K-1 Fiance(e) Visa Process & Proceduresfrom uscis to nvc
You're done with USCIS for now. Once they issue the noa2 they send your file to NVC. You can call them in a week or so to check on it. sometimes it just flies through there! Then once it's sent to the embassy you can check with DOS. They have info on when the embassy receives your file and apparently when your interview is scheduled. Mine isn't yet, but last time I called they just started rattling off the status..."your file was received by Montreal on xxxx and they sent you packet 3 on xxx and there's no interview scheduled yet" I was like, Wow, but my question is xxx lolol.

NVC: 1-603-334-0700...choose 1 then 5
DOS: 1-202-663-1225...choose 1 then 0 (have your new number ready...it starts with your embassy initials, ours are MTL for Montreal...NVC can give you this new number once they receive your petition)

Congrats!! Everything goes so fast now!!

K-1 Fiance(e) Visa Process & Procedurestimes and birth cert. question
Vermont is generally much faster than California. Once your i-129f is approved by them (lately 1-3 months it seems) it will be sent to the NVC. Lucky you, Vermont sends them to NVC pretty quick. It floats through NVC in a couple days but can take up to a month in some cases. Then NVC will send it to your embassy. Each embassy is different so you will want to check in the Germany forum to get a better idea of how long it's taking to get an interview there. Each embassy also has slightly different procedures & asks for some different things (forms).

I wouldn't go by the USCIS processing times too much. You will get a better idea on VJ using the timelines & searching for k-1's at Vermont. Remember though that VJ is only a very very small cross section of the amount of filers out there. This can skew the info here quite a bit. Don't let that discourage you. My general opinion would be that December was incorrect for Vermont.

To answer your birth certificate question...my certified copy only has one side also. I sent it the way it was given to me (one side). It was fine and not questioned. As long as it's a certified copy you should be fine.

Good luck!! and Congratulations!!

K-1 Fiance(e) Visa Process & ProceduresLive with my fiance while waiting
You may visit your fiance during the process (i assume you're the beneficiary?) as long as you enter the country legally. You'd have to get a visitor's visa if you're not from a vwp country (sorry i'm not sure if France is). You may stay as long as that visa is good. Be very careful not to overstay or you will be screwed. Many people visit during the process though, so why not you?
Good luck!

K-1 Fiance(e) Visa Process & ProceduresCan I file K-1 with my foreign fiancee in the US?
Yep, my fiance was with me visiting while we filled out the papers too. As long as they are here legally, there's no problem. They can visit periodically too (as long as they can prove strong ties to their home country at the US border) while you wait for your noa2.

Good luck on your journey!

K-1 Fiance(e) Visa Process & Proceduresblue or black ?
The other thing is that black copies best, blue second best, any other color isn't going to copy well.
With what Laura said, there are some black pens that have that really fine roller point that DO make it hard to tell if it's an original or a copy. Most pens don't do that.

K-1 Fiance(e) Visa Process & ProceduresPeriod of Validity?
Is there a reason she "wants" to finish the series in Japan? It's not necessary to do that. It would be so much easier to just finish the series in the US.

The period of validity is on the actual NOA2 you received in the mail. I would contact your specific embassy since they all have their idiosyncracies to make sure you do specifically what they want.

Estadia, I "googled" consolidation process uscis. I found one link that says this...

Once USCIS forwards records to the FBI for name checks, the process and the .... consolidation into a Clearance Report. 3. CLEARANCE ...

Sounds like Markand Hannah is right!! I don't want to jinx you or anything, but it sounds like good news!! I sure hope so. When I clicked on that link I couldn't find those words in the huge pdf file it links to, but it was official looking & from the USCIS regarding the FBI security/background check process.

K-1 Fiance(e) Visa Process & ProceduresDocuments to bring in USEM Interview
Sounds like you have a ton of evidence and are pretty well organized! All the forms you filled out and all the papers for the affidavit and anything on your consulate's checklist need to be original. You also bring photocopies of all of that so that they can verify them (but they should let you keep the originals). Sounds like you've got that all set. The rest of the stuff like proof & evidence where you wonder if you need copies (like emails & that stuff)...I'd take one copy of each, but do you really care if they keep that? You have them in your computer at home so I wouldn't worry so much about that stuff. I'm taking copies of everything (like you are) just so that if they do keep anything I know what they have and what they don't have of what I took. Hope that makes sense.

I can't think of anything you are missing unless either of you were in the military or married before, sounds like you're very well prepared.

K-1 Fiance(e) Visa Process & Proceduresport of entry question.....
QUOTE (Kathryn41 @ Jun 2 2008, 10:56 AM) <{POST_SNAPBACK}>
Was it a smaller POE office? I had a somewhat similar 'bad' experience when I tried to activate my K-1 at Marine City, Michigan. I had gone to the border station the week before to confirm I could activate the K-1 there and was told by the border official there (male ) yes. When we arrived to activate it, the woman now on duty refused to do so. She said that they don't know what to do with the envelope and so they don't activate them. No matter how much we 'discussed' it, she refused, so we were forced to return to Canada, go to another border crossing (Port Huron) and activate the visa there. The border official we talked to there said that yes, Marine City should have been able to activate the visa when we had applied there and had no idea why the woman said what she did. I suspect you just ran across an inexperienced official, especially if it was a smaller crossing station, and there will be another officer who is experienced enough in procedures to know what to do with the envelope. Definitely follow Pushbrk's advice and contact the officer in charge at the POE as a follow up.

Good ol' Marine City...we had crummy experiences there last summer too. Inconsistencies between officers and misinformation that set us back a month in the filing process (we were given incorrect info on the fee amount...it was changing soon so they told us to send the new increased fee...app sent back requesting correct fee...at least they were honest about it eh?) I've spent many hours in their little parking lot in the baking sun!!

K-1 Fiance(e) Visa Process & ProceduresFor those of you who got a recent divorce to be with your new Fiancee
I didn't mention it in my letter of intent to marry. I simply sent a copy of my divorce papers. I had no problems or questions about it. There's a part on the i-129f that asks about previous marriages...I also filled this part out appropriately. That's all. My timing was close too with the divorce date and filing of i-129f (also hasn't been an issue, nor questioned by uscis nor my fiance's k-1 interview at the consulate).
Good luck!

K-1 Fiance(e) Visa Process & ProceduresI-797 a.k.a NOA2?????
That's correct, it could be your initial notice of action from when they first received your petition. When I called they told me I had an RFE once, but what it actually was was when they first received our petition with the incorrect fee amount and sent it back (thanks poe officer for telling us the wrong thing).

However, at a glance your siggy says your noa1 was 204 days ago. You've certainly been waiting long enough that it COULD be your noa2. If you don't hear anything for a while (couple weeks) and your lawyer doesn't have info for you...maybe try calling NVC. They can look up your petition by the WAC number and tell you if they've received it. Then you'd know it was the noa2. You're gonna need that hard copy of the noa2 for your interview so I hope you get it!!

For the interview does the petitioner need to be present? Also are all of these documents necessary to take to interview? Thanks.

If you can make it, I would go. It's not necessary and true at some embassies you're not allowed in. BUT, I have read a few VJ members who've been turned down at the interview and told that the USC needs to be interviewed too.
If it's a hardship, then don't worry about it but I'd prepare in the back of my mind for plan B just in case.

K-1 Fiance(e) Visa Process & Proceduresworried about rfe for divorce papers
For what it's worth, my state doesn't give out anything specifically called "divorce decree" and they looked at me weird at the courthouse when I requested mine. They give the entire packet of papers that we filled out (ourselves) for the divorce and the important section is the one called "facts and findings" (for us anyway). They put the certification raised seal on the page that has all the signatures (judge, ex and mine). That was all they were concerned with at the consulate was that page and the front page stating what it was about. I gave all pages anyway. I've always been confused reading on VJ about ppl getting certificates and decrees as our area apparently doesn't do that. Luckily uscis and the consulate were't confused with our papers at all. No questions were ever asked. And for name change, I submitted a copy of my first marriage license and my birth certificate too. That's all your fiance should need to I would think (just as everyone has already said).

This seems like a dead thread, but I found it interesting what you say in #1. I was told those exact same terms different times I called about my I-129f In dec-feb. I also wondered if they all meant the same thing or if they were each different steps my case was going through. I never found out, but my case was recently approved and I got no RFE so all is well. Perhaps they choose files at random & put them through these steps to train new officers or just do it randomly as a spot check. I don't know. I just know that I have nothing in my past to warrant such scrutiny.

QUOTE (K1 Sponsor @ Feb 13 2008, 09:37 AM) <{POST_SNAPBACK}>
Hello all,

I am new on this board. Here is my K1 denied petition issue. Please give me any advice if you can. I was introduced to my fiancee in Vietnam in 2006 but I lied in my petition that I met her in 2004. I have no supporting evidence of the relationship between 2004 to 2006. I have evidence from 2006 until now. So, basically they rejected my application and saying that we lack of evidence since 2004. They want to return my petition back to the u.s. for appealing. They didn't tell me when will they return? I have no clue what to do next?

Any advice here? I did the petition all by myself. I didn't go thru. lawyer or service agent. Now, it is too much trouble and headache for me. Helppp. I wrote a letter to my Senator, do you think they can help out my case?

Thanks all.

says you lied you met her in 2004 in your first post then later on you said you just met her in 2004 but didnt have any feeling for her till 2006. so this is where people dont understand did you meet in 2004 or is it you just lied you met in 2004 i can not blame co for returning your case if you fiancee lied for you also. if it is your tring to de fraud the gov. for immigration purposes you forget how many millions they deal with a year and what they see and can detect as fraud. so if it is legit immigration attorney is your only action to solve the issue they get paid well to lie for you

good luck

K-1 Fiance(e) Visa Process & Procedurescover letter for evidence?
Hi everyone,
I am in the process of putting the I-129F packet together, and I have plane iteneraries, photos, receipts from purchases I made while in Mexico, emails, etc... to use as evidence. I feel like I should include some type of a cover letter before my evidence explaining what I have included as evidence. Is this unnecessary? I just want to make sure the packet is clear and organized so it's easy for the adjudicator to understand.

Thanks for your help!

K-1 Fiance(e) Visa Process & ProceduresI-129F Birth Certificate Information?
Hey everyone,
I have a question question about Part A, Question 10 of the I-129F. My citizenship was acquired through birth in the U.S. The next part says "Give number of certificate, date and place it was issued." Now- I know on the example form here it says just to include that if your citizenship was acquired through naturalization, but is that correct? I feel like I should put a number of my certificate (although it has a million numbers on it so I'm not really sure what number I woudl use anyway...) I just want to make sure that if I leave it blank, that won't cause an RFE. What did you do?? Thanks in advance for your help!

K-1 Fiance(e) Visa Process & ProceduresQuestion about change of address?
Hey there- I'm in the same boat as you. I will be moving into a new apartment in September, and then probably a year later moving again. I also put my parents' address as my permanent address, and I wrote that my fiance will be living there. I'm assuming that shouldn't be a problem. It's better to put a permanent address than an apartment you may be moving out of soon. Not positive about this though.

K-1 Fiance(e) Visa Process & ProceduresIncluding passport pages?
Hey everyone,
Ok- I took another look at my passport last night, and while most of the stamps are not legible, I'm considering making copies of my passport pages anyway. So- one last question before I do so: Do I have to make copies of every single page even if there are no stamps on that page? And do I have to make a copy of pages 2-5 which just include information for me about traveling? AHHH I just want to send this petition!!

K-1 Fiance(e) Visa Process & ProceduresIncluding passport pages?
Well, I'm including plenty of pictures- whether they be primary or secondary- the adjudicator can decide what my pictures are worth. I bought a cellphone while in Mexico though, so my receipt should be able to prove that my fiance and I are in love and our relationship is real, right? haha, just kidding. sorry- I'm feeling quite stressed this evening as I put the finishing touches on the petition.

I think pictures are secondary evidence- it seems silly to me too, but photos don't actually prove that you met within the last two years. They just prove that you have met. I dont' understand how a hotel receipt is better evidence than pictures, but I'll just go with it.

K-1 Fiance(e) Visa Process & ProceduresIncluding passport pages?
Hello folks,
So... I know that it is highly suggested that you include all pages of your passport as evidence that you have met your fiance within the last two years. However, this winter when I was visiting my fiance, he gracefully spilled water all over my passport, so all stamps have practically disappeared. I was scolded at customs in Chicago, and now I'm concerned that I might get an RFE for not including passport pages. I can include them, but you won't be able to see any stamps. I'm also afraid that they won't believe my story. Are there people out there who have not included passport pages and been just fine? I want to send the petition tomorrow, but now I'm just making myself really nervous...

Thank you very much for your help,
Caity

I believe that the medical is $135 (I think), and the fee for the visa application is $131. You'll also have to think about lodging while she's in Ciudad Juarez, food, transportation...

Didn't you send a copy with your petition???

Best to copy all pages.

He'll have his at the interview so they can look at it then.

Each Consualte is very different in what they request for interview so your best bet is to check the link above and then with the folks who went through Juarez to see if there's anything specifically you will need.

good luck at your interview!

I did not send a copy of my passport in with the petition, because when I was in Mexico in January, my wonderful fiance spilled a whole glass of water on it, leaving most of the stamps illegible (the man at customs in the US scolded me). I figured that it would be silly to include a copy of all the pages, when they adjuticator would look at it and not be able to read anything. We were approved without it. However, I am going to make a copy for his interview, (now at least I have the stamps from visiting him this summer) and include a letter explaining the reason why the stamps are blurry.

By the way KimandRuss, congratulations on the approval!
