I will try to be a bit more helpful here.
I would have him get a letter from his employer stating when he started, that it is a full time job, what he will make, etc.
Also the last 5 paystubs is a good idea.
I also got a statement from the bank, telling of all my transactions from the last year, and how much money I have in the bank now.
He still had to pay taxes while he was a dependent, no?
If the taxes says he did not make enough, that is ok, they just want to see he paid taxes. I had to do the same, send in my tax forms saying I didnt make enough. But I did, and it was ok.

Thanks a lot for responding. This is such an overwhelming thing to go through. I did look at the guides, and I think we're going to hire a lawyer and then have a private social wedding in canada (so technically we wouldn't be married yet) then file the k1 forms. which will give me lots of time to get ready to move to the states.

First let me apologize, I realize there are a ton of threads very similar to this one; however this is a very confusing issue and I need some clarification on my specific situation. My fiance (from WI) and I want to get married, and my family would like me to get married in Canada (BC). What would be the easiest and less time consuming route to take? we want to do this legally.

I understand that the American government would want us to fill out the k-1 fiance visa form, which would allow me to come to the states and get married. if I do this, do I then have to fill out a form that lets me return to canada? and if so can we both come and have a ceremonial wedding in canada? IF yes.... then how long does that take? (to be able to return to canada)

Or, can we get married in canada? then he returns the the states and fills out a K3 form? how does that work and what would you guys suggest doing?

also, if we get married in Canada, is the marriage license legal in the states? or can we have a ceremonial wedding, then he can file for a k-1 visa and we can have a civil wedding in his state? Sorry for all the questions.

I am looking over the i-129f and on pg 2 question 20 it asks "Your fiance will apply for a visa abroad at the American Embassy or consulate at:" then it has a box for city and country.

is that where we will put Vancouver, canada?

oh thanks so much!! My mom had talked to me earlier and she was certain I had to go to montreal, because everyone she knows has done it that way. So, that just pushed me over the edge. I dont think a lot of people research the different types of visas and they just get married, so that is probably where her info came from.

Hello all,

I am trying to wrap my head around all these costs and procedures that need to be done in order to marry my fiance. It's starting to become very overwhelming. I was just wondering, when you need to attend your interview do you have to go to Montreal, it was my understanding that they send you to the nearest embassy or w/e that is closest to you. I live in Vancouver, BC... so it will cost me about 800 dollars to fly to montreal, and with all the other costs involved... I really don't think I can afford that.

is it true that thats where everybody goes? or not?
-also does your partner have to go with you?

1. for the g-325a if you are unable to fit your work history on the page and have to create a separate page, do you have to have a separate page for each of the pages of the g-325a? ie have 4 separate pages w/ identical info on them.

2. for the I-134 can a retired person sponsor you? My fiance doesnt have a job right now, and really hes just been going to school since highschool, so, his mother (who is retired) would like to sponsor me instead of him. Otherwise we will have to ask a friend or a sibling of his.

WOW...... No I mean BIG WOW!!!!!! Well I have been around here since Oct of 2006 and all the post I have looked through I have not seen one case, as of yet, like yours. But to answer your question......Yes, I believe your BF can be the co-sponsor. I really do not care what your lifestyle is, but I hate to say, I am really thinking that you might get a lot of ###### here because of it, especially because other people are only with one person, and here you have two, and one is from another country, they might be bashing you for taking up more time for their loved ones to get here, by geting a second man from another country instead of picking one from where you are. I am not ragging on you, cause like I said I could care less what your life style is. But don't get depressed if you do not get a nicer respond to your questions. Well since you can't fire your lawyer this late in the game...just keep reading VJ, and make the lawyer work for his/her money. If you see something that doesn't look right....double check with info available on this site...and go back to your lawyer to make sure things are done correctly. Has this lawyer been hired for the complete process...i.e. the adjustment of status process too, for when your fiancee gets, you marry, and then adjust her status? If so, from what I understand that process is a little more detailed as far as paper-work goes,....so you may want to read the Guides available here to make sure all is done correctly when your time comes.

NO...... He was not hired for adjustment of status, I am glad I did not pay for that as of now, but I am also scared "Shitless" that I am going to screw something up if I have to do it myself. I paid him 2,150 for taking us all the way through until visa in hand and filling out the paper work on co-sponsor.

Well poop...I just looked at your timeline...so I erased my whole long winded post. You got approved w/out the letter of intent, though it is stated in the instructions as being necessary for filing the I-129F. Congratulations!

You may want to make sure that updated letters of intent are available for your fiancee, one from you and one from her, for the interview....just in case. Good luck!

Well To the both of the responders...... Thank You. Yes I have already been approved and I am currently on the very long waiting list for an interview in Dominican Republic. I know about the lawyers also, but I was the one who did not trust myself to deal with the paper work. I "DID" have faith in my lawyer, but I have noticed a couple of things lately that has put up a warning sign with them. Wish I could FIRE him and get my freakin money back to tell you the truth. I know I had brought a similar question before, but I am confussed, so please forgive me now. We are already awaiting to get a scheduled appointment for an interview so we are at the end stage as far as having my fiance come to the USA. My question is:

1.) When the petition was first filed was there a background check for his country and USA??

2.) Then when it went to the NVC was there another background check and did they do it through the FBI??

3.) Then when we go to the interview they do another background check with FBI for his country and USA?? Or do we have to have him fingerprinted before we go??

4.) Then after we file the AOS do they start another background check through the FBI for his country and USA????

I am sorry, I am still so confussed with this whole thing and a little aggravated because after all this time I still feel confussed. So in all how many background checks/FBI do they have to do?? I was arrested two times before but nothing serious, not felonies & only had to pay fines. Do i have to put that down in the I-129f under Part C number 2. My charges where trying to buy alcohol underage and disordly conduct



Yes...... My fiance had two cases similar, one fight and 2nd not having title to motorcycle, the only thing is I believe he was only detained but at the time of the application (I-129F) we said he was arrested. So he had only had to see a judge for the fight and then pay a fine, so our lawyer put down, no trial, case dismissed, paid fine. Not saying to put this down for yours, but do tell. 3) I-751 in order to lift conditions is now $465 plus biometrics I think...


The I 751 is paid for when we go to the AOS interview??

NO you file I-751 and pay for it within 90 days of the conditional green card expiration. Also the fee can always go up again by then.

Two other forms needed for AOS not mentioned, G-325A for the alien adjusting status, and I-864 with financial evidence provided by the US Citizen Spouse Sponsor.

I-131 is optional for K-1 holders if they do not intend on leaving the country while waiting for AOS, and is not needed for K-3 holders at all due to the K-3 being a multi entry visa.

It's funny how you just came down on the OP because she is new and is "supposedly" not liking the advice of the "Older members", and here you are still engaging in "RIDICULOUS" bashing. What is up with everyone!!!!!! First of all can you guys see what the hell USCIS is doing as far as having people stressed out and at each others throats?? Kim and I are just starting to gather documents and filling forms for a K1 visa. We know it's going to be a long and tough but we are prepared for it. We were so glad to find this site which is such a gold mine of information. I have 3 questions though for which I couldn't find answers so here they are:
1- Is this a problem if we send the application while I (I'm french by the way...) am visiting her. I managed to take 3 weeks off and I'll be visiting her. We read that I should not try to visit her while the application is being processed as there's a risk of being denied to enter the US so we'd like to send it as soon as I land so the 3 weeks I'll be spending with her will be three less weeks of being apart.
2- In the letter of intent that I'm filing, what address should I put because I didn't get if I should put the USCIS address or the embassy's address. Do I have to put the USCIS address on the letter that the petitioner will send and put the embassy's address on the letter that I'd be sending to the embassy eventhough I didn't read that I should send any letter of intent to the embassy.
3- Has anyone tried to enter the US while the K1 application was being processed? What are the real risk except being denied and what are the chances of actually being denied. Ok for this last quesiton I might not have search the forum enough :)

Hi,
I've read that some of you were having a hard time at customs when they had been visiting the US a few times within a short period of time. I am going to visit my fiance for another 3 weeks in the end of April while I spent 2 weeks in the end of January (I know, those damn french have too many vacation). I was just curious on what questions you can be asked and what should you really answer. Should I say that I'm visiting my girlfriend? Or just a friend? Shall I say anything?
I was just curious to hear some other people's experience...

I have a question about putting the social security number on the I-29F for your alien fiancé if they were ever given one. Fred was in the US for a year to study between 1997 and 1998. He had already finished high school in France, but decided to come for another year and wound up at my high school, and that’s how we met. However, he technically wasn’t a student because he was finished with high school at home and was able to get a driver’s license (the DMV will give a license to ANYONE! :) ) and he was also given a social security number, but his card clearly states that the number is not valid for working in the US. Do I have to put that number on the I-29F? Is it possible that when all of our paperwork is approved, they will just use that number again? I am curious if anyone else was here in the US on a student or work visa and had a SSN for that purpose already and used it. Any info would be greatly appreciated!

Thanks for the replies. I've never had any problem at the gate not even any extra questions and I've been to the US quite a few times. I've studied in the US back in '97, '98 which might help in letting them know I can follow the rules. As far as the ring goes, I just don't know if I should declare it or just have it on me (which i will anyway). I don't want to scare the POE officer by declaring this ring. On the other hand, I sure don't want to brake any law or jeopardize anything for a stupid mistake...Maybe I should form a club, something like the Worriers Anonymous, anyone is more than welcome to join up :)

Hi,
Here I am worrying again so I have to ask this question. As I said in my previous post, I'm worrying about coming to the US for the second time in 3 months to visit my not yet fiancée. The application has not been sent yet, we'll do that once I'm there to avoid taking the risk of being denied entry. But eventhough it has not been sent, I'm still afraid of being asked questions and don't really know if I should mention that I'm visiting "friends" or my girlfriend. I thank everyone who replied to me eventhough it seems there's no real answer to it. Now, my second question would be how risky would it be to come to the US with a ring in my carry on. I know that most of you would think this is crazy. I would just like to know what are the risks? Do I have to declare it? Would this give any officer a very good reason to deny me entry?
I know that I'm probably going to hear horrible worst case scenarios and that it's going to make me worry even more but I prefer to be prepared than sorry. What I find very sad is that I already feel guilty of something but the biggest crime I'm commiting is to be in love with her. I know there's nothing to debate here, the laws are what they are but still...

What day do I put in the slot where it says NOA1? The day that they received my application, or the day I actually receive the notice in the mail?

The website says my application was received on May 23, but I haven't gotten anything in the mail yet. I called and they said it could take up to 45 days to come in the mail, but that doesn't mean the application process is delayed. So does that mean I should put May 23 as the day I got my NOA1?

I'm a bit confused. :blink:


We seem to have the exact same timeline regarding sending out our packets, USCIS receiving our packets, and getting our checks cashed. I still don't have my hard copy yet, but I saw an image of one, and it really doesn't say anything more than what your case says online. We'll have to continue to keep our fingers crossed and hope that we get ours soon!

Hi all, just a quick question. I'm going to visit my fiancée in september and I just wanted to hear from the ones who visited their fiancée, while the application was pending, what did you tell the officer? Did you say you were coming to visit friends, your girlfriend/boyfriend or you fiancé? I'll be bringing proofs of tie to my home country but if I can avoid being taken to the "back room" using the proper words I'd be ok with that! So feel free to share and please only share if you actually visited.

My fiance and I got our NOA1 back in May and we often worried about him visiting after it was issued. He's here with me right now, and had absolutely no problem getting in, even though we were both nervous about it. He had so many proofs of ties back to France, but never needed a single one. The immigration officer asked him why he was here, and he just said, "It's my vacation" and nothing further was asked and she wished him a good trip. That's not to say this will happen all the time, but it's good to know that there really are times when the K-1 doesn't even come up. Really, just answer what they ask you, nothing more. Also, I can't say I've heard of anyone from an EU country who also has a clean I-94 record having troubles visiting the US.

We received our NOA 2 September 7th, while we were together, so that was good news. I just don't know how long it will take to get to the NVC, and then to the embassy, but I hope things continue to move forward.

Thanks for the feedback guys! I'm still not sure though... I mean, I have all the addresses and exact dates that I lived in each apartment... I guess like other people have stated here... I'll just put too much information and maybe there won't be problems!

This website is awesome!!! Especially for the information regarding RFEs... the providing evidence of meeting was the most stressful part of this... but now I feel a lot better!!! Thanks again everyone!!!!
