack to her in the morning it should be there in two weeks and then she should be good to go. Her interview is on the 23rd of July, with god's will and she passes I figured her arrival time to be around the 1st or 2nd week of august does that sound about right? also any recommendation on where to book flights here? All I have really found was Philippine air, but they only go to san fran, la, or vegas. id like to get her into either chicago, milwaukee, minneapolis, detroit or st. louis if possible. Thanks again!

Another example is how many of you pay 75-100 bucks an hour to have someone fix your car when you can learn how to do it yourself, then you have to trust your mechanic that he is not screwing you. In my line of work I can walk out to a multi-million dollar electronic system and know exactly what screw to turn so to speak. But that took years of training.

Sure, the immigration process looks a lot simpler to me now, but at first, it was a nightmare with countless hours of study, one error could cause major delays and even the loss of your fees to the USCIS. Yes, I had to gather the proof, but was directed as to which proof I needed and whether it was acceptable or not. Did have enough common sense to determine if my attorney also knew which screw to turn. Getting my intended here was too important to me then to try and learn all this stuff myself, and as pointed out, there is a lot to learn.

In regards to saving money, if you go to any building supply store, can pay over twice as much to have even a simple board installed and you pay that with post tax dollars that can add another 20-40% to that cost, if you buy it on time, that board can cost you over twice the installed cost, after taxes so you end up paying six times that cost of that board. Know a lot of people that paid 2000/3000 bucks to have their car fixed with the same problems they had before they started.

It was a lot easier for me to learn how to build a home, took a year off, did everything right and paid off the construction loan in two years. Yeah, people told me I am losing one heck of deduction for mortgage interest, but just replied, would rather give just 30% of that money than 100% of it to a bank. Wife and I also decided to have a large wedding reception to share our joy with our family and friends, even put on the invitations, please don't bring a gift, we just want you. Ha, that didn't stop them, anybody need an extra toaster?

Regarding that 1,500 bucks we spent on an immigration attorney, but my wife and I agreed to it, only a one time expense, do not plan on ever doing this again with immigration.

When I first got on the USCIS site that I had to learn about, my head was spinning.

I would get engaged and file asap. I know it's not exactly the way you had it planned, but if you want a May 2010 wedding...the sooner you file the better.

Look at the timelines for your service center (based on which state you live in), and the timelines for k-1 interviews for the consulate she'll go to (based on her location in canada). That will tell you better than anything can if it's possible.

I remember being so confused about all of this too! I can spell out the k-1 process specific to you. I'm not familiar enough with the spousal visas so hopefully someone else can take that.

K-1 process:
-Get engaged
-file i-129f
-noa1 (receipt of i-129f by your service center, Vermont or California depending on where in the US you live) You'll get this in a few days to a few weeks.
-noa2 (i-129f is approved and sent to NVC/natl. visa ceneter...then to the consulate...Montreal or Vancouver depending on where SHE lives in Canada) You'll get this in a few months (4-6 month range is typical...varies greatly for everyone)
-Consulate sends your fiance a packet with instructions on what to send back (forms, instructions on medical exam (this can take several weeks-over a month as it travels through NVC and then to the consulate)
-You send the packet requirements back
-k-1 interview is scheduled...fiance receives letter with the date & time
-pass the interview
-POE with k-1 visa (valid up to 6 months but only for 1 entry...so if she's not ready immediately, she has 6 months to get ready & cross ONCE)
-marriage (you MUST get married within 90 days of her entry
-file AoS (there is no timeframe, but most people file right after marriage if they can afford it lol...some wait over a year)
-With the AoS packet, you are sending forms filing for work authorization and travel parole. She won't be able to work until they send the EAD (employment authorization document) which is used in the interim while waiting for the actual Green Card. She also has to wait until receiving the travel parole papers before traveling to Canada if she wants to be able to return to the US (she'd get into Canada without them, but not back to the US).
-Green Card is issued when AoS is approved (this is Permanent Residence status WITH conditions (meaning it was obtained via marriage less than 2 years old)
-Lifting Conditions-must be filed after 21 months but no later than 24 months after the Green Card is issued.
-Citizenship (naturalization) ... Still learning about this. I recently read on USCIS site that it can be filed for 3 years after obtaining Permanent Residency. I'm thinking this means 3 years after the conditions are lifted because I always read it was 5 years which it would be if you include the 2 years you have conditional residency.

That's it in a nutshell! I remember being so confused, reading their forms and trying to put it into a timeline. I didn't have Visa Journeys at the time, thank your lucky stars you found this site NOW!!

Basically, you have to decide what is most important to you...
Being together right after marriage=k-1
Working immediatley when entering US-spousal visa options

How easy is it to travel/visit each other (you can visit during either process, but she'll have to prove strong ties to Canada (mortgage, job, utility bills, etc...whatever they ask for). Look at the current timelines for each visa you are considering and take your answers to the above into consideration.

Bad consequences are exactly what my fiance and I endured when he tried to visit me for 6 months during our k-1 process. He did not have proof of strong ties (mortgage, job (they'd want at least a letter stating your expected return date signed by boss or HR and pay stubs for proof), current utility bills). You've only listed things that will be a red flag to them. So the consequences for us were NO VISITS until he had the k1. In order to see each other for that entire year (yes it took a full year from file date to k-1)I had to visit him. The officer even told us he could ban him for 3 years right then and there if he wanted to. Ridiculous I know, but they do have that authority.

If she's going to visit you, it's going to likely have to be for shorter increments and she's going to have to show strong ties to Canada plain and simple. The request for a 6 month visit is what sparked off the whole interrogation for us. Yes, Canadians can VISIT for 6 months, but being your fiance is a red flag to them and that goes out the window.

I understand that others have had no issues visiting (haven't heard of anyone going for 6 months tho) during the process, but your/her situation sound too much like ours and I'd hate to see anybody else go through what we did.
