I have been asking and i didnt get any reply and am asking again....
Each time i login on the only DOS site i knew www.ImmigrantVisas.gov i am only able to check in on the fee only.. I just wanna know if there is any other websites which allows me to check for updates aside the website mentioned above and aside calling the NVC.
Hope i will get some response soon.

Ok, I don't make that much money and I couldn't just pull the $355 out of thin air...So i tired for the Fee Waiver Request. I got my I-130 back today 10/12/10 Rejected because i don't qualify for the fee waiver request...i'm cool with that(a little pissed but) whatever...but now i want to resubmit(When I get the money together) Can i use the same documents they send back to me? Do i have to send the rejection notice with this time? Have any of you gone through this process and can give input? thank so much ~*Daria*~

Ok, I had the wrong Affidavit of support in mind, though I still appreciate the clarification on the I-864 and I-864A.

The more immediate issue is the I-134 and a co-sponsor. If I should place this post elsewhere let me know and I'll do so. Does the co-sponsor fill out the I-134 as well, if so how do we differentiate the sponsor and the co-sponsor to USCIS?

We're not this far in the visa process, but I want to be clear on something so I'm not surprised later by it.

At http://www.uscis.gov/i-864 it states:

If you are using the income of persons in your household or dependents to qualify as a sponsor, you must also submit a separate Form I-864A, Contract Between Sponsor and Household Member, for each person whose income you will use.

I thought that when USCIS figures out if you have the money to support your beneficiary that they only look at the petitioners income and you can't get them to look at a households combined income, does the I-864A say I was mistaken and they will if it's filled out?

My wife got her CR-1 visa approved at her interview on February 3rd. Her visa just arrived at her home today, which was surprisingly fast. She's asking me how she can get her passport out of the packet without opening the wrong thing.....don't want any problems at the POE. How should she open it? Can she open the plastic part? It also says "do not detach stapled immigrant data summary," but it has no staple. Any ideas?

Explain question 14 of the I-130:

"14. If your relative is currently in the U.S., complete the following: He or she arrived as a::
(visitor, student, stowaway, without inspection, etc.)"

Now if here illegally, that is a major problem, but not as a visitor. But has to religiously follow the limits of that I-94, even a day overstay can be a major problem. But the DOS does have an I-94 extension form for 300 bucks if you want to stay longer. Person can even drive here with an international drivers license, but best to check that out with your DMV and especially with your insurance company first. But cannot work.

Now if that person cannot come here legally due to not having a visa, then you have to apply for an immigration visa, no choice in this matter. How do I know this? With one of this countries top immigration attorneys. Now if that stack of applications is not approved for the USCIS, that is when that person has to return to their home country or at least leave this one. But if approved, can stay here as long as they want without fear of an expired I-94 until they get their green card. But that depends upon how fast the USCIS is in the processing. Can also be rejected at your interview if any form of fraud is detected. If that happens, and you want to keep your spouse, you both can leave this country.

Use to be, even until very recently a Canadian or US citizen could spend as much time across their home countries borders as long as they wanted. As long as you didn't vote, work, or attempt to get a drivers license. Even though I have spent many months working in Canada, the Canadian country paid my US based company for my services, and the US government took about half my wages in taxes, so I guess everybody was happy except me. But I could not work directly for that Canadian company. Didn't need a passport, no limits on length of stay,

Really don't know how things have changed recently, like coming from a different country do they issue you an I-94 that limits your stay? Was in Canada last year, nothing like that, no tourist visa, happy to take my Master Card, could still be there, could rent a place, just couldn't work, I think the opposite holds true for Canadians coming here, you are here legally with your Canadian passport, just can't work nor vote. Just saying this as really no reason to have to separate, the paper work can be done here. Even more weight if you have kids that should automatically be US citizens.

USCIS isn't really a hardass on this subject in trying to split up a family, and its not like you married that person here, you are already married. Just seems like you have to go through that I-130, I-485, I-693, I-864, G-325A thing for your wife, will be asked the questions as to whether you were already a LPR, but mostly if you were here and deported for any reason. Can send in the entire pile at once with a big fat check, and within a couple of weeks should get a NOA, where now your wife is here legally. But still cannot work nor apply for an SS card, or a drivers' license. Applying for an EAD card with an I-765 may cut that wait down by a couple of months.

If you are working for the same company and being transferred, should have an immigration department in that company, since they are transferring you and your family, may even do all the paper work for you and pick up the tab. And for them, its 100% tax deductible, but not for the individual. With practically all corporations being international with a global economy, this practice of shifting families all over the world is quite common.

Read the previous two post, in my opinion, quite harsh, but were based on the assumption of what little information you provided. The most important thing is keeping your family together. Your wife had no choice in this matter and assume she was a minor when all this took place.

As long as she is not like my immigrant sister-in-law that refuses to even let my niece go home and visit her dad one or twice a year for a day. You should be fine if your new step mom isn't that way.

Major concerns for your dad, besides that I-864 is the I-693, read the latest form, filing is free, but far more stricter than when we applied. Don't know about your heath insurance, my plan didn't cover that and was quite a bundle of money. Don't know about Korean health cost either or if most of the test can be done there.

Also have another niece working in South Korea, sending me a bunch of photos, makes the USA seem like a dump. Why is she working in South Korea? Can't find a job here.

At least people wise, was no such thing as that 49th parallel, Canadians and US people crossing that border was no different than crossing a state line. We had many divisions in Canada, would work up there, and Canadians down here. But with a difference, my paychecks came from the USA based company, their paychecks came from the Canadian based division. They had to do it this way strictly for tax purposes.

Well there was a difference, if traveling with a three year old daughter and stopping on the USA side where she picked up a dandelion. Customs would take her "flower" away and she would cry, parents are suppose to be able to explain stuff like that to their kids, try explaining that!

Things have sure changed in the last couple of years, now going to Canada is no different than going to Iran. Why is it this way after some 200 years of freedom? I think you should be able to come here least on a tourist visa, can't work, and all that I-130/485 forms plus the others can be done more efficiently here. Be good to have that I-693 done in Canada if you have free health insurance, would cost a small fortune here. Might as well take care of the other forms as well and send the USCIS a pile of money. In a couple of weeks you are free to stay here, but cannot work until you get an EAD card. Then your green card, with the EAD can apply for an SS number and get a job. Report to your employer the change.

If married for two years already, avoid the I-751 hassle, but have to be a good boy for three years then apply for US citizenship. If you visit Canada for over 24 hours, keep records of those trips, will need that for the N-400.

Should have dual citizenship without problems, if you don't like it here, can go back. May not with the huge cost we have with health insurance, $14,000.00 a year for us and what's left the tax collector takes.

Must be talking about that I-864, US doesn't want your poor anymore, forget about that poem on the Statue of Liberty. Sure this post will be moved as this is the citizenship section. One nice thing about US citizenship, get rid of that I-864 liability.

Wife talked about bringing her mom here, but her response was, she was her only kid that came here, didn't want to leave the rest of her huge family. Maybe a good thing, we would never be able to pay for her health insurance where she is practically getting it for free in her home country. It wasn't that way here even 30 years ago, but sure is now. No place on earth has more expensive health insurance than we do.

Form is the I-864A, sponsor does the I-864, while my wife didn't have to sign, was suggested to us by our immigration attorney to do so. This not only combined our assets to really make it look good, it was a sign of balance in our relationship.

If I just signed the I-864, would be legally responsible for both my wife and her daughter, this way, we equally shared in that responsibility. While I willingly signed the I-864, she willingly signed the I-864a. A good way to start off a relationship.

We could tear those up when she and her daughter received their US citizenship.

I can bet those sponsors that brought someone here and were left holding the bag, even a divorce does not cancel that I-864 wish their sponsors signed that I-864a. But that wasn't my concern, can lose your job in this crazy economy, immigrant can have some incurable disease or get hit by a hit and run driver, and in this crazy country, would kick them off your health insurance policy due to a per-condition. Leaves one no choice but to seek some public or private aid. Fortunately none of that happened to us, but it can.

But the US may not recognize a marriage between a male spouse and four separate woman that is legal in other countries.

 

For me to get married in my wife's home country, that was way too complicated, plus we had no intention of living there.  But we did get our marriage registered in her home country at a latter date.  Due to severe time restrains with the imposed laws by the USCIS, we elected to get married by a federal judge.  Just told me to call him in the morning and would be happy to marry us during one of his many recesses and even could provide plenty of witnesses.  But we had our own that were free to move at a moments notice.  Could also get our marriage certificate instantly that we needed for the USCIS.  He was wonderful to us.  And no translations required, and no qualms with the USCIS with a federal judge signature on our marriage certificate.

 

Church wedding was out for us, could take months, always can get that marriage blessed later.  Also no laws that state your wedding reception must be held on the same day.  With my family, was a week later, with my wife's, a year later, couldn't leave until she had that green card and she didn't want to fork out 300 bucks for a traveling document.

 

Also no law that you must go on your honeymoon the same day.  We spent this time completely our immigration forms, and yes, after the forms were submitted, we could really enjoy our honeymoon with that burden out of the way.

 

Really the only thing of importance in your marriage is to keep the USCIS happy, if you don't, won't even have a marriage.  Unless you enjoy being 4,000 miles apart.

Sure doesn't hurt to have a back up sponsor as a safety net and when dealing with the USCIS from experience, not dealing with a board for anything, just one individual.  Doesn't seem right.

 

Or even trying to find some kind of a job.  Sure doesn't help to have a government that is shipping our jobs overseas.  Just recently, GM shut down a plant in Janesville, WI laying off over 4,000 people.  A pot and pan manufacture in Manitowoc left for China laying off another 3,000 people, and the list goes on and on.  Look at Detroit.

 

My son-in-law had a good paying job near Milwaukee that was moved to China, but found another in South Carolina, and can't see my grandkids anymore.  Kid brother had a nice paying job, married a woman from the Philippines that is a skilled nurse,  the I-864a helped them.  She is working, kid brother in his line of work can't find a job.

 

There are ways to work around this, you just have to find them, just can't sit idly at home.

When I married my wife, couldn't even open a joint bank account for a hundred bucks due to this crazy APA, nor put her as a joint owner on one of my vehicles, no greencard, no driver's license.

 

Since we were both previously married, sure wanted to see our divorce papers, but showing a marriage certificate from a federal judge was not enough for them.  We were never asked about our previous relationship.  Of course, no joint tax returns, weren't married long enough for this.

 

One big deal was that I-864 I had to sign, had to prove I was making enough money to support my wife and her daughter,  this was never brought up so far.  Not sure about your financial condition, may need a co-signer.

 

Another issue we had was finding an approved USCIS doctor for that I-693 that wouldn't rob us to death, was not covered under our health insurance plan.

 

We never send in any cover letter nor photos, but my wife did bring along our wedding album and our IO was curious to see them but was optional, for us, one very important piece of paper was a court order showing that my wife had permission to bring her over here.  We just sent in what they requested, no more, no less.

 

For this, my wife and stepdaughter received conditional green cards, now to remove those conditions, this is when they wanted a ton of evidence.

Interesting to pray to a God to overpower people that think they are gods. Found it equally if not more effective to tactfully deal with these people that I am not a criminal, only have good intentions, met my soulmate when I never believed there was such a thing as a soulmate before I met her. But they were not interested in neither her or me, only our papers. So was quite a chore and rather expensive to gather all this paper work, but both my fiancée and I had plenty of motivation to please the USCIS.

Consider it to be a miracle to even meet my wife, must have been in God's plan to give us the tools we need to develop the internet, without that, would have never of met her, and who would think the internet could have been formed with sand on the beach?

How about just saying thanks to God for meeting that special person, but the rest is up to you to gather what the USCIS wants. Can also thank God for helping me to find a good honest immigration attorney. While all those forms and which ones seem easy now, at first it was way overwhelming, but can also thank God or Captain Ewok for this site.
