K-1 Fiance(e) Visa Process & ProceduresVisiting during pending K-1 from a VWP country
I called USCIS yesterday and received a touch. But, I just checked and I have a touch for today. Could it be?

On another note - I posted to the ATTENTION JULY FILERS thread and it doesn't show up on the recent posts. What is up with that? Is it broken?

As I came in to LA from Figi - I asked the Immigration Officer after he scanned my passport if he can see that I'm going through a K-1 visa and he said "no". I was curious.

K-1 Fiance(e) Visa Process & ProceduresWhy do the process times at CSC keep going up?
QUOTE (EnZ @ Jan 18 2008, 11:08 AM) <{POST_SNAPBACK}>
Anyone have any ideas as to why the processing times keep going up? When I started my timeline the date was June 29th 2008 and now its all the way up to July 9th. I just wondered if anyone had any ideas as to this drastic change in dates.

Good luck to all, I wish patience was a virtue that I possessed

I am slowly learning patience. I remember when I filed in July that my date said October. Now it is January 18 and I am still waiting. Be ready for a long wait...

According to the USCIS the wait is about 6 months so your timeline looks correct.

Good Luck!
a-jeanneFemale02008-01-18 12:57:00
K-1 Fiance(e) Visa Process & ProceduresWhy is my processing time getting extended?
When I filed July 9th, I was given an estimated date of October 25 and it has moved constantly. Actually within a month it moved to December. Well, now it is January 21st and my adjucated date is estimated at January 22nd. Yesterday it said January 8th, so don't put too much weight into the timeline date. It is just that - an estimated date.

It's a long process - be prepared for the long haul.

Good Luck!

Signed - still hanging in there - barely!

K-1 Fiance(e) Visa Process & ProceduresPurchasing a house with my fiance BEFORE we have started the k1 application...
My fiance is still in the UK and we have already purchased a house here in the US and he has sold his home in the UK and bought another there just as an income property. We were fortunate enough to pay cash for both houses so there are no mortgages. We are just waiting for him to get here so we can enjoy this house together.

Good Luck on whatever you decide to do.

K-1 Fiance(e) Visa Process & ProceduresA question for RFE
I was told that my RFE was issued on the 28th of November and I didn't receive it in the mail until December 20th. I sent it back on the 22 of December and to date have not heard anything from the USCIS. I have made a few calls but with no luck or information.

What really upset me the most is when they tell you that they are sending an RFE and don't tell you what it is for or what is about. I could have used the month it took to get the letter to gather the information that they needed.

Our RFE was based on needing more proof - ie pictures, airline itineraries, tickets and proof that we had met within the two years before we filed. We sent plenty of proof initially, so we ended up sending passport stamps and itineraries for his last three trips before we filed. Then they also wanted signed copies of our divorce decrees, which they initially had, they just wanted them to be signed by a legal authority or a judge. Stupid - stupid.

So, here we are on the last day of January with no new information. Just waiting and waiting and waiting...

Yes, every case is different and don't let mine discourage you. There are cases that are approved within a couple of days after the USCIS receives the evidence. I hope that is the case for you. Good luck.

Hopefully, you have a copy of your petition. Have a look over it and see if there was a document that may have been unsigned, or perhaps you did not include your fiance's ( translated ) BC, divorce decree or some evidence of having met in person that could be crucial to proving your case...? That way, you can be ready when you get the hard copy RFE notice. Just a suggestion.
When you return everything back , write on the left bottom corner of the envelope in bold red
' RFE ' . Best wishes to you!

I'm a July filer and I received an RFE on November 28th although I didn't get it in the mail until December 20.

Check your documents in case you find something you can be researching in the meantime. Our RFE was based on them needing more evidence of a relationship. We sent everything that they requested but then sent copies of his passport and printed out the itineraries from his trips. Then we also got an RFE for our divorce decrees. They were not "signed by a legal authority". I was able to send our RFE back in a few days and they stated that they received our evidence on December 28th and we're still waiting.

Good Luck and best wishes. Let me know if there is anything else you need to know. Just know that I am here for support if you need it.

K-1 Fiance(e) Visa Process & ProceduresI-134 Co-Sponsor??
Hey guys-
I think I'm dominating the forum today as far as questions go... I just keep coming up with more and more!! Anyway, from what I understand, my fiance will have to bring the I-134 form to his visa interview. I am a full-time student and so at this point I don't my income is not over that of the poverty rate. My mom (and dad) are willing to be co-sponsors for him. How does this work? Is there a separate form they have to fill out? Will we be denied on the basis that I, his main sponsor, does not have a steady income? Thanks so much.

K-1 Fiance(e) Visa Process & ProceduresOdd G-325A Question
Hey guys,
I'm very new to the I-129F process and I am working on filling out all the forms necessary in order to send the petition. As I fill out the G-325A form and I-129F form online, using Adobe Reader, if the information doesn't fit, it puts a little plus sign next to the slot and then when I print it, the plus sign is there. Does that ring a bell for anyone? For example, when it asks for my residence in the last five years, when I type in the year, for instance "1987" it does not fit on the line. Is that supposed to happen? And how can I fix it? I want to avoid having to hand-write all these forms. Also, when it asks for employers and addresses, do they want the complete address (including street number, city, zip code...) Thanks so much for your help! Let me know if I need to clarify my question!

Hello,
I am planning on including love letters and emails from my fiance in the I-129F Petition package for proof of ongoing relationship. However; they are in Spanish. I am assuming that they need to be translated into English... am I able to translate the letters myself and include the translation, or is there another way I have to go about doing this? K-1 Fiance(e) Visa Process & ProceduresG-325A Employment?
Hey everyone,
I'm just trying to finish this G-325A form for my fiance, and he was a student for 4 years (and wasn't working) He had a job during school at one point, but then stopped working from 2005 until 2008. He currently has a job. I noticed on the sample form they say no to leave any time gaps between jobs, and to put "unemployed" if there are gaps. Should I put "Unemployed- full-time student"? What would you suggest? Thank you.

Hey guys-
On the G-325A for my foreign fiance, when it asks for his "last occupation abroad," do I include his current job- since that is technically "abroad" even though that's where he lives? Does that make sense?

Also- if I include letters we have sent back and forth, can I send photocopies? I don't really want to send of his original letters to me. Thanks so much for your help!!

Hello- my fiance is Mexican, and he also has 2 first name and 2 last names... I don't know what the "right" way is, but here is how I went about it

Let's say is Jose Miguel Martinez Perez

LAST NAME: Martinez Perez

FIRST NAME: Jose

MIDDLE NAME: Miguel

I don't know if that's the best way to do it, but that's what I did. I think I would definitely keep the two last names together. As far as the 2 first names, I don't really know. What do you think you'll do? I'm still in the process of filling out the G-325A and the I-129F also.

QUOTE (Kristen&Mark @ Nov 4 2007, 05:37 PM) <{POST_SNAPBACK}>
My fiance found out on Friday when our interview would be... not until January 2nd! AHHHH. We were really hoping to have him here by Christmas and thought it was possible, since some dates from Nicaragua were within 2 weeks of the interview. Anyone have advice for moving up the date or had success? Should I write the consulate in Managua or contact my congress person? Thanks. Keep the faith on your journey!

K-1 Fiance(e) Visa Process & ProceduresAfter NOA2... Just looking for guidance
USCIS will forward your packet to the NVC and that shouldn't take too long since you used VSC, but you never know. Ours took 5 weeks from CSC. Then it will be sent to the embassy and they will send her packet 3. Since she's not going home until Dec. 7th, she could very well receive packet 3 before that, yet not be able to return it until she's home and that will set you back some. As far as the affidavit, you must make 100% of the poverty level for I-134, and then 125% for I-184 which you'll need for adjustment of status. If you don't make that much, you'll need a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresSTUCK AT THE NVC!!
It is faster for K-1s, that is when your case is actually received. It took my case almost 5 weeks to be officially received, but once there, it was in a out in 2 days. K-1s will never show up in the automated system, because they just don't stay there long enough. Even after I had my NVC case number, I tried entering it in the automated system, and they still said they had no record of it. There's another whole forum about this subject on the K-1 subforum. A lot of people with approvals from CSC from the end of August on have had to wait at least a month for their cases to make it to NVC.
kimandfredNot TellingFrance2007-10-25 12:46:00
K-1 Fiance(e) Visa Process & ProceduresReceipt Numbers
Your USCIS receipt number stays the same throughout its time with USCIS. After you've received your approval, or NOA2, your case gets forwarded to the National Visa Center and there they assign you a new case number that is unique to whichever consulate you're using. We're going through Paris, so the first three letters of our NVC case number were PRS, then a new 10-digit number.
When you see your last updated date change, it's called a touch here. You'll see this on people's signatures, including mine that say 'touch' and then a date. It basically means that someone has handled your case, whether to look at it, or to just move it from one place to another. A lot of people get them if they call to inquire about their case. I've gotten some right before I received my NOA1 hardcopy in August (there was a big delay in receiving these for May filers) and I also got one when I got approved. Some people never get touched, some people do a lot. I wouldn't get too excited about touches until around 3-4 months after your NOA1.
This process definitely requires A LOT of patience, good luck!

K-1 Fiance(e) Visa Process & Proceduresembassy address
If you are just filing the K-1 to California, then use the California service center address on your letter. Once it's time for your SO to have the interview, you make another fiancé letter of intent that is dated closer to the interview, and then you use the address of the appropriate embassy with this letter.

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions
You may be able to stop stressing about the preparation of documents, but believe me the stress doesn't end there. It's a lot of waiting and not knowing what's going on. I really think that we ran into every 'bad timimg' issue there was. We sent ours out at the end of April, and it took forever to receive our NOA1 because the serve centers were backlogged with a huge increase of work visas. Then, there was the fee increase at the end of July and a lot of people trying to beat that increase that slowed things down even more. When we finally got our NOA2 in the beginning of September, we thought things would really pick up then, but they didn't. There was a huge delay in getting our approved petition to the National Visa Center because the California service center was having problems with their mail contractor, but after that, the embassy was quick to send out the packets and get an interview scheduled. I'm just so happy that it will all be over Christmas, at least having to be apart.

I don't blame you, we stressed too at first because there's just too much information and the more of it you read the more your head spins. Sometimes you get too many opinions and you don't know which is correct and it can be overwhelming and too much information isn't always good. blink.gif
The sooner you get everything sent away, the better because the wait can be very long!

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions
I believe that you have everything that you need on your end. I just pulled up the cover sheet that I used when we sent our things in. Here's what we had in our entire package, which we pulled directly from the guides.

Contents include:
- Payment in the amount of $170.00. (I know it's a lot more now!!!)
- I-129F (Your fiancé will fill out and sign, but make sure he has your info correct.)
- I-129F Supplement: Part B, Question 18, explanation of meeting in person (Another thing your fiancé should type up, sign and date.)
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- Birth certificate/US Passport (Petitioner)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years (Your passport and boarding passes are good. In lieu of your missing boarding pass, a flight itinerary would work. Also have the pictures of you two together, with both of your names and the date on back.)
- Proof of ongoing relationship (We included a few emails, cell phone bills, and a couple cards we sent through snail mail. We also included a receipt for the engagement ring, but if you don't have that, it's not necessary.)

We were together when we mailed the package out, so we could both go over it together in person, but if you can't do that, just be sure he has everything together and make him check and recheck if necessary.
kimandfredNot TellingFrance2007-12-19 13:46:00
K-1 Fiance(e) Visa Process & ProceduresI-129F Questions
About the picture you're talking about, I don't think it's necessary at this stage. Just have the boarding passes, and you can make copies of your passport stamps showing you visited if you don't have the flight info. If you have pics together, send those too and make sure you name who is in the picture and give a date. I hadn't even been to France when we sent our package so not having pictures yet with his family wasn't an issue at all. It wouldn't hurt to add translations if you want. I translated a few notes Fred wrote to me just to show proof of a relationship, but I really don't think USCIS is concerned with this at this point. They just want proof you met in the last 2 years, are free to marry, and the proper required documentation.
It's very easy to get really nervous and stress out over small details, believe me. I think we check and rechecked our package at least 10 times before we sealed the envelope and mailed it, but we had everything done correctly. Feel free to post the a list of your contents for a second opinion when you're ready to send it off, but if you're like us, two never married people who've know each other for several years before this process who've never committed any crimes or have had any immigration issues, I'm sure everything will be fine.

You could try to hand write them neatly in the box if you don't want to attach a separate sheet. We had to hand write the town that Fred is from over and over because it was too long to type in the box. Sometimes I had to put the first part of it above the last part, but everything went fine.

K-1 Fiance(e) Visa Process & ProceduresI-129F Questions
Hi Cecile,

1. Yes, put your two other names as your middle name. Fred explained to me that middle names are pretty useless in France, but we listed his anyway.
2. You should probably put your address now as your address. You can always change it later, and like you found out on the G-325a, you have to list your previous addresses.
3. I think we put N/A in those sorts of blanks, and if there was a question that had a yes or no box and it didn't apply either way, we left it blank.

Good luck and I hope this helps.

-Kim

K-1 Fiance(e) Visa Process & ProceduresMailing our cases to NVC...
No, USCIS will not give you any further updates by email about your case. Be prepared to wait a few weeks for your case to be forwarded to NVC, many have had to wait around 6 weeks. (We had to wait 5). CSC waits until they can fill a large crate with cases before shipping them off the NVC. You can wait a few weeks and call the NVC and speak to a customer service representative and give them your CSC case number and they can tell you if they have your case. Also, some people have called CSC to see if their papers were forwarded, but sometimes they weren't told anything or were given inaccurate information. You will eventually receive a letter from NVC that says they received your case and will forward it and with it, it has a new case number. Once you receive this letter, you can be pretty much sure that you're case has left NVC.

You can download it from here or the USCIS website and complete the info. A sample form is available on this website that shows you how to fill it out. Then get it notarized as close to the interview date as you can like Zee stated, and send it to your SO along with your tax return, and a letter from your employer stating your job, your status, and how much you earn. Your SO needs these things to take with them to their interview.
