K-1 Fiance(e) Visa Process & ProceduresAny experience on 221g Request of additional document at the Lagos Consulate
Go with all the document you took with you on your first interview just like the first post (Suleymon) stated. If the RFE was requested from the US petitioner, i will say fax it, and it in time both to the Lagos Consulate and The beneficiary (your spouse).

Contrary to Anh Map statement, there is a second interview in Lagos Consulate, i went through this same process first interview in January and the later in February 2010 at the Lagos Consul. The RFE was requested from me and not my Spouse who is the petitioner and in the email sent to me from the Lagos Consul i was told to bring them in on my second interview the with letter requesting for the RFE.

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!
Hi everyone,
Well, I thought I'd share my experience of visiting my fiance while having applied for a K1. Just so you know, I'm a French citizen and our NOA1 date is May 23rd (we're waiting and crossing our fingers to get our NOA2 very soon). I arrived yesterday in Chicago to stay with my fiance for 2 weeks. The line for immigration was really long. I had brought tons of proofs of ties to my home country (lease, bank statement letter from my employer, copy of the K1 application). So then I got to the officer. It was weird cause I had rehearsed my " I'm here to visit my fiance and some friends" which is the purpose of my visit but she asked:" why are you here today" and I don't know, in the moment i said: "It's my vacation" which is also true. I was expecting more questions but she stamped everything, no other questions were asked and she wished me a good trip.
So all this worrying for nothing, all these papers for nothing but like many said it's better to be prepared than sorry if something goes wrong...
I just thought I'd share this because we don't have many people sharing their own experience. There is too many: "I heard that a friend of my cousin's friend" blah blah blah.
At least you got something that happened yesterday and that I personally experienced smile.gif
Of course that doesn't mean that everyone will be let in and I might come visit Kim again and there will be no guarantee that they'll let me in...

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!
Hi all, just a quick question. I'm going to visit my fiancée in september and I just wanted to hear from the ones who visited their fiancée, while the application was pending, what did you tell the officer? Did you say you were coming to visit friends, your girlfriend/boyfriend or you fiancé? I'll be bringing proofs of tie to my home country but if I can avoid being taken to the "back room" using the proper words I'd be ok with that! So feel free to share and please only share if you actually visited.
Thanks,
Fred

K-1 Fiance(e) Visa Process & ProceduresTurned in packet 3 in person....but did not get interview date
QUOTE (Ak+Tk @ Nov 10 2009, 01:39 AM) <{POST_SNAPBACK}>
Morning everyone on VJ

MY fiance mani and i mailed in our packet 3 visa certified mail on 20th October and every week since that day we mailed the embassy asking if they had received it but we received no response till 6 November. at the same time on our end with tracking that package it says it was delivered so we assumed they just never emailed us back...On November 9 Monday mani and i took a 6 hour drive to the embassy to turn in our packet our selves and to hofully get our interview date..the embassy did not let mani my fiance in at all so i went in and did all the work but they still did not give us our interview date they said it will come by mail..when we returned home. i called the DOS to see if it was scheduled yet and it still wasn't i will give them a call back with in a few days. just wanted to update you this is through the Delhi Embassy.

have a good day everyone and take a few moments to thank all our veterans and remember those who aren't with us today on this Veterans day.

I'm sorry that they behaved that way sad.gif but Delhi embassy especially is known to be super rude..so hang in here you are almost done! You should go to interview with Mani and I'm sure they will let you in...they might not let you be at the interview but they will know you are there with him and that is the stongest evidance that both of you are together smile.gif I will pray for you and hope that you get you interview day ASAP!
when Mani goes for his medical make sure they fill out every single form that needs to be filled. b/c of physician's mistake our visa was delayed week and half. sorry I can't tell you what form he didn't fill out b/c Karan got sealed envelope from embassy to take it back to physician and then in return he gave another 'sealed' envelope back to send it back..which I think is stupid that you don't know what's going on and it's about you? anyways don't stress too much..you guys will get the visa in no time!!! smile.gif

Hi all,

I just filed for K-1 visa for my fiance. and just realized after looking at the copies of the documents that I made, on fiance letter of intent I made grammar error. I accidentally said: I intend to marry within 90 days of my arrival into the US using the K-1 visa. but I am the one applying for him. do you think I could get RFE for this?

just little worried now..

K-1 Fiance(e) Visa Process & ProceduresNew here and we have a few Questions we need advise on
QUOTE (slider100 @ Nov 11 2009, 12:00 AM) <{POST_SNAPBACK}>
First of all, welcome to VJ Jamie and Skye, this site and the people on here will help you a lot. I will try to answer your questions to the best of my abilities and I am sure the other senior members will be happy to help yall as well:-
Hi I found this web site last night and was so happy to find somewhere to get advise and support, I'm Australian and my fiance and I haven't started the K-1 process yet. I currently live in Canada, but plan to leave in Dec, drive with him to his home town, stay for Christmas then go home to Australia and start the process. We have a few concerns and would like some advise.

1. My fiance earns above the required amount for his household, however he has been at his job for 3 months and before this was studying, his parents who he lives, with are happy to co-sponsor me but individually don't quite make the amount. Will me need to find another co-sponsor or will they take the combined income?
-> As far as I know, the embassy/consulate will NOT consider a combined income. If you have a co-sponsor, he/she alone should meet the income requirements.

2. I read a co-sponsor has the same responsibility as a sponsor, does this mean my co-sponsor needs to fill out all the same forms his does, or only the affidavit of support?
-> The co-sponsor only fills out the I-134 i.e. Affidavit of Support. However, the co-sponsor will have to submit documents proving his/hers domicile status in the US along with copies of Birth certificate/passport indicating his/hers US citizenship.

3. How current does a police record check need to be for a country previously lived in? If I get my record for Canada before I leave, will it be acceptable for the interview.
-> The police clearances for most countries for embassy(immigration purposes) are valid for 1year. However, I would still try to be on a safe side and get them issued within 6 months of the interview date.

Last question.
4. Planning the wedding? we would like the big white wedding with everyone there, should we wait for all forms to be processed and approved or start planning for a date well past the project time line?
-> Well, this is a tricky question. You have to understand that your application goes through USCIS (Department of Homeland Security) and then once approved ( keeping fingers crossed for no RFE'S issued) then it is forwarded to the NVC (Department of State) and then to the beneficiary's listed consulate. So, it is kind of a long process. However, that being said, the current processing speeds are actually faster than what they used to be, especially the Vermont Service Center. I would advise to atleast wait till you get done with the USCIS stage for planning the wedding. I know most of the people on here might advice you to wait till you have your visa in hand and they are right too. That is just my opinion !
If you have any more questions, feel free to pm me. Take care and good luck !

Thank you, it is so nice to get good advise so fast appreciate it. S

K-1 Fiance(e) Visa Process & ProceduresVisiting before the K1 process
Thanks guys for your advise, Nik + Heather, I didn't look at like that, and I hope they don't, I've been in Canada on a working holiday visa for 5months and I'm moving home because I miss my family, I have a great job offer back home and we thought getting the paperwork together would be easier back Home. I think the best thing is to say I'm spending time with my Fiancee before I go home.

Hi, any ideas, I'm worried, I plan to drive from Canada to the US with my Fiance and his sister and spend a month with him over Christmas. His sister and him are driving up for the weekend and we are all going back together. Then I'm flying back to Australia, then we are applying for the K1. I want to tell the truth at the boarder, "I'm spending Christmas with my Fiance " I'm worried because I will have a lot of bags (4 suitcases) because I'm moving home, but I will have my flight home and I can print an email from my old employer offering me my job in Australia back. Will this be enough? what should I do at the boarder? Any advise? S.

So you want your Canadian police certificate, right? not your Australian one?

Are you sure you need to do with fingerprints?

I'm asking because I know I need fingerprints for my Aussie police certificate, but I dont think I need them for my Canadian one. I believe it's only a namecheck.

Not sure I'm any help... unsure.gif

Yeah It's for my Canadian one, I applied for my namecheck today in Toronto but I'm not sure if that's enough, I know I need fingerprints for Australia. I think I will apply for the fingerprint from Canada when I return to Australia, we haven't started the process yet and the guy at the office said he didn't think I needed the print, but if I did recommended I wait til it's closer. Do you know where I could find out if I need a fingerprint from Canada?

K-1 Fiance(e) Visa Process & ProceduresHelp with Police checks
Hi, I was hoping someone out there had some advice.
I'm Australian but currently live in Canada, I'm move back home at the end of the month and was hoping to get the police record thing before I leave (not sure what it is, haven't started the process yet). So I went to the police station today and applied for a back ground check, but they didn't finger print me, so I went to the place that does that, the RCMP, he suggested I find out how current it needs to be as he said most want it to be done 6 months before. It will take 4 months to process if I'm back in Australia.

Does anyone know how current the Consulate in Australia need it be?

Thanks S

K-1 Fiance(e) Visa Process & ProceduresThank you for your help
I was really nervous because I was living in Canada, driving from Toronto to Wisconsin with my Fiance and his sister and ALL of my things. I am moving back to Australia after my visit in the States, so I had my Flights home, a job offer letter from Australia and the Working Visa I was on in Canada. We drove through the Niagara boarder and my Fiance's sister was driving, so he asked her, "How long were you in Canada?" (the weekend), "Who were you visiting" (My brother's Fiancee), "Put the window down so I can see her". "Who's stuff is all that?" (All of ours), and "When is she going back" (She is going back to Australia 9th Jan) "WOW". That was it, he never asked me for paper work, after we drove away, they realized he didn't give back the driving license so we parked, I stayed in the car and they walked back to the boarder. It took longer to get that back then the crossing, the Lady at the board told them not to hand anything over unless asked. It was the easiest crossing I have every had.

K-1 Fiance(e) Visa Process & ProceduresBirth Certificate
QUOTE (Nik+Heather @ Dec 18 2009, 02:59 PM) <{POST_SNAPBACK}>
What most people think of as the "original" birth certificate is in fact the certified copy.

You will probably never see or touch your original birth certificate. It is held by the government.

If you have a rather official looking piece of paper, that's probably the certified copy, photo copy it, front and back (even if the back is blank) and send that in. You don't need that photo copy stamped or notorized or anything. If they want better proof, they will RFE for it, but I have never heard of that happening.

The rule of thumb for ALL documents throughout the process is that you only mail in photo copies, but take originals with you to interviews etc. If they want an original, they will let you know.

K-1 Fiance(e) Visa Process & Proceduresco sponser
Hi, I was wondering if anyone who has been though the co sponsor part can answer a few questions for me.

I read somewhere that the co sponsor needs to fill out all the same forms as the sponsor, does that mean the G-325A or only the I-134. With the I-134 form does the sponsor fill one out even though it's not enough income? How do they know which of the two I-134's is the sponsor's and which is the co sponsor's?

I read on the guides and info that having a co sponsor is fine but can be denied if the US petitioner has been unemployed for a long time with no chance or possibility of a job. Though if they have a good education and opportunity for work it will be OK, so my Q is how do they know about his education when on the G-325A they only ask for employment history?

Hi,
I know I left it to the last min but I'm going this afternoon to have my finger prints done and last week when I called the Australian police they asked me if I was having just thumbs, fingers or palm prints? I thought it was fingers and thumbs, is this right?
Also I have to send a set over to Canada because I lived there of a while, I called Canada this morning and they said to just send a cover letter and the address I want it returned too with the prints. Do I need to put my passport number or work visa number on there?

K-1 Fiance(e) Visa Process & ProceduresAbout proof of employment
My understanding is the employee doesn't need to purchase anything from TheWorkNumber, you go to the site, put in your employers code and have the site generate a code that you then give to the individual needing the verification in addition to the code you get from your employer. But then I think the verifying individual needs to subscribe to TheWorkNumber. I'm going to send these in as a "Lets see what happens so I can post it on VJ" in addition to my tax returns and pay stubs. Kinda ridiculous though, that the company I work for doesn't do their own letters, because if I had to have one, and the person I needed to give it to doesn't use that site, I'd be completely screwed since they've made it clear that's all they do is use that site.

K-1 Fiance(e) Visa Process & ProceduresI 129 F part C, please help!
dear all,

my fiance and i are preparing our I 129 F package but we are having some trouble with part C on the I 129 F, petition for alien fiancé(e). my fiance (the u.s citizen) was once convicted for a minor, non violent incident that resulted in a domestic disorderly conduct, which was amdended down to an ordinance. however, when we look up the court case online, the case is still mentioned as criminal.

the instructions of the I 129 F state that the "term "domestic violence" includes felony or misdemeanor crimes of violence committed by a current or former spouse of the victim, by a person with whom the victim shares a child in common, by a person who is cohabitating with or has cohabitated with the victim as a spouse, by a person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction receiving grant monies, or by any other person against an adult or youth victim who is protected from that person's acts under the domestic or family violence laws of the jurisdiction".

personally, i do not think we need to add it as it is amended down to an ordinance, but we still worry about it. we already called several institutions and also USCIS itself, who is not able to give legal advice on this.

do you think we need to add this case to the part C section on I 129 F? please help! we would really appreciate your answer.

K-1 Fiance(e) Visa Process & ProceduresG325A question about adresses
hi everyone, im currently filling out form G 325 A, Biographic information.

it says "applicant's residence last five years. list present address first"

since 1997, i have lived in the same house in the Netherlands. However, in between I lived abroad in the U.S (to work) & Indonesia (to work).
so i listed it as followed

adress in the netherlands from november 97 - present time
adress in indonesia from feb 09 - june 09
adress in usa from aug 08 - dec 08
adress in usa from aug 05 - june 06

does this look confusing now? or do i need to put my netherlands home adress in between the other places i lived?

also, the question 'applicants last adress outside the United States of more than 1 year", do i write my Netherlands adress there again? (even though only in the summer of 2010 id have lived at my Netherlands adress again for more than 1 year? )

thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresG325a employment question

Hi Jake, welcome to VJ!

I see your fiance is from the Netherlands.....so is my husband! I think that you could just put the Country club job once and then list the other jobs under that. I'm sure they have had people before who work two jobs and will understand that. As for the extra sheet, it sounds like you have it set up very nicely....I would say it should work the way you explained it.

If you have any more questions, please ask...and if you would like to join us there is a Dutch/American couples thread down in Regional Forums!

ETA: here is a link to that thread if your interested!

http://www.visajourn...h...&start=1260

Thank you! And thanks for the link to the forum, we will definately join that. I am actually in the Netherlands right now.

I would list the country club job only once too, put it where you think it makes more logical sense.
When I was a student and unemployed, I simply listed 'Unemployed.'
I definitely don't think the job description explanation is necessary, because I think your situation is straightforward.
And yes, I had an attachment too and I wrote "G-325A Supplement" in the top, recreated the tables on the original form, and then I signed/dated it after I printed it out.

Good luck!

Good to know, thank you very much!

K-1 Fiance(e) Visa Process & ProceduresG325a employment question
My fiance and I are filling out the G 325a. We have some questions about the past employment and adresses questions.

I have had the same employment since the summer of 2008, as bar manager of a country club which is closed in the winter for obvious reasons. At which time i find another job for the winter months. how would i state this on the form?
In example would i state it like this:

Country Club job : april 08-present
Other job A : sept 09-present
Job: B : sept 08- sept 09
Country club job : april 08 - present ?????
Job: C : sept 07 - april 08

Do I put the Country Club job only at the top one or also again down in the list?

In the past 5 years I have also been a full time student and therefore did not have a job. Do I put it down as 'Unemployed' or 'Unemployed/Student' or 'Unemployed' specify: 'Student'?

I decided to put the sheet as an attachment as not everything fits, so should I otherwise write a brief explanation (2-3 sentences) about my job situation or is this not appreciated?

Furthermore, on the attached sheet I typed: ATTACHMENT QUESTION: APPLICANT'S RESIDENCE LAST FIVE YEARS. Then I made a table where all the adresses fit (+ a possible explanation of 2-3 sentences) and under that I wrote a line with my full name, a signature line and the date.

What do you guys think? Thanks for all your help.

K-1 Fiance(e) Visa Process & ProceduresG325a - family section & last occupation abroad
Hey everyone,

I have some more questions about the G325a form. My father died so I wonder what I need to fill in at "city and country of residence', do I write deceased, n/a or maybe the last adress he lived?

Furthermore, we are a bit confused about the "last occupation abroad". I have never had an occupation abroad so I can fill in None, but my Dutch fiancee has a current job in the Netherlands but also worked abroad in Indonesia. Do we write the last adress she worked in the Netherlands or do we write it for Indonesia?

Thanks again for all your help,

K-1 Fiance(e) Visa Process & Procedurestranslations needed for this?

I would leave them both out of the petition phase as they are not needed. If you think they will help show a bona fide relationship at the interview, take them as they are. The Consulate will understand the phone bills. Not sure why you would show any Dutch bank account information at any time though.

thanks. dutch transactions that relate to the receipts, maybe a bit double to add though

K-1 Fiance(e) Visa Process & Procedurestranslations needed for this?

Unless hotel receipts show both your names, I would leave them out. I would print the photos several to a page, in color, on plain paper. Sort them as you please. Little plastic picture folders are likely to get discarded and the photos lost. Full sheets get two-hole punched and wired into the case file.

alright, thanks! what do you think about the dutch phone bills and bank accounts? there are only a few words and even if i did not write the english word next to it, its really easy to understand

K-1 Fiance(e) Visa Process & Procedurestranslations needed for this?
hey everyone, i am about to send the k-1 petition, but i have a question about translations.

we have phone bills from my dutch fiancée judith, where it states that she calls me. obviously its in dutch, but there are just some words like date time durations of call etc, so i just wrote those words next to the dutch words. we have the same with some of her bank transactions and some dutch receipts of hotels, train tickets, restaurants etc. is it really neccesary then to certify the translations? (http://www.visajourn...ge=translations). there are just some words and it is very easy to understand.

and how did you guys sort the pictures? i put 10 photos in a little plastic picture folder with the dates and location on the back of the folder..is that okay?

thanks guys
