K-1 Fiance(e) Visa Process & ProceduresI 134 question
I have a question about question #9 on the I 134 for my Fiancee

9. I have previously submitted affidavit(s) of support for the following person(s). If none, state none.

I had been married in Philippines in 2001 and brought my wife to USA (we have divorced 2006) Am I correct to assume I would enter her name in question #9?

Also question #11
I intend to make specific contributions to the support of the person(s) named in item 3.

What do I enter here? (we intend to marry within 90 days of her arrival)

Thanks, Buksol

K-1 Fiance(e) Visa Process & ProceduresTogether, Alone
Austin, your comment about feeling like you are a five-year-old really resonates with me. Today I called the USCIS hotline to inquire about the status of my case and he said the timeline for an NOA1 has been extended to 90 days instead of the previous 4 weeks. I cried on the phone with a perfect stranger. I then got mad and yelled at him, apologized, and cried again. I have about as much control over my emotions as a five-year-old.

That being said, whenever I talk to Nik... seeing him on camera, looking at his picture, reading his letters, etc etc. I can't help but smile. Knowing I am the luckiest woman in the world to be loved so much by such an amazing person... Sure, it's terrible we cannot smell, touch, taste, feel, kiss, the one we love but some people go their whole lives and never experience such emotions.

I guess, while I don't relish the trials of separation... I am accepting of what's happening. And the people here on this website are so incredibly supportive... I mean this post alone shows how loving everyone can be. What is the saying, "Misery loves company?" Taking it a little out of context, it's true. Having others who share your pain and anguish, who can commiserate with you during the process... it makes everything much more bearable (and I've only just started).

As far as words of wisdom go, I'm not sure I have any. The other posters on this topic have very eloquently stated very good advice. I will say this though... if you feel like crying, cry. It's perfectly natural to be sad because you are separated from your loved one. Just don't let your sadness consume you. It's kind of funny how it has worked out so far for Nik and I... Whenever I call him crying, he's steady as can be. Offering comfort and solace and cheering words... and sometime later we'll be talking about something and he'll burst in to tears about how he misses me... but then I'm there to help lift his spirits.

Someone else mentioned that you're not alone, and I'd like to echo that here. Because you're not. You have the love of your life and you have all of us here.

Good luck on your journey! I'll keep you in my prayers for a speedy approval. smile.gif

K-1 Fiance(e) Visa Process & ProceduresSignature rejected
QUOTE (patrick & relyn @ Nov 5 2007, 04:36 PM) <{POST_SNAPBACK}>
Im just a little confused about what signatures.......there are four copies of 325A but with carbon paper. Do you sign the top copy and its all good or do you have to sign each copy individually? Then you sign the 129F itself.........and sign the letter of intent to wed.
More concerned with the 325A "carbon signature". Is that ok?

I signed everything. Ok, not everything but very very close to it. My packet contained...
  • Check (obviously signed tongue.gif)
  • Cover Letter --signed
  • I-129F and supplement for question 18 --last page of I-129F signed and supplement signed
  • Statement of Intent to Marry (beneficiary and petitioner) --signed
  • All 4 sheets of G-325A including supplement for petitioner (for petitioner and beneficiary) --signed (12 signatures, 8 for me and 4 for fiance)
  • Passport style photo --didn't sign anything here, just labeled with names
  • Copy of ALL pages of my passport --signed the first page because I wrote "I verify this is an accurate photocopy of the original passport, bla bla bla"
  • Cover Letter for Evidence of having met --signed as well for similar statement as that for passport
  • Actual evidence of having met --didn't sign anything here
So yea... I signed almost every sheet of paper. You might not have any supplements to add to your packet and therefore wouldn't need to sign those... and I don't know if I needed to write statements as to the accuracy of the copies and then sign those statements, but it seemed like the right thing to do as I was putting together my packet (I think I read somewhere on here about someone else doing it). As to the 'carbon copy' thing. I'm with MR2nice on using the .pdf file. If you fill in the top one, the bottom 3 fill in automatically. Then you can print it and sign each individual sheet.

I hope this has helped! Good luck! I know everything seems really confusing... it'll get easier with time and study! smile.gif

K-1 Fiance(e) Visa Process & ProceduresK1 advice please
QUOTE (Bradan @ Nov 7 2007, 10:36 PM) <{POST_SNAPBACK}>
Thanks for reply YuAndYan. what about the tax return that they required. and i see on the G-325A they ask for employment information. if my sister Sponsor for me do they require me to have a job. or it can be all on my sister. thanks. please give me advice on how to do this. thanks alot everyone.

In order to file the I-129F you don't need to provide financial information (other than the check for 455.00$ tongue.gif). Like YuAndDan said, the sponsorship stuff isn't until the interview much later in the process.

If your sister can sponsor you, you do not need to have a job. You just need to prove that if your fiance was allowed to enter the U.S., s/he would not become a burden of the state. As to the tax returns... if you read the instructions on the I-134 form, it doesn't require you to send in the last 3 years tax returns. I-134, Affidavit of Support (.pdf)

Good Luck!

Hi E&S,

We have a similar story. My fiancee in china applied for an F1 visa in August. It was turned down for the exact same reasons, the school wasn't well known and she already had a comparable degree. Never mind that it was in business instead of english. Anyway, you arn't alone. Best of luck for your Journey.

K-1 Fiance(e) Visa Process & ProceduresWould previous denied non-immigration visa affect K1?
My fiance (USC) and i have known each other for soon 3 years and I actually spent quite a lot of time with him while I was in the US 5 times on business visa (b1), each time I spent 2 - 3 months - never over stayed. Earlier this year I was accepted by a university in the US so I tried to apply for student visa (F1) to go to that school, however my F1 was refused just because the school is not famous and that I have a BA degree already while getting another BA.. I actually re-tried my F1 and the 2nd time was turned down too in Sept this year.

I am just a bit concerned that this "history" would cause trouble for our K1 application. any idea?

thanks!!

we didn't submit any chat/email copies at all.. my man is just not the type of person who likes to write.. we have very few email exchanges and very few of them are romantic.. we hang on messenger every day too but still -not much of the chat record shows much ongoing relationship.. since i have an american number bought from Skyp In service.. we are on the phone for hours every day.. i hope the phone record can replace the email/chat records.. although the phone records only show his calling to an american number... wonder if that would be a problem.. i did attach a printed copy from my skype account page showing that american number is tied to my email address and forwarded to my chinese cell number.. hope the officers understand how such phone service works!

K-1 Fiance(e) Visa Process & ProceduresAbout to begin the Journey - I-129F questions
Regarding photos:

A friend of mine who has been through this two years ago told me not to put too many photos into the package as they will end up very heavy. Her case back then was that her package was too heavy and it was sitting at the customs forever on its way to the consulate until they called to complain.

What we did was organizing our pics by different visits on Office Word document (4 - 6 pics per page), then print out the documents. We have 7 visits totally to each other and so it was 7 letter-sized papers but all together about 40 photos. This way it is way lighter than sending 40 original photos. Also on each word document, you can add caption for each pic. For each paper, we add title too about who visit whom, where and when.

We had every document in our package either on A4 size or letter size, including our passport photos - we put them in a small ziplock bag and staple the bag to a letter-sized paper. It helped us to stay organized and hopefully helps the officer too when browsing our documents.

Good luck on your preparation!

although I also believe it isn't a problem, you might want to be prepared they would ask it at the interview. This happened to my friend at her interview - her fiance is 10 years older.

K-1 Fiance(e) Visa Process & ProceduresPackage 3 originals
Thanks for the info!! I have been doing some reading online, and it seems like when you send package 3, you only send in the paperwork(DS-230, DS-156, DS-156K) and you bring in the birth certificates, police records, etc with you to the interview, is that correct? Also, as for the translations, if my fiance is having his interview in Albania, and all of his documents are in Albanian, does he still need to get them translated to English?

K-1 Fiance(e) Visa Process & ProceduresPackage 3 originals
Forgive me if this question has already been addressed, but I have not been able to find any info on it so far... When I sent in my I-129f, I included the originals for birth certificates, divorce papers, etc ( I didn't want to risk any problems with copies!!) and now I see that they require originals for the package 3. Do I need to get new originals, or will they already have the ones I sent in with the I-129f?

I noticed that there is a question on the DS-156 asking "Have you ever been afflicted with a communicable disease of public health significance"
My fiance had TB about 9 years ago, should I answer yes? And if I do answer yes, is that going to create any problems with our application?

You can use the value of your house on the I-134. You need to show something stating that you own it and how much it is worth.

Check out the example I-134 here: http://www.visajourn.../Form-I-134.pdf

Thank you ZeeNusah, would you also send the I864 at the same time?

K-1 Fiance(e) Visa Process & ProceduresInsufficient Income
Hello, I am new as of today. My question is about the income. I am currently on disability for my back and have been for 5 years (inoperable). I am currently short about $2000 to meet the 125% poverty income level, but I own my home valued at $172,000, free and clear. My fiancee lives in China and I understand that the Embassy at Guangzhou only requires the I-134 form which does not ask for supporting evidence of the house like the I-864 form does. I would like to use the house as part of my assets to cover the $2000 I am short in income and looking for advice about this. Help sad.gif Should I also send her the I-864 as well as the I-134?

We had a Thai style ceremony in Thailand before Ying came to the US on a K-1 visa. We did not do anything that was legally binding. During the interview we did not mention the ceremony and when talking to others we called it an engagement party. We did not have any trouble.

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit question

Hi there,

I'm about to fill out and send over the I-134 Affidavit of Support form. But I noticed that the editions available for download here on this site and USCIS say at the top right "exp. 4/30/07" Does that mean that these are expired forms that no longer can be used? If so, where can I get the current ones?

Yes the 4/30/07 is accepted. On the USCIS website it also states that
2/28/07 is also acceptable. Versions 12/04/06, 7/14/06 and 6/17/06 are also acceptable according to this website.

yes it will be fine for the french person to visit during the process. you could be on the safe side and also bring some forms of evidence of ties to france, such as rent statement, letter from employer, bank statement etc. but thats just to be on the super safe side, normally its not even needed when travelling on vwp

DONT DO IT!!! I was advised by my attorney that my fiance SHOULD NOT visit me from Sweden while waiting for the k1 visa petition to be approved. This could cause the government to see their arrival and consider them abandoning their application. He said that it was only ok if the US Embassy in SWEDEN sent him written approval to carry with him to the US but still advised against it and said I should only go there to visit.

MANY people on this board have successfully visited the US while the I129f/K1 is in process. Please don't incite panic needlessly.

K-1 Fiance(e) Visa Process & ProceduresWhile waiting for a NOA-2
I am just curious, because I think it is possible for my work to ask for tourist visa for my fiance, they will sponsor her and take responsiblity for her. Every year my work asks for hundreds of visas for people from all Central and South America, and China. So I am curious is will it affect how they view my I-129F form at all if I have my work ask for a tourist visa for her in the meanwhile. Just to come and visit. Then to of course return for the interview process.
Thanks you all
and best of luck to everyone.
